      We had our truck refinanced through our bank and the company landmark hasn't received yet. We signed a deferment to protect our credit and just found out that it was refused. We make our payments to our bank now but landmark has it showing that we haven't made our payments which reflects on our credit. We have talked to our bank about the situation and the check has been mailed out to landmark.This company is extremely rude!!We do not control how mail is delivered.Landmark is telling us that we are trying to pull a fast one on them. Our bank has talked to a woman at the location about what is going on.Let me just say this..Our payments are being made through our bank for truck which took over loan.And landmark is calling us with their ********.Get your business in order!!

      Thank you for bringing this matter to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.

      On July 8, 2022, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $18,282.76 which was financed for a term of 60 months with monthly payments of $525.74 due starting on August 8, 2022.

      On September 13, 2022, the co-buyer *********************, contacted Lendmark to advise that you both were working with a credit union to pay off this loan agreement. Lendmark followed up with you both on September 24, 2022, to inquire about the status of the payoff check as the September 9, 2022 payment had not yet been made and Lendmark was informed by ************** that the check was mailed by the credit union on September 23, 2022 and Lendmark should be receiving the check shortly.

      On October 5, 2022, Lendmark connected with ************** again as the September 9, 2022, payment had been reversed by the financial institution for insufficient funds and to check on the status of the payoff. During that call ***** advised he would check with the credit union to inquire about the status of the payoff check.

      On October 12, 2022, the credit union called Lendmark to advise the payoff cashiers check had been mailed on September 20, 2022. During that call Lendmark advised we had yet to receive the check and inquired if there was a way to get another check issued. The credit union advised that if the check was not received by October 20th,the credit union could put a stop payment on the check and issue another one.

      On October 14, 2022, through October 26, 2022, Lendmark contact you both several times to either acquire a status of the payoff or to complete a payment as a payment had not been completed since your first payment on July 29, 2022.

      On October 31, 2022, ************** hand delivered the payoff check to the Lendmark Branch and Lendmark applied the payoff check to your account.

      We understand that you have requested that Lendmark remove certain information associated with the tradeline for the Lendmark loan account referenced in your complaint that was furnished to the credit reporting agencies (CRAs) by Lendmark. 

      The Fair Credit Reporting Act requires that Lendmark accurately report information to the CRAs. As the account was 30+ days past due on the date the loan was paid in full, the information reported to the CRAs regarding your account was accurate, Lendmark is unable to accommodate your request.

      On 5/27/2022 some how I received 2 late fees of $ 25 totaling two $50 ! Lendmark received there money every due date ! The money probably wasnt available when there system went to take the money ! But I made sure it was paid on the due date during business hours.

      Our records indicate you entered a loan agreement with Lendmark Financial Services on September 9, 2021. You also authorized a recurring Automated Clearing House (ACH) transactions by signing a Recurring ACH Form to start drafting on October 23, 2021.
      On May 23, 2022, as the customer was on recurring ACH, a payment was pulled for the account and on May 25, 2022,the customer made a web payment on the loan. On May 27, 2022, Lendmark called the customer to advise the May 25, 2022, payment was returned, and an *** fee was accrued as a result. The *** fee was paid on 8/24/2022.
      On July 23, 2022, the recurring ACH payment was pulled for the account and the customer made a web payment on the loan, the same day. On July 28, 2022, Lendmark called the customer to advise the web payment made on July 23, 2022, was returned and an *** fee was accrued as a result, as well as the recurring ACH was cancelled. The *** fee was paid on 8/24/2022.
      As of November 1, 2022, you have an outstanding fee balance of $0 on your account.

      We got a loan from lendmark balance of $***** April of 2022 we started paying on the loan 600 a month ariginal payment is 268 so as of October we have paid over ***** on this loan over ***** went to interest on a ***** dollar loan which means barely nothing went towards the car when we started getting statements everything changed these lendmark is ripping us off I read the reviews and not one is good you put your trust and it was destroyed

      Your interest for this loan is calculated using the daily simple interest rate. This means that interest accrues on a daily basis on the unpaid portion of the principal balance. When you make a payment, the interest that is due from the date the last payment was received will be collected before any portion of the payment is applied to the principal.

