Thank you for the opportunity to address ************** Dinzeys complaint. The complaint is that they were deceived into buying a subscription without disclosure of our fees.
It might be helpful to understand that AutoBidMaster is not like your local used car dealership. We operate a membership-based online auto auction marketplace and act as a broker to facilitate the purchase and sale of salvaged, damaged, and used vehicles through our affiliated dealer and dismantler network. Our process is fully explained on our site: www.AutoBidMaster.com, and anyone wishing to utilize our services must agree to our Terms and Conditions in order to use our services. *********************** agreed to these Terms and Conditions when they became a member of our Services on May 31, 2023 (the Agreement).
All of fees for our subscriptions and any purchases made via our Services are set out in the Rules and Policies Section of the Agreement. Also, Section 8.3 of the Agreement states that it is the members responsibility to know the type and amount of applicable fees and charges (including Membership Fees,Auction Fees, Storage Fees, Late Fees, Relist Fees, and other applicable fees and charges related to your use of our Services). Further, our fees are all listed on our website under Rules and Policies. In addition, on each vehicle listing page there is a Fee Calculator. The Fee Calculator lets a member calculate the total amount of any purchase before making such a purchase.
*********************** signed the Purchase Order for this vehicle, via DocuSign, on June 2, 2023. The signed Purchase Order states that all purchases made via our Services are subject to the Agreement. Again, the Agreement details all of the fees.
All sales via our services are as is and final. As *********************** has signed the Purchase Agreement and taken possession of the vehicle, this sale is final and there are no refunds.

I, as the purchasing party, have acquired a vehicle through the defendant's auction site. Following the sale, the defendant failed to refund the required deposit, which was mandated for me to participate in the auction. The defendant asserts that the funds are subject to a temporary hold, which will be lifted once the sale has been finalized. However, despite the defendant's claims of releasing the hold, my bank statements have revealed otherwise.********, I have submitted an overpayment to the defendant, and the defendant has stated that they have reimbursed the excess funds via Zelle. Nevertheless, no such transaction has occurred, and the defendant has been unwilling to provide me with the pertinent information that would demonstrate the transaction's validity.As a result, I am demanding the total sum of $1900, which includes the deposit of $400, the second deposit of $800, and the overage amount of $700 (plus any additional costs, if applicable), that the defendant is obligated to refund me.Business Response

We operate a membership-based online auto auction marketplace and act as a broker to facilitate the purchase and sale of salvaged, damaged, and used vehicles through our affiliated dealer and dismantler network. Our process is fully explained on our site: www.AutoBidMaster.com, and anyone wishing to utilize our services must agree to our Terms and Conditions in order to use our services. ******************** agreed to these Terms and Conditions when he became a member on January 30, 2019, and he agreed to our updated Terms and Conditions on July 2, 2021.
******************** has made no purchases through his account since December 2021 and thus he is not a purchasing party for any transaction since 2021.
******************** did make payments to our company on behalf of a different purchasing party for a sale in 2023. That third party is the owner of the account and the purchaser of any vehicle through that account. That purchaser became a member of our Services and agreed to our Terms and Conditions on November 22, 2022. The third party placed the deposits for this purchase. As provided in the Agreement with the purchaser of the vehicle, the deposits of the purchaser were cancelled. We have confirmation from our bank that those deposits were refunded to the individual who placed the deposits, which is not *********************
As ******************** made the original payment on behalf of the third party for that persons purchase of the vehicle, and pursuant to the Terms and Conditions to which he agreed when he became a member of our Services, all such third party refunds are made following our Terms and Conditions. The refund of the overpayment was issued to ******************** on April 4, 2023 at 2:23pm. The *** was accepted by Mr. ********* bank, attributed to his account, on April 5, 2023. In addition, our bank has confirmed the funds have cleared our account.
There are no further amounts due to the purchaser of the vehicle or *********************

