I had been consistently making payments on an old collection. I lost my job mid November and I called Blitt & Gaines to inform them that I did not have a source of income and I would not be able to make payments. This was on December 20th. I informed them that as soon as I was able, I would pick my payment up again. I was able to get a job the beginning of January, but my first paycheck was small and had to pay past due rent. I have been donating plasma to get by. On January 22, Blitt and Gaines sent a snap shot levy to my bank account, taking the little funds I had in there for my gas and light bill. This left me with a negative account balance and not enough money to pay my rent for this coming up month. I called and they said they tried to call me several times. I had only ONE voice-mail from them from the week prior. I received nothing in the mail regarding the levy and now my finances are even worse off, right when I was getting back on my feet. This balance started off at $1300 and it has been paid down to $392. It is obvious I was making an honest attempt to handle this debt. The companies that hired them to collect the debt are multi-million dollar companies, yet they act like bounty hunters over $392? This is how the rich stay rich, and the poor get poorer.Business Response

I received a letter from Blitt and Gaines P.C. which on the outside says "ATTORNEYS AT LAW", but on the inside says "Blitt and Gaines, P.C. is a debt collector." I believe this is wrong and goes against the ****** as its a manipulation tactic to make someone believe you are an attorney when you are actually a debt collector. This is abusive and a purposeful misrepresentation. Any mailing from an attorney needs to be separate from a collections agency. This is a fear mongering attempt to manipulate people. I order Blitt and Gaines, P.C. to cease and desist, and terminate any account thats has my name on it or information attached.Business Response

I am rejecting this response because:I did not receive validation letter in January. Send proof that one was sent.
Furthermore, the correspondence I received from Blitt & Gaines said I had until Feb. 5th to respond. A negative account was reported to the credit bureaus under my name before Feb. 5th. I demand this report to the credit bureaus be removed in its entirety.
Further still, see attached documents. The outside of letter I initially received from Blitt & Gaines says "Attorney at Law", while the letter inside says Blitt & Gaines is a collection agency. This is purposeful misrepresentation. I demand a cease and desist.

I am rejecting this response because:When I received the letter from Blitt and Gaines (per my attachment), it was unclear whether Blitt and Gaines Attorney at law, or Blitt and Gaines ****************** were contacting me. Whether they are part of the same company doesnt make a difference to me. What does, is who is trying to contact me. Is it the collection agency or the attorneys? I dont believe its right or fair to have Attorney at Law on the outside of an envelope, when its the collection agency thats on the letter itself.
I also believe I should have been given until Feb. 5th, as the letter from Blitt and Gaines indicated, before a negative account was reported to the credit bureaus. Blitt and Gaines and ******************** should be on the same page about these dates before sending them to me.
I do not see any attached validation packet. Please attach and resend.
I never disputed this account. Remove dispute from credit reporting. Ive only asked for validation of debt. I need to know for sure that this debt was my responsibility. Remove dispute from reporting, as that is false information.If this account can be validated as mine, I would be pleased to come to an agreement for complete deletion of account, which includes complete deletion from the credit bureaus.

I received letter from Blitt and Gaines that they are attempting to collect a debt in amount of ********* for ******************************** stating that I used a WebBank account . Only problem is I do not know or have an account with ********************************, I do not know what type of company they are and I do not have a WebBank account. The reference number they gave me was ********. It is interesting that they did not have my legal name on the invoice, I was married in 2018 and changed my name to **** at that time. The name on the invoice is *******, I have not been a ******* since 2018. Also, they do not have my billing address on the invoice, they used my physical address. My town does not have postal service, we use PO boxes for mail delivery. The only reason I think it was put in my PO box was because it was from an attorney. My credit card and bank statements come to my PO box. I did loose a debit card in ********* last year, it had my former name on it, but no address, and I called the bank and reported it and had the card canceled.Business Response

