    I am a disabled senior citizen who was in a bad car wreck, lost my other half in the accident and was on life support for several months in 22 and 23. I received a post card saying this company could get me out of my timeshares. I believed I was paying a company called Swithit, which is on all the contracts, but The Park At *********** was the comapny that charged two credit cards $14,400.00, inerest free, they said. They promised they could get me out of my timeshare, typically in 221 days. Switch it was a company the Park at Foxbourough contracts with to sell the time shares; which none of this was ever disclosed. I have left messages to attempt to work with the Park at ***********, not understanding the Par at *********** was selling me another type of timeshare/"club" with RCI points. I am on disability and wanted to work something out with the Park at *********** and if I knew they were just going to contract out my timeshares and attempt to sell them, I could have done that myself. This is a scam and the way they have failed to return phone calls is obvious of their poor intentions. I am currently waiting on a call from them, where they assured me they would try to have someone call me back today. It has been a year since receiving the postcard and in my opinion, being duped. it is obvious The Park at *********** has done this to many people, according to the BBB and the only way it seems the Park at Foxborough will take any time is by having to file a BBB complaint,

    I'm sorry for any lack of or miscommunication on the part of the resort. First I want to make sure you have all of our phone numbers. The front office of the resort can be reached at ************** and can transfer you to any department you need. ***** services also has a direct line at **************. I have looked into your membership and it looks like you are an active owner receiving ****** points annually. You can always opt out of your points for the year and put off paying your membership dues if you contact us before Nov. 1st in writing the year before the points are to be allotted. In addition to your Foxborough *** Points membership you also signed an agreement with Switch It to relinquish your other timeshares. If you have questions about that we can put you in touch with a representative that deals with that. We also have an exit plan if you have found that you no longer want to receive the ****** RCI points.     I would like to file a complaint against this business in regards to Elderly Abuse. My parents are senior citizens on social security; this business pressured them into buying a timeshare membership using scared tactics and lying about their current investments. They made my parents sign documents and did not allow them to read them, told them that they would get copies and could read them later. Come to find out that everything they used to scare them about their current investments was a lie, come to find out everything they told them about what they would offer was a lie, come to find out that later, they would have to pay over $8,000 more to complete a transaction set on lies.We contacted the title company and they have canceled the title swap; so there is no membership that will be had. I've attached a letter from my parents explaining the events.No one should have to go through this kind of abuse; this day in age where everything is so expensive, to steal from senior citizens using scared tactics is a new low for any organization. This organization needs to refund my parents the $14,000 they made them open in credit cards and will have to chose between food or medications over this bill. This company should be ashamed of themselves.

    In response to the complaint received 6/01/2024. 

    ***** ****** & ****** ******* entered into contract with The Park at Foxborough Resort's RCI Elite Rewards program, Resort ******************, and Switch it on 1/17/2024. The Park at Foxborough received $13,199 in exchange for an *** points membership of ****** points annually. An additional $2000 was to be paid separately to Resort ****************** to relinquish one Bluegreen membership. 
    At the time of signing both ***** ****** & ****** ******* were of competent mentality and no power of attorney or other proof has been provided to deem them otherwise. 
    The clients did chargeback the original $13,199 however the bank denied their chargeback as the charges were authorized by the client. 
    To date 9/20/2024 we had received no cancellation letter from the clients. 
    The Park at Foxborough's portion has now been paid in full and the clients *** Membership is activated. The client is able to opt of paying their membership dues and receiving their points if the resort is notified in writing by November 1st of the previous year. If the client decides they want to cancel their membership in full we do have exit strategies in which they can call us directly at ************** to learn about. 
    Resort ****************** has notified us that the client who originally said they had one Bluegreen Membership and wanted to hold off on relinquishing it until April, actually has two separate contracts with Bluegreen thus why the original $2000 thought needed to relinquish it was doubled. That contract is with Resort ****************** which is located at ************************************************* and can be reached at ************.

