This establishment is trying to collect a debt. We have a pretrial scheduled for Monday. I sent in the check to close out THE ENTIRE amount via Priority Mail, it arrived June 14th. (I missed two payments on my payment plan because I lost my job so now we're going to court I guess?). The check remains un-cashed, it is now June 27th. I cannot email--my emails return as BLOCKED. You can't call, you have to "sign up for a callback", you state your file number and they decide if your matter warrants a callback. I can no longer sign in via the Payment Website as my credentials don't work. its the last four of my social, so Im not sure what the problem is. This is horrific. THEY HAVE THE MONEY. CASH THE CHECK and leave me alone. And if there is a further issue, EMAIL ME and tell me so I can settle it. UNREAL. Truly unbelievable.Business Response

I was recently served by this company. I emailed them to see if there was a settlement that could be reached to avoid court. They emailed back for information to confirm this was me. I emailed them back. My file is RS723763. I emailed asking if there was a way we could settle without going to court, and after confirming my identity they stated we could no longer correspond by email. I am currently unable to speak on the phone, but would like to reach a resolution. I am unable to go to court, and would like to avoid having my check garnished as I cannot afford this. It seems as though they arent willing to work with me even though I would like nothing more than to resemble this. If there is any way to reach a settlement and have this resolved I would greatly appreciate it.Business Response

I am rejecting this response because:After submitting a complaint I was able to set up a payment plan. They never took the payments and rescheduled the court date. I submitted an $800 payment on their website and sent them a message through their website. I also stated in this message that my shared email is with my wife and that communication through that email would be fine. I just want this settled and to avoid court. I have taken steps towards this that they dont seem to want to work with. And before they say we attempted to run the payment and it didnt go through, this is false. After speaking with my bank, I have learned that they didnt attempt the payment.

Today June 14 th 2023 I received a 15 day notice for garnishment letter again from Stenger law in reference to acct ********. On 2/2/23 I received the same letter and immediately emailed, called and sent a letter with a tracking number that was sent Feb 7 th 2023. I explained how I was set up on a payment plan and had missed a few and filled out the forms along with sent a money order for 975$. I asked if I could continue my payments of 100$ which I have been doing and was told it would be fine. Today I received the 15 day notice again. I cant afford to pay more than that due to inflation and rising payments. Also a garnishment would affect my job and can not have it on my record. I will send the form back with the required documentation along with tracking info. I need to figure out if I can please continue to make these payments and if the 15 day notice will be cancelled? Also the amounts again do not add up. On 2/2/23 when the letter was sent it showed a balance of **** but I had made at that point 525$ in payments and had my balance at 6663$ then I sent the money order on 2/7/23 of 975$ since then I have paid another 500$ in payments and I have my balance at 5188$. I will upload all the images I have. I would appreciate a response and clarification of what is happening by email or response on bbb or mail. Thank you for your help.Business Response

Stenger & Stenger, P.C. is in receipt of your BBB complaint ******** wherein you state you received a notice of garnishment and that you need clarification regarding the balance. Please note that following your last complaint, Stenger & Stenger agreed to halt the garnishment and set up your previous payment plan of $100.00 a month due by the 10th of every month. The firm received the first two payments in accordance with the payment plan; however, your May payment was not received until May 31, 2023. The three-week delay in receiving the agreed upon payment caused garnishment actions to re-commence. The firm will again halt the garnishment and put your payment plan into place; however, please ensure that payments are made in accordance with the agreement. Additionally, Stenger & Stenger will send you a letter breaking down the balance of the account. My son ***************************** is being sued by ********************* for a debt by lvnv funding regarding a credit one bank, n.a. account ending in **** for the amount $1189.20. On June 2 my son called and spoke to **** at length trying to resolve this matter. We agreed on $951.36. I called back on Friday June 3 to pay that amount. I was informed at that time they could not accept a credit card. My son called 6/8/2023 to allow me to call n pay this matter off on his behalf. I asked to speak to **** and was told they don't have extensions to transfer me to ****. So I said we agreed on the $951.36 and I like to pay it off today. The guy on 6/8 said the agreed amount between **** had expired on 6/2/2023 but thats no true. I called on 63/2023 to pay that exact amount. He proceeded to tell me he couldn't accept my account to pay my son's debt since he's not on my bank account. I've read the other cases filed against them and I see they say n do whatever they want. Most of the time it has a negative impact on people trying to work with them and clear these matters up. I feel someone in the attorney generals office should investigate these situations. I will be calling there next. I would like someone to step in and make sure they don't overcharge me and cause me more hassels. I tried to clear this up but I don't feel they are serious about resolving this in a professional and timely manner. I'd like them to erase this debt to 0 and clear his name with the credit bureaus. We in good faith reached out to clear this up and put it behind us. I would be willing to speak to an actual attorney with the business but Noone else there!!!Business Response

