On November 30, 2018, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $1812.75 which was financed for a term of 24 months with a first odd payment of $99.72 due starting on January 4, 2019 and payments of $95.15, monthly thereafter.
The Lendmark account referenced in your complaint was charged off on September 25, 2020 and subsequently sold to Plaza Services. Lendmark is no longer attempting to collect this debt. On January 3, 2024 I sent a certified letter to Lendmark Financial asking them to validate the accuracy of my account that has been charged off. Despite the 30 day timeframe outlined by the Fair Credit Report Act for such responses it has been well over 6 months and I have not received any communication from them regarding my request.As of August 28, 2024 Lendmark Financial has not issued the necessary 1099C form which is required by law when a debt is forgiven or cancelled,I request that the BBB intervene to ensure that Lendmark Financial,1. Provides a timely and thorough validation of accounts in question.2. On October 26, 2021, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $6444.32 which was financed for a term of 48 months with a first odd payment of $254.01 due starting on December 2, 2021 and payments of $221.44, monthly thereafter.
Lendmark has mailed a copy of the Disclosure Statement, Promissory Note and Security Agreement (Contract) with the customers signature and a copy of the payment history, to provide ledger of account payment activity, to the customers address on file to provide proof of debt.
Additionally,if Lendmark Financial Services was forgiving the loan balance, you would be receiving a 1099-C, however since you are still responsible for the loan, you will not be receiving a 1099-C.

I am requesting original contract and documentation signed with my signatures, with Lendmark Financial. As noted that Lendmark has sent or mailed a copy of the disclosure statement, promissory Note or security agreement with signature, they have not done this to this date 9/3/2024. To state again I would like this removed from my credit report as I do not have a legal agreement with Lendmark Financial.

I took a loan from Lendmark to try to get caught up on debt. After taking the loan, my financial situation got worse due to my husband being denied disability and I had to enter into Debt Consolidation through another company in order to lower all payments and reconfigured how bills were being paid. Since entering into Debt Consolidation, Lendmark has been calling and harassing me at work. I have repeatedly asked that they do not call me at work but they continue to call daily. ***************** called today, 8/23/24 at 2:25 PM and harassed me. I had a loan with Lendmark that I refinanced back in November of 2023. Upon refinancing the loan, Lendmark released a title to a car that they had a lien on back to me. I was told I would receive the title to this vehicle within a matter of days. After a few weeks I had yet to receive it. I went to DMV and was told Lendmark had yet to release the title. I contacted them several times and was told a 3rd party business was the company that released the title and theyd get back to me. I have reached out several more times and have been given the run around on my title. I have yet to receive it and It has now been almost 10 months now. I really need this title to my car and I am getting no answers from Lendmark.Business Response