This business took one bid I made and made the bid higher than I was willing to pay. They stopped the bid before the time lapse when another person outbid me, I stopped my bidding. Somehow there was another bid and it ended everything abruptly making another bid on my behalf making me win the car. Given an investigation with other bidders I'm sure they will attest to the fact that the bidding time was not done and it was cut off before it's time giving my bid a win. I didn't agree to it and believe they are committing fraud to win bids and collect money placing higher bid without permission. This business is a fraud. I have bid once before with them and I know that the bidding time is set. This particular bid was cut in time and I supposedly placed a higher bid when I didn't. I told them I didn't want the car because they increased the fees without telling me the rates went up. I paid a year ago ******* fees and rates for a5000.00 vehicle I won. When I win this car the rates and fees doubled this was not what I opted for. The fees now were ******* dollars for a2500.00 dollar vehicle. They failed to say the fees and rates went up. Or I would have never joined again. They took my ****** deposit ****** membership fee and charged my card an extra ****** when I told the guy I didn't want it he said I wouldn't get the ****** or ****** back. He didn't tell me he was charging another ****** I'm just completely disgusted with their cheating people the was they do. I was ok with losing the 600 and 199 but a week later they charged for fees he never said anything about. I recently lost my wallet and later found it, i quickly cancel my debit cards and requested new ones. Few days later, i notice that my account was debited by this AutobidMaster LLC which i reported to my bank and i notice another debit again same from this people. My Bank reached out to them they refuse to respond. I reached out to them and was insulted by this agent called *****, He said they don't care and will not refund the monies debited from my account and that i cannot do any thing. This site is a scam and is stealing from people. I need help with the refund of all the money taken from my account $600, $100, $10.99, $130, $69. this all the money this people have been stealing from my account. Dear BBB,
Thank you for the opportunity to address the concerns in Mr. ******* complaint that a purchase was made on his account by someone else.
When a claim is made that someone else used a Members credit card, we need proof to validate such a claim. Generally, that begins with a police report. We requested a copy of the police report and Mr. ******* will not provide one to us.
In addition, the phone number provided by the alleged other person who allegedly used Mr. ******** account without his consent, is the same phone number as Mr. ******* did when he filed the BBB complaint. We find it unlikely that an alleged thief found Mr. ******** debit cards and also knew Mr. ******** phone number to use them in conjunction to open an account. Without proof that there was fraud regarding Mr. ******* account, we consider the matter closed.

It might be helpful to understand that AutoBidMaster is not like your local used car dealership. We operate a membership-based online auto auction marketplace and act as a broker to facilitate the purchase and sale of salvaged, damaged, and used vehicles through our affiliated dealer and dismantler network. Our process is fully explained on our site: www.AutoBidMaster.com, and anyone wishing to utilize our services must agree to our Terms and Conditions in order to use our services. ************ agreed to these Terms and Conditions when she became a member on February 23, 2023 (the Agreement).
In the Agreement between AutoBidMaster and ************, she agreed that she understood that all sales are subject to the terms and conditions of the Agreement. Each vehicle listing page shows a fee calculator so that buyers can calculate the final amount that will be due for any purchase. In addition,all fees are outlined in the Rules and Policies Section of the Agreement. Section 8.3 of the Agreement, in part, specifies that ************ indemnifies us for her failure or refusal to know the type and amount of applicable fees and charges (including Membership Fees, Auction Fees, Storage Fees, Late Fees, Relist Fees, and other applicable fees and charges related to your use of our Services).
As specified in the Agreement and on each vehicle listing page, all sales are final. Should a vehicle be purchased through our services and not fully and timely paid for, vehicles are relisted,as provided in the Agreement. The Rules and Policies Section of the Agreement provides,
If you do not complete your purchase transaction (by failing to pay, failing to pay in full, or for any other reason) before the payment deadline, you acknowledge and agree that we will cancel your purchase and request that Copart relist the vehicle for sale through the auction. If this occurs, you must pay the applicable relist fees ("Relist Fees"). The Relist Fee is the sum of Coparts Fee plus AutoBidMasters Transaction Fee. The type and amount of applicable fees is available here.
************ failed to pay for the vehicle, and it was relisted pursuant to the Agreement. There is currently a balance of $349.00 due on her account for the Relist Fees as specified in the Agreement.
We are sorry that *********** is unhappy with the vehicle she purchased via AutoBidMaster, but based on the Agreement between the parties, she is not entitled to a refund or other compensation.