Stenger & Stenger, P.C. is in receipt of your BBB complaint ******** wherein you state you had agreed to pay a specific settlement amount to our office; however, you were unable to make the payment when you called in. The firms records indicate that the referenced settlement offer made on June 2, 2023 was contingent on a same day payment, but the offer was then extended over the weekend to allow payment to be made Monday, June 5, 2023. The next two calls the firm received were both on Thursday, June 8, 2023, wherein the first call the firm received authorization to speak with you, and the second call wherein the firm offered to still accept the settlement amount despite expiration of the deadline previously communicated. Despite the fact that the settlement payment has not been completed, to help resolve the issue, the firm can extend this offer for the next thirty days. The payment can be run on the firms website, or over the phone. If you have any further questions or would like to discuss, please do not hesitate to contact our office at **************. Complaint: ********
I am rejecting this response because: I filed a complaint on June 8***** against stenger and stenger for a debt my son supposedly owes. File number ******** in which we both agreed that I had 30 days from June 26, 2023 to pay the discounted amount of $951.36. So today july 7, 2023 at 4:02 pm I called to pay the agreed amount. I spoke to a female ***** who said the account was closed. She then transferred me to a male. He informed me the account was closed and they no longer had anything to do with it. He gave a number to resurgent capital recieveables. We had a resolution that we agreed to and they aborted it almost immediately. I agreed in good faith to resolve and put this behind us only to be back at square one!! 0I've been up front and honest about settling this debt. I accepted the resolution and today I was told they locked the account out and no longer had anything to do with it. In response to my original complaint they agreed I had 30 days to pay the discount amount by calling there office. But today july 7 ***** I was once again given the run around. I feel this should be eliminated from his credit report and written off because of their deliberate violation of our agreement per bbb!!
Sincerely,

I received 2 letters from this collection agency stating that i had owed debt from Navy Federal. One of the letter it stated i had until June 4 and other one June 11 to respond or dispute the debt. I received my VA disability on first of the month so i gave them a call to set up a payment plan since i still had 3 days to respond to the first letter. I made payment plan for both my account . For the ***** being auto payment 6/3/2023 and 3rd of every month and other account first payment being 7/1/23 and 1st of every month. What am upset and mad about is the lady informs me they have filled a lawsuit on first account of ***** which I still had 2 more days to respond back. This is clear violation of the law. *********************************************** submitted legal paperwork before the official date for response time was even up. i have yet to receive a summon paperwork or have been served. I was given my city's court number and instructed by the lady to set up appointment to get served. Since I already made voluntary payment plans on both my account before the deadline. I want paperwork send to me saying that case has been dismissed or dropped so their will be no default judgement against me when i don't show up to court. How do you not follow the law thats clearly stated in the paper. PS lady also informs me you guys have no way to pay online and view remaining balance after payment which is super suspicious to me. Please send document stating case have been dismissed or dropped.Business Response

Complaint: 20137937
I am rejecting this response because: I have two account with ********************** & Stenger. I set up auto payment for both those stated accounts. One for $150 a month and other for $120. My problem is that i just found out am being sued on the account for $8796.76 case number 2023CVF01839K. As soon as i found lawsuit has been filled against me i called to inquire as to why, i had already set up monthly payment plan many months prior. i was told monthly payment for $150 has not being going thru while the payment of $120 has successfully being taken out every month. I was told payment for $150 cancelled due to insufficient funds which is false because i always put funds in my bank account first of the month to cover this 2 payments. I did verify with the bank that payment of $150 was only taken out once. I receive one paper on mail stating am missing a payment which i thought was error as i had auto pay. I have called to set up payment plan again to $170 per month first of every month starting Jan 1,2024. As you can see with my other account has always being paid on time for many months now, There was no need for a lawsuit when it was clearly accounting error or who ever inputs routing and account number as i thought my monthly payment of $150 was taken out every month. I would like this court case dismissed or closed due to agreement between two parties. As i stated in phone i would like this contract in writing send in timely manner so i can sign it and forward it back to you so you can file with court that we came to an agreement so i don't get a default judgement against me. I will be checking for update on my case online. I also have not received a sign contract for my other account that i requested 5 month prior. Please do a better job with communion if payment are missed or not going thur. Better forms of communion are my email ********************** or my phone number ************ rather then mail due to mails being lost in transit. Respectfully send
Sincerely,

