The company violated the FDCPA by contacting family and my work and confirming a debt was owed. They continually harass both myself and my family, I have not given any permission or had any interaction with the company that stated I agreed to have others contacted regarding this matter. Furthermore the “loan” in question violated state laws on usury and consumer lending licenses.Business Response

I have been receiving multiple calls from different anonymous numbers continuously harassing me. I have never came in contact with this company and keep getting threatened with “further action”. I believe this company using illegal methods as to also how they mysteriously pulled my information which I have not given to them which is also illegal. I received a call yesterday from a person named Cole b******* He stated that I was being contacted for service paperwork and needed to confirm my address. I called the number he provided ###-###-####. He wouldn’t give me any information until I gave him my social. He stated they were calling about debt from a simple fast loan company. He stated I needed to make a payment of 165 dollars every two weeks for the debt. This person contacted all of my family members, even my employer and that is against the law. They can only contact me. I haven’t received any letters or emails that this was being transferred to a collection agency. I contacted the simple fast loan company and they stated this was sent to debt direct portfolio and to call that number. They were very unprofessional and didn’t give me any information on what company they were from. They didn’t even provide me with an account number.Business Response

This company previously contacted me in September 2024 regarding an illegal and predatory loan through Plain green. The collection company violated various debt collection laws by calling my family and friends, disclosing the debt after I told them to stop doing so. Debt Direct told me they were closing the account and that I would no longer be contacted. Low and behold I am still getting calls on this as well as my family which is a violation. I would like for this company to honor what they previously said and to stop contacting me and my relatives stating insults and that I will be arrested. Account details cannot be provided on a platform, that includes the BBB platform, you will need to call into our office between 9am and 5pm EST Monday to Friday, in order to receive those details. The number for our office is ###-###-####. As previously mentioned, the calls you may be receiving are for a second account, not the ********** one you mentioned in your original statement. When an account is closed in the system it means it is being isolated from the remaining inventory and will not have any activity related to collections, meaning you should not be receiving any calls or requests for payment. The account is still a debt that is owed, but you will need to be the one to contact us when you are ready to make a payment. The ********** account you have disclosed on your original BBB statement was closed as requested and has not had any activity since. However, the second account is new in our system and therefore was assigned for collection. Because this account is new in our system the closure request was not applied since we only had the ********** account in our system at the time you requested it to be closed or else we would have closed both. Threatened legal action (fraud, de-frauding a financial institution) against me if I do not pay. Down right rude and threatening. Advised the "agent" on the phone that I have not received anything legitimate from them regarding any matter, nor have I received anything from my local Sheriff summoning me to court. I was contacted on Monday with a voicemail that said I would have a notice sent to my house and to call back with the reference number they provided. The following day my parents were contacted and given my information and were told that I would be receiving a notice. When I called back I was told that this was the last point of paying back before legal action, that it was regarding a tribal loan with plain green. I explained that loan is illegal and over 300% interest. The guy did not care and was rude he said I can pay $100 bi weekly. I was told if I defaulted it would go into legal action. I submitted a complaint through plain green and they said they are no longer trying to collect. It is illegal to use these collection practices and threaten with notices being sent like a lawsuit is coming to my doorstep. Let alone contact someone and tell them the same thing about me when it’s illegal. They said they would be sending out a cease and desist letter to plain green so they no longer collect yet plain green said they are no longer actively collecting!Business Response

This company is harassing. I have received numerous calls and voicemails with unknown numbers leaving harassing messages. They have been calling people I am related to and employment. leaving personal information on the voicemails which is a violation of the FDCPA. I was notified by my father about a file sent to him and myself, remind you .y father was never listed on anything and he reached out to me about it. I called the number and asked who this was and the lady responded very rude and said she would not tell me who this is until I gave the first 3 or last 4 of my social, so not knowing who and what she is I gave the info and then she said it was ***** ***** who I took a ******** loan out for last year for 800 and now I owe 2300 and said they will sur for that if I don't settle for that of not it will go to court for about 3800. I was scared and thrown off and said I wanted to settle this but never got any email and she said they sent letter in reference to this in which I never received. I got caught in the cross fire with how demanding she seemed and gave her my debit card number to set up payments for 6 months of $196 which she says with the taxes will be $200ish for every other week and that if it bounces, they will take me to court. I don't feel this company is legit and what to know if I should cancel my debit card that I set up a payment for this Thursday for them to take out?? Never had this happen and this was definitely a scare tactic and they got over on me for. Please investigate and also have them not contact my parents or myself again.Business Response

I was called by someone named Susan F*** in the underwriting department. Apparently this company is going to take me to court for a loan that I never took out with ***** ***** ****** They are threatening wage garnishments and putting a lien on my car. Susan’s direct number is ###-###-####. I just want to know if someone took this loan out in my name. I have the right to dispute this and look into this matter before being taken to court. How can you threaten someone that has never received correspondence because you sent the correspondence to an address I have never lived at or been associated with? As previously mentioned, your account will be closed as suspected fraud, which means that we would be reaching out to the agency in charge of handling the account and requesting it to be closed, in which you would not be receiving any contact. However, in order to permanently close the account you would still need a police report stating the account is fraud. If you are receiving calls from ****, then that would be the company who you should be contacting in regards to any requests you would like to make. In addition, any agency within our network is onboarded using a strict process, which include agreeing to and maintaining appropriate consumer contact policies and procedures, which means that harassment or threats of any kind would be investigated and if confirmed, then lead to termination of the business contract. To summarize, your account has already been closed and call recordings along with any other account activity has been requested. I was emailed from ***** ***** ***** that my default account was sold to Debt Direct Portfolio. I was waiting on a written response from them, voicemail, email or something so I could set up a payment plan and never received one. I then receive a random voicemail from a number starting with (945) from ************ ********* ******** saying I’ll be having a court case against me if I don’t call back within 48 hours. Her name was Juliana H****. My parents both receive a call from her as well saying they are possible accessories to this “crime” I committed and they should call back too. I get scared and call the number back and she has all this info on the debt I owe and throwing legal wording around and scaring me. I then let her know the only notification I got on who has my debt is from Debt Direct Portfolio and she claims I was flagged as a “no answer” and none of that matters. If I don’t pay something I’ll be sued. I tell her I don’t have anything to pay with now and she says she’ll talk to the attorneys if we can work something out. I also asked how she got my parents number and she said it was on my account?? I never put my parents number on my original loan!! This whole thing was weird and super unprofessional. I’d like to get something worked out but I’m freaked out and put off by this whole interaction. I also see I received a voicemail from the same lady a week before claiming to be Megan this time from Outdoor locating service?? They keep calling me from different Texas area codes even though the ************ ********* ******** has a 833 number according to who I spoke with from Debt Direct Portfolio. I was never notified this debt got moved somewhere else and now I’m going to get sued for “no response” after a month from when ***** ***** notified me about my debt??
