Ms. ******'s Bon Ton account ending in 4213 (Hereinafter, "the Account") was purchased from Fidem / Comenity Bank in February of 2023. The Bill of Sale from that purchase has been attached to this response.
The Account in question was opened with Ms. ******'s social security number, birthdate, email address of DECORAH******@GMAIL.COM and a mailing address of 8230 W Luscher Ave. Milwaukee, WI 53218
The Account was opened on 12/10/2013 with regular monthly payments applied and was charged off due to delinquency on 01/31/2023 with a balance of $804.86.
We contacted *********** Law Firm LLC and they responded with the below:
"Suit was filed 11/22/24, we were unable to serve so publication was completed 1/10/25.
The first contact we received from the Ms. ****** was an email on 1/17/25 disputing a different account in our office, so we mailed the documentation for that account, in the email the subject included the reference number for this account, she did not dispute the DNF Associates account.
A voicemail was received 1/27/25 requesting a call back after 4:30, we did attempt to call back after 4:30 on 1/29/25 and had to leave a voicemail. Several other calls were made and voicemails left for
Ms. ******, with no response. The most recent call attempt was made on 4/1/25 with no response. Judgment was then entered as there was no appearance at the return dates from the debtor or response from calls made."Customer Answer

If there’s a specific person due to the back and forth that would be helpful. When I call I have to leave a message and the voicemails left for me from them sounds like it’s possibly contracted workers not leaving a full voicemail saying, “Hello, hello...” Then the call ends

Re: Dispute of Account Number ********* – Fraudulent Activity
Dear Sir/Madam,
I am writing to dispute the account listed under the reference number above on my credit report. This account was opened without my authorization, and I have no recollection of applying for or agreeing to any terms with DNF ASSOC. As a result, I believe it constitutes fraudulent activity.
In accordance with 15 USC 1692g (Validation of Debts), I am requesting that you provide verification of this debt or a copy of the judgment within 30 days of this notice. To date, I have not received any signed documentation or contract that proves I consented to this account. Without a valid, signed agreement, there is no legal basis for this account to be associated with my name.
Since I believe this account was fraudulently established, I request its immediate removal from my credit report and ask that all collection activities related to this account cease. If you are unable to provide the necessary documentation within the 30-day period, you are required by law to remove the account from my credit file and stop any further collection attempts.
Please confirm receipt of this letter, and inform me of the next steps to resolve this issue.Business Response

I honestly don’t get why DNF ASSOC is reporting this debt under my name because I don’t owe them anything. I never signed anything with them, and when I asked for a copy of the original application, they didn’t even bother to provide it. It’s frustrating because this is hurting my credit for no reason, and it’s just not fair. How can they just put something on my report without any proof?

Dear BBB Representative,
I am filing a formal complaint against DNF for harassment and unlawful debt collection practices in violation of the Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. § 1692 et seq.
Complaint Details:
The alleged debt in question is past the statute of limitations and is legally unenforceable.
Despite this, [Debt Collector’s Name] has continued to contact me and my family members, which constitutes harassment.
I previously sent a cease and desist letter, yet they sold the debt to another agency, which is now also contacting me.
Their repeated attempts to collect or transfer this time-barred debt violate federal regulations and cause undue distress.
Requested Resolution:
I request that DNF
Immediately cease all contact with me and my family regarding this debt
Stop selling or transferring this debt to other agencies
Remove any negative reporting (if applicable) from my credit report
Comply with all FDCPA regulations moving forward
I am prepared to escalate this complaint to the Consumer Financial Protection Bureau (CFPB), the Federal Trade Commission (FTC), and my state Attorney General’s office if necessary.
I appreciate your prompt attention to this matter and look forward to your response. Please confirm receipt of this complaint.Business Response

I made an agreement with this company or the third party company they use to collect a debt to settle a debt so it would not go on my credit report. The legal agreement was that I could pay half of what was owed and they would not put it on my credit report. I paid the debt off as agreed and they still put it on my credit report for more than the payment agreement was for. Then after I payed the debt off in January for $800, they put the $1100 debt on my credit report damaging my credit in February. They do not honor agreements when collecting debt as they claim. This is a dishonest company and they should not be able to do businessBusiness Response