      When reviewing the payment history of the account, Lendmark identified you have made all payments on time or before their due date and several payments were for amounts greater than the amount due. As of the date of this response, your principal balance is $4,708.30.

      Lendmark has mailed a copy your payment history to provide the ledger of account payment activity to show how the funds have been allocated.

      I received a call and when I answered it was very rude and telling me Im going to jail and my checks will be garnished but I called back they hung up on me so I called the loan company and they told me who to call which was a whole different company, I had a family emergency and I dont feel like anyone should be talked to like the way they do

      Thank you for bringing this to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.

      The customer, ***************************, entered into a loan agreement with Lendmark Financial Services on May 24, 2021. The customers original balance was $6,220.83 which was financed for a term of 60 months with a first odd payment of $299.21 starting on July 8, 2021, and $214.07 monthly thereafter.

      During the course of the loan, the customer was unable to maintain the payments as outlined in the loan agreement. Lendmark Financial Services continually worked with the customer and provided a payment deferral in the early months of the loan in August 2021, which extended the loan term. During any stage of delinquency, Lendmark Financial Services reached out to the customer to better understand their hardship of why they may have been having trouble maintaining payments, but as Lendmark received no payments from the customer, the customer ended up defaulting and the loan was charged off in April 2022 and subsequently sold to Plaza Services.

      Lendmark understands that you have requested that Lendmark remove late payments associated with the trade line for the above referenced loan. The Fair Credit Reporting Act requires that Lendmark accurately report information to the credit reporting agencies and as the information reporting to the credit reporting agencies regarding your account is accurate, Lendmark is unable to accommodate your request.

      Also, at the point of sale, the customer was given a copy of ******************* Privacy Policy to advise the customer of what information can and cannot be shared. As stated in the Reasons we can share your personal information section of the privacy policy it states:

      For our everyday business purposes such as to process your transactions, maintain your account(s), respond to court orders and legal investigations, or report to credit bureaus; or as permitted by law. Does Lendmark Share? Yes. Can you limit sharing? No.

      Additionally, the customer was provided with a credit disclosure in addition to the application, retail installment contract, and privacy policy. The credit disclosure outlines Lendmarks intentions as it relates to credit reporting:

      Fair Credit Reporting Act Notice: We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.

      Lendmark has only shared the information which was outlined in the Privacy Policy. Should the customer want to limit the types of sharing, they can call ************ for further information or questions.

      This company basically coerces people to borrow more money even when they say they cannot afford it. But that is another complaint. Today I am complaining because I have reached out to this company numerous times because they are report this account as a charge off on my credit report for 10 months straight and as you are well aware, a charge off is a one time event, they will not even respond to my attempts to have them correct it. I would like this account removed from my credit reports at once.

      During the course of the loan,the customer was unable to maintain the payments as outlined in the installment contract. During any stage of delinquency, Lendmark Financial Services reached out to the customer to better understand their hardship of why they may have been having trouble maintaining payments, but the customer ended up defaulting and the loan was charged off October 2021.

      Lendmark has completed an investigation into your dispute and can confirm your tradeline is reporting correctly with the ************************** The customers account shows as an account status of charge off, a date of first delinquency of March 31, 2021,and an outstanding current balance of $9,751.19.

      The Fair Credit Reporting Act requires that Lendmark accurately report information to the CRAs. As the information reported to the CRAs regarding the customers account was accurate,Lendmark is unable to accommodate the request.

During any stage of delinquency, Lendmark Financial Services reached out to the customer to better understand their hardship of why they may have been having trouble maintaining payments, but the customer has not made a payment on the account since October 13, 2021. There was a judgment awarded to Lendmark regarding this account in March 2022, but Lendmark has yet to receive any of those funds. 

      Lendmark has completed an investigation into your dispute and can confirm your tradeline is reporting correctly with the ************************** Your tradeline is reporting as 180+ days delinquent, with a date of last payment October 13, 2021, and a date of first delinquency of December 8, 2021.

