Dear BBB,
Thank you for the opportunity to correct the facts regarding ******************************* complaint regarding payment for the vehicle he sold to AutoBidMaster.
********************** agreed to sell his vehicle to AutoBidMaster for $4,500. A check was issued for this amount. See attached.
********************** attempted to deposite the check into two of his accounts at two different banks, Navy Federal and ***** Fargo. See attached information provided from ********************* in regards to the check being deposited at ***** Fargo. Per the information provided by *********************, ***** Fargo rejected the check since it had previously cleared elsewhere.
Attached is the information from Navy Federal showing the check was deposited there on September 30, 2022.
The check has cleared our bank account once and the funds have been withdrawn from our account. Per our bank, they are unable to attempt to cancel or withdraw the check because ********************** has already transferred the funds into another account.
We do not owe ********************** any additional funds. Any issues that ********************** has flow from his attempt to deposit the check into two separate bank accounts.
Sincerely,

On December 20th, 2022 I tried to engage in a live bid for a car auction. I was readily meet with a Waiting for Bid Eligibility message and not ever allowed to live bid in any of their live auctions. I was told by customer support to not engage in preliminary bidding if I wanted to live bid. I have used different browsers such as Chrome and Firefox for Windows and Chrome and Firefox for Android and had similar results. Prior to this I was not allowed to live bid as I had participated in the preliminary bidding of another auction. I have the emails from customer support to backup my claim.I want to receive a refund of my $69 membership as I have not ever been able to use their services to purchase a car.Business Response

Dear BBB,
Thank you for the opportunity to correct the facts regarding *********************** Nwirans shipment of his vehicle through a broker, facilitated by AutoBidMaster.
****************************** utilized ************, LLC (********) to broker the shipment of his vehicle. Per the ********* Services Agreement (LSA) with ************,LLC, shipping times are not promised due to delays in ports, warehouses, transportation, and with third parties outside of EasyHauls control. Neither AutoBidMaster nor ******** guarantee shipment or receipt dates, any consequential damages that flow from a delay in shipping are not the responsibility of AutoBidMaster or ********.
In July,************, LLC was notified by the shipping company that, because of the delays in shipments to the requested area, keeping the booking as is would necessitate a shipping time of ***** days or longer. ************, LLC reached out to *********************** Nwiran to see if they wanted to pay for a different shipping company that could ship the vehicle more quickly but would also be more expensive. ****************************** said that they did not wish to alter the original booking, and as such, consented to the extended shipment timeline.

I am rejecting this response because:by the time they have my vehicle and I already have payed the amount they asked for they were asking for more money to ship my vehicle in a faster way , and if I rejected and wanted to find another company to ship which I should have done before , I need to pay more money for their warehouse and shipping from the auction I purchased from to their warehouse this is another loss , so it was like you pay more or you lose money or you will wait till we find something for you , adding for that my purchase was including shipping for ***** free zone in ****** , now the container will arrive ***** port which is about 300mile away , I need to find another shipping because they said that we will not ship to ***** free.It is not my problem if I have waited all of this time to pay more around 1000$ to ship the container to ***** free zone which was my purchase for and suddenly they were saying we will not ship there , why would they give me this quote? Why should I be stuck? Any other option I need will cost me more money than what it should be , I did my purchase through Auto bid master not any other company , my problem with them and one more thing the car will not arrive ***** in 12/8/2022 it is going to ****** !
Thank you for taking care of this , I hope they will take care of this and do not raise up their hand from this case because by those 6 months that I have waited the car is older one year now and a big amount of money frozen in it and the buyer canceled and I payed the fee of that .

A vehicle I purchased from AUTOBIDMASTER to export was seized by ** Cusotms at the port for being a stolen vehicle . ******** security sent me the document for the confiscation. I presented it AUTOBIDMASTER. I need my money back, plus transportation cost to the port and storage fees.I had purchased the Autobidmaster premium membership for a reason. Autobidmaster states that with this type of them membership, a dedicated teammate will help you with everything, from bidding to paying. On the website it states that this membership is the only level with a *********************** I purchase that service because I wanted everything to go well with my transaction. I paid for the premium membership because I knew it was a complicated process, but the Dedicated Buyer Agent would be the expert. How could this have happened that they sold me a stolen vehicle for export.I have all my evidence to show that Autobidmaster charged me for export and even tried to be the one to organize the export , but I decided to find another exporter after Autobidmaster kept giving me the runaround for weeks causing me to pay COPART expensive storage fees. So I paid Autobidmaster to organize the transportation just to the ******* port. The exporter shipping company has to clear all items to be exported through customs. That was when it was discovered that the vehicle was stolen. I have the 6051S (08/09) form which is the CUSTODY RECEIPT FOR SEIZED Property and Evidence from the US ********** of ******** Security.Business Response

