We ordered a Swing Set Deluxe + Play Deck Wooden Roof in blue/yellow from Spimbey.com (Spimba Inc bda Spimbey.com) on 8/4/2022 for $1,177 (including tax, shipping, and a baby swing accessory). My credit card was charged that same day for the full amount, processed via "Mollie." Order number is 43666. The company's website stated it could take up to 30 days for the product to ship & would arrive in 2 containers - accessories by mail & a scheduled delivery for the structure. Other than an invoice confirming order & payment details (attached as a supporting doc), I've received no other communication from the company or from any delivery company on their behalf. On 9/6/2022 I pulled the playset dimensions for our landscaper and noticed that all playsets were "out of stock." On 9/10/2022 I was unable to reach their website and the site remains unavailable. Spimbey's Instagram page is deactivated (which is where I first learned of the company, through their heavy social media advertising) and their physical location "permanently closed" according to Google. The company has not responded to my email for an update on the order (sent 9/11/22). I have no way of contacting the company outside of a generic [email protected] email address and any instructions on how to cancel an order or ask for a refund were only available via their website (which is no longer accessible). Given that the company seems to no longer exist & that I have no contact or recourse available as a customer, I would like the BBB's assistance obtaining a refund.Initial Complaint

On May 29, 2022 I placed an order on Spimbey's (dba Spimbey and Spimba) website for one "Spimbey Swing Set Deluxe + Play Deck Wooden Roof" with adjustment for a "Double Glider" swing priced at $879 along with one "Spimbey Baby Swing Seat" priced at $79 for a total of $958. With taxes ($58) this made my total amount $1,016. The account number for this order is #40321.
The website claimed that the parts would be sent in mid-June. As of this date I have not received anything from this company. I have reached out to them on three occasions.
On June 29, 2022 I sent an email through their website messaging system. I received a response stating the order was "on its way to the warehouse" and that person could not give an estimate of when I would receive.
On June 21, 2022, I sent another email. Someone replied on June 24 that included this "Your order is still in the warehouse waiting to be shipped. We have had some problems with our warehouse not sending packages and constantly delaying them. We gave them a trial period this month, which they failed to handle. To fix the problem we had to break off our partnership with them and hire a new warehouse, starting next week or so they will start shipping orders to the US. The current ETA is middle of August. As soon as your order leaves the warehouse, you will be automatically updated with a tracking number."
I then sent another email through the website on August 29th. I have not received a response to this email. I recently learned this company filed for bankruptcy. They have not made any contact to me informing me of this news. I learned about it through other customers leaving reviews about the company on Google's review area. The company has made no efforts to rectify this issue with me. I used Affirm to complete this order. I made two payments of $95.37 through Affirm. I need them to confirm this so I can obtain a refund through Affirm and not be asked to complete payments for items I never received.Initial Complaint

I purchased a Playset from Spimbey on July 5, 2022. I paid through Affirm, splitting the total cost of $2,213 over 12 months. The first payment made to Affirm was made on July 29, 2022 for $184.42. The second payment was made on August 26, 2022 for $184.42.
The spimbey website shows that they would deliver my Playset within 20 business days (which would be no later than August 2, 2022. After placing my order I did receive a receipt confirming my purchase, however I never received any other communication with this company. I never got a shipping or tracking number, and no communication to set up a delivery time. On August 12, 2022 I sent an email to the company requesting a tracking number or status of my Playset. I never received a response. I also attempted to call the company on numerous occasions, but the phone line was always busy and I was unable to speak with anyone.
On August 25, 2022 the spimbey company filed for bankruptcy. I have made payments to this company but never received the promised product. I am extremely disappointed. I have files with Affirm to stop payments and cancel the agreement I have with them. However there is no guarantee they will do this. I am worried that Affirm will file negatively on my creditInitial Complaint

In March of 2022 I placed an order for a swing set from Spimbey. I paid for the product in full (about $1,600)and was told my swing set would arrive in May. May came and went, they told me June. June came and went they promised July. At the end of July, with no confidence that a swing set would arrive soon, I requested a full refund I early August. I was told that a $300 cancellation fee would apply, and it would take 14 business days to process. After waiting the allotted time, I have checked and the company told me that the financial department was overwhelmed with refund requests from other customers in the same situation. Now, all email communication has stopped and the phone number listed is not in service. I believe this company may have closed without refunding me and what seems to be several other people who were defrauded by this company. Any help on getting the money I am owed back would be greatly appreciated. This company broke its promise to deliver a product or a refund. I purchased a playset from Spimba on June 4th totally $835. I chose to use Affirm to pay for the set. They said it would be 30-60 days until I received email notification on shipment. I reached out on June 24th through email and asked for an estimated delivery. They said they couldn't give me a date, but likely around the middle of August. On August 14th, I contacted them through instagram hoping for instant responses. I asked again for an update and they said they cancelled their contract with their current warehouse and started a contract with another so it would ship in 1-2 weeks. Well as of today, I have no shipment notification. They have deleted all their social media accounts and the business filed for bankruptcy. I emailed them and no response. I have not been able to get a response from the company and still have the loan out to pay the rest of the $835 because I have already made two $140 payments.Initial Complaint

I placed an order with SPIMBA, Inc (dba Spimbey) for deluxe swing set on May 14, 2022 totaling $2,055.00 under order #37507. When I placed the order, the shipping information provided by the company indicated that it would be 45 days before the set would be shipped. Once I reached 50 business days with no follow-up from the company, I started an email communication with one of their customer service reps to try and understand when my set would finally ship. They never provided me with an accurate shipping date, kept providing me with excuse after excuse as to why my order hadn't been fulfilled yet. About a week ago, I decided that it was unlikely that I would get my swing set and requested to cancel my order with a full refund as I was entitled to based on the cancellation policy provided on the company site. I have followed up 4 times since my initial request for a refund and have received zero response from the company. I since have found out that the company filed for bankruptcy. I have tried to initiate a refund from Affirm, the company i used to pay for the set, but their policy is that I only have 60 days from date of purchase to dispute the charge. I purchased a playset from SPIMBEY on June 24th. Their website stated that it would be shipped in 30-40 business days. I emailed the company asking for a refund and tried to contact them multiple times and nothing. The same thing has been happening to about 800 other people. I paid through Affirm and am now paying a loan on an item that I have yet to receive. The company filed for bankruptcy on 8/22/22. We ordered a playset from Spimbey.com on 3/23/22. The estimated delivery date given on their website (based on our purchase date) was in May. I followed up a couple times by email, once in April, once in July. In July, I was told that they made the decision to move their warehouse and did not have a delivery date, but it wouldn't happen within the month of July. I sent another email 8/25 to their customer service and have not had a response. I also reached out through their online chat feature and go no response.
Ideally, we would love the playset we ordered. If we are not going to get the playset within this month we would like a refund to be able to go purchase from another company.Initial Complaint

I purchased a playground for my son, I spent over $1800 through affirm to purchase this item through spimbey.com. They kept assuring me I would receive my item, it has been over 3 months and now the company has filed for chapter 7 and is not returning any emails or money
