      AmeriFinancial Solutions (AFS) does not claim to have a contractual relationship with the consumer. AFS is a collection agency collecting a bill for services rendered to the consumer. The consumer's account was placed with AFS for collections. The account is not being reported as being owed to AFS. AFS is furnishing data on behalf of the company that provided services to the consumer. If the consumer looks closely at the credit report it will indicate the name of the provider of services. When the account was placed with AFS the consumer was sent a letter explaining the debt. As a courtesy a request has been made to have this account removed from the consumer's credit. AFS does no control the amount of time it takes for the credit bureau to honor such a request. AFS looks forward to assisting the consumer. AFS can be reached at XXX-XXX-XXXX.       I have been requesting this your company provide me with validation of this alleged debt for clarification but I have not yet gotten any information as yet. I want to know what information the company possesses for I am worried that my personal information has gone into the hands of the wrong person and been used for their own interest.       The debt in question is for services rendered by the provider listed on document that was sent to the consumer. That document lists the name of the individual who rendered care, the facility at which the care was rendered, the date service was rendered, description of the service, CPT code, charge for the service and balance. That document was supplied to this office by the provider. If the consumer wants a copy of his medical record for the date of service, the consumer may contact the facility as the facility would be the custodian of that record. In a previous dispute the consumer claimed that the account was paid by insurance, there has been no insurance payment on the account. If the consumer is now claiming ID Theft, can the consumer supply a copy of a police report or other documentation. AFS looks forward to assisting the consumer so that this matter can be resolved.       I received emergency services at Four Corner hospital in Clermont Florida. My insurance didn't see the second provider nor did I. I was immediately sent to collections by Emergency Phys. of central Florida LLp Medical Health Care.) They have put me in collections and won't consider the bill paid by my insurance company. When I try to call with this with the payment paid on 7/2021, they say payment not received of $1543.00. They harass me and try to embarrass me with the collection's tactics, and I am furious! Please help me! I don't deserve to be in collections for this!

      The consumer's case description includes inaccuracies. The consumer was not immediately sent to collections. The consumer indicates that the account was paid on 7/2021, but the date of service was 11/2021. The consumer called AFS indicating that insurance paid this bill, since there was no record of a payment being made the consumer was asked if she would supply a copy of an insurance Explanation of Benefits (EOB) showing how the claim was processed and if payment was made. In response to the consumer's call a request was made to the credit bureaus to have this account removed from the consumer's credit. AFS made the request but does not control the amount of time it takes for the credit bureau to remove an account. Is this account still showing on the consumer's credit? If so, what credit bureau is still showing the account? AFS has made no attempt to harass or embarrass the consumer. AFS attempted to work with the consumer in resolving this issue. AFS has complied with the consumer's desired resolution by requesting that the account be removed from her credit. Furthermore, the account has now been closed.

On or about 2/21/2022 AFS posted a response to 2/15/2022 BBB complaint, on or about 6/8/2022 posted a response to the 6/6/2022 complaint and on or about 10/6/2022 posted a response to the 10/5/2022 complaint.       this tradeline has been created by unfair and deceptive means, in order to compel me to pay a debt which I do not owe. they have used my social security card as a matter of unauthorized use in order to create this tradeline on my consumer report where I receive no benefit violation 15 USC 1602p. which shall be punishable under 18 USC 1001 as they have submitted falsified documents to consumer reporting agencies in order to furnish this information as I never had any preexisting contract which obligates me into any agreement with this company. this is a form of extortion since they Knowingly used my personal information without my consent making an extortionate extension of credit which shall be punishable under 18 USC 892. I demand you cease and desist all collection activity and delete this fraudulently created tradeline from my consumer report. as the furnishing of this information is false and deceptive to begin pursuant 15 USC 1692j

      The statutory sections that are quoted by the consumer have no relevance as it relates to the bill in question. 15 USC 1602(p) The term "unauthorized use," as used in section 1643 of this title, means a use of a credit card by a person other than the cardholder who does not have actual, implied, or apparent authority for such use and from which the cardholder receives no benefit. "18 U.S. Code § 1001 - Statements or entries generally (a)Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States...." Deals with lying to the federal government and is not applicable. 18 U.S. Code § 892 - Making extortionate extensions of credit. The subject matter of this debt is services rendered to the consumer. There has been no unauthorized use of the consumer's social security card. AmeriFinancial Solutions (AFS) does not claim to have a contractual relationship with the consumer. AFS is a debt collector acting on behalf of its creditor client. AFS did not in any way use the consumer's personal information without the consumer's consent making an extortionate extension of credit. 15 USC 1692j is also not applicable. There was nothing fraudulent in the way AFS went about attempting to collect this debt. AFS acted in accordance with all applicable laws, but after a review of the account and as a courtesy to the consumer a request will be made to the credit bureau to have account XXXXXXXX removed from the consumer's credit. AFS does not control the time it takes for an account to be removed once a request is made.