Dear BBB,
Thank you for the opportunity to address the situation discussed in ************************* complaint.
It might be helpful to understand that AutoBidMaster is not like your local used car dealership. We operate a membership-based online auto auction marketplace and act as a broker to facilitate the purchase and sale of salvaged, damaged, and used vehicles through our affiliated dealer and dismantler network. Our process is fully explained on our site: www.AutoBidMaster.com, and anyone wishing to utilize our services must agree to our Terms and Conditions in order to use our services. ****************** agreed to these Terms and Conditions when he became a member on September 4, 2022 (the Agreement).
Per the Terms of the Agreement, the sale of all vehicles is on an as is, where is basis. All sales are final and there are no refunds on the purchase of vehicles. Per Section 2 and 7.1 of the Agreement, all buyers must inspect, research, and investigate the vehicle they wish to buy, prior to sale, to confirm that the vehicle meets their needs.
Per the ************** Vehicle Title Information System (NMVTIS)the vehicle purchased by ****************** does have a theft history. Per an entry dated December 8, 2022, the vehicle is reported as recovered. Often this means that an insured has been compensated for the loss of their vehicle but the vehicle is later recovered and then becomes the property of an insurance company to dispose of. That could be the case here, as the vehicle was titled into Allstate in June, 2022.
****************** said in her complaint that she purchased the vehicle to export. We do not know if ****************** researched the vehicles history as we recommend. Had ****************** researched her vehicle, she could have seen that the vehicle was marked as recovered. She also could have seen that the title was once held by an insurance company. This would put someone on notice that the vehicle was at one time stolen. If ****************** did not research the vehicle prior to sale, based on the Agreement between the parties, she is responsible for information she would have uncovered has she researched the vehicle as instructed by the Agreement.
AutoBidMaster is not responsible for any issues with exporting vehicles or US Customs. We do not control whether their systems are accurate or up to date. It is the responsibility of the buyer, especially if they wish to export a vehicle, to confirm that the vehicle meets their needs.
As a courtesy, weve reached out to our sellers to see if they can provide any documentation to assist ****************** with the US Customs Bureau. If we obtain any further information, we will provide it to *******************
As research about the vehicles history is the responsibility of the buyer, there is no refund or other compensation due in this case.
Please do not hesitate to contact me if you would like to discuss this matter further.
Sincerely,
*****************************

I am rejecting this response because: Autobidmaster had not reached out to me with any documents to assist me. Also, I had purchased the premium membership from Autobidmaster because I wanted the assistance of the dedicated buyer agent that comes only with this membership level. The person you advertise on your website as the person to help with everything.
I asked the agent if the vehicle was going to meet requirements for export. I was told yes. The problem is that the vehicle is recorded as stolen. If you, the seller, has evidence of a pay-off to clear up this confusion with customs, please email it to me, so I can present the evidence to customs. Why cant you provide the evidence? That would help a lot. Nobody has reached out to me from Autobidmaster with any assistance prior, except the callous emails from ***** stating that there is nothing they can do. This response on BBB is the first time there is any mention of helping with some documentation of history of a pay-off. You may want to inform your dedicated buyer agents that vehicles with a history of theft will be difficult to export. Wait!! I still dont know that the vehicle is not indeed stolen

Hello good day. My name is ************************* and I am contacting you to report the ********************** for fraud and theft of money from me. I explain what happened.I've been looking to upgrade my car for a newer one for about 15 days and I was looking for an SUV between 2019 and 2022. On October 13, I received an email that I had to pay for the car I won. something that never happened because I never bought this 2007 ****** car with 200 thousand miles. I wrote to them that I had not made that purchase and their response is that I had made it and that therefore if I did not want the car I would have to pay 800 dollars. I told them to check my account because something wrong with their system. The car that I wanted to buy was in Lot# ********* Olrando location (A/110/JJ060) a 2020 ***** CX-5. And the car that they tell me I have to pay for is Lot# ******** Olrando location (A/111/L070 )If you notice this ****** just came after the car that I really wanted to buy, their system must have had an error. and it turns out that the easiest solution for them is to charge me 800 dollars is a total fraud, there is the clear evidence. I ask you please help me to solve this citation. Thank you very muchBusiness Response

