    I am writing to file a formal complaint regarding Park at Foxborough's failure to respond to my repeated communications. I have sent multiple emails requesting assistance, but I have yet to receive any response.I am seeking the immediate cancellation of my timeshare ownership with Park at Foxborough. At 70 years old, I am dealing with significant health issues, including chronic back pain that required the installation of a pain pump. These medical conditions severely limit my ability to use the timeshare, and the financial burden it imposes has become unmanageable.I respectfully request that Park at Foxborough respond to my communications promptly and provide me with an option to cancel my timeshare. The lack of support and communication has only added to my frustration and stress.I look forward to a resolution to this matter as soon as possible.

    think I arrived late and missed a free lunch. Anyway, I wanted to learn about points, so I could spend 2-3 nights at one location instead of a full week. This was especially true so I could drive 2 hours from ******** over to the desert (************ area) for a couple of days at a time. Their representative was personable and did his warm-up jobto spend., the big boss came over and eventually made me a least costly/fewest points offerwhich sounded good, so I gave him by credit card and signed the paperwork. I left happy.During the next 12 months I was repeatedly disappointed (either resort or date not available) by *** as I attempted to use my points, so I paid $99 or so to bank these points for 2 additional years. Its been 10 years and Im now 83, so I cant remember how many years (at least 3) I was disappointed by *** before I chose not to pay any more money and renew my membership with ****** July 2017 I received a letter from The Retreat at Foxborough (who?) stating that on September ******, as stated in my contract (hold on my contract is with Leisure Getaways) they would do the paperwork to resume ownership of the Trust Membership. Initially I thought no big deal, and chalked this bad experience up to timeshare horror stories that are constantly in the news.However, after researching and learning about the potential negative consequences of owning a timeshare, I realized that there could be real risks involved for me or my estate if I do not address this ownership with The Retreat at Foxborough which I did not consent to being signed up for. I also did not sign or agree to any terms or conditions of ownership with any ********* entity. I was completely blindsided by the letter I received in 2017 suggesting that I am part of an agreement with a company which I had never heard of previously.

    We entered into a contract on 8/27/2024. The contract stated we have 5 days to cancel. We sent the cancellation request on 8/31/2024 by certified mail. They proceeded to charge me anyway.

    My wife and I entered into a contract with you on 8-17-2024 and cancelled the contract in writing on 8-31-2024 sent by certified mail postmarked 8-31-2024, within the five day cancellation period as per your contract.     As per the contract there is a 7 day cancellation period in which you can send a certified letter to cancel the contract. If your contract was signed on 8/17/24 we would have needed a cancellation letter postmarked no later than 8/24. You stated you mailed a cancellation letter on 8/31 which was 7 days past the end of the cancellation period.     We were pressured into signing a contract and we filed two credit cards - DISCOVER card and ******* card. They wanted us to pay $18,000 to get rid of 3 timeshares. I would like to get out of the contract.

    We answered a mailer to eliminate our timeshare in ****, **. The 2 hosting the event told us they were working with ******** and ***. We were told we could eliminate the previous contract and join ***. The purchase agreement we signed only mentioned The Park at Foxborough. When I questioned that, they said it was because they are an RCI H323330313537353435**H. They told me an account with ************* would be opened and would be interest free and the only cost would be $129/month for 100 months totaling $12,900. This was emphasized several times. We were told we would go in a program where we would get the $12,900 back after a 10 year term. This program was with a company called *********. We signed the contract. We also signed a form for a company called ********. This company would be used to eliminate our timeshare. In Nov &#**;23 SwitchIt said we would need to pay our current timeshare $3,200 to cancel the contract. We declined because we were told the money paid to ******** would be the only money required for this transaction. The account opened with ******** was an interest free credit card account but only for 9 months. After that we called the H323330313537353435**H and they opened another credit card with **************** that was interest free for 15 months. They told me at the end of those 15 months to call them and they would transfer it to another credit card. At no time were we informed we were purchasing a timeshare at The Park at Foxborough. It turns out the 2 were with The Park at Foxborough the whole time but never disclosed this information.

    We have reviewed your contract with The Park at Foxborough and it clearly shows that you signed a purchase agreement for ****** RCI points annually through the Park at Foxborough. There is no "timeshare deed" associated with this purchase. You purchased an *** points membership. I have attached this contract showing clearly your purchase of ****** annual RCI points through The Park at Foxborough. If you have questions about your membership you can call member services at ************. 

    A separate part of your purchase that day was through Resort ****************** that you contracted to do timeshare relinquishment. Their contact information is ************************************************* ************** for any questions regarding timeshare relinquishment. I have uploaded your contracts through them as well which also clearly states on the Switch It page line 6 that you " agree to continue paying any and all fees associated with the property, including but not limited to, maintenance fees, taxes, assessments etc. We fully understand that the property cannot be transferred unless all fees and assessments are current and property is free and clear of any mortgages. We fully understand that if this agreement is entered and initiated after July 1st that we will be responsible for the following year of maintenance fees". This is most likely what the $3200 is that needs paid towards you timeshare in order to relinquish it. You can call Resort Title Research at ************ to find out.

