I put a Layaway at this cash America I put a necklace on Layway that was $589 with taxes included .I paid on it for months when I went to go pick it up . In gave them my final payment .Layway was not in the Location that was in the computer first red flag So guy tell the manager and she went to go look for it in the safe She finally came out the back after about 20 minutes and opens up a box with a necklace that look like it been broke in welded back together it wasnt Even the same necklace that I put on the Layaway So I told her I need a refund because Im not going to accept something that I didnt put on layaway that looks like that. She refuse to give me all of my money back Even though I never left the store with the item It was Not the necklace I put on the Layaway I told she thats not what i put on layaway So I told her I need a refund Im not going to accept that I didnt put that on layaway. She refuse to give me all of my money back. And her response was that she can buy the necklace back from me .Thats the only thing that she could do. she had me feeling embarrassed like I did something wrong and basically forced me to sign a paper to only accept $500 of my money back becauseSo at the end of the day I end up losing like $89 because she only gave me 500 backBusiness Response

This **** shop charged additional interest fees on many items my wife and I had in ****. When my wife and I came in to get everything out of **** Before we left ************* to drive to ******* to get our items out of **** we spoke with the manager who gave us a price to get our items out. Once we got there they charged us an extra months interest on these items, even though we paid every month as required to keep our **** agreement. We end up paying an extra $437 to get our property back. My wife Vanelopye ********* and myself ******* ********* were cheated out of this additional money as we both had property in this establishment.Business Response

I visited the **** shop and purchased two subwoofers, which I had never considered. I was surprised to learn that a **** shop could sell speakers. I immediately connected them to the amplifier, activating the speaker kicks on the amplifier to enter protection mode. I then tested the subwoofer and discovered that the voice coil was defective. I contacted the company, who informed me that they sell them as is and will not take any action regarding it. However, I did visit the store right away and informed them.Initial Complaint

Entered by BBB staff LO Consumer pawned a video game system at the Cashland location in ******, **. He went back for it and when he got home and turned it on there was another user logged in and a game was downloaded. He contacted the business and asked why there was another account logged in. He states they did not have an answer for him. Consumer states in their policy it states that the merchandise will not be touched while in their possession.Business Response

I purchased a computer from the store with a 30 day warranty for any issues that were no fault to mine. I came back on day ************************************************************ They tried to fix it but no luck. Then the manager comes and feeds me sone bullsjit about he cant take it back because my acct is on there. Knowing full aware that my whole issue is with no being able to log into my acct through the computer. I said I wanted to take care of this cause I just drive 2 hrs from ******** fl and have to drive back 2 hrs. He said for be to reset it and come back tomorrow and he would honor the warranty. If I could get it reset now he would do it now. So I walked to my truck and reset it and he turned the lights off and Walesout the back after looking at Me through the front door. I have the computer reset now but he left anyways with it taking care of me. I placed a 14k gold bracelet in layaway 3 months ago. Finish paying it off today January 11, 2025 around 12:00pm. I asked the employee if it was go and solid so it wouldnt come off my wrist. He clean it and put it on my wrist. The bracelet came off in the mall. And I took it back to the store the same day around 3:00pm and they charged me a restocking fee. For an item that was already broken.I purchased a 14k gold bracelet in layaway three months ago. Today, January 11, 2025, I paid off around 12:00 pm. Before I left the store, I asked the employee if the bracelet was secure and if it would stay on my wrist. He assured me that it was and cleaned it before putting it on. However, when I went to the mall it came off and a man gave it back to me. Returned to the store the same day, around 3:00 pm, and was charged a restocking fee for an item that was already broken. I still want my $33.00 cause I return it back the same day.Business Response

I bought a pair of 2.5 carat diamond earrings from CashAmerica. I was reassured by three different employees at the time, including a manager, that the diamonds were natural earth grown stones. Since the purchase, I have taken them to three separate professional diamond dealers for evaluation. They are 100% lab grown diamonds. It states on the receipt 10k link neckless. i returned two years later only because i needed money for the holidays Mr. **** examined the neckless and stated that he would not make a offer because the neckless was not real. I then ask for a refund as I had purchased the neckless at this specific **** shop. Mr. **** then ask for my Identification and confirmed that I had made the purchase. he then took my neckless to another room and came back, he then confirmed it was the neckless i purchased. Mr. **** stated that the previous crew at the time i brought the neckless that had been fired because of fraudulent activities he took down my number and said that someone from the upper management would be in contact after two weeks i went back to the **** shop and was told that someone would be there shortly i then spoke to Mr. *** ***** who went on to offer me a ******** dollar store credit he stated that was all that could be done as i had not returned the neckless in six months of the Purchased date. There was never a need to return i was satisfied with the product until Mr. **** informed me that the neckless was not what Cash America Pawn it was and had no value In which case the Warranty should be considered voided as 1. Texas Deceptive Trade Practices-Consumer Protection Act (DTPA): This statute prohibits businesses from engaging in false, misleading, or deceptive acts or practices. The sale of counterfeit goods constitutes a violation of the DTPA.2. Uniform Commercial Code (UCC): The *** implies a warranty of merchantability, which requires goods to be fit for their intended purpose. A counterfeit item fails to meet this standard.Impact on Return Policy:1. Voiding the Return Policy: If Cash America Pawn sold a counterfeit necklace, their return policy may be voided due to their breach of the implied warranty of merchantability.2. I have five pieces of Jewelry in here with a lot of money every month I went in there made payments and had them print out the dates due every single time I made a payment had him go over it with me we figured out what was due when and when I had to pay it I made all my payments I went on vacation I make sure everything was paid before I got back now I'm back and they're saying that I didn't make any payments on my expensive earrings and I lost them okay even if that's true that I didn't make a payment which isn't and of course I don't have all my receipts but even if it is true which is not why wouldn't they have pointed it out to me. When we went over the payments one by one when they were due every month how is it possible like I was told oh we overlooked it how is that even possible for both of us to Overlook at every single month. I have a using buying and selling with this specific **** Shop for quite a while now Cash America pawn in *****. Work got slow and I ended up putting some of my things. One item was a ladder that I had $300 for it approximate value cost and I would **** this ladder on and off back-and-forth from the **** Shop multiple times probably 70 times and it was always a low price so I can easily get it back out whenever I needed quickly to use for work, but I was using this item in between checks for a little gas money.I didn't realize timing by that time is enough just enough to have been sufficient enough to have to forfeit the item because I didn't pay for it and I didn't realize that much time went by so in between all that I have been wheeling and dealing and buying and selling, phoning and doing all type of transactions at the same **** Shop with the same people that I consider to be almost friends, good business . But the manager told me that it is on layaway For another customer now as you can imagine I've been fighting that I am simply asking the manager and the employees that work there. Why would one of you kindly enough help person that is not working struggling everything that is not good and just had let me know that my item would be lost if I didn't make a payment, knowing I just lost track of time...Instead, the manager said that she tried doing me a favor by allowing it to have extra ********** time my rebottle was it was not anything of value to me that time, because I never knew it That the situation was occurring, so how could that make anything good for me as I am buying other junk in there **** Shop, and not paying for my ladder to get out so she sat and watched and waited for it to be forfeited and then I believe had someone that she knew put it on layaway So I would not be able to get ***** back, if discovered, which was discovered now. I am unsure what to do now knowing I have to try and come up with money to replace It's a hardship now