    I went to an informational meeting to get out of my timeshare. The man there claimed to be an arbitrator for all the timeshares and RCI because all the timeshares went through them. He also said he represented Foxborough RCI located in *******, ********. These things were guaranteed: My timeshare with Diamond Resort would be removed from my name within 6 months, and I would have to pay no more maintenance fees. RCI Platinum would give a 25-year settlement with the use of Foxborough Resort complimentary. Finally, his company would enroll my husband and me with Vacation Safeguard Loyalty, which I was told was similar to a term life insurance policy. All my money would be returned through this company in 10 years, though I could opt to leave my money in the program for 20 years. For just $129 a month for 100 months at zero interest for a total of $12,900, an account would be opened with Vacation Safeguard Loyalty for us. After ten years, I would receive this money back in full. When I told him that I couldn't see to read without my glasses and my husband was dyslexic, he said he would read it to me. After we signed the papers, he went into the back room to make copies. He came back with an envelope. He told me that he would have to send the rest of the contract as his printer was not working. He said that we would receive the rest of the contract in 5- 7 days. Due to family emergencies, I did not realize I had not received the contract. I did not know that he used the money to buy points in Foxborough Resort until the credit card company he had enrolled us in, informed me. I called the number on the envelope and *********************** the owner of Foxborough answered. I told him what had happened. He said he would send me the complete contract. It wasn't until February that I contacted Safeguard and found that he had not started an account for me with them. We have received no contract and Foxborough has not delivered on any promises.

    My wife and I attended a presentation in which we would learn how to eliminate our timeshare with *******. Instead, it was a time share sales presentation for RCI through a company called Foxborough Resort. We attempted to contact ********* after signing the agreement with no success. We were never given contact info for them. The presenter stated he worked for ************** not RCI. He guaranteed we would be able to dissolve our Wyndham membership at the cost of $2,000. We would receive ****** RCI points in return. The annuity payments would be paid on Mr. Beard&#**;s Barclays card. It would be $129/month for 100 months (8.3 years) at 0% interest until we paid $12,900. Instead, we were borrowing $12,900 on a credit card. The interest rate on the card would be 20,9% after July 2024. The presentation was untrue in many ways. (See notes from the presentation.) One being, the monthly cost was $1**, which is $1000 difference. Foxborough stated they would zero percent credit cards and transfer the remaining principal prior to incurring interest. We would still have to pay a transfer fee of up to 3%. The refund portion was in the form of the "annuity" that would be refunded after ten years. We have never received our new member packet. It has been over three months. We don&#**;t have a member number or any correspondence from RCI. He said we would have paperwork on the annuity after making several payments in good faith. We were also told not to make any more payments to *******. That was also not true. The representative from the title company, Switch It, said if there were any outstanding balances due, the application for dissolution of the membership would be rejected. While working with Switch It, we tried to clarify the relationships between the organizations RCI and Foxborough. She had someone from Foxborough reach out to us. The transfer paperwork, however, had the wrong last name on the application. This may cause additional costs. The sales presentation was not only full of false information, it was high pressure tactics which required a decision on the spot. This did not allow for time to research the products or the arrangements. After having time to do that, we see there are many reasons to be concerned. We want a full refund for all the costs incurred and an opt-out of an RCI membership.

    After a nine-month struggle, the Park at Foxborough has repaid us in full:  our initial cost of $13,299. Additionally, the company repaid a balance transfer fee of $517, as promised. We appreciate those repayments.

     

    My wife and I spent a great deal of time in great frustration attempting to resolve this issue. We filed complaints with the ************** BBB, the ************************** office, the South Carolina Consumer Affairs branch of the AGs Office, our local sheriffs office and enlisted the help of media contacts to expose an operation that grossly misled us and prompted us to purchase a timeshare property that we would have never bought had we not been misled.