I apologize that my English is not very good but I want to respond to the letter that AutoBidMaster company sent you regarding my situation. First I want to make it clear that it is not about having the intention of not paying something. I am clear that if I bet on a car and then I don't want it, I should be penalized, I totally agree. But this case is totally different. I contacted them immediately when I received the mail saying that I had to pay for the purchase of a 2007 ****** and when I spoke with them I explained that I would not pay for anything I did not buy, I never bet on that car. And it bothers me that they want to award me the purchase of that car. Their response all the time is that I have to pay and that the system says that I should buy it. But they never reviewed the case in depth, of course it is easier to cancel and collect ********************************************************************************************************** addition, I have the evidence that all the cars that I bet were cars. SUVs from 2020 onwards. At no time have I even looked at a sedan and less than ************************************************************************************************************** with the lot number #61902222 located in position 111 of the auction that day was a ***** 2020 lot# ******** which was number ********************************** my favorites list. Now if I tell them that their system failed and it was not the first time because two days before I wrote to them explaining that I had problems with my account. Therefore, their system does have faults. The failure was simple, I bet on the ***** 2020 in position 110 and the system captured the bet for the next car, which was the ****** that was in position 111. Now it is easier to blame others and collect. But it does not take into account all the factors that *** have caused this error on your system. Example: served, Internet, capacity and speed of uploading and downloading information and many more. There are many mistakes Now it is not fair that they force me to make a payment for something that I never bet. Let them give evidence of the time the ***** 2020 auction ended and the time I made the bet there they will see that the system failed. Together with this email I send you one more proof that your system had an error days before. This is an email I sent to them on 10/11 two days before this problem happened.I want to finish thanking you once again for taking care of my case.Business Response

Dear BBB,
Thank you for the opportunity to respond to ********************** reply to our response.
Our business records show that ******************** emailed us that he could not bid on his account on October 13, 2022, at 10:13am. ******************** would not have been able to place further bids on his account at that time because he had previous bid on, and won, a vehicle earlier that day at 9:50am. We responded to ********************* email at 11:02am. The next reply we received was ******************** stating he would not be paying for the vehicle he purchased.
The fact that ******************** was not able to make additional bids/purchases because hed already won a vehicle that morning, is further indication that our system was working correctly. As I previously stated, we checked our system and there were no issues on October 13th.
We are sorry that ******************** is unhappy with the vehicle he purchased via AutoBidMaster, but based on the Agreement between the parties, he is not entitled to a refund or other compensation.
Please do not hesitate to contact me if you would like to discuss this matter further.
Sincerely,

I am rejecting this response because:
Sincerely,
*************************Hello good morning and thank you for responding to this summons. but they are giving information without foundation and without proof since I never wrote to them on October 13 telling them that I could not bet, I wrote to them alerting them about a message that you sent me saying that I had won a bet that I never made. But that day I never wrote to them telling them that I couldn't bet because I did but to the ***** that was in the position before that ******* I wrote to him on October **************************************************************************** bet. and together with this writing I put the proofs of the emails. Once again the bad job they are doing is demonstrated, they are stealing money from people without foundation or evidence. and I'm going to go as far as I have to go because this country is a country of rights and you are begging people. once again thanks to Bbb for his excellent work. and excuse my english

