DNF Associates, LLC (Hereinafter, "DNF") has received the above referenced complaint, which has been forwarded for investigation and response. Upon receipt of the complaint, the Account in question was placed in a cease status. To clarify for Mr. *****; DNF is a passive debt-buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open lines of credit nor perform collection services or accept payments. Mr. *****'s delinquent **** * ******* * ****** account ending in **** (Hereinafter, "the Account") was purchased from *** **** ** ******** in October of 2024. Please find the Bill of Sale linked to this purchase attached to this response. The Originator notified the Complainant of this transaction via email to his confirmed email address. Please find a copy of that notice attached to our response. The Originator did not notify us of any dispute received in response to that notice. The Account was opened on 02/11/2024 and kept in good standing until it was charged-off due to delinquency on 09/17/2024 with a balance of $4235.00. Mr. ***** made his first and final payment toward the Account on 03/13/2024 in the amount of $66.67, which was his minimal payment due at the time. Please find attached billing statements to confirm this information. The Originator has not notified us of any dispute regarding the validity of this Account. Since DNF's purchase of the Account, Mr. ***** has discussed arrangements with a collection agency hired by DNF, with his last contact with them being 11/01/2024. Unfortunately, he was unable to come to an agreement and no resolution has been reached. According to the placement file provided by the Originator, the Account was opened with Mr. *****'s social security number, his birthdate, his confirmed daytime phone number, his confirmed mailing address and a confirmed email address of *****************************. Because of the information being linked to Mr. ***** and the Account History we do not find the Account to be fraudulent or false in nature. If Mr. ***** can provide proof of fraudulent activity (I.E. police reports filed at the time of the incident, communications with the Originator, etc.), we will reinvestigate. DNF has not yet placed a tradeline on any of Mr. *****'s credit bureau reports. However, we would like to notify Mr. ***** that this Complaint does not hinder DNF's right to report in the future. FCRA laws allow this, as DNF meets the criteria for a passive debt-buyer and current creditor of the Account. If Mr. ***** would like to discuss how to resolve the balance owed on the Account, he should contact ******* ********** ********* *** at ************, as they have been hired by DNF to negotiate and collect on our behalf. Thank you for the opportunity to address and resolve this matter. If we can be of any further assistance to your Organization, please do not hesitate to contact me at ************. Upon receipt of the complaint, the Account in question was placed in a cease status. To clarify for Ms. *******; DNF is a passive debt-buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open lines of credit nor perform collection services or accept payments. Ms. *******'s ******************** account ending in **** (Hereinafter, "Account A") was purchased by DNF from *** **** ** ******** in April of 2024. Please find the Bill of Sale linked to this purchase attached to this response. *** **** ** ******** notified Ms. ******* of this transaction via email to her confirmed email address. Please find attached a copy of this notice. Account A was opened on 10/18/2021 and kept in good standing until it was charged-off due to delinquency on 03/25/2024 with a balance of $1096.04. Ms. ******* made her final payment towards Account A on 12/06/2023 in amount of $17.00, which did not the meet the minimum payment due at that time. Please find attached billing statements to confirm this information. Ms. ******* first became delinquent on Account A on or around 08/27/2023 , nearly two (2) years after the account was opened. According to the placement file provided by the Originator, Account A was opened under Ms. *******'s name, social security number, birthdate, previous address, phone number and email address. We have since updated the file to reflect Ms. *******'s most recent contact information. Ms. *******'s ******************* account ending in **** (Hereinafter, "Account B") was purchased by DNF from ******* ******* **** in June of 2024. Please find the Bill of Sale linked to this purchase attached to this response. Account B was opened on 06/08/2019 and kept in good standing until it was charged-off due to delinquency on 05/16/2024 in the amount of $231.00. Unfortunately, this payment, as well as many others, was declined. Please find attached billing statements to confirm this information. Ms. ******* first became delinquent on Account B on or around 12/14/2023, over four (4) years after the account was opened. According to the placement file provided by the Originator, Account A was opened under Ms. *******'s name, social security number, birthdate, previous address, phone number and email address. We have since updated the file to reflect Ms. *******;s most recent contact information. Because the information can be linked to Ms. ******* and the years of Payment History we do not find the Account to be fraudulent or false in nature. If Ms. ******* can provide proof of fraudulent activity (I.E. police reports filed at the time of the incident, communications with the Originator, etc.), we will reinvestigate. DNF placed a tradeline on Ms. *******'s Trans Union report regarding Account A on or around 06/19/2024. DNF placed a tradeline on Ms. *******'s Trans Union report regarding Account B on or around 08/22/2024. FCRA laws allow this, as DNF meets the criteria for a passive debt-buyer and current creditor of the Accounts. Since receipt of this complaint, we have added a Compliance Condition Code to both tradelines DNF furnished to indicate the Accounts are in dispute. We find no error in our credit reporting. If Ms. ******* would like to discuss how to resolve the balances owed on the accounts, she may contact us during business hours. We will then place the Account with a third-party collection agency in our network to negotiate and process payments on our behalf. Thank you for the opportunity to address and resolve this matter. The Originator did not notify us of any dispute received in response to that notice. Additionally, a former collection agency hired by DNF sent an initial collection notice to Ms. ******** via **** on 06/29/2023. The agency has no record of any dispute received in response to these notices. The notice described has been attached to this response. After review of the information furnished to Ms. ********'s tradeline, we find no error in our reporting. Because of the extensive account history and the information being linked to Ms. ********, we do not find the Account to be fraudulent in nature. If Ms. ******** can provide proof of fraudulent activity, we will reinvestigate.
