We have a contract with Buffalo Biodiesel for collecting our restaurant waste oil. Their container has been leaking and they refuse to service it. They claim its not leaking. A neighbor reported us to the DEP and the DEP agent stated that they could visibly see it leaking and Buffalo Biodiesel will still do nothing about it. We got a new company to drop off a collection barrel and now Buffalo Biodiesel is threatening litigation because we have a contract with them. This customer called stating there was a leak. We sent a driver to inspect the vat and he stated there was no leak. We also have a radar device (serial number **********) that measure real time volume, our radar did not show any drop of volume (see notes below) Also if the DEC confirmed the VAT was leaking we would have been notified and we have not received any notice from DEC, EPA etc. As the radar device shows oil volume in the vat remains steady and our driver's visual inspection showed no leak we are unable to consider this a leaking vat. 06-Jun-25 Sebastian B. I understand you feel your vat was leaking but our direct observations along with our real time radar level shows there is no leak. We would like to continue to do business with you and resolve the contract breach. I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.
I have attached the video of the leaking container. The container was supposedly emptied by your company in May and we have not used the container since then therefore it should be empty. However it’s not empty and it’s still leaking I tried attaching a video showing a consistent drip of oil at the bottom of the container but it won’t upload. So I included a picture and as you can see there is no oil on the top as the container hasn’t been used for about a month or more. And it’s still leaking! I did email the video to your employee who reached out to me.

We are a restaurant whose cooking oil is collected through Buffalo Biodiesel. Our oil has been collected 2 times, and we have been promised payment but have not received any payment yet and it’s been close to a year, with the first collection around fall 2024. We have called the Buffalo Biodiesel company multiple times and were either redirected, put on hold, transferred over and over, saying to contact this or that department which was all futile as it led to no results, no payment, and no one still had any answers and produced no results or progress whatsoever. That, or we were told to request a check through their website, or other “instructions” to receive a payment yet still no response, still nothing and it’s the next year already. They seem to be avoiding payment.
We have a receipt from the first oil collection, which is attached to this complaint form, however they never filled out the date. Despite that, it would’ve been around fall 2024, probably November. The second oil collection, we were never given a receipt by the driver/collector even though they collected our oil. However, we DO in fact have evidence, security footage that our oil was collected the second time. They owe us at least $500.
Additionally, we need our oil collected for the third time and we have called and contacted so many times yet still no one is here to come pick up the oil. It’s been weeks. We need a response, and for this business to act like a business.Business Response

We signed an agreement form with buffalo biodiesel inc back in 2023. It’s been a few weeks later, their equipment still never appears to be on site. We contacted them numerous times and never receive any response. We have no where to dump our oil. Therefore we contacted a different company, and they came right away. Now it’s been 2 years later we received a pre suing letter from them saying they have not collect any oil from us and their equipment was missing. They gave us options of either pay them 2400 to sign out of contract or 750 for their missing equipment. This is ridiculous and make absolutely no sense.Business Response

You signed the contract on 08/22/2023, Our records show that our driver, ********* dropped a 350gallon Vat on 10/03/23, well within our policy of 90 days. Since that time you have not called or requested an oil pick up from us. We noticed you still have a competitor onsite which is a violation of your contract. Please review your contract regarding your obligation to use us as your exclusive oil collector. The pre-suit notice is to ask you to come back into compliance and give us your used cooking oil. Also please refer to your contract regarding our equipment placed on your property. You are responsible for that equipment so if you have requested a competitor to remove it, you will need to reimburse us for that equipment. I signed on with Buffalo Bioldiesel in January 2018.
They dropped off a tremendous tank, way bigger than I would ever need and abandoned it.
My phone calls were ignored, I was never serviced, I was completely forgotten
Months and months of forgetting about me that tank was finally full and no one was there to retrieve the oil. When I finally contacted somebody, said they no longer service my area. I was forced to go into contract with a new company. When the product became immensely valuable BB came back in the pictures that I was violating the contract that I thought was null and void. I released my new company from the contract and brought Buffalo Biodiesel back on. From this point on they kept on calling the police and claiming I was stealing the oil that I was disposing of. Evenwhen I called them to pick up the oil they claimed it was not full and I was stealing from myself. Periodically they would disappear, notService and then report me again to the local authorities. after the contract expired, I attempted many times to have them remove their container, which was in fact, not registered to their company, but to company that claimed it was stolen property. All these years later, I just got served with a lawsuit claiming that my company produces 350 gallonsof waste oil a week and I owe them upward of $11,000. Shocked and disgusted that a company can be allowed to continue to do this to unsuspecting victims. Didn’t take long after I became part of the racket where I realize thatthis is their MO and I’m not alone. One of the worst thug like mafia wannabe companies that I have dealt with and all my of operating restaurant. Getting paid with secondary I just wanted my oil removed in a sanitary efficient way. Although I've lost much time with this issue, I just want this suit dropped.Business Response