      Im filing this complaint against ***************** financial because I found out that they put more of the payment to the interest instead of the principal which makes it hard for you to pay off the loan. I pay $232 a month on a loan that continues to go up instead of coming down. I am tired of paying this loan to Lendmark. Ive been attached to them now approximately three years going on four and it should not be that way. Please if someone could check into this, I feel it is a predatory lender and find out Why do they put more of the payment that you pay to the interest and not the loan not the principle of the loan. Because they are the only ones benefiting from getting money and we are not paying off the debt. Its a struggle please help us. Thank you .

      Thank you for bringing this to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.

      The customer, *************************,entered a loan agreement with Lendmark Financial Services on November 19, 2021,when they paid their previous loan by renewal. The customers original balance for the new loan was $6,060.11 which was financed for a term of 48 months with a first odd payment of $321.23 and monthly payments of $238.44, starting on January 3, 2022.

      The customers interest for this loan is calculated using the daily simple interest rate. This means that interest accrues on a daily basis on the unpaid portion of the principal balance. When the customer makes a payment, the interest that is due from the date the last payment was received, will be collected before any portion of the payment is applied to the principal. Therefore, if the customer is unable to make full payments on their due dates, they will have to pay more interest than they would have if they paid on time. It is even possible that if the number of days between the payments is too great, the amount of interest due may actually exceed the payment amount resulting in no reduction to the principal balance that month, as the entire payment will be applied to the interest due.

      Lendmark identified the customer made payments past their due date in January, February, and April ****************************************************************************************** June 2022, as the last payment received by the customer was on April *******, ****************** provided a payment deferral, which extended the loan term by 2 months and brought the customer current. However, the customer did not make another payment until July 29, 2022 when the due date was July 3, 2022.Furthermore, in August and September 2022, the customer has also made late payments resulting in late fees and greater interest accrual in between payments.

      As of the date of this response,the customers principal balance is $5,979.65, and the customer currently has $578.00 in outstanding in interest. Additionally, the customers outstanding daily interest per diem is $5.84 which will be the amount of interest that is added daily until a payment is made. Should the customer want to get the principal balance reduced, they should pay more than the outstanding amount of interest accrued. The payment will first go toward interest and any additional funds will reduce the outstanding principal balance.

      Furthermore, there is no prepayment penalty for this type of loan and if the customer wants to make more than the minimum payment, once the payment has first gone toward interest, the remaining amount and any additional funds will be applied to the principal balance.

      Attempted to contact the business and encountered a person by the name of ********. The purpose of my call was to inquire why the online app asked for an employer for which I entered but received an error message that the employer was invalid. In speaking with ********, she alleges that the application came thru. She further stated that based on Credit History, I would need a ********* or a Paid Off Vehicle as collateral. Immediately inquired as to how she derived at that decision considering that I always receive alerts when my credit is accessed. I didn't receive any alert and I further inquired as to the necessity of a ********* or collateral having just received a small loan from One Main absent those requirements. She promptly intervened to let me know that 'we are not One Main; but Lendmark' as if I didn't know the business that I was speaking with. I politely told her not to be insulting for which she just wanted to overtalk me for which I literally became angry and frustrated. Further she scolded me by saying she didn't do anything; but read what the requirements were, etc. Clearly, she was unable to properly answer my questions and when reminded her of her rudeness with the One Main comment, she angrily said that I was now making things up and that she was going to disconnect the call. After I said a few choice words, I disconnected the call.

      Thank you for bringing this to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.

      The customer, *******************************,filled out an application for credit with Lendmark by visiting www.lendmarkfinancial.com on September 13, 2022. At the time of application, in order for Lendmark to assess the creditworthiness of an application, Lendmark requests the customers credit report. This is fully disclosed up front at the time of loan application on Lendmarks website.

      When the application was returned from the credit reporting agency, the application is reviewed for adherence to Lendmark Underwriting Policy and Procedures. During a phone call conversation with the customer, ****************** reviewed the application and underwriting criteria that needed to be met in order for Lendmark to move forward the meeting the requirements of a loan.

      As the customer requested contact from the business, the Lendmark Branch manager reached out to the customer on Friday, September 23 but did not reach the customer and left a message. Should the customer have further questions out the process or still want to connect with Lendmark, we encourage the customer to give the ****************** Branch a call back.
