      Lendmark Financial Services, LLC (hereinafter referred to as "Lendmark") is in receipt of your consumer complaint. We have had the opportunity to review the complaint and will address your concerns as follows.
      On May 3, 2019, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $4500.00 which was financed for a term of 48 months with a payment of $206.95, due starting on September 15, 2019, and monthly thereafter.
      Lendmark has mailed a copy of the Disclosure Statement,Promissory Note and Security Agreement ("Contract") with the customer's signature, along with a copy of the customer's payment history to provide the ledger of account payment activity, to the address on file to provide proof of debt.
      Additionally, we understand that you have requested that Lendmark remove certain information associated with the tradeline for the Lendmark loan account referenced in your complaint that was furnished to the credit reporting agencies (CRAs) by Lendmark. The Fair Credit Reporting Act requires that Lendmark accurately report information to the CRAs. As the information reported to the CRAs regarding your account was accurate, ****************** is unable to accommodate your request.

      I would like for *************************, the Branch Manager, to stop sending me these "We've reserved $1000 for you" letters when this individual specifically has declined me over and over for loans (despite them claiming to help those less fortunate on their website). I have called and requested that these letters be stopped; and still, she continues to have them sent. I would like my name taken off their **** mailing list permanently and for them to stop contacting me with these bs letters immediately - or else!

      You obtained an installment loan secured by personal goods with Lendmark on September 2, 2020, for the purpose of household expenses in which $ ***** was given directly to you. As fully disclosed on the Disclosure Statement,Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed of $ ******** interest rate of *****%, a total payment of $4,938.12 to be repaid over 36 months in $ ****** monthly payments.

      This loan has been renewed three times with the most recent occurring on September 8, 2022. The amount paid directly to you was$ ******* and $6,076.74 was paid on the prior loan. The Amount financed was $ ******** with an interest rate of *****% for a total of $ 13, ****** to be repaid over 54 months in $257.36 monthly payments. There have been 12 payments made on the account with the last one being made on November 8, 2023. Additionally on December 26, 2023,you requested to no longer be contacted by telephone and your account was notated and calls were restricted.

      We have not had any contact with a debt management company on your behalf. We encourage you to reach out to your local branch to provide the contact information and for any available options you may have to bring your account current as soon as possible.

      This company has a system that claims you don't make your car payment on time and tanks your credit report with late payments. The management is so horrible and degraded me for asking for a hardship deferment. Which I signed and agreed too. Then claimed a late payment every month since June 2023. Then calls me stated I missed April's payment tanking my credit score more. I don't want my car they can come have it. And I want all my money back that I have paid ****** for 21 months as of April 2024. I also want restitution for harassment and emotional distress as well as my destroyed credit score. The first account is direct consumer installment loan entered April 29, 2022, to finance the purchase of a 2010 ****** Corolla (vehicle) from 83 Autos, LLC.As disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $8,225.53 with an interest rate of *****% for a total of payments of $13,511.82 to be repaid over 48 months in $281.25 monthly payments. In April ************************************************************************************** bringing the account current. The status of this account is current and due June 01, 2024; no late payments are reporting for this account.

      The second account is a sales finance installment loan entered September 27, 2022, to finance the purchase of auto accessories with the original amount financed was $1,588.00 with an interest rate of *****% for a total of payments of $2,182.68 to be repaid over 36 months in $60.63 monthly payments. There were three payments made on this account with the last payment being on December 28, 2022,and late payments being reported until it was charged off on August 25, 2023.      

      A copy of both loan agreements and payment histories have been mailed to the address on file for your review.

      I am rejecting this response because: I did not fall behind I made a deferment that your company refused to honor for over a year and the. Tried to say I didn't make April's 2024 payment and that's not even the first time your company tried. Take the car or legal action will be filed for the false destruction of of my credit with the car. Your company is a joke and in violation of the Consumer Protection Act I have already spoken to a lawyer.

      On 08/15/21 I entered into a settlement agreement with LENDMARK FINANCIAL Attorneys **************** On 04/09/24 I paid the final settlement agreement amount. I paid the settlement on time as agreed NEVER LATE each month throughout the agreement. Unfortunately, LENDMARK FINANCIAL has relentlessly and intentionally sabotaged all three trade lines manipulating the monthly update. Finally, Im requesting LENDMARK update my trade line status to settlement paid as agreed never late with all Four credit bureaus, ************ Experian, and Equifax.

This account charged off on April 25, 2019, due to nonpayment as contractually agreed, with a balance of $ 4, ****** owed.

      On October 25, 2018,Lendmark was granted the below judgment:

      Prejudgment Interest $ 455.30;
      Filing Fee $ 74.00;
      Attorney Fee $716.46
      Other Fee $ 57.88
      Total $ 6,080.03

      On July 30, 2021,you entered a settlement agreement with ******* & *****, P.A. to pay $2500.00 in $50.00 consecutive monthly payments for 50 months to satisfy the judgment. The last payment made to satisfy the settlement agreement was made on April 9, 2024, please allow 30 to 45 days from this date for the credit reporting agencies to update the tradeline reporting associate with the account. Additionally, the tradeline associated with the account would be updated to report as settled for less than the full balance.

      We also contacted ******* & *****, P.A. to confirm that no other agreement was made as to how information would be reported to the credit reporting agencies.