I am rejecting this response because: this debt does not belong to me. I am requesting the forward flow and purchase agreement. The actual copy and not photo copies of a complete audit trail calculation of this balance that you are trying to collect. The agreement that grants you authority to collect on this alleged debt. Documentation that shows i agree to pay this debt with my ink signature binding both parties and documentation shows I gave you permission to have my information and paperwork showing i gave you any authorization to. No consent to having my information and unauthorized use of my social security number is identity theft and you will be reported as such. The affidavit of corporate authority (who from the board of directors appointed you to represent the company you are trying to collect on behalf of?) A copy of your state license including license number that gives you rights to collect in my state. Until you can provide sufficient proof I am asking that you cease and desist all collection efforts on any account that you have in my name. Cease and desist all collections efforts such as communications by phone, postal Mail, text messages, social media, email, until sufficient proof has been provided. I spoke to ********************* about a garnishment that was put on my wages for credit card debt that I didn't do. I disputed with Experian and she lied and said they never got anything. And they are not trying to remove it. I want the judgement removed because I was not notified and I didn't make the debt. I sent a police report and a cease and desist letter. 6/5/2023 I received a letter from B&G showing that I paid to date $20,100 to them and the balance due is $9293.74. I am rejecting this response because:My mother is 83 years old, has expensive medical bills and medicine. And has paid already $20,500 on this bill.
She has been paying this bill for 10 or more years and she has not received any statements from Blitt and Gaines explaining the interest rate, total amount due, amount paid and fees until receiving the letter attached to this email. How are you able to find out what is due if the company doesnt send out that information but expect people to just continue paying based on good faith.
She did receive the judgement Jun 30, 2009, showing amount due of $13124.62.
A letter dated 11/8/2016 showing a balance of $17118.26.
A letter not dated but shows a balance of $14,645.83.
Blitt and Gaines only call or contact if a payment is missed.
Per your letter the outstanding balance is $9070.58, where did this figure come from? One letter even mentions a settlement amount that Blitt and Gaines wanted to work out. How can we settle if you kept charging interests.
The $16105.96 has been paid. She has paid you $20500 to date.
You stated in the letter the original amount of the judgement with interests, $16105.96, this isnt true,the judgement amount is above. Nowhere do you show or provide a valid explanation for the remaining balance.
Id like this debt to be considered as paid in full.

On June 22, *************************************************** since 2021 in a credit resolution case. They informed me that a judgment had been entered against me resulting from a failure to appear in a court case concerning an account they were negotiating on my behalf. Upon checking the local court records I found that this law firm claimed to the courts that I was served a summons regarding this case. In the court records the firm claims to have delivered the papers to someone at my physical address, however the physical description does not match my physical description at all, the personal service does not note that identification was checked upon delivery, they do not note that any signiture was obtained for delivery. Furthermore this firm also claims to have mailed papers to the firm representing me, however that paperwork was never received. This law firm has managed to obtain a default judgment against me due to my failure to appear and have obtained an order to have my wages garnished through my employer as of May 30, 2023. My claim is that this law firm falsely obtained this judgment and in fact never actually delivered any paperwork physically to my residence nor by mail to the company representing me. Now that I am aware of these precedings I have filed papers with the court on my own behalf and had to spend time and money to resolve a situation I should have been aware of in July of 2022.Business Response

I am rejecting this offer because Blitt and Gaines has shown they are not willing to actually work with me in this matter. Yesterday I spoke with the representative Mr ********************************* and asked if we could discuss a settlement to resolve this issue. ********************* informed me he was not able to discuss any settlements with me. The firm Blitt and Gaines continues to use the courts to threaten and bully me, they have lied stating to have served and mailed papers when they have not. They have declined any and all offers made on my behalf to resolve this issue and come back with the same unreasonable offer of their own to settle. I am not in any position to take on a large ******* based law firm financially and I believe they are taking full advantage of that. It is in my best interest to settle this matter but the facts are I cannot afford to do what they are demanding, this law firm is using this to their advantage to strong arm me into an unreasonable settlement. I would be happy to discuss a settlement in this matter and work with Blitt and Gaines to come to a reasonable settlement that I am able to responsibly fulfill in a timely manner.

Their payment processor is a complete joke. It's a good thing we take screenshots, that show when we made a payment in their system -- so far 3 payments have been flagged as fraud by our bank, even after we've called the bank to let them know we're making the payments to this firm. Then, when the suspected fraudulent payments are returned, they don't attempt to contact you -- they just file with the court claiming you're in breach of contract, that you haven't fulfilled your payment obligations and they want the full balance.
