I filed bankruptcy in 2023. My lawyer works with a dealership called ash auto out of *******. My credit was tanked. They set me up with prestige financial for my loan services. I never verbally visited with ash autos financial team or prestige prior to signing the loan all was handled via email. I did not realize I would be paying 24% in interest where my almost $600 a month payment would barely go towards principal. Its been over a year. Ive barely scratched the surface of my principal. Im in a worse spot now than prior to the bankruptcy because of this predatory loan. They will not refinance. They finally added an option to split the payment into installments thru the month but then I lost my job. Ive dealt with rude representatives and responses. They have NO options. I really dont want to go through a repossession with as much of a mess as my credit is now. But they also have a really misleading statement balance on their website where it shows payments werent made but were and when asked they brushed this off. I just feel like I was prayed upon by the company at a weak point and now instead of being in a better spot like my lawyer said after bankruptcy I am in a worse spot. DO NOT USE THIS FINANCING COMPANY. Whatever your situation is I promise you it cant be worse than what Prestige will do to you. There should be companies out there to help following bankruptcy but I promise you this IS NOT A VIABLE OPTION. Take my naivety and desperation on not understanding what I was signing and RUN AWAY FROM PRESTIGE. I did not understand what I was getting into and now I want to kill myself because I dont see any way out of this situation. My car was sold to me at a higher value then what it was. AND after I signed the papers my insurance informed me the car had been through and accident but NO ONE at Ash auto or prestige notified me and when I asked at Ash auto about the accident claim after signing they claimed they didnt know anything about it. had a vehicle loan with prestige that went into default. they got an order to garnish my wages. I agreed to a onetime payment to settle with them of $8,000 to settle the debit and stop the debit. if I paid the debit by the end of October the Garnishment would by nov 5 2024. I paid the$8000 on 10/28/24 . I called prestige office spoke to ******* and verified they received the payment; my account had been marked paid in full/ all debit satisfied 10/28/24. on 11/1/24 my wages we garnished I Called Prestige and they said stop garnishment to go thru I asked about the refund of my stolen funds the agent sounded confused. on 11/15/24 prestige garnished my wages again. I went to my courthouse where the garnishment paperwork is file the same time i paid prestige the agreed Apon $8000 they filed an extension for garnishment for an additional 8 years. this has to be not only illegal but predatory.Business Response

I am rejecting this response because:
this has been an ongoing issue since I paid the $8,000 on 10/28/2024 I spoke with ****** originally and was told paperwork was gonna be filed on 11/4/2024, he said I'd probably only have one or 2 garnishments before everything was settled and anything paid after the $8,000 I was going to get reimbursed for, I called back on a few different occasions and got nowhere, I called the Courts on 11/18/2024 and was told nothing was filed with them since September 7th when they tried to put in another Judgement for another 6 years, I went down to the Courts on Tuesday 11/19/2024 and filed a motion. I'm a single mom trying to support my 2 kids and myself and I did my part to work with them due to ex-husbands negligence and still getting garnished to date. I have all my paperwork, receipts and copies of what I had to pay for the filing fee and certified copies I had to send. They did set the hearing for motion on January 13th 2025 at 1:30pm. This has gone on to long and it's not fair. They also just kept giving a run around with all the different people I've had to speak with because the Original ones were "always away" and this is unethical and stealing.

We received confirmation that our attorney has filed with the court to stop the garnishment and we have done everything we can on our end, there may be a delay as we are at the mercy of the court. Ms. ******** refund check was sent overnight to her employer on 12/5/2024, and any subsequent refund will be processed the same. Based on my review, the judgment was granted as of 2/16/2023, and this was not a voluntary repossession. Prestige made attempts to reach Ms. ****** after her bankruptcy was dismissed in March 2019, however, we were unsuccessful in reaching her to work out a payment plan. PRESTIGE FINANCIAL ***************************** PREFERRED LEASE 5501 HEADQUART PREFERRED LEASE 10/21/2024 Account: ********************************************* S Number: ******X According to IRS publication 4681 and published information about cancelled debt from different CRAs verified websites, when a consumers debt is canceled, forgiven, or discharged (charged-off) for less than the amount owed, the amount of the canceled debt is taxable. If taxable, it must be reported as canceled debt on the consumers tax return for the year in which the cancellation occurred.Taxable canceled debt is now income and must be reported as ordinary income by using designated forms instructed by the IRS.Therefore, income is legally excluded from being furnished on a consumers credit report. As previously stated, a charge off-what credit reporting agencies consider cancelled debt, has also been vaguely pointed out by those same agencies to be correlated to ordinary income. They have furnished a charge off on my account. We have established that a charge-off is also ordinary income and must be filed by a creditor as written off debt and reported by the consumer as taxable income per IRS publication 1099c. Therefore, this information that PRESTIGE FINANCIAL S is furnishing on my consumer credit report is inaccurate and must be immediately removed.And by continuing to furnish this harmful information on my credit report, they risk violating congresses 15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies.Customer Answer

I financed at 2018 Kia ******** through Prestige Financial in July 2023. Starting November 2023, I started having engine problems that continued through May 2024. I contacted Prestige Financial and was advised to take the vehicle back to where it was purchased to trade it in. When doing so, I was informed they could not take the trade. June 2024, I informed Prestige that the vehicle was still not drivable and I could not afford to continue to pay for ***airs to the engine. I at that time had to purchase a new vehicle through Auto Giants. I informed Prestige Financial that the *** could be picked up at the Auto Giants lot. After going back and forth for about a week with the **** about my decision to surrender the vehicle, I did not hear anything from their office for over a month. Then in September I was notified the vehicle was still at Auto Giants and they (prestige financial) tried to convince me to keep the vehicle although it was not working and the warranty expired shortly after purchase. I recieved an email from a *** on 10/15/2024 asking the same questions again and stating they were going to send me information to surrender the vehicle and am still waiting for it.Business Response
