Curacao is puzzled by Mr. ******* complaint, which contains no facts pertaining to Curacao and merely names it in passing while stating that Mr. ***** has no account with "credit one bank" and no "contract with ****************" --two third parties that are wholly unrelated to Curacao. Thank you for the opportunity to respond to Mr. ***** in regard to his dispute. Everyone who applies and is approved for Curacao credit receives a copy of the Curacao Credit Card Terms and Conditions, and that is the contract that governs our relationship as creditor and debtor. The Credit Card Terms and Conditions are also posted on our website, and are available upon request in any of our stores. Moreover, Curacao is an original creditor and not a debt collector within the meaning of the federal Fair Debt Collection Practices Act. As such, it is exempt from the validation requirements of the Act. It is also expressly exempted from the validation requirement by Californias ********* Fair Debt Collection Practices Act. However, customers also get a receipt/ invoice evidencing their purchase and all purchases and charges during the billing period are itemized on the billing statement.Customer Answer

I am rejecting this response because: they did not provide me with a copy of the contract as requested. This response they sent me solved nothing. I want them to prove that it was me that opened up the account for All my information was stolen including handwriting, birth certificate, pictures of my social security card etc Was exposed in a data breach and now incorrect information on my credit report coming from this company is being used and reporting on my credit report as delinquent, I demand this account be removed from my credit report

We have reached out to Mr. White via email requesting additional information to help us do a more thorough investigation of his Identity theft claim as we only have the email he sent as form of communication. In order to open an identity theft claim, we will need a completed ID Theft Affidavit and a copy of the claimants photo identification. Thank you for the opportunity to respond to Ms. ********* complaint. Our review of her account indicates that Ms. ******* contacted both our **************** and our ********************** using the same phone number provided (partially) in this complaint. During these calls, Ms. ******* repeatedly asked to close her account; we made clear to her that she would have to bring her account current before she can close it. At no time during these calls did Ms. ******* dispute the account's existence, balance, or the fact that the account is late. Contrary to what is indicated in her complaint, we have no record of Ms. ******* asking to have a copy of her application forwarded to her, but we will send a copy to the email address registered in her account. On 11/26/2024 I, ordered/online purchase of the Dream Cloud 14" Tight Top King **** ******** from Curacao grand total $1,275.92. Their motto is to feel confident with their purchases and if your order can be found for less at another store, they would match the price (beat it) and the competitor's interest rate! Their online advertisement for this mattress was $989.99 however, they charge me $999.00 in addition to a recycling fee of $10.50, shipping and handling $189.00. The worst thing about this purchase I found out to be, was the same Dream Cloud 14" Top King ******** could be purchased at ****** for $835.00 without taxes. The Curacao Team sent me a Delivery Status Notification and Confirmation on 12/3/2024 scheduling the delivery for 12/4/2024 between 12:00PM and 03:00PM to my home in Banning California *****, however when they arrived the delivered the wrong mattress a( 12" Nectar King ********) which can be purchased at AMAZON for $849.00. As I informed them of their error Curacao just told me to contact ***************** I've been given the runaround since the delivery with no one from Curacao attempting to correct their error. I was even given a Case # CAS-******-W4T5S6, "******** Identity Inquiry". however, Curacao refuses to address this situation continuing having me contact different departments. This evening I finally got through to ****************** who wouldn't address the fact the wrong mattress had actually been delivered, but gave me the option of the option of either keeping the merchandise OR paying a RESTOCKING and PICKUP Fee thats all they were responsible for. Everything else was to be addressed to customer service. ********************** has now scheduled the mattress to be picked up on Wednesday 12/11/2024 but has not committed on how they will rectify my situation. I want to feel confident about the mattress I purchased not with the one they are attempting to force upon me. The price needs to beat ****** price including delivery.Business Response

Thank you for the opportunity to respond to Mr. ******* complaint. We have reviewed the purchase and we are sorry for the inconvenience this whole situation has caused Mr. ******* We have proceeded to refund the delivery fee of $189, credited the $25.18 in finance charges and $20 in late fees that accrued due to the late posting of the delivery fee credit. We have also removed the 1/30 everlate **** due to the late posting of the return. We would like to compensate Mr. ****** with a $100 coupon for online purchases or $100 gift card for any purchases done at the store. As for the Pricebeat, we do not see any submitted request in our portal. However, if the request had been made it would have been voided due to the return. We tried calling Mr. ****** to let him know about the outcome but we have not been able to make contact with him. I recently identified a fraudulent account under the name La Curacao, opened on 09/16/2021, with account number **********, on my credit report. This account was not authorized by me and is a result of identity theft.I have reported the incident to the *** and my local police department. Copies of the *** Identity Theft Report and related documentation are attached.Please remove this account from my credit report immediately.
