New Day’s breach of contract dated July 30th 2022. My patio enclosure project did not move forward due to the company’s inability to provide features that were agreed upon before signing our contractual agreement. Alternative options were offered that did not meet our needs and were aesthetically displeasing to the eye. Full disclosure of all options that would or would not be available to us would have allowed for us to make a more informed decision before signing a contract to move forward. I was not opposed to paying a small fee for my CAD plans but I want a refund and New Day refuses to provide one.

      * I insisted on having skylights which is listed on the contract and New Day could no longer provide after signing the contract.

      * An LVL beam was to be installed which is also not on the contract.

      * We requested no materials be ordered without confirming approved drawings with me which they confirmed they would not and had not. Another payment request would have been made if they had already ordered materials which they hadn’t.

      * A start and end date was never provided just approximate number of weeks from start to finish.

I requested a refund on the 30K deposit I put down as they were in breach of contract and unable to provide the services promised. I was told I needed to sign a cancellation form and would not receive a refund because I didn’t cancel within 3 days of signing the contract. I wasn’t informed about all the things the company couldn’t do until well after the 3 days.

      Business Response

      Date: 02/28/2023

The room needed to have an LVL beam due
to the projection, snow load and glass roof panels. This is why many projects
go thru CAD so they are structurally sound and up to code. We suggested if you
did not want the LVL we could decrease 2 walls by 6 inches and you did not want
that. After this you decided to do you own deck and change the room size after
the CAD drawing has been completed. In November you said you wanted to cancel
and we sent you a Release Agreement freeing you from any obligations in
exchange for the deposit. We did not receive a response. In December you
contacted your Design Consultant asking for a price for a Solarium, which we
provided. You also declined on that project and sent in a cancellation notice. We
can move forward on your project and have put a lot work into it to make it a reality.
Please see the signed document noting the three-day cancellation policy. Thank you
      for reaching out.

This letter details the poor quality of the work, errors made, lack of communication, and constant misinformation pertaining to the job done by Great Day Improvements. And despite all this, they out of the blue threatened to take a lien out for the last payment of $3K--without having even been billed. That amount should have been comped to us for the work we had to do to repair the damage they did. Their business has been completely unresponsive, irresponsible, and incompetent.Contract signed in November 2021 project finished in July 2022, past the contractual period.Measurements were taken on day one and contract was signed. We called the office and asked when the install would start and was informed someone had to come out and take the measurements first. When we told them measurements were already taken, the office told us they now needed to take precise measurements. Took two months from that date for someone to come out to take more precise measurements.Late in the process, we were informed that it was up to us to deal with the electrical company for them to do their part of the project. At least the electrical company was reliable and responsive, unlike Great Day Improvements. In fact, the lack of coordination with GDI became a standing joke between us and the electrical company.Install crews used our backyard as their personal trash can and ash tray and did not clean up after themselves.Material and debris were left all over our yard for weeks. It killed our grass and some of our mint plants.I spent hours picking up screws (hundreds of them) and sharp pieces of sheet metal. After crews left each day, we had to clean up after them. As a result of dozens of nails being left all over the driveway, my wifes tire caught one of them and went completely flat. The downspout was removed from the house but the hole in the gutter was not addressed. With the next rainfall, water poured down the side the house and into our window. I had to call **** to come out and fix it, which he said he would do that Friday but we didnt see him for nearly 2 weeks. The outdoor spotlight was damaged during installation and had to be fixed.New deck posts had to be ordered because the original ones were damaged during de-installation, adding weeks onto the project.Different colored screws were used so that had to be redone,The roof leaked twice and had to be fixed. The gutter leaked so that had to be fixed. We asked the crew to caulk the outside frame (the part cut into the house) because there was a gap between the frame and house so rain was getting inside.***** was dropped on our deck and then tracked around the deck. We had to clean that up, although it some still remains. We waited weeks for the glass wing install. We were told they had to measure the opening and have one made. Its beyond me why this wasn't this part of the initial precise measurement process. It was Sept 10 months after signing the contract and outside of the range we were given and they finally completed the work. For the panel that was made too short for the inside of the room, ending abruptly where it should have extended to the edge, they put in a bright white piece of wood that is an eye sore. We will have to do the painting ourselves.Overall, there were several additional concerns that substantially increased our dissatisfaction with GDI.We repeatedly received incorrect or inconsistent information. It occurred so often, that we finally just stopped answering calls from the office as we could not trust the information being provided. We were repeatedly given dates when crews would be out or specific aspects of the job would be done, but for the most part, those dates and promises were not kept. There seemed to be a complete disconnect between management, crews, and contractors, with one hand not knowing what the other hand was doing.Throughout the many months we waited for this project to get underway and the period after the work began, we did not receive any updates from the company so we would know where things stood or what to expect. We had to call and email them every few weeks just to find out what was going on. Toward the end, after we mentioned the possibility of needing a lawyer, suddenly they came more responsive.Of note I brought up the majority of this to ***** (a supervisor) who was extremely apologetic for the sloppiness of the install crews and was appreciative of our patience given that this project was taking so long. This is an unacceptable way to do business.

