I'm making this complaint because I checked my credit reports and saw a reporting from AMERISOL on Dec 31, 2022 and as allowed under the Fair Debt Collection Practices Act (FDCPA), I am requesting that the debtor validates the alleged debt. I was not aware that there was a debt from PHOENIX EMRG MED BROWARD LLC for a 2017 date of service and I was unaware of any amounts owed. I never received any bill or a breakdown of any fees owed as the establishment is permanently closed.
Additionally, I am allowed under the Health Insurance Portability and Accountability Act (HIPAA) to protect my privacy and medical records from third parties such as debt reporting agencies. I never gave permission to PHOENIX EMRG MED BROWARD LLC for them to release my medical information to any Third party such as AmeriFinancial. I am aware that the HIPAA does allow for limited information about me but anything more is to only be revealed with the my authorization. Therefore my request is twofold-validation of debt and concerns about a HIPAA violation. Please respond with a breakdown of fees including any collection costs and medical charges. Provide a copy of my signature with the provider of service to release my medical information to you.
As required by law, you will cease any credit bureau reporting until the debt has been validated by me. Please send this information to my address listed as my formal debt validation request, which I am allowed under the FDCPA. Please note that withholding the information you received from any medical provider in an attempt to be HIPAA compliant can be a violation of the FDCPA because you will be deceiving me after my written request. I request full documentation of what you received from the provider of service in connection with this alleged debt.

The consumer's account was placed with
AmeriFinancial Solutions (AFS) on 7/13/2017, At that time a validation letter
was mailed to the consumer and that letter was not returned. On
9/10/2017 a second letter was mailed to the consumer and that letter was not
returned. Pursuant to the applicable section of the FDCPA the consumer’s
request for validation is not timely, but in the hope of resolving this matter
documentation will be mailed to the consumer that will enable the consumer to
understand the nature of the debt. The consumer will also be provided with an accounting of the
information that was received from the provider at the time the account was
placed for collections. AFS does not have the consumer’s medical records. In accordance with the Health Insurance Portability and
Accountability Act (HIPAA) a health care provider is permitted to release
Protected Health Information for treatment, payment, or healthcare operations.
According to www.hhs.gov the term “Payment” encompasses the various activities
of health care providers to obtain payment or be reimbursed for their services
and of a health plan to obtain premiums, to fulfill their coverage
responsibilities and provide benefits under the plan, and to obtain or provide
reimbursement for the provision of health care. In addition to the
general definition, the Privacy Rule provides examples of common payment
activities which include but are not limited to billing and collection
activities. A provider does not need a consumer's consent to place an account

It has recently been brought to my attention that AmeriFinancial was reporting an account to all three Credit Bureaus. TransUnion and Experian have removed this account in good faith, since they did not find sufficient evidence to validate it. However this account is still showing on my Equifax Credit report. This account has made it impossible for me to rebuild my credit and rent/purchase a home. The financial burden of this account is holding me back from being able to afford continued medical treatments. I have not received a letter validating the alleged debt and do not think that it has been sent to the correct address. Furthermore I dispute that this is a debt that I owe. My correct address is the one attached to this complaint. I would have disputed it from the beginning if I had received the proper documentation. I request that this alleged debt be removed from the final Credit Bureau (Equifax) on my credit report, so that I can continue medical treatments.

Even though it is AFS's position that this matter was handled properly AFS will honor the consumer's desired resolution and request that account XXXXXXXX be deleted from the consumer's credit. AFS does not control the amount of time it takes for the credit bureau to honor such a request.

The company furnished several debt collection accounts to my consumer report. I sent a letter asking for validation and a letter agreeing to settle for a deletion without acknowledging the debt is mine or accurate. In our correspondence the company sent me a reply to the settlement letter in which they referred to me as "Ms *******".
The company and I never discussed any gender, pronouns to be called or anything of the sort whatsoever and I am highly offended, embarrassed, and mentally troubled by the careless action on their behalf.
I tried to resolve this matter previously via a certified mail letter explaining my troubles and a resolution to move forward, as well as a CFPB complaint in which the company placed the weight of their insult on my shoulders by saying that I never gave them pronoun to address me as so they wont do anything to resolve my issue. I responded by stating if I never gave them a pronoun why are they placing these gender or pronouns upon me. In another letter they sent me they referred to me as "Sir or Madam" which i have no issue with seeing that a gender or pronoun wasn't assumed and placed on me and I didn't give them anything in any of my correspondences for that to change and be insulted by their careless assumption of a gender or pronoun for me.
I stated the federal statute they broke by insulting me(15 USC 1692d(2) but they remain non-compliant and unwilling to do anything to resolve the issue for their misconduct.Business Response

Accounts XXXXXXXX and XXXXXXXX were investigated upon consumer request. At no point prior 1.5.23 in any correspondence did the consumer instruct on proper pronoun use. The consumer's claim that AFS will do nothing to resolve this issue is inaccurate. AFS appreciates that the consumer brought this matter to our attention. Now that is it known that consumer desires to be addressed as a consumer first, the accounts will be noted accordingly. The use of the word "Ms" was inadvertent and will not be used again to address the consumer. As there has been no violation of the FDCPA no money will be sent to consumer. Pursuant to a previous validation request on account XXXXXXXX documentation was mailed to the consumer on or about 9/23/21 that would enable the consumer to understand the nature of that debt. There is no record of any previous request for validation as to account XXXXXXXX. Now that a request has been received documentation will be mailed to the consumer that will enable the consumer to understand the nature of that debt. In accordance with applicable law a request was made to the credit bureau to have both accounts updated as disputed.

