On 06/03/2025 I received a $99.95 charge on my debit card from a company I had never heard of before. The charge was for Active Advantage subscription services from the company Active Network, LLC. Upon looking up the company name, I found that they receive many complaints for covertly signing people up for their free trial while people are trying to by something else online. I believe this charge resulted from when I signed up for an athletic event. This company continues to remain in business despite the endless complaints and consumers rejecting the the companys deceitful attempt to make it look like they are resolving the issue. Along with the charge, I have no other charges, and I have never used their services, had no idea I had them, and cant even cancel my subscription with them. I have tried signing into their website to access an account under my email and no account exists. I attempted to email them with no actual response. I demand a full refund in the amount of $99.95. The card used has been canceled so no further charges may be incurred from this scam company.Business Response

deceptive and unfair business practices associated with the Active Advantage subscription program operated by ACTIVE Network While they state that "Active Advantage is an opt-in loyalty program extended to participants post-registration," this assertion is misleading if users are enrolled without **clear, affirmative consent** or if the offer is **obscured** within the registration process. The ************************** (***)** and numerous state laws prohibit what is known as **negative option billing,** wherein a consumer is charged for services or products they did not knowingly and intentionally agree to purchase.### Legal Basis Under the **Restore Online Shoppers' Confidence Act (ROSCA),** online businesses are required to:* Clearly and conspicuously disclose all material terms of the transaction before obtaining billing information;* Obtain express informed consent from the consumer before charging them; and * Provide a simple mechanism to stop recurring charges.If ACTIVE Network is **pre-checking subscription boxes, burying the subscription terms in fine print, or auto-enrolling consumers without conspicuous notice**, such conduct constitutes **unfair and deceptive acts or practices** in violation of:* **Section 5 of the ************************ Act;*** The **Electronic Fund Transfer Act (EFTA);*** Applicable **state consumer protection laws**, including those addressing unauthorized charges, deceptive trade practices, and failure to obtain informed consent.### Demand for Redress Any funds withdrawn from consumer accounts under these deceptive practices may constitute **unjust enrichment** and should be **promptly refunded**. In early October of 2023 I signed up for a Bubble Run that was being hosted by CE FUN RUNS, and the sign up process was conducted via the website "ACTIVE network" (**************************). I proceeded to go through the motions and input my basic information; first & last name, email, phone number, and the card I was using for payment. I checked out as a guest on the website and I don't remember seeing anything about signing up for a trial, membership, or even creating an account. I did receive 2 initial emails about the race purchase receipt, a confirmation email for the race, and an email about a 30 day free trial but missed the fine print at the very bottom that said that my card was on file. Not long after I received emails leading up to November 4th, the original day of the race, that said the race was postponed and would be hosted the following year, I am still waiting. As I was cleaning out my inbox I happened to see an email that said "Welcome to another year of Advantage!" I did not recognize the name so I clicked on it and saw that I was charged for a membership last year in Nov 2024, and the "another year" part prompted me to look into Nov 2023, both years showing a charge of $99.95. I found the emails that talked about the trial and membership and that I was charged with the card on file, which I didn't remember giving for any membership or account creation. I struggled to find the charge in my bank statements because the transaction name was different than how the email said it would be presented. Further inspection of the emails led me back to the Bubble Race and realized that ACTIVE was the site facilitating the transaction. I also realized that emails that stated membership and the charge weren't appearing as I went further back into my inbox's history but did appear when the email address was used in the search. I received a charge on my credit card from ACT AADV ENDTRIA for $99.95 on May 23. I have no idea what it is for. And I did not consent to it. I received a $99.95 charge on my credit card from this company for an annual membership. I do not recognize the company, their website or any of their products. I cannot find any record that i signed up for their service. The only correspondence that I have had with the company was two years ago when they assured me that I had been un-enrolled from their service and would not bill me again. I contacted the company two years ago for a similar reason. I did not think i had signed up for their services then and disputed the charges.Business Response
