Received a parking citation. First I did not see clear markings for payment.Second, I received the first notice today with late fees already attached when I never received a citation for the parking. As posted, Main Street Commons allows for 90-minute complimentary parking on the North side (green area of map) of the parking lot. I think its ridiculous that Im getting a bill for over $100 when I never received a citation in the first place telling me that I had one this seems like a predatory practice. We did not see anything on the parking spot that said anything about paying, I do not mind paying the initial parking citation but I think its ridiculous to have me pay over $100 when I didnt even know that I was cited . I would appreciate if you would remove the late charges.

Was charged 57 dollars for not paying to park in their parking lot. There was no visible signage on entry or exit from the lot requesting payment. Requested an appeal, response was failure to see signage is not an acceptable cause for an appeal. They provided images from June 2023 of their signs but do not have any recent images in the month of November 2023 to prove proper signage was present on the day I parked. The locations of the signs are all in inconspicuous locations examples are far corners of buildings in the back of the parking lot so if you don't drive around the parking lot you won't see them. One sign that was in the June photo was facing the opposite side of an entrance so if you entered the way I did you won't see the sign (if it was there). There was also about a 20ft vehicle parked across 2-3 parking spaces which can be seen in the image they captured of my car that could have potentially blocked 2 signs.Business Response

Upon careful inspection, it has come to my attention that the signage is positioned opposite to the flow of traffic in the parking lot. The images provided by Skyy Parking depict the flow of traffic, and unfortunately, the posted signs are not visible as they are situated behind vehicles and in inconspicuous locations where attention to the driving path is obstructed.
I understand the importance of clearly communicated regulations, and I believe that the current placement of the signage hinders drivers from being adequately informed. Given this, I kindly request a reconsideration of the ticket in light of the visibility challenges posed by the signage placement.
If possible, I would appreciate a review of the images provided by Skyy Parking, taking into account the obstructed view caused by the signage's placement opposite to the flow of traffic. I am confident that addressing this concern will contribute to a fair and informed resolution.Initial Complaint

I am a manager with the new backwoods brewing company that opened in *********. I have tried to pay online but my custom license plate isnt valid when trying to purchase a day permit. I have tried calling the company and left a voicemail. I keep getting invoices for payments that the automated system wouldnt let me purchase. This is 10 mail in a single day into my inbox. Entered the lot with the intention of parking however after researching the prices from the link on the sign I decided that the lot was too expensive for my needs. Thus I exited the lot expecting not to pay. Apparently being in the lot for the time it takes to make a decision on if u are going to park there is all it takes to be fined. Expecting this to be an honest mistake I filed a claim with the business requesting they drop the fine and parking fee for a service I decided not to use. There response was by entering the lot I had agreed to using the service. This is honestly ridiculous as the prices are not posted on the sign itself (there is a link that u can use to pay that then shows u the prices). there is a small sign by the entrance that's not readable from within a car and one at the back of the lot. There is no way to know the lot is payed before entering it and by the point you realize apparently u have to pay or they will fine u.Business Response

The signs are not visible before entering the lot making pay by phone before impossible. There are no gates or other traffic controll devices indicating that this lot may not be entered into without paying. In addition I did not leave the lot to do a pickup or go to any business. I stayed long enough to ascertain the nature of the payment before leaving. This is word for word the same canned message I got when submitted a appeal to them directly. I am rejecting this response because:
There is no way to know the nature of this lots rules before entering the lot. There are no traffic controll devices or signs big enough or clear enough that state the cost and that entering the lot will result in necessity to pay. It's common practice to drop someone off or check payment prices in a lot without paying. By having rules so different from the norm it's clear to me the payment structure is built as a trap to catch unsuspecting motorists off guard. Had I don't waked up to the sign and checked carefully I would not even know the price as I had to go to a link to check how much it costs as nowhere on the lot is the price clearly and simply displayed.

I received a ticket in the mail from this company. On July 14 I contested the ticket on the legal basis of ORS *******. This contestation was ignored and never resolved. Their 'communication' specifically dissalowed the possibility that I could even contact someone, so I sent in physical letters. On 8/3 they sent me a letter doubling the fine and threatening me with collections. I sent in a letter stating that such an action was not legal given the contestation was still open and had been opened prior to the time after which my right to do so had lapsed. On 8/28 they sent me a letter acknowledging my contestation, claiming there is absolutely "no valid grounds" on which I could make my argument, utterly ignoring the import of ORS *******. In this letter they formally denied my contestation. However, as this denial postdated they're doubling of the fine, I sent in another physical response explicating why such a post hoc maneuver was illegal, as a ticket may not be elevated (done on 8/3) prior to a dispute being resolved (which they claimed was accomplished on 8/28). I never got a response. The ticket was sent to collections. I considered contesting with them, but do not have the legal resources to do so and so paid the elevated $120, though I still contend I should legally have been charged $0.Business Response