Autobidmaster states that I won a vehicle auction for a 2011 Acura ** located in *********** **. I received an email on 2/3/2023 at 9:22 am, I promptly responded at 9:45 am, stating that I did not bid on this vehicle and asked for my bidder number to be changed. I have been dealing with this issue for the last 10 days and have yet to be provided any resolution/compromise. Instead, I am being strong-armed/forced to pay to relist a vehicle that I NEVER bid on! As of 2/13/2023, Autobidmaster has notified me that they kept my deposit of $600, charged my credit card $800 without my permission, and told me that I still need to pay another $200 on top of the other charges. Autobidmaster claims that I bid on this vehicle 9 times but I did not place a bid on this vehicle. Autobidmaster has been unable to provide proof of the bid via ** address and ********************************** are not willing to listen or effectively look into my issue. I have been a customer of ********************** since 2019, and since then I have purchased a few vehicles using this service. All of the vehicles that I purchased, were bid on from my home office located in ************ or ****************, promptly paid for, and picked up by me within 2 business days following the completed purchase. The account history should be proof enough that what I am saying is true. Additionally, this same issue happened once before, and it was promptly corrected by placing a to the company.I have requested documentation regarding this purchase be emailed to me immediately. Documentation should show each supposed bid, the date, the amount bid, the time that the bid was placed, the ** address from where the bid came, and the Geo-Location. I have asked for documentation showing proof that my account has been closed. I do not believe this company can be trusted and I feel that my personal information is at risk of being compromised. Section 8.3 of the Agreement provides, You hereby agree that you will be liable to AutoBidMaster for any breach of the Agreement, including but not limited to the items listed below, and you unconditionally release AutoBidMaster and their Dealers from any and all liability whatsoever for any losses or damages (whether direct or indirect, known or unknown, foreseen or unforeseen, and including attorney fees) arising out of or in any way related to any of the following: Your failure or refusal to strictly comply with our Rules & Policies Any bids, purchases, and or payments made via your Member Account.
Further,Section 1 of the Agreement provides that when charges are made on a Members account, AutoBidMaster may charge the credit card on file for such charges. Section 1 states, in part, By using our ******************* Services, and Services, you agree that we are authorized to charge any credit card on file for fees, payments, and or any other amount due under this Agreement.
It was ****************** responsibility to make sure that no one else could bid through his account and based on the Agreement and his waiver provided by Section 8.3, **************** is responsible for ******** through his account.

I purchased a vehicle ******* Sidekick, LOT #********) on 2/2/23 from AUTOBIDMASTER and completed payment for the vehicle and for shipping on 2/4/23 using their payment system. I chose them for shipping because they stated transit time was 1-3 day. It has now been 10 days and they still have not arranged shipping for this vehicle. I called them every day last week and was told 3 different days last week that shipping was arranged and the vehicle would arrive the next day. All three times, the shipping was cancelled. It will be 11 days starting tomorrow. This complaint is due to storage fees being incurred. They are charging me $25 a day for storage. This is a violation of CALIFORNIA PENAL CODE 532, THEFT BY FALSE PRETENSES, or defrauding by someone of money or property by way of false promises. Autobidmaster's website states, "AutoBidMaster has made shipping even easier! AutoBidMasters full-service logistics team handles all the details of your vehicle shipping, saving you time and money and reducing risk with our fully-vetted licensed carrier network." It also states, "TRANSIT TIME 1-3 DAYS" just above the shipping quote on the order form. They include this disclaimer by way of an asterisk, "Please note that transit time is from actual vehicle pick up to delivery. These are only estimations. Variables like weather, location and holidays do impact those timelines".Please note that the weather has been fine from 2-4-23 until 2-12-23 and I am 400 miles from the car's location. I paid $610 for shipping, which is the going rate. Nowhere does it state that if ********, the company affiliated with Autobidmaster that arranges hauling, fails in arranging hauling, storage fees will be incurred at the rate of $25 a day. I called autobidmaster and was told that after 4 days from the day I won the car, I am responsible for storage fees. I was also told that they are not responsible for these fees and they are a separate entity than ********. ******** also stated I am responsible for these storage fees. This is a conflict of interest. There is no incentive for Autobidmaster or ******** to actually ship your car. They could hypothetically take weeks to ship your car and the buyer will be out several hundred dollars in storage fees. Again, this is not stated anywhere on the bid page or the shipping quote.Since the shipping quotes provided by Autobidmaster do not mention anywhere that if their hauler fails to actually deliver your vehicle, you incur hundreds in storage fees, this is Theft by False Pretenses. They need to amend all shipping quotes to state up front that if they or their affiliate fail to ship your car, you will incur daily storage fees and also the specific amount of these fees, which increase over time.Also, since they did not notify of this, I would like to not have to pay all these additional storage fees that I was never notified of.Autobidmaster will now post beneath this specific complaint a bunch of legal gibberish that they hide behind, such as , "We are only a broker for shipping services. We don't have control over when third party drivers are available to pick up vehicles. We do not make any commitments as to when vehicles will be transported". If this is the case, then why do you state Transit time 1-3 days on the quote? In other complaints about shipping times and storage fees, Autobidmaster has posted, "The buyer must agree to the agreement on____date. Buyer purchased shipping through ******** LLC. ******** LLC is a separate company to Autobidmaster. Autobidmaster is not responsible for buyer's transaction with ********". Please note that if you ******* "Is ******** affiliated with Autobidmaster", the answer is "we're partnered with Autobidmaster, a premier Copart broker, to offer shipping services through their site". To reiterate, Autobidmaster should state on the front page of their shipping quotes that if they fail to pick up and deliver your car, that shipping fees are incurred and the specific amount of these fees. Since I was not notified of these fees up front when I paid for delivery, I would like to have these fees waived.Business Response

