On 03/29/23 16:48 customer requested loan to be closed and UCC be removed. This request was done that day, took the state 14 days to reflect the change. Ok. I have looked into this and it does not look like the state has removed it yet. We process the paperwork to have it removed on the date that was previously given to you. We requested with the state again to please remove our UCC filing and quickly as possible. (Considering they didnt get it done prior). On 03/08/23 06:33 customer agreed to a line of credit for fuel. UCC was then filed for the loan. On 03/08/23 14:28 customer signed a factoring contract with us, on 03/17/23 11:35 customer decided no to use our services, and UCC release was filed. Customer was not happy on the time the state was talking in changing status, as we cant control how fast the state department changes status customer became unhappy.Customer Answer

I opened up my DOT and MC Authority in February 2023. As soon as I filed, I received phone calls from “Jake” with Fleetsmarts offering a fuel card. They sent me a card anyways and then wanted me to speak to their sales associate, “Buck” who tried to force their Factoring service on me. They emailed me an obligation letter stating they will beat all deals I currently have but I will be obligated to sign with them. After I told them I did not want to sign any papers because i didnt want to feel obligated.
After choosing another Factoring company, I was alerted that Fleetsmarts, through a UCC filing company, filed a UCC-1 lien filing against my company through my state secretary.
This is very fraudulent and Fleetsmarts should be stopped by the FMCSA.Business Response

My name is ********* ***** I am the owner of ********* *** **** ********. On Thursday, March 9 I was attempting to do business using my UCC code 2 complete a job offered by truckstop, A company that processes daily missions with daily pay. I was not able to except an offer with the company because my UCC code had been blocked by Fleet smarts gas card company. During the conversation with Fleetsmarts.net A few months ago, while talking with the agent I was persuaded to receive the gas cards with no obligation. Upon getting the reading material about the gas card, I decided that the cars would not fit my business model because I would still be paying for my gas in the card would not give me any benefits. Because my UCC code is blocked by fleet smarts I cannot conduct any other business which would generate revenue for my company on a daily basis. I have attempted to call flea smart at ###-###-####, customer service and ###-###-####, business services, and the same repetitive message I’ve been so busy that they cannot answer is there a recording. I also have left a message for them at Fleet smart.net. My resolution is that they release UCC code, that was a obtain without authority, by completing the documents sent to them by email from [email protected], Jennifer I**** point of contact. I cannot conduct any business without the use of my UCC code please assist me in contacting this company, which appears to be a ghost pseudo-entity, N release my UCC Code back to me per my authority. On 02/02/23 00:29 customer agreed to a credit line for fuel. A UCC was then filed for the debt. Customer refused further calls to address issues. UCCS are required filing whenever a debt line is applied for. It is not for only factoring. We have 35000 customers that we help with there trucking needs.Initial Complaint

Fleetsmarts entered a UCC filing and send fuel cards to my mailing address before asking for my approval. I never signed anything with them or confirmed a business relationship with them. In spite of this, a UCC filing was submitted on 01/31/2023 with the help of a masking company. All their competitors are pointing fingers at them - a lot of their customers are facing the same problem as mine.

They offered a fuel card to my new trucking company and even before they sent out the fuel card they placed a ucc filing against my company without telling me they would and without me signing anything. Around December 22, 2022, I received a call from a guy asking me would I like for them to send me a fuel card. I agreed to have them send me card; however, I never committed to doing business with them. Fast forward to this week, I am wrapping up loose ends trying to get every thing situated and find a Factoring Company for my newly built business. I am on the phone with OTR company and they tell me I need to get a “letter of release” from blue water capital, which is over Fleetsmart. I explained to OTR that I never agreed to doing business with them and why do I need a "release letter". She explained it like it was some kind of lien on my company stating I agreed to work with them. That is a LIE!! Again, I never agreed to a such thing. I called them today (1/4/23) and spoke with Nina who agreed to send an email over "releasing" my company from them. At first she tried to say she did not see anything and there was not an UCC on my company. However, she was lying. I received a letter and OTR confirmed it. I asked her who would be completing the action of releasing him and she stated John. I asked who is John? She stated John is the owner. I asked for the last name and she said we do not give out last names. It’s hurting my company financially because it is holding everything up. Fleetsmart is placing UCC on companies without contractual agreements and without signatures. This action by Fleetsmart is very disturbing and deceptive. Around November 10, 2022, I received a call from someone asking me would I like for them to send me a fuel card. I said yes send me one. That’s as far as I committed to doing any business with Fleetsmart/blue water capital. Later, while trying to decide which factoring company works best for my newly-formed business, they informed me that I need to get a “letter of release” from blue water capital, which is over Fleetsmart. So I started calling them, (fleetsmart) they told me yes they would remove it-ucc filing-after talking with several different people over several weeks now,I still haven’t received the release. It’s hurting my company financially cause it’s causing a pause in everything. Fleetsmart without my agreement; without my signature, nor, entering into any contractual agreement, I still haven’t activated the card-nor do I intend to- they put a ucc on my company now I’m catching hell trying to get them to take it off. This is a very deceptive practice: they’re done others like this as well. And it’s very damaging, especially to a newly formed trucking company.
