      Thank you for the credit file documentation.

      From the information supplied, we have located the account in question.  CBV is attempting to collect a debt on behalf of FIDO against a DIVIYESH ***********************.

      As a data provider, CBV provides the debtor demographic information (debtor name, address, telephone number, date of birth) and account details to the credit reporting agencies.  The credit reporting agencies decide what individual report the debt is attached to.

      Since the complainant's name is different that the debtor name, it may be that the credit reporting agency has assigned the debt to the incorrect party.  The complainant should contact the credit reporting agencies for assistance.

      It appears the consumer has a problem with data provided by Equifax and / or TransUnion. The consumer should contact them to determine next steps. 

      As explained earlier, CBV simply provides the credit reporting agencies (Equifax and / or TransUnion) with the debtor name and the debt details. The credit reporting agency then decides which individual person the debt is attached to.

      ********* has been sending alerts to my credit report stating that I (THE ***** *******************) owned them money which I don't. I never have ask for any kind of loan or owned anyone money. The alert started in September 2023 and it is still ongoing even after I filed an investigation through *********** which acknowledge that it was indeed their errors and they were informing ********* about it. The alerts did stop for a few month but came back this month (March 2024). They didn't even remove those alerts from my credit report in the first place even after *********** informed them about it. The loan is in the name of THE ***********************. He and I are parent and child living at the same address hence maybe the confusion, similar name and same address. That is his problem and not mine and I am the one being charged for those loans which is ridiculous. Even when the correction was made through ***********, ********* still added another alert to my credit report this month (March 2024), What I am looking is for Fairstone to credit those alert to the right person (THE ***********************) and remove those alerts that are affecting my credit report since september 2023. It is impossible to communicate with them hence I am filling a complaint here. In the file attach, there will be information about the loans on my name (screenshots of the alerts), the correction made on my profile (name was wrongly written and was eventually corrected), the letter of the loan issued to the other person and the answer from *********** following the investigation written in french. I have yet to contact Equifax following the issues and have now been given notice about a new debt under ********* with a debt collector company in my credit report. This is getting ridiculous. ********* stated that whatever they have declare are accurate meaning declaring the debts are under Mr. THE *********************** but I THE ***************************** have just received a new alert in my credit report from a debt collector from *********

      As a data provider, the collection agency or creditor simply provides the credit bureaus with the debt information (account number, balance, etc) and the consumer demographic (name, address, date of birth etc).  It then becomes the credit bureaus responsibility to ensure the debt is attached to the correct party.  *** data provider has no control over this process.

      It would appear the complainant has a similar name and the same address as the debtor.  *** complainant needs to contact the credit bureaus directly.

      As a summary, it appears the complainant's issue is that the credit reporting agency is reporting a debt to them, that belongs to a person with a similar name who resides at the same address.

      As explained prior, a creditor or collection agency does not 'select' the individual where a debt is ultimately assigned to.  That is the responsibility of the credit reporting agency (Equifax or TransUnion).  As CBV previously explained, we have reported the correct data to the credit reporting agency, and it would appear that Fairstone has also supplied the correct data.  The issue is with either Equifax or TransUnion.

      I was contacted by CBV Collection Services Ltd by email from their litigation department about a debt with ***** ****, I questioned how old the debt was and when I last made a payment towards the debt and reminded them that they can't collect from a debt greater than 6 years old. They responded to tell me the debt was from ************************************* October 2015, almost 9 years ago. They are still reporting this to the credit bureau and threatening me with litigation if I don't pay. I want them to cease trying to collect it and to definitely remove it from the credit bureau.

      I can confirm that CBV is attempting to collect a debt that was purchased from the original creditor, ***** **** ****** *****, on November 22, 2016.  The date of last activity on the account is October 14, 2015.

      Please note there is no prohibition on collection agencies attempting to collect aged debt in your Province.  Further, there is no record on our system that this debt is reporting to a credit file.  Should you have information to the contrary, please provide proof of same so that we may investigate.

