    I am rejecting this response because you had no legal right to post to post to begin with. I also am requesting you remove your comment that the owner request it not be published!
    You have no right to post that as the owner of the *** never contacted you, I did, the registered agent for the ***. 
    The laws in ************* are very clear and the names and numbers of the ***s are not published on ********** site for a reason. The date created, business name and # are published and that is all!
    Remove that comment please about the owners request because I am NOT the owner, but the registered agent with POA to handle these things.

    We have reviewed your request that Bizapedia remove certain information from its website, and have consulted with Bizapedia's legal counsel regarding the nature of your demands.

    As you may be aware, the First Amendment to the U.S. Constitution guarantees the right to publish publicly available government records. See *** ****** ***** ************, 420 U.S. 469 (****). As the Supreme Court has noted, "[t]here is no liability when the defendant merely gives further publicity to information about the plaintiff which is already public. Thus, there is no liability for giving publicity to facts about the plaintiff's life which are matters of public record." Since the Supreme Court decided *** Broad *****, federal and state courts throughout the country have reinforced this principle. As an example, in ****************** Cty., 280 F.3d ****, **** (7th Cir. ****), the court found, "[t]he ************* held in *** that the First Amendment creates a privilege to publish matters contained in public records even if publication would offend the sensibilities of a reasonable person."

    Additionally, regarding your complaint about Bizapedias use of your purported trade****, such use has been limited to an essential point of reference and is therefore fully protected. Such limited use constitutes a classic statutory fair use under 15 U.S.C. 1115(b) and a nominative fair use under federal common law.  Under the classic fair use doctrine, Bizapedia is *********** use anothers trade**** in a descriptive manner, including to identify the owner of the ****.  Under the nominative fair use doctrine, Bizapedia may use anothers trade**** to identify that owner of the **** or its products or services so long as Bizapedia only uses so much of the **** as reasonably necessary and so long as that use does not suggest a sponsorship or endorsement by the trade**** holder.   Both fair use defenses have been thoroughly analyzed by federal courts throughout the country.  See, e.g., ****** ******************** ********* 292 F.3d ****, **** (9th Cir. ****).]

    Finally, we submitted a request to ****** and Bing to check the page in question for changes. The search engines will generally update their search results whenever they detect a change to a page's content, although the process can take anywhere from 1 to 30 days. Please note organic search results are not controlled by Bizapedia and there is nothing further we are able to do to hasten their update or removal. You will have to personally communicate directly with entity that owns the search engine through one of their online tools to have a search result removed in an expedited manner.

    Bizapedia.com cannot claim that they are using records which are publicly available, as the ***** Secretary of State has updated the address to our business address. However, Bizapedia is still displaying our personal address. Although it is hidden from the general public, it remains visible to their paid customers. If they are genuinely acting in good faith, they should use the business address that the ***** Secretary of State has on file, rather than personal addresses.

    I have two businesses (******************* custom Art LLC and Bee Like That LLC. BIZAPEDIA has my home address and personal information publicly listed in their site for both of my businesses. I had tried contacting them for both of my businesses to remove this information but they have not. I have tried to call the customer service number but it is out of order. I cannot have this information public and need it removed.

    I'm filing a complaint against Bizapedia, LLC in *********, **. I have not in any way authorized Bizapedia to publish my personal name and address (although home address listed is old) and that of my company "******'s ****************** This is a violation of my privacy, safety, and security. I moved recently, and soon they'll have my current address listed.