I do not accept the response from this business. The fact that we had several correspondences in which a gender wasn't assumed and also a correspondence in which the business referred to me as "Sir or madam" shows that no gender had been discussed or determined at all before the letter in which they assumed a gender or pronoun and addressed me as "Ms *******". That is a FDCPA violation of statute 15 USC 1692d(2) which states A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section,
(2) The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader.
Obscene is defined as offensive to morality or decency.
Profanity is defined as Obscene, vulgar, or insulting language or blasphemy.
Harassment is defined as Words, conduct, or action that being directed at a specific person annoys, alarms, or causes substantial emotional distress to that person.
It's very obscene, harassing, profane and embarrassing to address and assume someone as the wrong gender with no prior communication establishing a gender or a preferred pronoun. Even worse this communication happened through the mails so a gender was assumed.
Hopefully that is not a standard practice of this business, the practice of assuming the gender and pronouns of consumers and blaming the careless action on the consumer by stating that no prior gender was discussed, I should not have to be burdened with the responsibility of stating my gender in order to avoid having one assumed and placed on me by this business.
Each time I have to correspond with this business about this issue takes more and more of a toll on my emotional health. This is so offensive and embarrassing because of many things that have happened to me and the fact that it's a clear violation but they remain non-compliant to what the law states their responsibilities are when in violation of of the laws stated previously.
I demand that the accounts pertaining to the correspondence in which I was violated cease all collection activity, cease reporting to any consumer reporting agencies or businesses, and remedy of 1,000$ check sent to my address for my rights being violated.

The consumer's claim that the accounts listed in the BBB complaint are fraudulent is not accurate. The two accounts are for services rendered to the consumer. When the accounts were placed for collections, the consumer was sent a letter explaining the debts. When the consumer failed to respond to the letter the accounts were reported on the consumer's credit. Per the consumer's desired resolution and after further review of the accounts a request will be made to the credit bureau to have accounts removed from the consumer's credit. Dear BBB,
This has been recently brought to my attention. I have been bed bound for several years. Ameri financial solutions was placed on my credit reports on 07/27/2017. It is tarnishing all 3 major credit reports Experian, Equifax and TransUnion. I never received communication via any means (mail, email or phone) from this company. This is now over 5 years past the legal statute of limitations in my home state of Florida. I am a Christian missionary. Several years ago, I developed a very rare disease and survived a partial amputation. I am currently on State disability benefits, home bound, and do not own a car or drive. I need assistance for everything. Due to the DAMAGE ON MY CREDIT, I am unable to get the multiple therapy treatments I need to resume mobility and strength. I ask that you kindly remove this ASAP from all 3 credit agencies so I can start my treatments after the Holidays in ***** name I Pray.

After reading about the consumer's hardships a decision has been made to close the account and request that it be removed from the consumer's credit. On 12/21/22, AmeriFinancial Solutions (AFS) made the request to have the account removed but does not control the time in which it takes the bureaus to remove an account. When this account was placed for collections, a letter was mailed to the consumer. In general, the applicable statute of limitation deals with the ability of one party to commence a legal action against another party. The running of a statute of limitation limits the remedies available to collect a debt but not the debt itself. AFS wishes all the best to the consumer.

I sent a letter to Amerifinancial Solutions on January 28, 2022, about some collection they reported on my credit report. I told them I was writing them a letter to tell them to send the debt back to the original creditor (Wake Emergency Phys P.A.) that sold it to them. It's illegal but not enforceable for a collection agency to buy debt from another company, then go after that person as if they had a contract with their collection agency. I know this collection agency does not have any paperwork showing that I made agreements with you with my signature. I told them that if their collection agency does not send this debt back to the original creditor, I will file a complaint with the CFPB, BBB, FTC, and the Attorney General. Also, I will hire a consumer attorney to sue your company for injuries up to $1,000. I will also file complaints against the credit bureaus. Despite a previous written request on January 28, 2022, these debts that I told them to send back to the original creditor, these items still remain on my credit report in violation of Federal Law.Business Response

When reviewing my credit report from 3 bureaus I noticed that Amerifinancial was listed with a balance of $927. I reached out to credit bureaus and disputed since I have no business with this company and never heard of them. Apparently, they reported back to credit bureau that this is accurate information and it's me. I then reached out to them that I have no knowledge of the said account, that I never signed or gave permission to any outside company for anything medical. I also stated that they were violating HIPPA with having my medical records when permission was not given. I was then told that they do not have my medical records as which time I stated well this says medical collection. I sent a certified mail to them requesting that they provide payment history, procedure/s or what took place, Doctor I saw, what was diagnosis, itemized billing, and my signature stating that they can have my account. They stated that they do not have to do that which legally is not true. Now they have changed the account open date and the status still shows Open Account which is not accurate legally if they claim it to be a collection company. AmeriFinancial Solutions (AFS) has never spoken directly with the consumer so the consumer's comment about any conversation that was had with AFS is not accurate.
