I called Republic Finance and paid off my loan in full plus interest last month, then on 9/17/2023 they reported to my credit report that I am delinquent with a $0 balance. I also sent them a copy of my Active Duty Orders showing that I'm deployed overseas and that I'm covered under SCRA.Business Response

("Republic Finance") to provide excellent customer service and

allow this to serve as Republic Finance's response to case #20617813. As requested by the BBB guidelines, we have

consumer as "the Consumer."
Upon
receiving his complaint, Republic Finance immediately investigated the Consumer’s
statements made therein. The Consumer states he had requested a 6% rate
reduction on his loan pursuant to the Servicemembers Civil Relief Act (“SCRA”), 50 U.S.C. Appx. §§ 501,
et seq. It is Republic Finance’s policy to fully comply with both the letter
and spirit of the SCRA and to provide relief designed to aid those
Servicemembers who are called to duty in the armed forces. Republic Finance’s
records show that it received the required documentation from the Consumer to
process his request and that his request was approved and processed on
September 26, 2023. The interest rate on the Consumer’s loan has been reduced
to the 6% ceiling rate as of the date of commencement of Active Duty or
deployment in accordance with the provisions of the SCRA.
As a part of its investigation, Republic
Finance agrees with the Consumer’s desired resolution to correct his credit
report. Republic Finance will mail a letter under separate cover to the
Consumer detailing the aforementioned actions and considers this matter
satisfactorily closed.

On 1 September 2023 I paid a bill of 540 dollars to Republic Finance. I expected a receipt to be in the mail, but I never received it. I've called numerous times and they seem to think it's a joke. They keep telling me it's in the mail, but as of 14 September 2023 I still haven't received it. It does not take that long to send a receipt through the mail. They seem to think it's funny. From what I have seen so far with this company is that they been straightforward with me up until now.
They do call a lot everyday, about 10 calls a day which is technically harrement.
Fast forward, I spoke with the call center about a week ago. The person I spoke to, I told her as I told everyone else I talk to every time, is that I got into a car accident in December and that has really set me behind after that. She asked me if I could pay $14.00 by August 31, 2023. I told her I would try to make that payment but was not sure. I am really behind on my other bills such as my electric bill which right now is a little over $1100.00 and all of my other bills are behind as well. She stated for me to not let it get charged off and never stated they were in the process of filing a court summoning. Thinking that was going to be it was absolutely false. Yesterday August 24, 2023 I had paperwork at my door. When I called the center to to tell them I was not notify when I spoke with them. I am struggling so bad with financial hardship I just do not know what to do anymore.Business Response

I had no income from October 2022 to March 2023 and was (and still is) waiting to receive unemployment.
I immediately contacted Republic Finance to make them aware of my job loss and advised them I could no longer make my originally $360 monthly payments so they ran my credit and advised me they could refinance my loan and payments wouldn’t be due until January 2023.
I made a payment in January and February of 2023, however I was still experiencing financial hardship and waiting to receive unemployment so I defaulted once again.
I started back working March 2023 and was hoping I would be able to start back making payments but there was a significantly decrease in my salary.
Throughout all of this, I remained in contact with the branch manager, ******** with my last conversation taking place on 7/28/2023.
She informed me the Plano branch was closing and my account was going to be transferred to another location and I would receive my new account information via postal mail.
On 8/21/2023, I received a citation stating I am being sued and I NEVER received a call to discuss my account or any information in the mail from the new branch regarding it.
The documents show my account was transferred to the new branch on 8/5/2023 and the branch took legal action on 8/18/2023.
I hate my circumstances is the reason I fell behind on payments, but the new branch didn’t even make an effort to speak with me before filing a petition. I prefer to settle the account without the court being involved because prior to things changing, I had a very good rapport with my original branch.Business Response

Consumer by telephone to discuss this matter on August 23, 2023, August 24, 2023,
and August 30, 2023 but was unsuccessful in his attempts. Republic Finance
mailed a letter on August 30, 2023 to the Consumer requesting that she return
our calls to discuss this matter in detail. As of the date of this response,
the Consumer has not contacted Republic Finance.

Republic Finance’s, RVP (******), has not contacted me at all and definitely not on the days included in his response.I spoke with ****** at the Mesquite branch and she confirmed no one from that branch has contacted me but it’s noted the RVP has.
The information the company is providing is just untrue and although I am liable for the debt that is owed, failing to contact to discuss my options and make arrangements was not given to me — instead they decided to file a lawsuit.

A payment was deducted that should have not been taken from my checking account cause if my balance to be zero which cost me insufficient funds payments in 4 transactions which would not have occurred if payment had not been taken as requested. I was refunded 1 I suffer fund but the payment was not in need of insuffice t fund payment when it was deducted. All transactions coming from my account totaled 4(-1) that I was refunded. But I should be refunded the additional 3 that I was charged BECAUSE Republic deduced the fund when they should have.
Branch manager 99 was helpful I. Saying he had checked but could not refund me because of cooperate specifications.

I got a loan from this company on July 12th of this year.Jose said he was making copies if all the paperwork for me,but when I got home and looked over the forms I noticed a charge 79.45 for insurance. I have several accounts that are charge off's. The IRS clearly defines a charge off as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes your reporting of this account inaccurate! By Definition The IRS Clearly says a Cancelled or Charge off is income. The reporting of this account as a debt is inaccurate. The lender must file Form 1099-C and send a copy if the amount of debt canceled is $600 or more and the lender is a financial institution, credit union, federal government agency, or other applicable entity. Fair Credit Reporting Act (“FCRA”), Republic Finance is obligated to
investigate credit disputes that are complete and meet certain
requirements. According to the FCRA, a
dispute notice is complete when it is submitted in writing directly to the creditor
(i.e., not through a private, non-profit organization such as the BBB) and
includes the following: (1) sufficient information to identify the account in
dispute (e.g., consumer's full name, address, telephone number, and account
number); (2) the specific information that is being disputed and an explanation
of the basis for the dispute; and (3) all supporting documentation or
information to substantiate the dispute, to the extent available (e.g., a copy
of the relevant portion of the consumer report that contains the allegedly inaccurate
information, a police report, a fraud or identity theft affidavit, a court
order, or account statements). Therefore, Republic Finance has determined the Consumer’s
credit dispute is incomplete because it does not meet all of the three
afore-mentioned requirements. If the Consumer
has any additional information to satisfy the requirements set forth above, he

I have called and left 2 voicemails asking them to stop the payment scheduled for this coming Friday, July 28th. I informed them I have obtained an attorney and I am currently in an active bankruptcy case. I simply asked for the payment to be canceled now thst im in an active case and to let me know when it is cancelled.