I didn't get what I paid for and have been trying for almost a year...

      1. The contract specified clearly that they will install a glass called High-Performance Comfort-Gard Plus glass
but they installed a totally different third-party glass with INTIGRAL logo on it - See Dropbox link to the picture
      of glass below:

      ***********************************************************
      2. I asked them to replace the glass for the entire sunroom and they did - See Dropbox link to the pictures
related to the glass replacement below:

      ********************************************************************
      3. The paperwork for the glass replacement clearly specified AGAIN that the High-Performance Comfort-Gard
Plus glass needs to installed and they promised that the glass will bear the High-Performance Comfort-Gard
Plus logo on it. However, they installed a random third-party glass AGAIN - See Dropbox link to the picture of
      random third-party glass below:

*********************************************************  4. As a result, insulation feature is non-existent and as a result, the temperature inside my solarium is the
same as the temperature outside, rendering my solarium, which is supposed to be a 4-season sunroom,
unusable during the winter. However, they advertised that the glass they are going to install is "the most
advanced glass available to maximize heating and cooling return”, suggesting that their glass is the best
in terms of thermal performance, which is absolutely false.

If the glass they are using to build their customers' sunrooms is GENUINE Comfort-Gard Plus glass they are
advertising, why don't they put "Comfort-Gard Plus" logo on it? "Comfort-Gard Plus" is Patio Enclosures'
Registered Trademark and it is a common sense that every company puts its Registered Trademark logo on
its genuine product, unless it is something fake, right?

      Business Response

      Date: 02/21/2023

      Thank
you for reaching out with your concerns. At the time your solarium was being
processed we were having issues with our glass oven. Instead of halting all
production and setting us back for weeks, your glass was purchased from another
glass vendor. Their glass is the very same quality as ours and we would not use
a cheaper product. Your room was still custom manufactured as promised. We also
do not stamp or logo our glass “Comfort Guard Plus” The solarium is meant to be
used year- round but in colder climates it will need a heat source to make them
fully conditioned. We assure you, your room is exactly what you paid for.

      Customer Answer

I am rejecting this response because:

You initially installed a glass made by ******** and agreed to replace the glass since it is a breach of
      contract. And I appreciate that.

Due to what happened before, on the contract to do the glass replacement for the whole solarium, we clearly
and explicitly designated that it is "real insulated High Performance Comfort-Gard PLUS glass.... not a
third-party glass...". Please refer to the contract to do the glass replacement below:

      **************************************************************************

The statement in your response, below, is a proof of breach of contract to replace the glass:

"At the time your solarium was being processed we were having issues with our glass oven.
Instead of halting all production and setting us back for weeks, your glass was purchased from another glass vendor."

Once again, the contract stated that it is "real insulated High Performance Comfort-Gard PLUS glass.... not a
      third-party glass..."!!!

      Business Response

In response to Mr. ***’s complaint, Great Day Improvements
DBA Patio Enclosures went into contract with Mr. *** on 11/13/2020 for a
Solarium with our Comfort-Gard Plus Low E/Argon Glass

Mr. *** was not satisfied with the glass provided and his
research is not applicable to what we manufacture. We do not purchase third
party units. We take raw glass from one of the main distributors in the
      industry.
Once we receive the glass here is our process –
      1)Glass is purchased in sheets from ***** in 96” x 130”
2)The glass is then cut into units for what we are manufacturing
3)Once cut, the glass is tempered in our facility
4)After the glass is tempered it is then injected with argon between the panes
5)There is to much information for all of it to be placed on the glass
After the process which is all conducted in our facility the
unit is assembled into the frames.