    I went to a meeting in order to get out of my timeshare. This company opened a credit card in my name. They charged it $12,500. They then reported the card as stolen and another card was issued. I never personally used this card.

    You signed a contract with us and credit card authorization forms on 8/3/2023 over a year ago (attached) authorizing up to $12,500 to be charged for our program. You applied for the *** ******* credit card that went pending at the time of sale and also a **************** Card that approved you for $12,500. When you received your new credit card in the mail to your home you called us and gave us the credit card numbers to be charged $11,199 to pay for the The Park RCI Points program. You had 7 days from 8/3/2023 to cancel this membership; it has been over a year. You are now an active The Park at Foxborough RCI Points owner Member number 1-6562551 issued ****** points per year. We never reported any credit card as stolen, we have no notes of anything about that. We have attached your signed contract and authorization forms for your viewing to hopefully resolve this complaint.

    I have reviewed the business' response and am rejecting it because: The complete response to this fraud and part of their scam. was detailed in my complaint, It is my understanding that this merchant has since reversed these false charges and have credited ***** Fargo for the complete charge of ********* and I will be refunded the money I paid for the payments towards that amount. The big lie is that I supposedly bought another time share instead of what I was told was an annuity that I never received, and that I opened this account with ***** Fargo which I didnt, WHATS THE REAL STORY PARKS AT FOXBOROUGH, HAVE YOU ADMITTED YOUR SCAM AND REFUNDED THE FALSE CHARGE TO AN ACCOUNT YOU OPENED IN MY NAME WITH ***** FARGO? PLEASE STOP SCAMMING THE ELDERLY AND ALL THE OTHERS REPORTING THE SAME SCAM TO THE BBB. YOU HAVE A F RATING FOR YOUR BUSINESS PRACTICES.

    At the time of sale you applied for a ******** credit card and a **************** credit card. You went pending on the ******* card and were approved for $12,500 on the ***** Fargo card. At the time of sale you were not given any temporary credit card numbers. The credit cards you applied for were mailed to your home. You had to call us and give us the credit card numbers over the phone in order for us to charge the card in and we have signed authorization forms to do so. There was a 7 day cancellation policy and it has been over a year since the purchase date. Foxborough has fulfilled their side of the contract in opening your *** Points membership and issuing points. We never reported any of your cards as stolen, that is something that you would have had to do yourself. If this membership is something you no longer wish to have, then you can speak with our transfer department and find out your options for relinquishing your ownership.

    We signed a contract with the park at Foxborough resort to help us terminate our time share with Wyndham, join ***, platinum, and receive a $10,000 annuity. We signed the contract on July 13, 2023. The Foxborough program did refer us to a title company and we are now removed from our Wyndham timeshare. We are also members of *** platinum. The Foxborough program Will not respond to my inquiries, regarding when we will receive our promised annuity. We were told in the presentation that we would get a $10,000 annuity, and the paperwork shows the name of the annuity is safeguard. The person who returns my calls from Foxborough is ***** ******. Mr. ****** has said he would look into our annuity, and many times has not called me back. I did talk to him recently, and he again said he would look into our annuity.

    I have contacted park at Foxborough resort three or four times in phone conversations. I have been contacting them for over a year. They always say the same thing that their response says. They never look into it and they never call me back with any follow up. A man name ***** ******, who works in management, has also stated he would look in our complaint. He has never offered any resolution regarding never delivering our cashback refund. You are welcome to continue to contact park at *******, but I doubt if they will do anything other than say they will look into it. 
           Is there anything BBB can do or we can do that will further encourage park at ******* to provide us our cash refund indicated in our paperwork?

    I hope this letter finds you well. I am writing to express my growing frustration and disappointment regarding the lack of response to my previous correspondence sent in April. Despite the considerable time that has elapsed, I have not received any acknowledgment or reply from your side,and this prolonged silence is both disheartening and unacceptable.Our situation and stance remain unchanged since my initial letter. We have experienced numerous discrepancies between what we were told at the time of our timeshare purchase and what was outlined in the contract. This has led to significant dissatisfaction and a strong desire to terminate our timeshare agreement with The Park at Foxborough Resort.When we initially engaged with your sales representatives, we were presented with a series of promises and assurances that were pivotal in our decision to proceed with the timeshare purchase.Unfortunately, upon closer examination of the contract and the actual experience we have had with the resort, it is evident that many of these promises have not been honored. These discrepancies include the following:1. Availability and Booking Flexibility: We were assured that booking our desired dates would be a straightforward process. However, we have consistently faced challenges in securing reservations, even when attempting to book well in advance.2. Maintenance Fees: The maintenance fees discussed during the sales process were significantly lower than those stipulated in the contract. This discrepancy has placed an unexpected financial burden on us, which was not communicated transparently.3. Resale Value and Exit Options: One of the key selling points was the purported ease of reselling the timeshare or exiting the agreement. Contrary to these assurances, we have encountered significant obstacles in exploring these options, with little to no support from your team.Given these points, we firmly believe that our grievances are justified and warrant immediate attention.

