Innovis is providing inaccurate personal information on to CRAs and I want it to stop immediately. My Credit File is not 100% Accurate, pursuant to the Fair Credit Reporting Act (FCRA). My personal information is being reported inaccurately and I need my credit file corrected now. I am a homeless Human Trafficking Victim. I uploaded my determination documentation to Innovis and they accepted my documentation at first then a week later they refused to accept paperwork and refused to tell me why they were not accepting the determination. your complaint, you claim that Innovis refused to block adverse information
resulting from human trafficking from appearing on your Innovis Credit Report.
You also claim Innovis did not provide you with a reason for declining your
request.

-Per our communications with you by email on 2/1/2024, 2/15/2024, 3/5/2024, and 3/20/2024, and by phone on 3/20/2024, Innovis informed you that the documentation you provided with your request does not satisfy the requirement which has been prescribed by the Consumer Financial Protection Bureau in 12 CFR § 1022.142(b)(6)(i)(A)(2). It states, “Victim determination. Documentation that is of a determination that a consumer is a victim of trafficking made by a non-governmental organization or members of a human trafficking task force, including victim service providers affiliated with the organization or task force, authorized by a Federal, State, or Tribal governmental entity to make such a determination.”
-The CFPB provides strict requirements to non-governmental entities in their commentary to the final rule 12 CFR Part 1022, published June 24, 2022. The CFPB states, “To clarify, the final rule does not permit a non-governmental entity or human trafficking task force to provide an authorization to make a victim determination under this section for itself or another entity. Instead, the authorization must be made by a Federal, State, or Tribal governmental entity, and each governmental entity may establish their own criteria for making such authorizations.”

CFPB Human Trafficking Final Rule Detailed
Overview the Consumer Financial Protection Bureau (CFPB) has enacted a
significant regulation to aid victims of human trafficking. This rule, which
took effect on November 1, 2023, necessitates consumer reporting agencies
(CRAs) to establish a process for blocking adverse credit information that
stems from human trafficking. What Victims Need to Provide: Victims of
trafficking are required to submit "trafficking documentation" to
CRAs, which comprises two essential elements: Victim Determination:
Documentation from a Federal, State, or Tribal governmental entity. Court
documents or other records from a court of competent jurisdiction.
Certification from non-governmental organizations or human trafficking task
forces that are authorized by governmental entities. A self-attestation signed
or certified by an authorized entity. Identified Adverse Items of Information:
Documents pinpointing the adverse information that arose due to trafficking,
such as coerced debts, criminal records, or eviction records related to the
trafficking experience.
Process and Timelines: Upon receiving a
submission, CRAs must block the adverse information within four business days.
If additional information is needed or if any documentation is missing, the CRA
must notify the consumer within five business days. The CRA is limited in its
requests for additional information and cannot challenge the victim's
determination of an item being related to trafficking. A final decision on the
block request must be made within 25 business days. If a block is declined or
rescinded, the CRA must notify the consumer, attempting to resolve any
submission deficiencies beforehand. CRAs are prohibited from making judgments
based on the validity of the facts presented in the trafficking documentation.
Consumer's Preferred Contact Method: Consumers must indicate their preferred
method of contact, and CRAs are obliged to use only that method for all
required communications.
Notification and Recordkeeping: After a final
determination, the consumer must be notified in writing within five business
days, including an explanation of the outcome and a link to the CFPB’s consumer
complaint portal if applicable. CRAs must keep records of consumer submissions
and compliance with the rule for seven years after a submission is received.
This rule represents a critical step in protecting the financial identity and
integrity of human trafficking victims, ensuring that their credit history is
not further marred by circumstances beyond their control. Innovis has
informed me that the documentation I provided does not satisfy the requirement
which has been prescribed by the Consumer Financial Protection Bureau in 12 CFR
§ 1022.142(b)(6)(i)(A)(2). It states, “Victim determination.
Documentation that is of a determination that
a consumer is a victim of trafficking made by a non-governmental organization
or members of a human trafficking task force, including victim service

Sir/Madam, I am reaching out to bring to your immediate attention a serious
matter of noncompliance by Innovis with the Final Rule, specifically sections
1022.142(b)(6) and 1002.142(b)(2), which are critical to the protection of
human trafficking survivors, such as myself. Despite my efforts in providing
all mandatory documentation to Innovis for the purpose of blocking adverse
credit report items as a result of being a victim of human trafficking, Innovis
has not only disregarded my requests but has also repeatedly demanded
additional documentation beyond what is legally required.
The documentation I have submitted, which
includes victim determination documents from an authorized non-governmental
organization, a signed self-attestation statement, and proof of identification,
should suffice under the current regulations. Innovis's persistent refusal and
the consequent denials of my dispute have effectively denied me the rights
provided by the Final Rule. I urge the CFPB to take swift and decisive action
to investigate this matter and to enforce compliance by Innovis, ensuring that
the adverse items resulting from human trafficking are blocked from my credit
report as per the law. I insist that this case remain open until Innovis has
rectified their noncompliance and the adverse items have been removed from my
credit report. I await your prompt intervention and resolution in this matter.

your previous request, received 3/3/2023, Innovis removed information from your
Innovis Credit Report as a result of the ID Theft Report you provided. The Tomo
Credit account referenced in your complaint was not included in the request
received 3/3/2023. Additionally, an updated copy of your Report was mailed to
your current address, dated 3/27/2023. The Report shows the Tomo Credit account
you dispute is not currently on your Innovis Credit Report.