There was an upgrade done with Mr. *** for our Solarban 60
(SB60) then after the project was completed we did Mr. ***’s entire room in
Solarban 70 (SB70) at no additional cost as customer good will. This is the
      most efficient glass we offer.
All of our glass units are manufactured in our facility then
shipped to the branch prior to installation.
There is no other glass options that Patio Enclosures
offers, we provide a warranty on the product because it is made within our
facility which Mr. *** has on his finished Solarium.
Mr. *** was provided this information, we would ask this
case be closed seeing that we fulfilled our contract with Mr. *** with the
materials as agreed upon with the addition of our upgraded glass at no
      additional charge.

      Thank you,

      Customer Answer

I am rejecting this response because:

First of all, you keep changing stories: Last time you said "Instead of halting all production and setting us back for weeks,
your glass was purchased from another glass vendor" and now you are saying "We do not purchase third party units".

Second, your statement that "There was an upgrade done with Mr. *** for our Solarban 60 (SB60) then after the project was completed
we did Mr. ***’s entire room in Solarban 70 (SB70) at no additional cost as customer good will" raises two serious questions:

      1. If the Solarban 60 (SB60) you initially installed is Comfort-Gard PLUS, the contract has been fulfilled. Why would you "replace the
entire room in Solarban 70 (SB70) at no additional cost as customer good will"?

      2. If the Solarban 70 (SB70) you installed the second time is Comfort-Gard PLUS, why would your salesman assured/fooled me both verbally
and in text messages that the glass to be installed is Comfort-Gard PLUS (Later on I found out that the glass installed is Solarban 60
(SB60), which is inferior to and cheaper than Solarban 70 (SB70))?!!! If this is not a scam, what is?

Finally, according to ******'s Insulating Glass Unit Performance Comparisons table below, Solarban 70 (SB70) is a low-end insulation
glass, how can you advertise that the glass to be install is "the most advanced glass available to maximize heating and cooling return”,
suggesting that the glass is the best in terms of thermal performance? Once again, if this is not a scam, what is?

Stanek Windows | Great day Improvements Complaint.
I reached out to Great Day Improvements on 9/28/22 notifying them of damage that occurred at my home as a result of a failed window they had installed several years earlier. Since that initial communication attempt with the company, I have worked with three different individuals to try and resolve the issue. Communication with them is very difficult, resulting in many emails before a response back to me. Calling them doesn’t work as the call goes directly to voice mail. They did send out a crew to evaluate the problem by doing a water test. The test revealed the issue was not normal wear and tear but rather a failure of the window. I was hesitant to move forward with the repair but the Order Break Out Specialist, ****** **** assured me that if the repair didn’t work he would order me a new window. Unfortunately, after another rain storm, the window continued to leak. After several more attempts to communicate with ****, he did inform me in November that this window, along with another window that had failed during their initial inspection, were ordered and being shipped in January. When I followed up with **** in January he informed me he was leaving the company and provided me with his manager’s information, ****** ******. She ultimately put me in touch with **** *******, Regional Operations Manager. I provided him with pictures of the damage and on January 20, 2023 he responded saying he would dig into this a little bit and follow up with me by the afternoon of Monday January 23rd. I never heard back from him. After several more failed attempts I let him know I’d be making a formal complaint with the Better Business Bureau. It has been over four months since I initially reached out to Great Day and I am unable to repair the damages to my home until this window is replaced. I have been very patient with Great Day Improvements. I am simply asking them to abide by their promise and warranty and replace the windows they said they would

Despite the company’s claim that I’ll hear back asap, it has been 6 days and I still have not heard from them.  This appears to be the norm for them.  They apologize,  blame labor shortages, make empty promises then don’t do anything to rectify the situation.