     

    While our struggle with this is over, our concern is that other consumers may have fallen prey and did not pursue an avenue for repayment. Just look at the alarming number of complaints in this posting. We encourage others who respond to fliers offering free discussion sessions on how to eliminate all of your timeshare obligations to conduct thorough research on the company making such offers. It will not be easy to determine the actual name of the company making such offers. They do not want you to know who they are, and they will not tell you the truth in the presentation. You would, in fact, be trading one timeshare obligation for another.  Even after you may have made a purchase, most states have a period of time allowing consumers a right to rescind a contract. We should have done so. The BBB of ************** was invaluable in assisting us,  providing some moral support, and directing us to agencies (including the **************************** of the *********************************)  that had the legal authority to investigate fraudulent activities and bring the necessary pressure to resolve issues. The company we engaged touted an A+ BBB rating. It was, in fact, an F rating.

     

    My advice to others is to continue the pressure. Dont give up.

    My wife and I entered a contract on Nov 17, 2023 with The Park at Foxborough, Branson, MO. The contract stated they would get us out of a Timeshare contract with a different company and enroll us into RCI (40,000 annual points) for approximately $17,000. The contract also offered additional provisions / benefits and each of us received a RCI credit card. After returning to Virginia, we decided to opt out of the contract using the 7 business day opt out period listed. We sent certified letters stating we were opting out mailed on Nov 28, 2023. This time period included two weekends and Thanksgiving thus meeting the 7 business day opt out requirement. After not hearing back for a few days, we contacted Mr. Austin, the manager/owner of The Park, on several occasions (email, text, phone). He continues to refuse to cancel the contract stating he doesn't care when we mailed the certified letters, it took too long and he won't cancel. We only get this verbally as he has yet to respond to text or email in writing. In addition, he took the action to initially charge the RCI credit cards $13,199. Request help in getting this company to honor the tenants of the contract, cancel the contract and reverse the credit card charges.

    I am rejecting this response because:  on page 8 of the document we originally submitted, it clearly states 7 business days allowed to cancel the contract.  The other reference which we also included and the other party submitted simply states 7 days.  It does not state calendar days.  To be very clear, contracts should specify.  If not, the norm is the benefit goes to us.  In addition, I doubt valid contracts would hold one section to calendar days when another section clearly states 7 business days.

    Attended an informational meeting. This meeting was held on November 29th 2023 at the Courtyard by Marriott *** ******** **** *********** ** *****. I understood that the meeting was going to be about exiting my current Timeshare with Hilton/Diamond Resorts. The salesperson said he was an arbitrator for ******* **** because all the Timeshares run through ******* ****s.
    I ask him his full name and what company he represented, and he said he represented Foxborough RCI located in Branson Missouri for ******* ****. The first name that he did give me was "********". Come to find out that I was charged $11,000 on a new Barclay credit card (master card) through ******* ****. I did not activate the card. I did speak with a representative from the RCI Barclays Bank and filed a formal complaint with the Bank.
    I also received a credit card from ***** ***** **** (***** ***** ***** I called that bank and had that card frozen. There were no charges to that account. I did not activate that card .
    I had tried to get in touch with Foxborough RCI to no avail. I have left messages and I get no response. Phone Numbers associated with this company-************, ************,************.

    I am rejecting this response because:I tried to contact this business 5 days after digesting the contract. I felt betrayed and instead of exiting the timeshare I already have,I found out I just inadvertently purchased another timeshare.  
    When the owner called me (after many messages and full mailboxes) he was very clear that I was not going to get out of this contract.  He was very curt and deliberate.  I felt very intimidated.  I felt very upset.  He did not try at all to be reasonable. My voice got very loud and I finally told him I was going to talk with an attorney.  At that point I hung up on him.

    He responded to me with a text message…In short…If you don’t complete the transfer fee to the title company you will have spent 11000.00 on nothing.  I don’t want that for you.  If you would like your attorney to contact me my number is ************.  ***** ******.

