    The basis for my dispute Eastern Account System,Mr. Joseph P. C******* **** President,EASTERN ACCOUNT SYSTEM,******************$124 - was required to notify me prior to 10/14/2022, or no later than 30 days after.

    EASTERN ACCOUNT SYSTEMfailed to notify me about reporting derogatory info. to *******, ********, and ********** In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); “The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after 10/14/2022, furnishing the negative derogatory information to a consumer reporting agency described in section 603 (p),’ 15 U.S.C. ss 1681s-2(a)(7)(B)(I). Plus broke commercial law under UCC § 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response.


    Also, EASTERN ACCOUNT SYSTEM" failed to give me my "Mini-Miranda" five days prior to placing this derogatory item on all of my credit reports, per Section 807(11) & FDCPA §809, which is $1000 per violation and the state of ** allows treble damages.

    Under § 809. Validations of date and Mini-Mirandi under Section 807(1)Eastern Account System,Mr. Joseph P. C******* **** President failed to send me my initial communication before placing this alleged derogatory status on my credit reports further violating the FCRA, I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to $2500 and can be enforced by the FTC, and that my state attorney general can also enforce this with a $1000 penalty as well.

    I attached a copy of the law and the actual document from the federal reserve

    The debt in question is for
    the balance owed to *** for services through 8/3/22. The account was placed for
    collections 10/14/2022, Eastern cannot send notice prior to the date since we
    did not have the account yet.

    Eastern Account System did send notice 10/18/22, at
    no time was this correspondence returned as undeliverable. The billing address
    is the same that is listed in the complaint. The consumer is allow time (a minimum
    of 45 days) to dispute, validate or pay the debt prior to credit reporting. Several
    attempts were made to reach you by phone as well without a response.
    Payment was made directly to
    the original creditor. The account has been
    updated and now reflects a zero balance.  Updates to the credit bureaus occur on the 10th of every
    month, please allow 30-45 days for the bureaus to update your report.

    I am rejecting this response because:I never received all the docs and required FDCPA notices that Eastern Account System of Connecticut, Inc. Company allege they sent with no proof , no one said they're to send certified mail, but courts have held that:
    A “strong presumption” of receipt applies when notice is sent by certified mail, because it creates actual evidence of delivery in the form of a receipt. ******* ******** ** ***** ****, 506 F.3d 274, 279 (3d Cir. 2007) (emphasis added). A “weaker presumption” arises where delivery is sent via regular mail, for which no receipt, or other proof of delivery, is generated.
    Also, I have no agreement or sign contract with Eastern Account System of Connecticut, Inc. under T**as contract law, but continue collection action which is a $1000 violation:
    1. The Debt Collector must offer proof of the debt as owed by providing copies of the signed intrument or judgment from the original creditor. *******, FTC informal staff opinion letter, May 17, 1993. See *** ** ********** ******, Inc. 493 F. Supp. 701 (D.N.D. 1980); ******** ** ********, 950 f.2D 107 3D cIR. 1991); ****** ** ***** General American Credits, Inc. 943 F.2d 482 (4th Cir 1991), et seq.
    2.
    So, Eastern Account System of Connecticut, Inc. violation of continuing collection activity and no proof that I was served with my "Mini-Mirandi" rights, neither shown to the BBB or me, I will go forward with my legal action, as well as turn this over to the proper governmental agencies and **** *******

Any collection activities and communication during the 30-day period may not overshadow or be inconsistent with the disclosure of the consumer’s right to dispute the debt or request the name and address of the original creditor.

    The debt in question is for the balance owed to ********** ********* Associates  for services originating 8/13/21.  The account was placed in collections  February 2022. he consumer is allowed  time to dispute, validate or pay the debt prior to credit reporting.


    Eastern Account System did send notices  at no time was this correspondence returned as undeliverable. Additional notices were sent prior to and after credit reporting. Per the original creditor, this balance remains valid and due.   Validation of debt has been requested, and will be sent upon receipt.

    A consumer's permission is not required to report an account to the credit bureaus. 

    Due to recent changes with the credit bureaus, once a medial debt is paid the bureaus will remove it from the credit report.

    3)Details about the age and amount of the debt including a copy of the last billing statement from the original creditor; a detailed explanation of any interest added or payments made since the last billing statement and the legal authorization for this interest; the date the original creditor claims this debt became delinquent.


    4) Whether this debt is within the statute of limitations and how that was determined.

    5) Please also forward details about your authority to collect this debt: whether you are licensed in my state and if so provide the date of the license, name on the license, license number, and the

    license number, and the name, address, and telephone number of the state agency issuing the license.

The validation will have the original creditor, ********** *********, the charges, the date of service and I believe everything you are looking for.  The date of service is 8/13/21, just last year.     I have spoken to ********** ********* ********** * ***** regarding this debt. these are the facts of this current matter:

    In August 2021 I got covid, and I was rushed  taken to, I spoke to the ***** ** Rep, and this is what she told me

    1: They improperly billed the CT scans(which was related to covid) to my state insurance and ***** ** denied the claim. 

    2. The CT scan was part of my insurance coverage because it was COVID-19 related.

    3. The ***** Rep stated to me that ********** ********* coded the claim wrong, and they had up to 1 year to fix the situation but never did.

     

    I just got off the phone with ********** ********* and they are looking into it to fix the situation

    In March 2021, my family experienced a home fire in which many of our items were considered unsalvageable, including our Internet equipment from *** cable company. After the restoration company came in and did their thing, I called *** and explained the issue that the equipment could not be returned as the restoration company deemed it as unsalvagable. The person from *** freezed our account and explained that nothing more needed to be done with the equipment considering the circumstances. He explained to call back when we got settled back in our home and they would send new equipment for internet usage. In July 2021, we had equipment resent. In September 2021 we sold our home, and ended internet services as *** is not available in our new area. We sent the equipment back prior to moving. After moving, we received a past due message from *** that we had to pay for equipment. I called and spoke to someone who said they’d research and get back to me….no follow up. Now I’m being told that I have a debt collector on my credit report, though have never received any correspondence from this company. This needs to be removed immediately, especially as I was never even notified!! They are destroying my credit over a decision *** made to wipe the equipment fees considering the circumstances of the fire. No one ever told me I’d be responsible to pay for anything!!!!! And to then not even notify me of this collection company getting involved?! This needs to be made right immediately.

    received a notice that I have a collection from EASTERN ACCOUNT SYSTEM on my credit report. It says it was opened on Jun 02, 2022 for $137 with account number starting in (account number) that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the FCRA and FDCPA.

    I would like for this collection to be removed asap or I will file a CFPB and FTC report.

    I filed for Chapter 7 bankruptcy in Aug 2022, and it is still open. Now, in Dec 2022, Eastern Account Systems popped up on my credit report, trying to collect for *******, which was included in my bankruptcy. First, it is illegal to try to collect while I am in the automatic stay due to bankruptcy filing, secondly, it is illegal to try to collect on an account that was included in a bankruptcy.

    I want this illegal collections account removed from my credit report(s)

    I reached out to Eastern Account Systems regarding a debt that is currently reporting to the credit bureau under my name. I sent an official request, certified mail to get validation of this debt on 9/2/22 with 30 days for them to comply. We are now at over 90 days and they are unable to and have not provided any information required by the government to keep this alleged debt on my credit report.

    I received a notice that I have a collection from EASTERNACCOS on my credit report. It says it was opened on 09/29/2021 for$282 with account number starting in ******** that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the FCRA and FDCPA.
