      CBV collections (******) placed a collection action with ******* against me. The action is for CBV ******, though there is no proof of the ****** debt, not even an account number. The details of the action make no sense. It indicates the last payment to be Nov 1, 2017; which is the same as the delinquency date Nov 1, 2017. This is not my debt, there is no ****** account that was delinquent Nov 1, 2017. In fact, I opened a new account the month before (Oct 4, 2017), I doubt ****** would let me open an account if I supposedly owed them over $3,000. What strikes me is that this collection action was reported August 2023, just in time for me to be renewing my mortgage. This action is not reported by **********, which is the service I use. I can see CBV has been checking my ********** report quite regularily and never filed any collection action against me until this August. * ******* **** ** ********* *** * **** ******** ********* ******** **** ********** ** *** *** *** ** ** *** * **** **** ** *** **** ** ** ******* ****** ** ****** ******* I also recieved a letter from "*** ***** ********" in June 2023 threatening me with legal action and court proceeding if I don't pay. I assume it's for the same account as it mentions CBV and ******, but the amount is diferent from the collection action. If a lender didnn't let me know I would not have been aware of the collection action because I use ********** and a soft credit inquiry would show if I am checking my credit reports. CBV did not file with **********, which I find suspect. ***, *** *** ******* *** ********* ******* ** *** *********** They purposely hit me when my mortgage is up for renewal so I would pay even though this is not my account because of the credit rating implications. **** ****** ** ************ *** **** *****

      I am rejecting this response because: the collection claim lacks supporting documentation. For example the original creditor account number and itemized bill. The dates in the collection action do not correspond to any outstanding ****** account at the time. And as the collection action states I made a payment on Nov 1, 2017, how can it be delinquent at the same time (as per CBV stated collection action) Nov 1, 2017. The collection action and the *** amount owed is different without any explanation. CBV has not provided any documentation to show this debt to be substantiated and is using the threat of court action to ****** me to pay a bill I do not owe. Conventiently, CBV has regularily looked at my ********** credit report and it seems odd that all of a sudden when I need to renew my mortgage CBV pop up trying to get some money for a debt that is not mine. **** ********* *** ******* Further, CBV should be aware no legal action can be taken on a debt over two-years old and is using *** ** *** *** ******** **. This is not my debt. The onus is on CBV to provide the documentation required BY LAW as to the authenticity of this account. I dispute CBV's insinuation this debt is mine and it was not made in good faith. Prove it. I will not contact some paralegal firm, it's not on me. It's on them. I will not be forced to pay something I do not owe. CBV has a nasty reputation for unethical business practices.   

      I will take this court. Or they can take me to court. I will win because this collection action is complete ********.

      I am rejecting this response because: the business has not provided any additional information to disprove my position which is the debt is not mine. The onus is on the business to provide the information required under the Collection and Debt Services Act. Specifically;

      information on how much you owe and the type of product or service that put you in debt
      the name of the business/individual you owe money to
      the amount of the debt on the date it was first due and payable and, if different, the amount currently owing
      notification that a breakdown of the current amount owing will be provided upon request
      the name of the collection agency and collector who are demanding payment of the debt
      that the collection agency is registered in *******
      the contact information of the collection agency, including the full mailing address and telephone number and, where available, email address and fax number
      a disclosure statement, which explains your rights and the steps you can take if you think you think the agency broke the law

      Given the above information was not provided it is clear the businesses claim is not based in fact. 

      On the advice of my lawyer I will not entertain frivilous and wrongful debt claims. The burden of proof is on the business, not me.

      I am not *****e Hempel   CBV are calling the wrong person       I found this:  Who does CBV Collections collect for?
      CBV Collection Services collects national debts on behalf of companies such as ******, *****, ****, *** and ***** ****.
      The company works with many blue-chip clients, including government bodies, banks and telecommunications firms.

       

      Please note  I have never dealt with any of the companies that are noted above and I AM NOT ****** ******   I did however recently have my bank account hacked

      It would appear the indebted party was, or is still, using the complainant's telephone number with their creditors.  While we strive to train our agents to best action these type of situations they are not able to make changes to our database when consumers fail to notify us we are calling a wrong party.

      The database has been updated accordingly.  Calls may resume if a new account is placed with CBV that contains the complainant's telephone number.  Should this occur, the complainant simply needs to speak with an agent.

      CBV Collections is reporting a collection that is also somewhere else. It was transferred from CBV to another collection agency with whom I am dealing. They will not remove it from their files and it looks like I now have two collections when I only have one with them.

      When a consumer chooses to pay the original creditor directly the agency is forced to wait on the creditor to notify us that the account is paid.   We have no control on their timetable.