    On December 29thI received a message from the BBB requesting any written information concerning my complaint against RCI Park at Foxborough in Branson Missouri.

    I submitted the “ written contract” that I have with this business.  Today I am sending a timeline so you can better understand the steps taken to get me to this grievance stage.

    November 29that 6:00p.m.- 7:00p.m. I attended an invitation only event at the Courtyard by Marriott*** ******** **** ** ********** ** *****.  The event was an informative meeting to discuss the following topics.  Permanently eliminate all your timeshare obligations, find out if your Timeshare contract qualifies for Amnesty if it no longer suits your needs, and learn how to access GUARANTEED savings above and beyond your current timeshare benefits. Information was shared with the group by a gentlemen who didn’t introduce himself, and after I ask his name and who he represented he responded with ********, I am an arbitrator for ******* ****.  He said that Barclay funds all of the current timeshares. They ask for no money up front, but to pay 129.00/month for ten years and then in 10 years you get all of this monies back.  He explained it as an annuity.  As time went on I ask several questions about the business.  I did not know what RCI was, and I had never heard of The Park At Foxborough.  He said that it was a well established business.  I ask him if it were rated with the BBB, as was mentioned on the flyer I received in the mail.  He said don’t pay any attention to the rating.  He said people write a complaint and it causes their rating to go down.  As time went by I was very skeptical until he said we are not asking any money up front.  You will only be billed 129.00/month.  So I caved in and signed the contract.  I did not receive my copy of the contract that night, because he was having printer problems.  He said I would receive it the next day.  I did not receive the contract in the mail until December 8th.  So that was 9 days later (7 business days later).  After I got a chance to thoroughly go over the contents of the contract, I knew I had made a mistake.  Instead of exiting the Timeshare that I already had, I instead now owned another timeshare with The Park at Foxborough.   So on November 29thin little over an hour I had a signed contract but I didn’t get to go over thoroughly until 9 days later. 

         On December the 9thI called (************) the Foxborough Processing Center. (this number suggested to me by “********”. For any questions or concerns that I had.  I called 3 different numbers and they went straight to voicemail box which was full.  December 10thI called the above number again, same response, voicemail, mailbox full.

    On December 11thI tried the phone number posted on the Foxborough website.  No one answered, but I was able to leave a message.  December 14thFoxborough called, but I was not available to answer at that time.. ( I was substitute teaching).  I returned the call asap and I got no answer, but I did leave a message for someone to return my call. 

         On December the 15thI called ******* ****.  I found out that a credit card account was opened for me at the ******* ****. This credit card had a charge of 11,000.00 from Foxborough.  I called the ***** ***** **** and was also made aware of a credit card account opened in my name.  There has been no charge on that account.  Both banks froze my accounts.  The ******* **** filed a dispute with The Park at Foxborough in my behalf.  They are still investigating the situation. 

         On December 18thI received a call from ***** ****** (owner of The Park at Foxborough).  He had received a note from the ******* **** about filing a dispute.  He ask me what I wanted.  I told him I was misled/scammed and I wanted out of the contract.  He raised his voice and told me “that wasn’t going to happen.”  That I had signed a contract and that I was bound by this contract to follow through with the deal.  I told him that I was going to contact an attorney.  Shortly after that conversation ended, he text me with a message….”If you don’t complete the transfer fee to the title company you will have spent 11,000.00 on nothing.  It would be best for us to handle this because of the attorney fees that you will have to pay on both sides of the contract. 

         On December 18 I also filed a claim with the Attorney Generals Office (****** *******) in Louisville Kentucky.

         I have also notified all credit bureaus. I also filed a complaint with Discover (Fraud) card. 

    I recently contacted a personal attorney, but I have not conferred with them yet.