Dear BBB,
This is our second reply, third total response to ********************** complaint. For the purposes of accuracy and completeness, Ive included the two prior responses with this response.
Our response remains the same as detailed in our three prior responses. There was no error in our system. The documents provided in this third allegation do not change our response and were previously addressed, but for the sake of completeness, they will be addressed again here.
******************** has attached three documents to this third allegation. The first document is an email dated October 14, 2022, from AutoBidMaster to ******************** that his password has been reset. Our business records indicate that ******************** requested this reset at 9:58am on October 14, 2022. ******************** resetting his password on October 14, 2022 is not relevant to the purchase he made on October 13, 2022.
The second document attached is a string of emails between ******************** and our customer service team, where in ******************* says that he did not intend to purchase the vehicle and our customer service team explains to him that we confirmed in our system that the bid came from his account and that, as we previously explained herein in our October 18,2022 response to this BBB complaint, per the Agreement between the Parties, a member is responsible for ******** that come through their account, even if they bid on the wrong vehicle or purchase a vehicle in error.
The third document attached is a watch list of vehicle ******************** noted as watch under his account. Whether a member utilizes a watch list or not is irrelevant. Members are not limited in the vehicle they can bid on by those only in their watch list. Some members do not use their watch lists at all. Whether or not the vehicle ******************* purchased is on his watch list, or the vehicles on this watch list are different than the vehicle he purchased, it is irrelevant. Members are liable for the vehicles they actually purchase regardless of what is in their watch account.
Whether ******************** wanted to bid on a vehicle before the vehicle he purchased or after the vehicle he purchased, he is still responsible for the vehicle he actually purchased. We have confirmed that there is no error in our system. If he bid in error, it is his responsibility.
Section 8.3 of the Agreement states that a member is responsible for ******** generated from their account. In addition, the Rules and Policies Section of the Agreement provides,You are responsible for all bidding and other activity that occurs through your Member Account (whether through our Services, Copart's website, or through kiosks at auction facilities).
Once ******************** placed his bid, it cannot be retraced. As is stated in the second document provided by ********************, we verified ********************** bid with the auction. We verified it in our records. The winning bid came from his account and as such, he is responsible for his purchase of the vehicle.
If vehicles are purchased and not paid for in full, Members are responsible for the Relist Fees as provided in the Agreement. To date, ******************** has not paid this Relist Fee and the balance remains due and owing on his account.
Please do not hesitate to contact me if you would like to discuss this matter further.
Sincerely,
*****************************

October 18, 2022, Response
Dear BBB,
Thank you for the opportunity to respond to ********************** complaint regarding the vehicle he purchased via AutoBidMaster.
It might be helpful to understand that AutoBidMaster is not like your local used car dealership. We operate a membership-based online auto auction marketplace and act as a broker to facilitate the purchase and sale of salvaged, damaged, and used vehicles through our affiliated dealer and dismantler network.
Our process is fully explained on our site: www.AutoBidMaster.com, and anyone wishing to utilize our services must agree to our Terms and Conditions, Rules and Policies, Privacy Practices, and Terms of Use, in order to use our services. ******************** agreed to these when he became a member on June 6, 2015, and ******************** agreed to our updated Terms and Conditions governing the sale of this vehicle on September 5, 2022. (the Agreement).
As is stated on every vehicle listing page, and also in the Rules and Policies Section of the Agreement, all sales are final. Section 8.3 of the Agreement states that a member is responsible for ******** generated from their account. In addition, the Rules and Policies Section of the Agreement provides, You are responsible for all bidding and other activity that occurs through your Member Account (whether through our Services, Copart's website, or through kiosks at auction facilities).
******************** reached out to our customer service team on October 13, 2022, where ******************** said he did not intend to purchase the vehicle. Our team explained to him that because he purchased the vehicle when a winning bid comes through a members account, even if he did not intend to make such a purchase, he is committed to making that purchase.
******************** also reached out to our team on October 17, 2022, and we again directed him to the terms of the Agreement. There was no error in our system.
If a member does not timely pay in full for a vehicle purchased and arrange to have that vehicle transported from the auction yard, the vehicle will be relisted for sale, as provided in the Agreement. The Rules and Policies Section of the Agreement provides in part as follows,
If you do not complete your purchase transaction (by failing to pay, failing to pay in full, or for any other reason) before the payment deadline, you acknowledge and agree that we will cancel your purchase and request that Copart relist the vehicle for sale through the auction. If this occurs, you must pay the applicable relist fees ("Relist Fees").
******************** did not timely pay for the vehicle and as provided in the Agreement, was charged a Relist Fee. As further provided in Section 1 of the Agreement, By using our ******************* Services, and Services, you agree that we are authorized to charge any credit card on file for fees, payments, and or any other amount due under this Agreement.
We are sorry that ******************* is unhappy with the vehicle he purchased via AutoBidMaster, but based on the Agreement between the parties, he is not entitled to a refund or other compensation.
Please do not hesitate to contact me if you would like to discuss this matter further.
Sincerely,