I am rejecting this response because:1) once again your response is absurdly immaterial, as though you are willfully missing the point.
2) If it really was that simple you would have led with that, as my initial complaint with the BBB specifies dates.
3) Your response is a straw man in that the main substance of my complaint has nothing to do with whether the ticket was issued validly but whether your elevating the ticket and sending it to collections while we still had an open dispute within said 90 days was a) appropriate and b) legal, both of which I contend they were not. This has nothing to do with whether the ticket may or may not be now reviewed for validity as per your policies.
4) as the money for the ticket was received by you through selling the debt to a collections agency, it is obvious that no review of the tickets validity is material to whether I am due recompense as I am contending you ought to compensate me for the money I had to pay to collections. Such a situation is obviously outside the scope of your normal policy for refunds for tickets where the money was paid to you.
5) I continue therefore to demand compensation.
6) You have not responded to any specific claim, argument, or presentation of evidence I have made either in our initial dispute over 3 letters, and now over three BBB mediated correspondences. I demand you actually engage with me and my words, both in this mssage and in all prior letters and correspondences.

Sunday, August 27, 2023, Skyy Parking issued a violation for parking without payment of the parking fee. I have several concerns with this violation.1- I would have been at the *********** Church in *****, ****** during this time, so it is concerning to me that you have a photograph of what appears to be my car on a Sunday at 10:41am. 2- The photo claims to have been taken in downtown ********* on a weekend, yet I am the only car parked in the parking lot?3- Where is the "no parking" signage? I have lived in ********* for over 25 years and have no idea where this lot is located. ****** Law states that "it is the responsibility of the person or agency which desires to prohibit parking, to have such signage installed and maintained so that it can be clearly visible and thus complied with."4- I have attempted to reach Skyy Parking, but the address is a PO Box and the phone number goes straight to voicemail, with no option to speak with a live person. 5- I have not paid the fine because I am not even sure this is a "real" business and was nervous to provide credit card information online. The Skyy Parking website specifically states you cannot pay with cash or check, or in person. It all feels very unprofessional and like a scam. With a 1.5 average rating and 59 BBB complaints in just 12 months, this company clearly has an issue. I feel like this vehicle was photoshopped into the lot, but assuming someone else was driving the company vehicle, I still feel like this is entrapment and I should not be issued a violation. Further, the violation was sent to my corporate office in ******** ********, and since this is a company car, the violation went through many different company departments before it was sent to me, and after a late fee had already been assessed. We cannot provide documentation that parking is not allowed because it is allowed. Parking is allowed by the public so long as that payment is made upon parking. Our records cannot locate the complainant by the name or address so we cannot locate an exact parking violation this is coming from. If you did not receive notice it is simply because your DMV records are not up to date to receive correspondence. If your parking violation was issued in August it most likely has already been assigned to a third party for debt recovery. further, it is inaccurate of you to make the claim that my dmv records are not up to date. This vehicle is a company car and is registered to Altria. The citation had to go through them before it came to me and by the time I received notification, a late fee had already been added.
This situation has taken too much of my valuable time. I find your business practice and your deflection of accountability to be extremely unprofessional, but none the less, I will meet you in the middle and pay the parking fine, and I request you delete the late fee.

I did not receive a response to my last correspondence asking Skyy Parking to meet me half way, with me paying the $50 fine I disagree with, and them waiving the $50 late fee for a ticket they sent to the wrong address.
Are they going to respond, or is this issue unresolved and closed?

On 11/16/2023, we parked in a lot adjacent to **************************************. The sign at the lot said "90 minutes free parking," and we were not there for more than 90 minutes. Charging a $55 fine on top of this deceptive signage is ridiculous and (as others have said) predatory. We would appreciate it if the BBB would investigate Skyy Parking's business practices.

I received a bill from Skyy parking alerting me to a violation that I parked without paying. I work as a sales rep in the area and was calling on an account. I saw no signs indicating this was a pay for parking area nor did I see a pay station or attendant. I went into the account for less then 20 minutes and had I known, I would have parked across the street. I didn't get the notice until the 28th of October and it said it was mailed on the 21st and that I had 30 days. I was trying to find a way to appeal or contact the company to see if there could be a resolution but there no phone number for them easily found. I went to appeal on the 20th of November and was hoping to get a resolution. Instead the next day, 11/21, I see it automatically double to $110 for a $5 parking fee? I would like to just pay the $55 and be done but I didn't even get that option. How can it be 30 days if it was MAILED on 10/21 and automatically doubles 30 days later? I wouldn't have received it on the 21st anyways as it takes a day for the it to be received, processed, and sent the mail. So it didn't give me a full 30 days to pay or appeal, bot to mention I didn't receive it until a week later. I would pay the fee but don't feel I was given a fair chance to appeal and get a decision.Business Response