      Once the creditor notifies CBV that the account is paid, we will update the account status accordingly.  For clarity, the credit item will not be removed, but rather updated to reflect a 'paid' status.

      They claim that I owe *** ********** money. I’ve had a *** ********** for 13 years and paid my balance in full each month for those 13 years. I called *** ********** and they said my account is in excellent standing with a zero balance. The account number that CBV Collection sent me doesn’t even exist with *** **********, nor did it ever, according to ***. CBV has manufactured a false report and they’re trying to manipulate me for a debt that I never incurred. When I told CBV that their account number was bogus and that the bank said it was a scam the response was they were going to proceed with collections on the account. They are nothing but a ***** ** ***** *** ******* ****** ** ***** ***** **** ******** ****** Don’t trust them for a minute!

      I am rejecting this response because: I have called *** ********** on 4 separate occasions and each person I spoke to denies the existence of that account number *******. My credit history has no derogatory information concerning this account or any other account so I’m not a ****** ** ******** *****. I am a victim of a collection agency trying to coerce me into paying for a non-existent account debt. I have opened a file with the ********* ******** ****** ** ****** and should this ******* person try to contact me again they will conduct a full investigation into this matter.

      This is a complaint for a contact *** **********. This company has sat here and called me numerous times, and not given the waiting allocated time between calls.       We are unable to locate an account associated to the telephone number supplied by the consumer.  However, in general, a collection agency is not required to wait a prescribed amount of time between attempts to reach a consumer by telephone.  In some provinces a collection agency is only allowed to contact a debtor three times in one week regarding a specific debt.  Contact is defined, usually, as speaking with a person and does not include calls that result in no answer or no connection with an agent.

      CBV Collection Services Ltd has continually contacted me regarding a debt they claim I owe with *** ****. I have not had an account with *** **** for over a decade (past the statute of limitations time frame), nor did I have any outstanding debt with them. They also attempt to contact me beyond the 3 times per week limit that is permitted by law (this is harassment). I have talked to their agents and they refuse to give me any information without me providing my personal information to them, which I don't feel comfortable doing.

      CBV is acting in good faith attempting to collect a debt on behalf of ***.  I have reviewed the account in question and can confirm that CBV has not exceed the allowable number of contacts with the debtor as set out in legislation.  For clarification purposes,. a collection agency may only contact a debtor 3 times in a seven day period regarding a debt.  Contacts are defined, generally speaking, as when the agency speaks with the debtor and do not include contact attempts.

      Please note there is no prohibition on a collection agency attempting to collect aged debt in *******.  Limitations legislation only precludes the use of litigation to resolve a debt.  Finally, when contacted by CBV a debtor is asked to verify if they are the correct party before we release private and sensitive debt related details.  When a debtor refuses to cooperate, the agent is forced to end the call, and collection efforts resume.

      The consumer is free to contact *** directly to confirm the debt legitimacy or to obtain debt details.  The consumer should tell the *** agent that they are in collections to ensure they are routed to the best possible department for assistance.

      CBV is attempting to collect a debt in good faith, after receiving the debt from the original creditor.  In some instances the agency is unable to provide detailed documentation to substantiate the debt immediately.  In these situations a consumer can contact the original creditor for assistance.  They should notify the original creditor the account is with a collection agency to ensure routing to the correct internal department.

      Credit bureau listings will remain unchanged until the account is either recalled by the original creditor or paid.

      Cbv collections keep calling me saying that I owe money to ** ***** from over 8 years ago. They have no bill, no exact dates, nothing. I've asked them for the information regarding said money or charges, asked for an itemized bill. They said they can't or don't have that information to give me. They call day and night, and all they want is the money, they expect me to pay with no bill, no information or even guarantee that if paid it will go and be done. I've checked my credit rating, there is no open cases or accounts against me. I have no way of even contacting them or a person's name. They can't even pronounce my name correctly. I need them to stop.

      I am rejecting this response because: they have provided absolutely zero proof that the debit belongs to me. In fact, they admitted to not having any records that it was even me. I cannot follow up on hearsay that 8+ or so years ago that I may or may not of had an account or a debt anywhere without any details. Or bills or anything that ties me to unpaid accounts.

      Via ****** ***** I have a 100% payment streak with zero missed payments. So how am I "in good faith" suppose to trust one company that is designed to chase debit, **** * ***** ******* ** ********** ******* *** **** ****** *** ******* when a company designed to be the building blocks of credit says I have nothing owning. * ********** **** ***** *** * *** ** ***** ***** ** ** ******* ****** ** ***** ** ***** ** ******* ******* ****** ** ********** A simple wrong digit typed or called could mean numerous things "in good faith".