Stenger & Stenger, P.C. is in receipt of your BBB complaint # ******** wherein you indicate that you had previously set up a payment arrangement with Stenger & Stenger over two accounts with the firm, but have now received a lawsuit on one of the accounts following non-payment, but the non-payments are due to an accounting error on Stenger & Stengers behalf, and that you would like the court case dropped, and better communication if payments are missed, preferably via email or phone number. Stenger & Stenger has reinstated your previous payment arrangement with updated account information and will dismiss the lawsuit that was filed for non-payment. Please note that following the failed payments on 7/1/2023, 9/1/2023, and 10/2/2023, and prior to filing the legal action, Stenger & Stenger did attempt to call you several times, but at a different number than what is listed on your complaint. The firm has updated your contact information to the phone number listed in the complaint. In addition to the calls, letters indicating that payments had not been received were sent to your address on 7/13/2023, 9/22/2023, and 10/16/2023 in an attempt to notify you the firm was having difficulties running the payments. If you would like to receive documentation via email, the firm does require written authorization from you to do so; however, most correspondence must be sent by mail. Lastly, Stenger & Stenger will send you documentation outlining the terms of the agreement for both cases, and you will receive payment reminder letters prior to your scheduled payment dates that will state the balance of the account and the scheduled payment. Stenger and Stenger have been taking ACH payments from my account for years, under my permission. Payment arrangements were made. The debt has been now paid in full yet they did not report it to the credit reporting bureaus that the debt was paid in full. Last payment was made April 18, 2023 for $5.17. My credit report was not updated and it is still showing a $5 debt to the credit company Stenger and Stenger is working for. Theyve had over a month. It should have been reported as paid and closed. My address has changed if any paperwork needs to be sent. I may be contacted at ******************** for new address if needed.Business Response

Regarding my account ********, I called Stenger and Stenger PC @************ on May 25, 2023. I spoke with a gentleman who collected my payment and credited $583.10 to my account. Moreover, scheduling a payment for the final payment of $583.10 on June 26th, 2023. Additionally, he stated that the judgment and filing from today will be canceled. On my second contact, on May 26, 2023, I spoke with three different representatives, who informed me that the payment had not been received and credited to my account and that a payment plan for two installments of $583.10 had still been established. These representatives seem to have given me different information about my account and yesterday's events. I request to talk with a supervisor after being transferred. The team lead or supervisor who called me was very unprofessional, talked over me when I was asking a question, and the call never progressed. I would prefer a resolution to this issue because I do not want to be sued because of the chronic disease that made it difficult for me to pay my obligations.Business Response

This company is a joke. I have been making payments to them since 2017. They continue to accept my successful payments of $50 or more. When there is a gap between payments they go to the court house to start garnishment. They dnt reach put to follow even though they ask you if they can follow. If I give yiu authorization to follow up why not do it. They just want money money without trying g to reach a resolution with clients to resolve the debt. I just made a payment to them 2 weeks ago and they went and filed a garnishment. They want you to pay what they want you to pay. At least I'm making payments. I have been making payments on and off since 2017. When I first paid on the debt they stated I owe $740.40. Over the years since 2017 I have paid them $540 or $560. On the garnishment they say I owe the$713 how. I'm not gone double pay them. My debt was not $1500. When I called they stated I owe $514.44. I'm still trying to figure how. If I have paid yall $560 why do I still owe $713. This is a scam company. I called today a d the rep told me they were releasing the garnishment a d I asked her could they send the paperwork to me so I could send it up to my payroll company she told me no. Why. I can't afford for my wages to be garnished. They rep could have called over just like ******* did for one of the other clients I seen who wrote a review. They just want money and do not care about your lively hood. Yes it was a gap in between my payments because I was diagnosed with breast cancer and also had a partial knee replacement. Do they care about that no. They just threatened to garnish your wages.Business Response

Stenger & Stenger, P.C. is in receipt of your BBB complaint # ******** wherein you indicate that you have been paying on this account, but a garnishment has been put into place and that the garnishment amount is incorrect. The release of the garnishment has been filed and sent to your place of employment. The garnishment was set into place in March after not receiving payments for several months. The amount reflected on the garnishment is from that point in time, not including payments made after that date. Please further note that our records indicate that several payment plans have been arranged previously to avoid garnishment, but payments were not received as agreed. With the new payment arrangement in place, the garnishment has been released; however, please ensure payments are made in accordance with the arranged payment plan. If you have any further questions or would like to discuss, please do not hesitate to contact our office at (888) 305-7775. Regards, Stenger and Stenger, P.C.