    I Attended an Exit Timeshare presentation. They initiated opening a Barclays RCI credit card and charging $11,199 to this card in our name. I have sent a certified letter to Foxborough Resort requesting to OPT Out. I spoke to *****************************, Customer Support at The Park **********************, *****************************************************************************. She acknowledged receiving the certified copy Opt Out request. She then wanted to know if we wanted a check mailed for the $11,199 or a credit back to the credit card. I responded to credit the credit card. She said she would do that but we needed to sign a docu-sign form. She was to email this to us. We have not received the form. We have not received any further response or communication. We have filed fraud charges with the ******** Attorney General and fraud charges with ************* RCI.

    Details: - Trans Dt 05-11-23 - Charged $12900.00 to incorrect
    Credit Card w/o authorization - RCI committed to issue a Bank of America interest-free credit card for 100 months to which the above amount of $12,900.00 was to be charged - Issues have been identified that the legal paperwork is full of errors and customer service has been notified and they have done nothing but ignore my requests. (See attachment) - No attempt has been made by RCI to correct these issues or contact me about any resolutions - Contract number #9632; client #12322 - We have contacted Customer Service several times and been ignored and put on hold for more than 2 hours without follow-up. - I have sent a check, priority mail to Resort Title Research as requested.

    I am rejecting this response because: 

    It is not accurate.  ****** has tried to correct some of the problems that his traveling staff have made.

    They did not follow-up on initializing a new 0% interest account and added charges to my personal account that I instructed them not to charge too!!

    Not pleased with the outcome of this situation. I was told previously that these charges would be reversed and not that they cannot be reversed.

    I recently became aware that in October 2021, Colorado Springs, my parents, ******* and ***************************** were solicited ( via live phone call) to go to a presentation where they would be released of any obligation of a timeshare acquired in 2014. They havent traveled since 2018, unless accompanied by me, and have not utilized their timeshare to make it cost effective. They are still being billed for maintenance fees, and have received no additional paperwork from the company that did the transfer ( but have signed documentation stating that Marriott desert springs villas ** and *******************, were transferred under a corporate exception to release them from ownerships. Instead they left as owner/members of another resort property. With $10,000 in transaction fees. they are elderly, cognitively, impaired, ( I have a power of attorney so Im able to speak and investigate on their behalf). Nobody will call me back from the actual company, although Ive spoken with several others that were on the periphery of that transaction, or previous ones. There are several negative reviews online about this company, called Foxborough resorts and the park at Foxborough. Club 365 is somehow involved. Although they say they ( club 365) never receive money from clients at all that they get paid from another entity, usually the property or the corporate owner of the property. The payment authorization form that my parents thought were attorneys fees says its for club 365 fulfillment. $6254. There are another $4000 in processing fees to ******************* and desert springs Marriott. Several of the emails and/or phone numbers from the paperwork are no longer in service.Im sure there are some missing information. Ideally, Id like to get my parents, some sort of refund and release them from all liability and ownership.

    We stayed here over the Labor Day weekend after winning a Condo stay at a Charitable auction. We were charged over $200 for a stain in the carpet that they say we left. The stain was already there when we checked in, we just didn't report it because didn't know we had to. There were instructions about missing dishes and other things in the condo, which we did an inventory on all that stuff and turned it in to the front desk. I disputed the charges with my credit card company right away, but just found out because I signed some paper when we checked in saying that they could charge my cc for any damages, that they can't stop the charge.

    I apologize for the delay in communication on this issue. It is standard procedure for all hotels to have a clause in their registration paperwork that you must report any damage upon entering the room so that you will not be charged for it when you leave. You did try to chargeback the fee with your credit card company multiple times and they sided with the resort. In this case we had both reports from housekeeping and maintenance turn in the giant red stain on your day of checkout and employees from both departments said they were positive it was not there the day you checked in as we do inspections prior to check-in as well as the day guests leave. We charged you $200 for the carpet cleaning but the stain was never able to come out so we did end up having to replace the carpet in that room which cost a lot more than $200 in the end. We hope hope you still had a great time in ******* and are more vigilant in reading your registration forms at check in.
