I am receiving threatening letters from this company after going to **** who failed to bill my ******** properly. My only source of income is *** so obviously I need ******** to be billed rather than billing me. I need all threatening letters or calls to cease.Business Response

We have not sent any threatening letters, we sent the validation letter that was written by the **** and required by law. Her ******** was billed, they did their adjustments and applied the balance to her deductible (copies attached) If she would have just contacted us we could have explained that to her. I am rejecting this response because: The company broke federal HIPPAA laws by receiving by private and detailed medical information. I definitely did not request private detailed medical information in fact I didn’t even request private billing information because I already have that. I have contacted the company directly and they have admitted that they did not properly bill ******** because they use the wrong CPT code and I should’ve been seen under physician and not a nurse practitioner. The collection agency is recklessly obtained my private medical information and made statements that I owe money that I clearly don’t owe. They are going on third-party false information. I have asked that they cease all communication and involvement with me and instead they requested my private medical information which is for prohibited by federal law. My only source of income is ****** ******** so obviously they can’t get a cent from me even if they acted in good faith or if the debt was valid.The company is to cease all communications with me. I filed a complaint with the original medical office and will re-file for sharing my private and detailed medical information.If a collection agency reported on my credit report and it is to be removed at once.

I am rejecting this response because:
Being a disabled person and for HIPAA laws I vehemently forbid the requesting of my personal medical information. There is absolutely no valid reason whatsoever that a collection agency needs to view the details of my very personal medical information in the company has violated federal laws. Additionally they’re trying to collect money that is not do them as them and tried to lie and say that the insurance company has already paid their part. As stated numerous times before the proper CPT code was not submitted and therefore the insurance failed to pay. The company needs to include where I specifically gave them permission asking for the details of my delicate medical information. I will wait.

Please see attached paperwork that shows "consent for services and disclosure of Protected Health Information" that she signed. Her statements are untrue. When a medical debt becomes delinquent, the medical provider has the right to turn it over to collections in order to get paid for their services.Customer Answer

I am rejecting this response because: with the application they have sent they have confirmed that they are reporting a account based off a medical transaction making this account in Violation under the FCRA. but even more thank you for confirming your HIPPA violations for breach of security under 45 CFR § 164.304 Security incident means the attempted or successful unauthorized access, use, disclosure, modification, or destruction of information or interference with system operations in an information system. as i never consented to you to have access to my medical application which would be a a breach of my security. you have also showed you have used my social security card without my consent to successfully create this account as i never wanted to or would ever consent to your company having my social security card which is unauthorized use under 15 USC 1602p.i have read over the consent form and there is no clear and conspicuous statement allowing this application or information to be transferred to a 3rd party collection agency or allowing this account to be reported to consumer reporting agencies. meaning if you turned this form in to a CRA to get this account reported you would be in violation under 15 18 USC 1001 by entering this deceptive form to get this account created on my behalf which shall be punishable under 18 USC 1001(3)

I've disputed this inaccurate account on my credit report numerous times, and still no avail. MCA (Medical Commercial Audit) has been harassing me for a payment that I don't owe them, nor the creditor! The account on my credit report shows that they're collecting on behalf of 01 Midwest Express Care 4 Indiana. My balance with Midwest Express Care 4 Indiana is 0! MCA is in violation of FDCPA section 807 and I would like this account deleted from my credit report immediately! In addition to this, there's no way they can validate a debt that I don't owe! I spoke with the original creditor and they confirmed that my balance was 0. Again I would like this account deleted, or I will look to escalate. A collection agency shouldn't harass me about a debt I don't owe! I do not owe Midwest Express Care 4 Indiana, therefore, I do not owe MCA!! Also, all paid medical bills under $500 must be deleted from my credit report as of July 1st. They can't report a paid medical bill anyway!!Business Response

This bill is from 2/17/2020 and yes, he has been disputing it since February 2021 and we keep providing proof that he owes it. His facts about the credit bureau are wrong. I reached out to this Company on several occasions requesting validation of information on my Consumer report and instead of adhering to the law, they told me to pay or else. Then proceeded to slam phone in my face several times. I called back and they blocked me from every phone number possible. This is unfair abusive treatment. They are additionally operating unlawfully and refusing to adhere to the laws which govern them, in accordance with the FCRA and FDCPA. This is unacceptable. They are using illegal extortionate means of collecting on an alleged debt and refuses to address the issue. I have been blatantly dismissed each time I seek out answers. These allegations are false. I have attached proof of the debt. She received the money from the insurance company (it was out of network so they paid her instead of the dentist) she refuses to listen to us or acknowledge that. She kept calling and citing laws that had no relevance to this account. We did block her number because she was harassing us with numerous phone calls. We are not contacting her anymore but it will remain on her credit. The doctor received no insurance payments for his services but she did.Customer Answer

Nothing they said indicates their actions are lawful! The are committing fraud and have breached my privacy. This alleged debt has not been validated. Furthermore, they obtained my non public personal information without my consent. No consent is fraud! Regardless of what them, the alleged creditor, or any CRA says. That's federal law. Besides that there is no excuse to hang up, speak condescending to, and block a customer for exercising their rights! Horrible business! I won't stop until they are held accountable.

This was not sent in error, I am a consumer by law and my information was misused and now I have some false not 100% accurate accounts on my credit report. Unauthorized used of my credit report. I demand deletion of the items and information plus I demand monetary compensation!!!Business Response

We have not talked to her, she has not responded to any phone calls, letters or emails. If she had a problem with the bill she should have called us and we could have checked into this. We contacted our client, proof of debt is attached. She paid part of this bill with her boyfriend's credit card so when the client refunded her money due to the Cares Act it went back on that card which is standard practice. She is mad because now he is her ex boyfriend and she thinks they should have refunded her. The manager told her that is between them and not their issue.
