My husband and I received a loan from Lendmark financial while in a hard place due to family issues.We paid on the loan from 8/21/2019 up until my husband lost his job and I was the sole provider. 12/28/2022 was our last recorded payment. We knew at the time this was wrong but I couldnt afford a place to live let alone all of our bills and to eat. So we did what we needed to and I stopped paying. We just received paperwork on 1/3/2024 from the District court of MD with a court date and judgement amount of *******. I immediately when I could contacted Lendmark and they gave us the number to the law office to try and reach a settlement, I spoke to a ******************** from the law firm who told me that after speaking with Lendmark the actual amount I owe to settle this is ******* cents. I asked why my court ordered document has a price lower for the judgement then what was being quoted me and she had no answer for me. I still offered a settlement every ***** in my account ****. She contacted Lendmark they immediately declined my offer and wont take anything below ******* wouldnt even counter my offer. Lendmark will not work with me in order to settle this, and on top of that going to court is cheaper then trying to work with them? This makes absolutely no sense and is unethical. I feel like I have been completely taken advantage of. I paid on the loan for 3 years, my family was going through a crisis and I couldnt pay any longer. Now they wont even help me with a counter offer to make things right? And quoted me 2 thousand dollars additionally which bring the balance to way more then I even borrowed from the company to begin with. This place should honestly be shut down.Business Response

My current loan number is 0068-115316. This loan evolved from an initial loan of $11500 from I believe October of 2021 for the purchase of a Polaris SXS. The loan originated from the ********** Lendmark. I do not have that original loan number because its not available on the app. account. The interest rate from this loan was **** percent for 48 months . At the signing I declined life insurance in order to keep the loan at an affordable price. I have nothing but good things to say at the time for my lendmark worker, *****. We communicated several times regarding the loan and met in person at the store a couple of times. She was very friendly, easy to talk too, and appeared trustworthy. I felt like I got to know her. So in March of 2022 something came up that I needed a $1000 so I called ***** and asked her about the $1000. She advised me they she could do that and "could just tack it on to my current loan." She advised me that she would send me something to docusign and then deposit the money into my checkings account. I had no reason not to trust *****. So, she sent me the docusign form, and since I was at work and I trusted her. I signed it and submitted it back to her. I understand that I didn't read what I was signing, but again, i had dealt with her personally on the first loan and had developed a trust. Plus, I was at work and didn't have time to read. This transaction appeared to go fine, as did the original. I continued to make my payments and the payment, The payment didn't increase much so I was not alarmed to anything nefarious regarding this second transaction. I thought it was like she said, "tacked on to my loan". Nothing alerted me regarding the payment amount that anything drastic was different. I continued making the payment on the from **** until **** when I was in the process of relocating for a new job. I needed money to help me move. You entered a precomputed installment loan secured by 2018 Polaris Sport Side by Side with Lendmark on October 18, 2021, with an amount financed of $11,022.00,interest rate of *****%, term of 60 mos., with a payment of $321.33. The first payment was made on December 3, 2021, and the last payment was made on March 3,2022. You paid on this loan for 4 months before refinancing the loan because you needed additional funds to cover personal expenses.
On March 16, 2022, the previous loan was refinanced, the amount financed was $12, ******, at a *****% interest rate, for 60 mos., with a payment of $318.50. You made ten payments of which seven were made late and resulted in late fees being accessed to the account. The last payment made on this account was April 28, *********** refinancing the loan to obtain additional funds to cover personal expenses.
On May 17, 2023, the previous loan was refinanced, the amount financed was $13,359.97 at a *****% interest rate, for 60 mos., with a payment of $388.49. The first payment made on this account was July 21, 2023, and you have made five total payments on the accounts to date.
During the loan transactions all loan terms were explained, reviewed, and executed by you.Additionally, a copy of the loan agreements and disclosures were also provided at the time of loan closings. LENDMARK FINANCIALS 2022-10-20 !I was surprised to see that there were a few companies on my credit report that I didn't recognize. It looks like they put an inquiry on my file without me knowing, but this shouldn't be possible unless it's something approved by me first. I checked the U.S. Code and it looks like Section 604 states that all users must have a permissible purpose under the Fair Credit Reporting Act to obtain a consumer report. Can you please remove this inquiry from my credit file or provide me with documentation (physical proof) that you have a permissible purpose for it? I am rejecting this response because: my point is the company did not close the account when I informed them of the vehicle $4000 requirement to be fixed and I had half. They allowed it to sit from that time until I made my last payment in September. The vehicle had been tore up and you all were asked to pick up the vehicle months before my last payment. You all neglected the customer and her request when asked. You all allowed it to sit there to add interest. Then the ********** ** location also was closed and I was having to call surrounding places to make payments and funding options. The location and people whom I originally was dealing with that office closed without notice to the customer. It was a huge run around and dealing with different individuals and told different things each time regarding repairs..hint why I made a payment in Sept. They allowed my vehicle to sit way over a year before filing anything..even when the cx asked them to do so..I am seeing other individuals with this same issue with thus company. Lawsuits are filed and all as a result. I also have filed with magistrate ***** due to the neglect of the communication and availability to the company location loan was placed. The location closed and don't think it has reopened to this day. They were not on my last payment date.

I am rejecting this response because: a letter may have thought to have been sent but it was not received. I as well as many others were very much unaware. The letter posted only stated to call another location. I drove over an hour more than once to the location. You all still neglected to close a loan when I was denied for it to be fixed. The loan sat possibility because the location was closed and in Sept when I spoke with another location reason I made the last payment. I asked repeatedly to close account. Your company neglected to assist the customer to the best interest and save the customer thousands of dollars due to the closing and dealing if that location. My loan sat over year incurring interest. No explanation for that