All transactions between customers and AutoBidMaster are governed by the terms of the Agreement between the parties. **************** agreed to the Agreement covering his latest transaction on October 24, 2022.
**************** elected to purchase shipping brokerage services through a third-party company, EasyHaul.com, LLC. Per the ******** Services Agreement between **************** and EasyHaul.com, LLC, he agreed that as a shipping broker they cannot commit to specific shipment times but that he would be kept updated about the shipping process as it progressed.
************, LLCs customer service team has reached out to **************** to resolve his issues. EasyHaul.com, LLC has communicated to us,AutoBidMaster, the issues **************** has, have been resolved and that *************** is satisfied with the resolution to this matter.

I am rejecting this response because: The shipping company affiliated with Autobidmaster, ********, never arranged for shipping. After 11 days, they told me they still could not find anyone to ship my vehicle, and that if I paid more money they might be able to find a shipping company. I agreed to pay $200 more. I then received a bill the next day (day 12) for $800 dollars more to ship my vehicle, or a 125% markup from originally quoted rate of $613. At this point, the fees Autobidmaster and Copart charges plus shipping would be 400% more than I originally paid for the vehicle. On top of all this, I had to pay storage fees for 12 days. Copart, Autobidmaster, and ******** are fleecing their customers by stalling on shipping and charging exorbitant shipping fees. There is no incentive to actually ship the vehicle customers purchase, because these companies make large sums of money on storage fees and jacked-up shipping rates. They also do a bait and switch with the quoted shipping rate after failing to ship the vehicle for more than a week, jacking up the shipping rate by more than 100%. I cancelled shipping with ******** and got another well rated shipping company to pick up the vehicle for a reasonable rate one day later. I would like a refund of the out of control storage fees, as their sister shipping company, ********, never arranged for shipping after 11 days. It seems that Copart, Autobidmster and ******** are in an incestuous relationship designed to fleece their customers as much as possible. This whole experience has been awful.

AutoBidMaster, LLC; EasyHaul.com, LLC and ************ are three separate companies. AutoBidMaster, LLC is an ****** motor vehicle dealer. EasyHaul.com,LLC is a Washington and Federally licensed transportation company that provides shipping brokerage services. Copart,**** is a publicly traded company based in *****.
************ runs auctions and sells vehicles. AutoBidMaster, LLC buys and sells vehicles. EasyHaul.com, LLC brokers the transport of vehicles.
**************** created an account with AutoBidMaster, LLC. AutoBidMaster, LLC is not aware of any other relationship **************** may have with ************, other than as provided in his agreement with AutoBidMaster, LLC (the Agreement) which makes **************** subject to the terms and conditions provided by ************
**************** purchased a vehicle through his membership with AutoBidMaster, LLC. That sale is subject to the terms and conditions of the Agreement. The Agreement provides that regardless of what transportation company is hired to transport the vehicle from the auction, if the vehicle is not picked up in a timely basis, Copart will charge Storage Fees for the vehicle which must be paid by the buyer.

Storage Fees are charged by Copart, LLC and are the responsibility of the buyer when they are incurred. It is false to say that AutoBidMaster, LLC and EasyHaul.com, LLC are making large sums of money on storage fees AutoBidMaster, LLC and EasyHaul.com, LLC make no money on Storage Fees. Storage Fees are charge by Copart but only when a buyer fails to follow the terms of the purchase agreement and not pick up the vehicle in a timely matter.
Ive reached out to EasyHaul.com, LLC and they told me that there was an agreement with **************** to get his vehicle shipped but that **************** cancelled the shipment, and he was refunded his shipping charges.