I am rejecting this response because:
Sincerely,
*************************BBB Thank you very much for the work and the work you are doing regarding my case.
Clearly in this last response we can realize that they are evading responsibility and the mistake made. They have written a message with more than 10 paragraphs explaining each and every one of the emails sent by them and by me, but none of them mention the email I sent them on October 11 at 1:12 pm two days before of the problem in your system, where I am telling you that I am having problems with my account. But also that they send proof that I wrote to them on the 13th telling them that I couldn't bet, I never wrote to them telling them that I couldn't bet. I wrote to them asking for an explanation of a bet or purchase that I never made. I sent that email to you attached with all the other information and they saw it.
Why don't they mention the truth of those emails at any time? That's why when I saw that they sent me to pay for a car that I had never bet on, I clearly thought that my account had been hacked and I decided to change the password quickly.
Gentlemen, this auction is not a live auction, where one raises the card with a number and the bet is automatically registered. We are talking about an internet auction through a digital network where there are thousands of people connected at the same time where there may be various factors that affect the system, both in the network and in your information server, I may have delays or lag as happened on the 11th When I wrote to them that I had problems with my account. Your system is not perfect, you have to know that.
Thank you very much BBB for all your support and your service, but I will continue to insist until exhaustion this is a fraud of this company and I am sure that I am not the only one affected.Initial Complaint

I want to formally complaint on the exploitation and unethical behavior by Autobidmaster. I needed to ship some vehicles to *******, and i was quoted $1,825 for the shipping by Autobidmaster. I make an upfront payment right away for the quoted amount and they confirmed the payment. Though It took them forever to actually shipped the vehicle, needless to mention the insults i received from the owner of the vehicle as a result of the lateness of Autobidmaster in the shipment of the vehicle. However, it was eventually shipped to ******* and the owner paid for the clearing and custom duty, and the vehicle was cleared but to my dismay, the clearing agent acting on the instructions of Autobidmaster refused to release the vehicle to the owner,?on the ground that Autobidmaster claimed that i owed them additional $490 extra for storage without which they cannot release the vehicle. My question is, they quoted for the service and what they quoted for was how much i paid, if they were not able to delivered in a timely manner, is that supposed be my fault, why would they hold a legitimate owner of a property up from collecting his vehicle. I need your help to prevail on this monster to get the vehicle release to the owner. Both the clearing agent in ******* and Autobidmaster in ************* were all rogues, exploiting the innocent customers. I have already paid more than double the price on the first vehicle they shipped for me. They collected $2,950 to shipped by Ro-Ro to ******* when people are actually shipping cars for between $1,200 and $1,500.Please use your good office to intervene by prevailing on Autobidmaster to release the vehicle to the owner in *******. They have collected their money I didnt owed them anything. They just want to be funny and be cheating uninformed people.Thank you and God bless NB Prior to now when the shipping was not done on time, i wanted to opt for Ro-Ro like the first one, but they told me, the shipping arrangement was completeBusiness Response

Dear BBB,
Thank you for the opportunity to correct the facts regarding Mr. ******* complaint regarding the delivery of his vehicle.
We provide customers two options to ship their vehicles: RORO or in a container. RORO rates are higher but this service is generally faster than waiting for a container to fill.
**************** choose to have the vehicle shipped in a container. Container shipments take time to fill with other vehicles for other buyers. We have no control over how quickly other buyers will want space in a container going to the same location as any other vehicle.
Per the terms of the Agreement between the parties, a customer is responsible for paying all storage fees charged by the warehouse after thirty days. We were billed $490 for Storage Charges and those were invoiced to ***************** Per the terms of the Agreement, the vehicle will not be released until all balances on the account are paid.
We are sorry **************** is unhappy but based on the terms of the Agreement between the parties, **************** must pay all amounts due before the vehicle is released and should the amounts not timely be paid, per the terms of the Agreement,we will take possession of the vehicle and sell it to mitigate our damages in this matter.
Sincerely,

I purchased a vehicle through Autobidmaster on 8-18-2022. On 8-19-22 I spent hours trying to pay for the car on moneygram. There was a problem on autobidmasters end. I have emails from them to prove it. I had to go to the bank and wire transfer the funds which cost me an additional $20.00. By this time it was too late to pick up the car. I was charged for 5 days of storage despite the fact I picked up the car at 8AM on Monday the 22nd. They were given multiple chances to do the right thing and refund the storage fees. The vehicle would have been picked up on the 19th were it not for their inability to receive the payment. **************** of goodwill would have garnered them a good review. It is a total of $45. I'm sure there others who have suffered worse losses than I. They blame everything on me for not paying promptly or removing the car in time. I'd have done those things were it not for their issues! The are inconsiderate!Business Response
