      I would like to file a complaint as of December 3,2022 I sign up for ******************** because Lendmark Financial Services charged me $1,797.60 because of my past due bills ******************** staff look up the history but couldn't find the information on Equalfax about my past due bills so as of December 12,2022 I looked up the History on Equalfax I saw that it has Lendmark Financial services History but it did not have more information about the past due bills it did not show anything for ******************** to see I do know that Lendmark Financial Services is hiding all the information from ******************** or other Credit Counselors to see the information on the Equalfax (credit report)

      Lendmark has reviewed your account and can confirm all calls have been made within Lendmark's policy. 

      Complaint #2: Along with knowingly working with *********************** 10 and under to trap someone in a whilst he commits vehicle fraud by selling and providing unreliable transportation.

      Lendmark rejects any accusations of knowingly working with a third party in order to defraud our customers. You willingly completed a loan application in order to secure an installment loan to purchase a vehicle from the dealership of your choice.

      You have requested that Lendmark stop repeatedly calling and leaving messages regarding your past due account. Lendmark has not made excessive calls as it relates to your past due account, however have notated your account to lessen the calls received.       They do not serve you a proper notice for garnishment of wages. I was told we would refinance my loan as well as fix my due date so that Rent and my car stuff are not all on the same time. I was told oh we served you at this, but I updated my address several times, I was not informed of their garnishment against myself. Also the car has had so many problems and they pushed me to work with this dealer i used only when i asked if there was another dealer in town i was told well you already talked to this one Company is a liar when it comes to working with the sick.

      Complaint Issue #1: They do not serve you a proper notice for garnishment of wages.

      On 10/31/22 We spoke with you about making a payment in order to stop the garnishment process. You notified us on this day that you had lost your wallet but would commit to making on time payments going forward in order to stop the garnishment process.

      On 11/7/2022 We spoke with you regarding the missed payment you agreed to make during the 10/31/22 communication and you informed us you were unable to do so due a medical emergency.

      On 11/17/2022 Your account was sent to the attorney to begin the garnishment process as we had been unable to collect a payment as you had promised.

      Complaint Issue #2: I was told we would refinance my loan as well as fix my due date so that Rent and my car stuff are not all on the same time

      Lendmark did a review of your account, and it was determined that due to your judgment status and the last payment date being made on 9/27/22 we would not be able to extend the option for a refinance. Several attempts were made by telephone to discuss further but we were unable to reach you.

      Complaint Issue #3: Also the car has had so many problems and they pushed me to work with this dealer I used only when I asked if there was another dealer in town, I was told well you already talked to this one

      Lendmark only processed the loan application you submitted and had no input on the dealership or vehicle chosen by you.

      You have requested that Lendmark process a refund on your account and after a review of your account it has been determined that a refund of any kind would not be warranted, to that end Lendmark is unable to accommodate your request.

      I am rejecting this response because:

      I did have a medical emergency in which I got hospitalized, I offered to provide proof. This hospitalization plus the loss of my wallet made me unable to complete my payment. This was not on purpose as when my wallet was taken I had to fight my bank to get my funds back and to be honest I am still waiting. During that time I had to move money around and now no one will communicate with me on how to go forward as this garnishment has become determinatal to my personal safety. I asked someone to work with me and I got no answers and I even reached higher then the branch manager that holds my account with no response.

      I am requesting a stop on my garnishment so that my payments can resume. As I am going on disability due to my illness...

      After contacting Lendmark and informing them of making a pay off payment within the next few days being agreed upon on both ends. Within 3-4 days Lendmark has contact both me and my wife 23 times multiple times a day, multiple different phone numbers and 4 different staff members. One of which demanding we contact them and was very rude towards my wife. I have documented the days, times, and staff on all of these calls. I am seeing this as harassment and am seeking resolution.

      On April 26, 2022, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $6,478.48 which was financed for a term of 54 months with a first odd payment of $237.20 due starting on June 2, 2022 and payments of $209.46, monthly thereafter.

      On November 8, 2022, Lendmark received an error message from your personal banking account due to non-secure funds for your November 2, 2022 payment. All prior payments had been made on time and Lendmark followed up with you to inform you of the transaction and to better understand if there was any hardship in making that payment. 

      On November 9, 2022, Lendmark had contact with *************************, the other party on the loan and Lendmark was informed that the account had personal banking account had recently closed and that you'd both be in contact with Lendmark to make a payment by the end of month or to pay the account off in full. 

      On November 29, 2022, Lendmark connected with you during a follow up call and you had informed us that you would be paying the account in full by the end of month. During that call, Lendmark gave you the payoff information. 

      Lendmark has reviewed the calls placed to both you and ****** and can confirm the calls on the account have been made in accordance with Lendmark policies. Lendmark encourages you to stay in communicate with your branch regarding your account.

      My husband (*****) and I purchased a metal carport from BlueRudge Metal Structures for $3402.43 on Sept 10, 2022 through Signature Homes. We chose to finance the amount with Lendmark (3 mos same as cash). According to Lendmark, Signature Homes had to be "put back in the system" before they could issue the check for Blue ******** continually contacted Lendmark to get status in order to get an install date for the carport. Every time I called Lendmark, I spoke to someone different and they would explain how long of a process it was taking. Within the last 6 weeks, I've called them at least 5 times. I was told 2 weeks ago that the money would be ready and that they would call us. We have NEVER received a call back from Lendmark for any reason. Our carport install was scheduled for last Friday, so I contacted Lendmark AGAIN to ask if the check would be ready. They claimed that it would be ready the next day. AGAIN, no phone call. Our complaint is that because of Lendmark's unprofessional business practices and the lack of customer courtesy, it caused us an undue hardship as we had to borrow the money from our savings account to pay BlueRidge upon completion of the carport install.