I am rejecting this response because: Autobidmaster's response to my complaint states that I entered into a ********** Services Agreement (LSA) with ********* LLC to broker shipping of the vehicle. ******** will endeavor to obtain transport ASAP but no guarantees are made regarding the timeline. There are two problems with this statement, when you accept the shipping services on Autobidmaster's front page of your bid for the vehicle, it states, "Transit time 1-3 days" and also there is zero mention of storage fees if their shipping broker doesn't pick up the vehicle. This is the crux of this complaint. 12 DAYS after I picked up the vehicle, ********* told me IF I GAVE THEM MORE MONEY THAN THEY ORIGINALLY QUOTED, they could then arrange for pickup of my vehicle. I told them I would give them $200 dollars more than the original quote. They contacted me later the same day by phone and text and told me they were successful in finding a transporter, but there was no mention of the final cost. I then received a bill the next day for $800 DOLLARS M0RE THAN THE ORIGINAL QUOTE, or $1423. Autobidmaster in their last response to my complaint, states "I reached out to ********. They told me there was an agreement with ****************, but he cancelled the agreement. Of course I cancelled the agreement, they pulled a bait and switch on me and more than doubled the agreed upon shipping rate to an obscene amount of more than double their origially quoted rate. This is after 12 days from when I purchased the vehicle. Meanwhile I incurred hundreds in storage fees this whole time. I finally realized I was dealing with criminal behavior from ********, Autobidmaster and Copart. I found my own shipper at this point for $170 more than they originally quoted (1/3 more than original quote, not 228% more as per ********'s bait and switch quote). The vehicle was picked up 2 days ****** by a competent and reputable shipping company. They need to amend all shipping quotes to state up front in the qute that if they or their affiliate fail to ship your car, you will incur daily storage fees and also the specific amount of these fees, which increase over time. Also, since they did not notify of this, I would like to not have to pay all these additional storage fees that I was never notified of.To reiterate, Autobidmaster should state on the front page of their shipping quotes that if they fail to pick up and deliver your car, that shipping fees are incurred and the specific amount of these fees. Since I was not notified of these fees up front when I paid for delivery, I would like to have these fees waived.***********************

On 2/2/2023 I was the highest bidder on a **** Chrysler 300c. The Total invoice was $1,786, The same day 2/2/2023 I went to my bank and did a money wire, after 24 hours 2/3/2023 I call them to see if they got the money, they claim they do not have it. I then spoke with my bank and attempted to trace the money wire but still have yet to get back to me. I also submitted to them a receipt of the money wire from the bank. On the 2/7/2023 I spoke with my bank again and they attempted to cancel the money wire so I could pay them through a different method. In the Agreement between AutoBidMaster and ****************, she agreed that she understood that he was purchasing the vehicle on an as is basis, with no warranties, and without reliance on any of the information provided in the vehicle listing. She further agreed that it was her responsibility to research and inspect the vehicle before bidding on the vehicle.
In the Agreement, AutoBidMaster explains, and members agree and accept that as AutoBidMaster does not have possession of the vehicle, we cannot and do not make any representations regarding any vehicle. We expressly disclaim any representations and or warranties regarding the vehicle. We require that members agree that they understand and agree to such conditions of all purchases, prior to making any purchase. Section 2 of the Agreement specifically states, in part:

Had there been these issue that **************** complained of an inspection would have so informed her prior to her purchase. AutoBidMaster cannot force buyers to inspect vehicles or have someone inspect a vehicle on their behalf but having fully informed a potential buyer of the limitations of our information and services, and that inspections are strongly encouraged, we are not responsible if a buyer elects not to inspect the vehicle.
**************** agreed that she was buying this vehicle on an as is basis, with no warranties, and without any reliance on any of the information provided in the vehicle listing. Were it not for her agreement to our Agreement and Purchase Agreement, we would not have provided the Services. The Agreement, Section 1, provides in part:
AutoBidMaster has priced its Services based on your agreed validity of the disclaimers, waivers, and allocation of risks as assigned, as provided in this Agreement. You understand and agree that all disclaimers, waivers, and allocation of risks provided herein are essential to the basis of the bargain between you and us, and that without such AutoBidMaster would not provide the Services at the prices outlined in our Rules and Policies.
We have explained to **************** if there is an issue in the ownership documents from a prior owner, we will, as a customer service courtesy, attempt to resolve the issues with the prior owners, but in order for us to do so, shell need to send the title to us. Weve sent her our ***** mailing information but have not received the ownership documents from her.
We detail the risks of purchasing a vehicle to members before they can make any purchases through out services. Members agreed to these conditions both in the Agreement and in the Purchase Agreement. We are sorry that **************** is unhappy with the vehicle she purchased via AutoBidMaster, but based on the Agreement between the parties, she is not entitled to a refund or other compensation.
