I am writing to express my profound distress regarding the sharing of my nonpublic information with the three credit bureaus by your institution. This act has resulted in the dissemination of inaccurate information on my credit report, causing substantial financial and emotional turmoil.As per 15 USC **** Section 602, I am *********** the protection of my privacy, which includes the accurate representation of my financial history. You entered an installment loan secured by consumer goods with Lendmark on June 5,2015. At the point of sale, you were provided with a copy of Lendmarks Privacy Policy to advise you of what information can and cannot be shared. As stated in the Reasons we can share your personal information section of the privacy policy it states:
For our everyday business purposes such as to process your transactions, maintain your account(s), respond to court orders and legal investigations, or report to credit bureaus; or as permitted by law. Does Lendmark Share? Yes. Can you limit sharing? No.
Lendmark has only shared the information which was outlined in the Privacy Policy.Should you want to limit the types of sharing, you can call ************ for further information or questions.
We have reviewed your account with ******************, which was charged off on April 26,2018, and subsequently sold to Plaza Services. Lendmark is no longer the owner of this debt. On November 20, 2023, we received the check from the insurance provider which was posted to the account and released the title to the collateral even though there was a remaining balance of $2430.48 left to be paid to satisfy the terms of the loan agreement. We recently refinanced our van through Lendmark (5 months ago). Twice now, even though we are on autopay, they have not taken their money. I called the first time and they said sometimes it takes a few days to process. It eventually came out. It happened again but this time it hadn't come out by the end of the week. So I walked in with cash and explained they hadn't taken my money yet and I wanted to make sure it got paid. They declined (on Friday, 3 days ago) and said, "we wouldn't want to double charge you. It's still processing in your bank" so I left. Then today they call my husband's work harrassing his employers as if we were at fault and hadn't been trying to pay them. Not once did they call us, either before or after I went in on Friday, over the weekend, or today. I called them to let them know the money hadn't been taken. I then brought the cash in and was told not to. IDK if they are trying to fraudulently rack up late charges or what but this is unacceptable. I have requested in writing that Landmark Financial at **********************************************************, contact me by mail only because the calls I was getting were excessive. My payment is due on 18th and I usually split the payment between my pay dates resulting in the payment being completed after the due date but the ***** in late charge is always paid. One call I got was two days after the due date and I asked if I could make a payment around the first and was told no and they cant carry my payment into the next month when I asked what that meant there was no explanation and then I asked if my payment would be report to my credit report if its not more than 30days late and I was told no. I made the payment and all payments since as I mentioned, split between pay dates which fall after the due date. the fact that I was told I couldnt and they couldnt carry my payment outside the month is deceptive and untrue. I sent a letter to this office asking to be contacted by mail only. I have a secured loan with Lendmark Financial. The branch I was located in, the ****** ********** branch, severely mismanaged my account. They were closed by Lendmark because of issues as this branch. I sought help from Lendmark at a nearby branch in *******. The managers diligently worked to do a three month deferral on my account to get it current (as it should have already been). I docusigned over 7 documents from March 2023 to November 2023. The "corporate office" was to have updated my billing and corrected my credit reporting. 6 months later, this has not occurred. It is negatively affecting my credit. The managers have escalated this repeatedly, no one will simply update this account!!!! I am furious as this has been going on for months and is not being taken care of!!! It is a simple accounting issue for the back office, but no one will take responsibility and fix it. The branch I work with now is wonderful, but their hands are tied. I need someone to fix this billing issue to bring my account CURRENT and correct all of my credit reporting to reflect NO DELINQUENCIES or missed payments. I do not accept this response. While the Lendmark corporation did finally process a deferral as promised months ago, the miscellaneous charges have not been removed, credited, or placed at the end of the loan. While my payment is now listed as current and due for the month of December, it is for almost $700 more than the monthly payment of $494.
This needs to be corrected immediately. I need confirmation that these extraneous charges, some of which were generated by improper billing in the ****** branch in March of this year, are all removed/deferred/or credits applied. My amount due should be the monthly regularly payment.
I will reserve judgment on the credit reporting issue until the 30 - 45 days have expired.

You entered an installment loan secured by consumer goods with Lendmark on January 09, 2017, amount financed $5500.18, at an interest rate of *****%, for a total balance of $10,089.60 to be repaid in 60 monthly payments. This account charged off on August 26, 2019,due to nonpayment as contractually agreed, with a balance of $5164.81 owed.
On September 11,2023, you contacted the Collection and Recovery Specialist requesting to settle the account. An agreement was reached that you would pay $2000.00, and the payment would satisfy your obligation under the loan agreement. Additionally,the tradeline associated with the account would be updated to report as settled for less than the full balance. The last payment made to satisfy the settlement agreement was made on October 5, 2023, please allow 30 to 45 days from this date for the credit reporting agencies to update the tradeline reporting associate with the account.

You opened a sales finance installment loan with Lendmark on March 8, 2022, with an amount financed of $1979.24, interest rate of 18 % for a term of 36 mos. On May 20,2022, you refinanced the previous loan, the amount financed was $2,625.44, in which you received $600.00 directly, and the interest rate *****% for a term of 36 mos. On September 1, 2022, you refinanced the previous loan, the amount financed was $3,785.23, in which you received $999.99 directly, an interest rate of *****% for a term of 48 mos. On December 5, 2022, you refinanced the previous loan, the amount financed was $5,032.02,in which you received $1,000 directly, with an interest rate *****% for a term of 60 mos., a payment of $181.78.
During each loan transaction all loan terms were explained to you, and you reviewed and executed the loan agreements. It was specifically expressed that any refinance where you would receive over $100.00 in direct funds would result in the forfeiture of the sales finance interest rate from the original loan prior to refinance.
