    Please see attached proof of debt.  What she states is not true.  We didn't violate any laws or rules and no one needs her signature to put it on her credit.  She incurred debts and didn't pay them.  She has never responded to any letters, or phone calls.  She has not tried to resolve this with us or the ****** ****.

    I am receiving threatening letters from this company after going to **** who failed to bill my ******** properly. My only source of income is *** so obviously I need ******** to be billed rather than billing me. I need all threatening letters or calls to cease.

    We have not sent any threatening letters, we sent the validation letter that was written by the **** and required by law.  Her ******** was billed, they did their adjustments and applied the balance to her deductible (copies attached)  If she would have just contacted us we could have explained that to her.  She owes this balance.

    I am rejecting this response because: The company broke federal HIPPAA laws by receiving by private and detailed medical information. I definitely did not request private detailed medical information in fact I didn’t even request private billing information because I already have that. I have contacted the company directly and they have admitted that they did not properly bill ******** because they use the wrong CPT code and I should’ve been seen under physician and not a nurse practitioner. The collection agency is recklessly obtained my private medical information and made statements that I owe money that I clearly don’t owe. They are going on third-party false information. I have asked that they cease all communication and involvement with me and instead they requested my private medical information which is for prohibited by federal law. My only source of income is ****** ******** so obviously they can’t get a cent from me even if they acted in good faith or if the debt was valid. 
    The company is to cease all communications with me. I filed a complaint with the original medical office and will re-file for sharing  my private and detailed medical information. 
    If a collection agency reported on my credit report and it is to be removed at once.

    I am rejecting this response because:
    Being a disabled person and for HIPAA laws I vehemently forbid the requesting of my personal medical information. There is absolutely no valid reason whatsoever that a collection agency needs to view the details of my very personal medical information in the company has violated federal laws. Additionally they’re trying to collect money that is not do them as them and tried to lie and say that the insurance company has already paid their part. As stated numerous times before the proper CPT code was not submitted and therefore the insurance failed to pay. The company needs to include where I specifically gave them permission asking for the details of my delicate medical information. I will wait.

    We talked to ********* on 12/8/20 and told her to call the billing department at the clinic (not affiliated with us at all) if she was having issues with her insurance.  We have not talked to her since then and she never asked us to verify the debt.  I have attached proof of the debt to this complaint.

    USC 1681a-3 (3)Restriction on sharing of medical information.—Except for information or any
    communication of information disclosed as provided in section 1681b(g)(3) of this title, the exclusions
    in paragraph (2) shall not apply with respect to information disclosed to any person related by common
    ownership or affiliated by corporate control, if the information is— (A)medical information; (B)an
    individualized list or description based on the payment transactions of the consumer for medical
    products or services the only way this law can be by passed is under 15 USC 1681B(G)(ii) the consumer
    provides specific written consent for the furnishing of the report that describes in clear and conspicuous
    language the use for which the information will be furnished. so unless your company can provide me
    with a document where i give you or the original creditor specific written consent to furnish my medical
    transactions then this account must be deleted immediately by law. if you believe you have not
    committed any violations then send me a statement sworn under penalty and perjury that this account is
    not based of transactions for medical products or services

    Please see attached paperwork that shows "consent for services and disclosure of Protected Health Information" that she signed.  Her statements are untrue.  When a medical debt becomes delinquent, the medical provider has the right to turn it over to collections in order to get paid for their services.

    I am rejecting this response because: with the application they have sent they have confirmed that they are reporting a account based off a medical transaction making this account in Violation under the FCRA. but even more thank you for confirming your HIPPA violations for breach of security under 45 CFR § 164.304 Security incident means the attempted or successful unauthorized access, use, disclosure, modification, or destruction of information or interference with system operations in an information system. as i never consented to you to have access to my medical application which would be a a breach of my security. you have also showed you have used my social security card without my consent to successfully create this account as i never wanted to or would ever consent to your company having my social security card which is unauthorized use under 15 USC 1602p. 

    i have read over the consent form and there is no clear and conspicuous statement allowing this application or information to be transferred to a 3rd party collection agency or allowing this account to be reported to consumer reporting agencies. meaning if you turned this form in to a CRA to get this account reported you would be in violation under 15 18 USC 1001 by entering this deceptive form to get this account created on my behalf which shall be punishable under 18 USC 1001(3)