      The loan application would be in my husband's name....***********************. The branch we visited and had conversations with was at the Gloucester, VA location. As I stated before, I had to initiate all conversations as Lendmark never called us back as they would tell me each time I contacted them. Their responses progressed from "the person handling it is on vacation, we're working on it, got all the signatures, to should be ready today". It has now been a couple of weeks since I was told the "check" would be ready "today" and still no one has contacted us.  As I stated in the original complaint details, the purpose of the 90 day "same as cash" loan we (*****) were seeking was to install a metal carport from BlueRidge Metal Structures. The undue hardship was that ***** had to take the money out of his personal savings account to pay for the job, so he'll lose interest on that money he had to take out. It appears that Lendmark NEVER intended to give ***** the loan and just lied to us. We do not intend to call them back and we will not recommend them to anyone for a loan. VERY UNPROFESSIONAL!

      The process of receiving the loan was started well in advance (Sep 10, 2022) to be able to pay the contractor to install our carport. Because Lendmark didn't follow through with the loan in a timely manner (after several attempts on our part with several agents), *********************** had to get the funds from his own personal savings account. The carport was installed on Nov 14, 2022 and the contractor (BlueRidge Metal Structures) was paid in full.  WE NO LONGER NEED OR WANT THE LOAN FROM LENDMARK!!!!  Cancel the loan!

      The exact bank location of Lendmark Financial Services that previously held our auto loan does not auto-populate/pull up on the BBB website, so we chose one that did pull up. The exact location to the Lendmark Financial Services that previously serviced our auto loan is *****************************************************************************. We had Navy ******************** refinance our auto loan from Lendmark and they never sent the title to Navy ********************. Lendmark Financial Services told us multiple times that they had, as they are legally supposed to since Navy ******************** now services the auto loan and paid Lendmark Financial off. Fast forward months and months later, Navy ******************** still has not received the vehicle title, and as a result, our auto loan has been converted to a much higher interest rate and monthly payment. We have done all that we can in our control to get Lendmark Financial Services to send Navy ******************** the auto title and do not know where to go from here. Do we call the police on them? Can BBB help with this? Lendmark has been very shady in the past when we call and they hang up when we inquire about this. Please help, Lendmark Financial MUST be held accountable for this.

      The due date for my auto loan is each month on the 12th, however I was charged a $3 late fee when I made a prepayment early on the 11th.Last month when I paid my loan on the 11th I was not charged the late fee because my payment is only due on the 12th.This month, when I made a payment one day early I was charged a $3 late fee.

      On September 12, 2022, you entered into a loan agreement with Lendmark Financial Services. The $3.00 charges you are referring to in your complaint are not late charges but maintenance fees. As part of that loan agreement you signed, the account maintenance fee is outlined as followed:

      I agree to pay an account maintenance fee of $3.00 for each month of the scheduled repayment period of this note. I acknowledge that the fee is included in the payment amount shown in the payment schedule on page 1 and the total of account maintenance fees for the term of this note is included in the Finance Charge as disclosed on page 1. In the event this note is prepaid in full, I will receive a refund of any unearned portion of the account maintenance fee as determined by the Rule of 78s. The account maintenance fee will not bear interest. If there is no total of account maintenance fees shown on page 1, this provision shall not apply.

      I have an auto loan with Landmark Financial. I began having health issues soon after obtaining the loan and tried to work with my branch with nothing but rudeness in return. In July 2022 my car broke down completely. I called and spoke with ******************* and gave her the location of the vehicle and gave permission for them to reposses. Ms. ******** refused and stated I would need to bring the vehicle to the office. I explained the car was not drivable. She laughed and said she couldn't help. I began having health issues soon after purchasing my car and called the office several times only to be met with rudeness. I explained I had hospital and doctor records to prove this and still received no helpful assistance, however they have found the time to report me to the credit bureau each month. I filed a complaint against the Bristol branch and was assured upper management would contact me, but I haven't heard from anyone. I am disabled, recently widowed and this company is causing major emotional and financial issues which I will take up with Legal Aid.

      On September 21, 2020, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $7,087.75 which was financed for a term of 48 months with a first odd payment of $337.99 due starting on November 3, 2020, and payments of $263.46, monthly thereafter.

      During the course of the loan,you have been unable to maintain the payments as outlined in the installment contract. Lendmark Financial Services has continually worked with you and provided payment deferrals in May 2021, July 2021, September 2021, and May 2022, which extended the loan term. During any stage of delinquency, Lendmark Financial Services reached out to you to better understand their hardship of why they may have been having trouble maintaining payments.

      As you have advised that you are interested in surrendering the vehicle, and have provided the location of the vehicle, Lendmark has assigned your account to review the status of the loan and vehicle for potential repossession. If you are interested in having the vehicle reviewed for repossession sooner, you are welcome to transport the vehicle to your local Lendmark Branch.

      I offered numerous times to provide documentation from hospitals and doctors offices to show why my payments were not being fulfilled.  ***** blatantly told me they weren't interested and the last time I spoke with ************ offered to provide them.  ***** girls are just covering their own tracks.  They have been made aware of my health issues since 2021.  Also, since ***** informed me that I had disability insurance on the loan, why is she not accepting my medical documentation??  That, sir, is being far from helpful and cooperative.  Also, if you can inform me how to drive an undrivable vehicle to your office, please advise.  Again, an instance of your company's stubborn and extremely unprofessional behavior.  I have requested TWICE, through your corporate number, to have *****'s manager contact me.  NO RESPONSE....yet you tell the BBB you are being cooperative.