I entered into a five year contract with this company with promises of better payout rates ($0.25 per gallon) and service. I am now six months into the contract and have yet to receive a dime for our oil disposal. I contacted them a few months ago and they claimed they had not yet picked any up which is impossible as much oil as we dispose of per week. Yesterday, I received a letter in the mail (attached) informing me our bin had been emptied by thieves. This company is making up this theft ring up to avoid payment for our oil! They also took the bin of our former company (*** ***) without consent. I used to receive between $40 - $60 every month from *** ***. Buffalo Biodiesel has not paid me a single cent.Business Response

Hello I called this company to remove an oil tank on june 12,2024 and it is now may 9th 2025 i have been contacting them constantly about having them pick up there equipment and i signed a cancellation of equipment and still no one has yet to come. I told them that we can not have the oil tank here as it is a hazard and our landlord is getting into a lawsuit with the neighboring apartments next to us. They have been very unprofessional and i have not been the first person that has gone through this headache. They said they would come remove it within the two weeks i signed the agreement of removal. It has been well over two weeks and nobody from the company has contacted me or my business about this ongoing issue. I need to have it removed or I will be involved in a lawsuit with my landlord. They have said countless times they will schedule the oil bin pickup and not a single person has reached out. Please help me get this solved and get this oil tank out of my property.Business Response

I am the owner of a property that was previously leased by ***** **** ******* *** *******. They had a contract with Buffalo Biodiesel to collect their used cooking oil, which required the placement of two large grease collection containers on the property. On January 30, 2025, Dirty Bird moved to a new location and informed me that they requested the grease containers be moved to the new site. However, instead of relocating the containers, Buffalo Biodiesel delivered new containers and left the original ones at the old location.
Since February 2025, I have been in contact with Buffalo Biodiesel to have the containers removed. Despite being assured multiple times that the request would be fulfilled, the containers remain on the property. The most recent communication was with Jeff, the Facilities Manager, on April 2, 2025, when he stated he would personally arrange for the pickup. As of today, April 7, 2025, the containers have not been removed, and I have not been provided with a clear timeframe for when this will be addressed.Business Response

I signed a contract for a year for removal of waste cooking oil in june/ july 2024.in contract States they would pay me for my cooking oil, and I have not received any money.I called a numerous amounts of time have gotten the run around we are now 9 months later and still no money. I asked to remove the been and they said no that they would sue me for breach of contract. I am also the owner of the property as a separate entity and called again as that entity and was given the run around again and said I was lying. Basically, they are stealing the oil and not paying me for it! I really just want the container removed off my property and call it a day. ***** ******* When i was solicited in May 2024 about there service the salesman who was with there company said I would get paid every month and can cancel at any time which is not true. It was in September when they where here the yorktown police witnessed them taking the oil and then denied it.I have a copy of the receipt for the pick up that I have attached which shows it, but if you look at the receipt it shows the name of the business ********* ****** ******* ***** but it is my container.I called up that day and spoke to a *** ***************** which I was told was the owner from the driver and he said that he would take care of it.So a couple of more months past and I called again to two people that day Mike and Sebastian and they gave me the runaround again.iasked to speak to a supervisior the gave me a woman called Naj and she was alittle more helpful and I told her about what was going on and she agreed that the oil was being taken and credited to ********* ****** ******* ***** and promised me a check for all the back oil payments and would fix it.but that did not happen. So I called as the owner of the property which I am and the told me I was lying that I am not the property owner and can't have the container moved.So about 3 weeks ago I saw the truck here taking the oil again and I asked him(driver) again who are you here to service and he said ********* ****** ******* ***** but he took it out of my container again.So I recently contacted the BBB and then short after I received a registered letter that I will be sued for breach of contact, but they have not fullfilled there part of there contract to pay me.I really don't want any money but just the container removed from the property.They could make it so easy and just remove it and be done but they are not.I am in the process of getting the police report from that day in september but I am trying to locate the original contract.If you need to get in contact with me ************ *Business Response

During the summer, a representative of BB came to me after noticing an oil container from another company at my business and informed me that said business was no longer operating and failed to mention that another business had purchased them. Without that information, I entered into a one-year agreement with his company. A few weeks later, a representative from my original company visited, stating they had received a cancellation notice and a request to pick up the current oil tank on my behalf. I contacted Buffalo Biodiesel to explain the situation, hoping that, since they had misrepresented the facts, they would release me from the agreement I had signed so I could resume business as usual. I have not gotten any response back from BB, and they have yet to fulfill their end of the agreement for over eight months. I would like this company to either finish the job or drop the contract instead of sending me a letter threatening a lawsuit.Business Response

I have been contacted by a manager at the company, they have said they would complete the work but afterwards the General Counsel called and stated that they would release the contract. I thought that was weird but that is a satisfactory response. I would've liked something in writing and mentioned it to the General Counsel, still have not received that but overall, this is not a big deal.
