      Complaint: 22085941

Thank you for your prompt response to my complaint. However, I must respectfully reject your resolution for the following reasons:

Firstly, I would like to bring to your attention that the address associated with the account in question is one that I have never lived at or been associated with. This raises significant concerns regarding the accuracy and legitimacy of the account. As such, I request that a thorough investigation be conducted to verify the details of this account.

Secondly, while I understand the requirements of the Fair Credit Reporting Act (FCRA) to report accurate information, I firmly believe that the information reported in relation to this account is not accurate, as the account was not opened by me.

Given these circumstances, I kindly request that Lendmark Financial Services re-evaluate the information associated with this account and take appropriate action to remove this inaccurate and potentially fraudulent entry from my credit report.

I trust that Lendmark Financial Services values the integrity and accuracy of the information reported to the credit reporting agencies, and I hope for a resolution that reflects this commitment.

Should you require any additional information to facilitate this investigation, please do not hesitate to contact me.

      Complaint: 22085941

I am rejecting this response because:

Thank you for your response to my complaint. However, I must respectfully disagree with your findings and would like to clarify the ongoing issues:

      1. Inaccurate Address on File: Your response indicates that the address associated with my account in your records matches the one provided in my complaint. I would like to reiterate that the address associated with this account is incorrect and is not, nor has it ever been, my address. This discrepancy is a significant concern, as it suggests that the account may have been fraudulently created or manipulated without my authorization.

      2. Incorrect Reporting of Tradeline: The reporting of the tradeline as "60 - 89 Days Past Due Date" is inaccurate and does not reflect my actual payment history. This erroneous reporting is negatively affecting my credit score and my ability to obtain a mortgage, as I am currently in the process of purchasing a home. Under the Fair Credit Reporting Act (FCRA), 15 U.S.C. 1681s-2(a), you are required to report accurate information to the credit reporting agencies. The inaccurate reporting of this account is in violation of these provisions.

      3. Request for Immediate Correction: Given the inaccuracies in both the address and the payment history, I am formally requesting that Lendmark Financial Services immediately correct these errors. Specifically, I ask that you remove the incorrect address from my records and update or delete the erroneous tradeline from my credit report. Failure to correct these inaccuracies constitutes a violation of my rights under the ***** and I will pursue all legal remedies available to me.

      4. Further Actions: Please be aware that I have also filed disputes with the major credit bureaus (Experian, Equifax, and TransUnion) and a complaint with the Consumer Financial ***************** (CFPB) regarding these issues.

I urge Lendmark Financial Services to take this matter seriously and to take immediate action to resolve these discrepancies. I look forward to your prompt response and the correction of my credit report.

      Sincerely,

I have been a long-time customer of **********************. This current loan I am sending a complaint about was done in July 2019, because of the very high interest all payments made are basically only 1/2 to principal and 1/2 for the high interest rate. Although I may pay my payment after the due date, the 5th of each month, I pay before it's a 30 day late for the entirety of this loan. The harassing collections calls have recently been unbearable the entire month of July 2024. More specifically this week 7/29-7/31 I have received calls back-to-back, even from (Potential Spam) numbers that coincide with my area code (540) back-to-back. Before I had a problem with them contacting my referrals and work number. To my knowledge they have not attempted as of late. I am asking that this business does not call my cell phone, home phone, work phone, referrals etc. They can continue writing me at the same address that is listed on my loan in which I currently reside. I do not wish to ever receive any further offers of additional funding from this company due to the excessive phone calls.

I am filing a complaint against company for inaccurately reporting an account on my credit report. The account was listed without my authorization or verification. Despite my efforts to resolve this issue directly with the company, they have not responded or provided verification, violating the Fair Credit Reporting Act (FCRA).

      Dear ***********************,

You entered an unsecured consumer installment loan with Lendmark on November 24, 2023. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $4,694.55 with an interest rate of *****% for a total of payments of $8,451.11 to be repaid over 48 months with a first odd payment of $232.69 due starting on January 8, 2024, and payments of $174.86, monthly thereafter.
This is a precomputed loan, the starting balance or the total of payments on the loan reflects both a principal and an interest component and each payment made on the loan is applied to reduce the total of payments. Further, the total amount of interest is computed at the inception of the loan and does not change.
The statement you received from Lendmark reflects the amount you owe if you were to pay off your loan to term (the contracted 48 months), currently $7,344.12.
The balance being reported by the credit reporting agencies reflects the amount you owe if you were to pay off your loan account by the end of the month, last reported at the end of May 2024, is accurately reported as $4,177.46
Lendmark can confirm the balance being reported is accurate as of the date of reporting to the credit reporting agencies.
We trust this resolved the complaint brought forth. Should you or the customer have any further questions, please do not hesitate to contact Lendmark Financial Services. You can do so by utilizing our customer contact portal accessing the link below.

I am rejecting this response because:

Sincerely, Because 7300 dollars and something is incorrect you see on my proof I have sent you what the remaining balance is and it is concurrent and accurate I did refinance a loan about seven eight months ago to get down my payment with no money out without narrowing money but that would have already reported to credit ********

      Dear ***********************,
Lendmark Financial Services, LLC (hereinafter referred to as "Lendmark") is in receipt of your consumer complaint. We have had the opportunity to review the complaint and will address your concerns as follows.
As stated in our previous response, this is a precomputed loan, the starting balance or the "total of payments" on the loan reflects both a principal and an interest component and each payment made on the loan is applied to reduce the total of payments. Further, the total amount of interest is computed at the inception of the loan and does not change. The statement you received from Lendmark reflects the amount you owe if you were to pay off your loan to term (the contracted 48 months), currently $7,344.12. Should you want to pay off the loan off early, there is a potential you will pay less than the total of payments.

The balance being reported by the credit reporting agencies reflects the amount you owe if you were to pay off your loan account by the end of the month, last reported at the end of May 2024, was accurately reported as $4,177.46. The balance reported to the credit reporting agencies as of the end of June 2024 is accurately reported as $4158.01, please note that the CRAs are separate entities from Lendmark and Lendmark does not control the amount of time it may take for the CRAs to process the update.
Lendmark has mailed a copy of the Disclosure Statement, Promissory Note and Security Agreement ("Contract") with the customer's signature, along with a copy of the payment history and detailed payoff, to the address on file to provide proof of debt.
We trust this resolves the complaint brought forth. Should you have any further questions, please do not hesitate to contact Lendmark Financial Services by utilizing our customer contact email address. ***************************************
