On 5/3/2024 I attempted to contact Blitt and Gains, P.C. to engage with them about an outstanding collections balance they have with myself and my spouse. The representative "***" that i spoke with was argumentative and cut me off multiple times during our conversation and when i attempted to tell him that I was also recording the call for verification he yelled through the phone that i did not have authorization to record the call. I am interested in getting my account resolved however i will not be abused and screamed at through the phone if this is the desired contact Blitt and Gains wants to have with individuals i would rather meet them in court where they will be held to a professional standard.Business Response

This is a collection company that I was attempting to work with to clear a debt. A proposed payment plan was presented to them by me over the phone. I was told that they would have to determine if they would except this and call me back. I never heard back from them until being served with paperwork telling me that they are suing me. I called them again and was told they made ONE attempt to call me, left no message because they do not do that and then no other attempts. According to my own research this is a very common practice for company, it allows them to obtain summery judgements against their debtors. I was told on my call that they do agree to my plan, however now they are using the slowest method possible, **** standard mail, to send me an agreement form to sign and send back so that they can send it to the court and stop the lawsuit. However in ******* there is only 20 days in which this can be done. This will likely allow them to obtain a summery judgement against me. I am disabled and can only get part time work. Can not afford an attorney to deal with this. It would be more than wha this company wants from me.Business Response

I was taken to court and we settled on an agreed arrangement for checks to be taken out on 2/2/2024 and each month thereafter for a year. Everything was agreed on and signed by the judge. I received a letter soon after 2/1/2024 stating that my check from 1/22/2024 was returned. We did NOT agree to 1/22/2024, we agreed on 2/2/2024 per the court statement. I've tried to reach out to them using their secure messaging system as I want everything in writing from now on. I never received a response after attempting to reset the automatic payments since it seems they have canceled the entire series. I went to email them again and everything in the secure inbox had been deleted, even sent messages. I'm not able to send a new message through their system either. I'm glad I printed off the message I sent through that system with timestamps on it just in case. I do not want to contact them via phone since I want everything in writing and they will not respond and I continue to see penalties and fees on my credit report. This is extremely frustrating.I've even tried reaching out to the company that owns the account and I keep being directed to Blitt & Gaines.Business Response

My issues with Blitt's and Gaines is the same as all of the other's, one would think that after losing class action that they would want to do business Right. I have talked to Blitt and Gaines twice attempting to set up payment arrangements and both times told to call back if my company don't show up in court. I don't feel that my company needs to be involved, and believe that my character speak for itself, because I have had arrangement with this company before and paid 100%. I also feel that since January 18 when I called and attempted to set up the arrangement, if they would have taken the money I would almost be done. The in Justice that I think that Blitt and Gaines is doing to me and others is that there actions continue to lower consumer's credit scores,Business Response

On or about the 12 of February 2024. I was served with collection papers by Blitt & Gaines, P.C.I then contacted them and worked out an agreement to pay the outstanding debt. They verbally agreed to begin auto drafting my checking account beginning on February 23, for the amount of $185.00, and would continue debiting my account on the 23 of each month for the same $185 until payoff of the account. Due to a clerical error on their part they took the first payment a full 10 days before the agreed upon date, causing financial difficulties. Then they emailed a payment agreement outlining the original agreed payment schedule that I was to print, sign and fax back. This agreement contained flawed terms, including wrong payment amounts and incorrect payment dates. I called them to address my concerns with the inaccuracies and was told Its fine, ************ and fax it back. Which I did. After returning the agreement via fax, their company rejected the agreement, due to the inaccuracy, and has now sent a second email with new details. I called today (03/06), and was informed that without a second signed response, they would take everything to court and tell the judge that I refused to pay or cooperate.Business Response

The inaccuracies of your staff do not recuse you from your obligation. The debt has been paid as of today. It is my hope that you adjust your procedures to better serve your customers. Had it been me that was incorrect or had produced such an inaccuracy, there would have been ramifications and I would have been held financially responsible.

Since 7/6/22 my ********************************** has been receiving letters from Blitt And Gaines, PC regarding garnishing wages for *********************. There are 2 businesses located at ***************************. I have notified Blitt And Gaines numerous times supplying them information for **************** stating, he has never worked for **************, that he worked for ************* in the same building no relation to **************. I did the leg work for them and told them he started work at ************* 7/29/13 and terminated 4/21/17 he was a 3rd shift ********, his last known address is ************************************. After the 3rd letter I spoke to ***** S******* on 1/30/24 @10:39 am. Gave her all the information I had again and have not received any replies to my emails. I was told this is going to the correct department and ************** Corp., will be cleared for the collection of ****************, and ************* will be contacted. I did receive an email on 1/31/24 from ******************************* that this case will be dismissed. I am still receiving Letters from them for collection. These letters are supposed to go to ************* where he was employed. For some reason this company cannot to their job and is unprofessional. In accordance with the Fair Credit Reporting Act. The List of accounts in the files provided has violated my federally protected consumer rights to privacy and confidentiality under 15 USC ******* U.S.C **** section 602 A. In late January I was informed by my employer that they had received a letter saying that they had to restart a garnishment. Firstly I had received no notification no paperwork no mail in physical forms. This company had tried to garnish last summer. I was in a payment plan with a legal group since 2019 and Blitt and Gaines tried to piggy back onto this. I was paying ****** a month to resolve old issues. I contacted the legal group I was with and Blitt and Gaines took off the garnishment or a lawyer did. They were told that they could not double dip on a debt. Months have gone by and things were quite. Then with no notification no paperwork no mail in physical form. No summons nothing. My HR representative informs me that they had received a letter telling them to restart garnishment. My business with the legal group whom I paid from 2019 to 2023 had concluded. Then these characters are after monies not owed to them for which I've paid to someone and concluded business with. Blitt and Gaines goes around my back completely with no form of notice in any form and goes straight to my employer! This cannot be legal and from what I've read about their business practices is somewhat shady at best. They have had multiple complaints for exactly this practice. I am currently my father's caretaker and POA. What his social security doesn't cover for expenses I do. This unfair and I feel illegal garnishment is now affecting myself and by proxy my father. This garnishment needs to stop now !!! And these people need to be out of business.Business Response