We had a great day improvements to do a patio enclosure. They started the project and then left for six months. They came back, did a small piece left again for six months. After about two years, they almost completed the project. The project was still missing, trim, and lots of defects in the material. They claim the project was completed, we started making payments to finance company and was glad to just be done with great day improvements. We are in the process of selling our house and the title company called and said there was a lien on the property from great day for an unpaid balance of around $2000. We called their finance company that they set us up with and they said great day never sent final invoice over.

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me , only under the condition that they actually do contact me and fix the rips that are in my screens the cement problem that's chipping up and correct the fact that my room leaks like a river in the spring. This happened last spring and I'm assuming it's going to happen this spring also. I have tried contacting the company that put this in I have emailed them I have called them on the phone and left them voicemails I have also texted them without any response from any of the people I have tried to contact so I will impatiently wait for a call from the person that responded to this I would also like to know the person's name and the manager's name that will be calling me and their phone number

We entered into an agreement with Great Day Improvements to have our screened-in porch replaced with custom sliders. The design was never approved by us, and the measurements the vendor took did not fit the initial discussion or concept. We were assured symmetrical sides and they are not. The project started 2 weeks ago and nothing has really been done. I have contacted the vendor several times to try work in good faith to fix the issue, but they are fairly non- responsive and are not attempting of fix the situation to our satisfaction. They removed structural beams, replaced them three times as the "custom" glass frames do not fit the existing openings, even though they were measured by them. The glass transoms are not uniformed and they explained that was do to existing conditions, even though the product is CUSTOM-Made. We discussed this at the initial consultation and were assured that the product would be made to fit the existing conditions, installed by Great Day Improvements employees, be able to be installed in all kinds of weather, would take 3 day to install amongst many other falsehoods. The pictures attached are where we are at 2 weeks in (installed and removed 3 times)

April of 2022 I called Patio enclosures to get a window replacement that was broken . I have been waiting to get fixed for 9 months. I keep hearing that they will order it and it will be on the next truck but they never order it. I called them today 1/8/23 and was told that they still have my not ordered it. This is the company that build the room and the only ones that can replace it.

We sincerely apologize for the delay. This genuinely was a human error and oversight. We will waive the labor costs to install the glass for your inconvenience. Someone from the local branch will be contacting you soon to make further arrangements.

I called about this problem before but they only started the work. My sunroom had a broken window. I called the company 15 months ago. They started the job by taking out part of the window but brought the wrong window to put in. I have called the company multiple times but have not heard anything

We contracted with Patio Enclosures / Great Day Improvements in March of 2022. Work began in August of 2022 - which was later than what was stipulated in the contract but acceptable. The contract stated 2 - 4 weeks for completion barring any reasonable delays. We are going into mid January and the project is still not complete. The communication has been poor at best. Some parts to the project were not even ordered until late November - only to arrive in December. At that time we still had to wait to schedule install. They continually tell us they are going to arrive to complete the project and then do not. Additionally they do not contact us to let us know until we reach out. Most recently they scheduled an install for January 6th (This was approximately a month ago). They confirmed the January 6th install last week. I reached out this morning to confirm they were still coming today - no response. I then reached out again later in the day. They finally responded saying no one was coming today because the offices were closing early. The porch has been partially completed but is still wide open to the elements - as such, the interior is being damaged by said elements. The delays and communication for this project are far beyond any reasonable expectation.

I am rejecting this response because:  While the Field Supervisor has reached out to me, I still do not have a firm installation date for the Amana Unit or the remaining glass. I was told the Amana Unit would be installed already.  This has not happened yet.  When those items are resolved, I will accept the resolution.   NOTE: These items do not constitute project completion.  They, however, are the most pertinent items to be completed as the porch is still open and may be damaged by inclement weather.

Per your conversation with our Field Supervisor on 1/17/23, we have ordered the 2 required pieces of glass for your installation and the time frame is at this point is approximately 3 weeks. This portion of the process is mainly out of our hands when it comes to production and shipping times but we are doing our very best to get your project installed as soon as possible. As the BBB only gives us 9 days to respond to a complaint, the time frame for your installation is beyond that date. We will continue to update you on an ETA as we have more firm dates and times. Thank you for your patience.

The porch is done and the consumer is not requesting further assistance from the business.  He is not happy with everything, but considers the matter resolved.