    I have looked into your account and you originally purchased through CPN which is a third party. The only portion of the contacts you signed that are Foxborough's responsibility is delivering your *** points annually when you pay your membership dues (the amount you signed agreement to in the contract), which we have done. It appears that you are two years behind in paying your membership dues which will cause a point block on your account and inhibit you from being able to book reservations through ***. In regards to the resell value and exit options of your ownership we do have an exit option. You can always call the front desk directly at ************** and ask to be transferred to owner services to talk about that option as well as pay your past due membership dues or get answers to any other questions you have about your ownership.

      I have reviewed the business' response and am rejecting it because: I have followed the instructions above.   When I called the front desk at **************- I reached ***** on 09-24-24 at 11:25 am.

      She transferred me to ******* in owner services. ******* does not know who the 3rd party CPN is and neither do we.  ******* could not help me and said she will have a sales **** return my call in the next few days to

    discuss an exit strategy.   We do not wish to continue paying ownership dues for this ******. RCI points.  She also told me the exit fee is $2,495.00.  I asked her about the resort buying back or reselling to pay these fees and

    she said she would take my phone number and have someone return my call..  We have done this 10 times b4 and no one returns my call.  She said we owe fees for  years 2023, 2024 and 2025 which would be over $2,000.00.

    We have paid them over $10,000.00 dollars plus the 1st years maintenance fees and have never been to the resort.  We feel we have already paid a lot of money for nothing and should not be billed anything..  Our

    ownership should be sold at their expense and our purchase price refunded..  This was a total scam.

      We are visually impaired senior citizens and my husband is a Vietnam Veteran.  Can we get some help with this please.  It is cruel to abuse people like this.

    We understand your frustration and would like help but the only portion of your contract that pertains to Foxborough is your Park at Foxborough Membership Agreement and *** enrollment forms. Those of which entered you into our *** points program with a yearly membership due of $599. You paid your first years dues April 19th of 2022 and received your points after. You booked a vacation in March of 2023 for ****** points. You booked another vacation in 2024 for ****** points. The only obligation Foxborough has to you is to issue you ****** points annually after you pay your membership dues. Even though you have been past due on your membership dues, Foxborough still issued you points that you were able to use/save. Any dispute over your original purchase price would be with the company you originally purchased through which appears to be CPN.  CPN is a third party timeshare resell and liquidation company. The contact details we found for this company are Consumer Protection Networks **************  at ******************************************. If there is anything Foxborough can do pertaining to your past due membership dues, points allotment or cancellation program we can have a sales *** reach out.

    On June 27, 2024 we went to an informational meeting to get out of our timeshares in ************, **. The salesman said he was doing a test program for *** to relieve people of unused timeshares. During the sales pitch he started talking about points for a vacation and $259 a year cost. He never mentioned Foxborough during his presentation. He did mention a cost of $149 a month for 100 months and being reimbursed the entire balance after 10 years. If something happened to one of us, part of the payment would be canceled. Never once did he mention Foxborough. I saw the name on the paperwork and on one it stated we were on Foxborough property. We would open an RCI charge card to pay the $149 payment. By this time, we were exhausted and it was getting late at night. He was talking so fast we really didnt have time to process. We never received a copy of our charge card applications but I did take pictures of it. When the paperwork came, it was hurry up and sign it. We never had time to process or really discuss the paperwork. Imagine our shock to see an $8219.00 charge from Foxborough and we are now owners of another timeshare. The charge was made while we were sitting at the meeting. I have tried multiple times to talk to someone to resolve the issue. I have left messages but never received a return call back. Please do not deal with this company. They are not a reputable company. We would like a refund of our money.

In your contract it states that we need a cancelation letter within 7 days of signing the contract in order to cancel. You should have copies of your contract from the meeting.     To whom it may concern,My name is ***** ********, and on 4/20/17 at ********************* in **********, we were given a complimentary dinner to listen to **** ****** discuss how Leisure Getaways/Legacy Adventures could get both my mother (****** ********) and myself out of our current timeshares and into something better. We listened to the whole speech about how they can get us out of our timeshares in 6-9 months, possibly up to a year. We were also told that we would only be responsible for the first year of maintenance fees to our current Timeshares (mine is at Villas at ************* in *********, **) if they were not able to get us out before the fees were due.Another part of that promise was to get into essentially a better Timeshare known as the Retreat at Foxborough. With this promise, some of the perks would be to get ****** RCI points for only $300 per year (also know as the maintenance fee). This fee we were also told would never go up in price. Also, if we wanted to purchase more points in a year, we could ($100 would get us ****** more RCI points). Also, if we didnt need that many, or even any points, we could either pay less, or just not pay any at all. Along with this, if we ever wanted to get out of this with the Retreat at Foxborough, we could just let the company know and we wouldnt need to pay. It was never explained to us as a timeshare, but more of just something to be able to take vacations like a Timeshare.

The only portion of your contract that involves Foxborough is the issuance of your ****** points yearly after you pay your $300 membership dues of which we have upheld. It appears you have not paid your dues for 2023 or 2024 which will put a block on your points going further until you pay those. In regards to additional points being purchased we can do that, no problem. We do have exit options if you are wanting to get out of membership just call us directly ************ and ask for owner services.
