Bought a timeshare July 12 2022 at 730pm we left and got homeJuly 16 I was sick with the Gout we had no AC had people come to look at it it has to be replaced at the cost of $15000 and our car died and needs replaced We tried to call Sunday July 17 and got no anwser and then tried to call Monday July 18 and got no answer Due to a 1 Hour differencer then sent Email Mon, Jul 18, 2022 to **** and we asked for an emergency cancellation because we will not have the Money for the timeshare or to replace the car **** said we missed the deadline by 1 day but he would forward the Email All we are asking is for our $1100 depoist back and cancellation of the contract of the sum of $4289 so our credit will not get messed up and have to take bankruptcy we will have to get a loan for our AC Replacement and wont be able to with this debt We are in our 60s and both are disabled and have our Social Security check and Disability check To live on and did not forsee a problem before these disasters hit us Thank You Have a Blessed DayBusiness Response

I am rejecting this response because: Have heard from the BBB and got an email from them but have not heard back from a Rep below is the answer to my email Fri, Jul 29, 2022 Also I have not got my Refund of my $150 booking Depoist and need the $1100 down payment However, we are not indifferent to addressing our client’s concerns. We have provided a copy of your letter to the Sales Department and expect that a representative of theirs will be in touch with you within 2-3 days of the date of this letter to discuss your cancellation request and determine next steps. Please be prepared to provide them a clear explanation of the concerns that led you to request a cancellation so that they may review the circumstances and determine how best to address your request outside of the standard rescission period.

I was shown and purchased a timeshare that was called a "Lockout"consisting of 2 bedroom on one side and a separate 1 bedroom unit on the other side with Spinnaker in 2006 and first used it in 2008. when I used both weeks and took 8 friends and family with me where 3 people stayed in the 1 bedroom and 6 of us stayed in the 2 bedroom side. I asked the to go back and look at my first stay and was told that they only have records of stays back to 2010. From 2008 until In July 2021 this was honored. Even though the Deed only showed a 2 bedroom. Which I was told by the agents that sold me the property **** ****** and ** **** the vacation manager at the time that they could only write it up as a 2 bedroom. I did not feel good about this and expressed it to them, and they told me that no one was trying to cheat me and to just keep the initial form with both their signatures showing what I was purchasing. At the time the vacation manager told me that all of their lockouts came with 2 bedrooms on 1 side and 1 bedroom on the other side and as long as it showed lockout on the initial form it would be honored. My first stay I used both weeks and took 9 friends and family with me where 3 people stayed in the 1 bedroom and 6 stayed in the 2 bedroom side and to prove it I asked them to go back and look at my first stay and was told that they only have records of stays back to 2010.
Now I feel I have been defrauded out of what I was shown and bought and paid for.Business Response

On 6/12/22 we attended a sales pitch on buying a timeshare.
1. We were told that we can travel anytime/anywhere for 385.00. I went to book a vacation and was informed that it would be almost 2000.00 for the week.
2. We applied for the credit card and told we were approved for 3500.00 and that we would get 6 months at 0% interest on the card. That in turn that would qualify us for paying 50% down and would have 12 months at % interest to pay the final 5000.00 for the timeshare. The credit card company never sent us the card and the company does not answer the phone. So now we have to pay the entire balance of 8500.00 with a 16.95% interest rate.
3. We were lied to about all aspects of this deal and since we have not utilized any of the benefits, would like this transaction to be cancelled. They breached the contract by telling us there would be no interest in paying as well as lying about the cost of future vacations.
I was interested in a timeshare, just no longer with this company who lies to their customers!Business Response

I have been trying to contact ********* ********** *********** to make a payment. Whenever I call, five things always happen: 1) the message that someone will be right with you is played; 2) the message stating that the person on extension xxxx is on the phone is played; 3) the message stating that the extension's voice mailbox is full is played; 4) the message stating that "an error has occurred" is played; 5) the call is disconnected. We regretfully purchased a timeshare through King’s Creek Plantation, now owned and managed by Spinnaker, and it’s been a nightmare ever since. This is just an ongoing expense that is leading us nowhere. We are unable to rent it out on VRBO which is something we were really counting on in order to cover the fees. The maintenance fees are also much higher than we ever expected. There is nothing good or affordable about being timeshare members. In October of 2021 I had a serious battle with Covid-19. This put me behind on money because I had to be out of work for multiple weeks. This was something that I could not have predicted and was not able to financially plan for. We are still dealing with the loss of income from those weeks. At this point we are just trying to get back on our feet. We have no intention of going on vacation anytime soon and see no use in being timeshare members. All it is doing is taking more money than we have. We are worried about what will happen to us if this isn’t taken care of soon. We were quickly dismissed when we reached out to King’s Creek Plantation regarding our circumstances.