      To make suitable arrangements to repay your obligation you should contact an agent at **************.

      Since receiving this mobile number back in May 2019, I have been receiving MULTIPLE calls and voicemails per day from various phone numbers looking for someone named "*******************************?" or something similar to that. While this may have been her phone number at some point, it hasn't been for over 5 years. They need to stop calling this number and start verifying their phone records with the phone providers. This business does not have my real name and I'd like to keep it that way but they insist on taking my information in order to speak with them which is why I am approaching it through the BBB instead, hoping you are able to keep my name out of it. I need them to remove my phone number ************ from this ***************************' file and be done with it.

      CBV is attempting to contact a *********************** with respect to multiple matters in our office.  It would appear that this person was, or is still, using the consumer's telephone number as a contact with their creditors.  I can confirm that each time an agent is told we are calling the incorrect party that file is updated accordingly.  However, new files continue to arrive.

      I have updated all open accounts in our system to reflect that we are calling the incorrect party.  Should dialing resume the consumer should simply ask the agent to transfer the call to a supervisor for assistance.

      This business keeps calling me about a debt that is not mine. They claim I owe money to ***** **** which I have never visited or borrowed from. I haven't even received a letter in the mail indicating the details of this debt. I contacted ***** **** directly to see if my name had been used to take out a loan and they said they don't have any of my information on record and the debt does not exist. Despite that, this company calls daily looking for me to repay debt I do not owe. This is affecting my credit score despite not being mine. I am looking to have this resolved immediately.

      This company began calling me over a year ago multiple times a week harassing me. They say they are CBV or CVC collections or something like that. At first I thought they were some type of scam. Their number changes frequently. Presently they are calling from ************. They have called on 4/05/24, 04/09/24, 04/11/24, 04/18/24. 04/19/24. To name just a few recent dates. They claim to have bought a debt they say I had with ***** from some 15 years ago only I have never owed ***** any debt. I have called ***** and they have confirmed my account is fine and had never been in arrears or been a problem or there any record showing any sale of debts sold to a collector ever. I have told them I have spoken with ***** and I do not have any debt nor have I ever had any **** nor do I owe anyone any money so they need to stop calling and harassing me but they will not listen to me. I have also told them I have been informed that even if there was a debt from 15 years ago they have no legal right to collection now as too much time has now passed so on those grounds alone they should stop harassing me but they insist they will not stop calling me until I pay them some 200 dollars or something to that affect. This is getting ridiculous and I am getting really ****** off with this company. I want them to stop harassing me. I do not owe any money and I will not be sending them any money to get them to stop calling me. I would really appreciate it if you could help me make them stop asap.       CBV is attempting to collect an aged debt in the complainants name. While we believe in good faith our efforts are to the correct party, it is possible we are calling the wrong person. The complainant should contact an agent and determine if they are the correct party or perhaps the victim of identity theft. At that point a best course of action can be determined. 

      Further, there is no prohibition on a collection agency attempting to collect aged debt in the complainants home province. There is only prohibition on a creditor using litigation to recover a debt after a certain time had elapsed.

      I am rejecting this response because: I have made several attempts at talking reasonably with these people and they will have none of it. They are not reasonable people they only insist they are right and that the only way they will stop harassing me is if I pay them money I know I do not owe. They have made threats, they call relentlessly and none of it makes any sense and should be against the law. I recommend they find someone else to harass as I am not about to pay a bunch of crocks money I do not owe.

      False report issued to credit bureau. There is no debt owing but they managed to make 2 false statements to the credit bureau that have showed up on my credit report. They also harass me calling constantly every day. I tried calling to get it removed but they refused without me providing additional personal info which * *** ********** ** *** *********** *** ***** ** **** ** *** ******* *** ********** **** ** **** *** *** *********** One of their messages claimed it was related to City of ********. The only charge I received last year for City of ******** was related to a hospital bill which was settled in full directly with the hospital months ago. I want BOTH (2 claims) removed immediately from my credit report and the constant calls and messages to cease.
