      My personal vehicle was booted by LMS Parking on 2/2/2023 at the address *** ******* ** ***** ****** ** *****. I was charged $160 at approximately 9:00 pm by an attendant working for the company. I am making a complaint because after reviewing the towing/parking ordinances for the town of Boone, the signage required in the parking lot does not meet the standards described in the ordinance and is unlawful. The ordinance states that the signage related to the parking lot must have a white background with red lettering facing the parking spaces applicable to the signage. The only sign in the specified parking lot that meets even some of the requirements is not facing the parking spots in question, nor does it specify which parking spots it applies to. There is only one sign facing the related parking spaces, but this sign does not meet the required color standards nor the size requirements stated in the town ordinance. Because of this I believe LMS parking has performed multiple illegal vehicle immobilizations due to incorrect and confusing signage. The only signage that met the descriptive requirements of the ordinance is in no way facing the parking spots I was booted in, nor is it visible from the parking lot in question in any way. The only visible sign is in no way in regulation regarding ordinance. Additionally, this inadequate sign does not display the information required in the ordinance such as parking hours, the contact number for LMS Parking, or a warning of immobilization.

      I am a resident at **** ****** ***** ** *****, and I pay $90/month for my parking space there. My parking is through LMS Parking, not my apartment complex. My car recently broke down and I have a loaner car. I called LMS multiple times to report my temporary vehicle and got the recording every time. It said to leave a message, and someone would be in contact with me. I left 2 voicemails and called many more times. No one ever reached out. My car was booted and when I called to get the boot removed and let them know the situation, they said they couldn't find record of my messages or calls - even though I have the call log on my phone. They said I would have to pay the $160 that Saturday and wait until Monday when the IT tech was in office for them to find my messages. I asked how they would all of a sudden be able to find my messages on Monday when they weren't able to find them on Saturday. He assured me that they would find them and reimburse me my $160 on Monday. I called him back on Monday and he said I had reminded him to check for the messages and that he would call me back in 5 minutes. He never returned my call. I called multiple more times throughout the week and never got an answer or a call back. I am now wrongfully out $160 for weeks and no one is able to give me any information on when I will be getting my money back. I have all my call logs to prove that I called multiple times and left voicemails. It is unacceptable that the communication has been so poor and I have been forced to pay $160 - not a small amount of money - because no one was answering the phone lines for me to report my issue, and something is clearly wrong with their machine if they are unable to find the voicemails I 100% left. I left another written message on their "contact us" page in hopes that this would get through. Up until now, no one has been able to put me in contact with anyone who is able to resolve the situation.

      Temporary rental vehicles can be registered with your leasing office or by calling LMS Parking. If all agents are currently assisting other callers then a voicemail would be required.       There has been no communication of an illegible message. I was misled to believe that they would "find" my voicemail and then issue me a refund. They mentioned their voicemails sometimes go to different servers and they would need their IT tech to find mine. He assured me if there was a voicemail left, they would find it. Nothing was ever mentioned about illegible voicemails or any issues with their system that could possibly lead to not finding either one of my messages that I left. I pay $90 a month for my parking spot and it is not right for me to have to pay an additional $160 because their staff was unable to answer the phone for me to report my issue each time I called, let alone respond to any of the voicemails left. LMS has been extremely unprofessional and unreliable. There has been little to no communication with me on the status of my issue, not to mention they will not answer or return my calls since I made payment. 

      Again, it is not right for me to have to pay an additional $160 because they are unable to field calls or return messages reporting my temporary vehicle. They have also been providing no information or help with this issue thus far. I would not be surprised if this isn't the first time they have made $160 due to not answering their phones and "not finding" voicemails that were left.

      Registered my vehicle to park at my sistes for 6 hours. I got there at 2 which gave me till 8 to leave. At approximately between 6-6:30 the company locked my tire up. Their justification, I forgot to enter 3 letters from my license plate, yet I received confirmation that it was registered.

      When registering a vehicle the form specifically states "Incorrectly entering your Vehicle Tag # could result in your vehicle getting wheel locked and/or towed". If the vehicle's information was not entered in correctly then the vehicle could be wheel locked or towed at the vehicle owner's expense. The confirmation email gives details on what was entered in. Upon receiving the email the vehicle owner can review and make corrections as needed by submitting the correct information. The confirmation email is an automated email sent out when the applicant submits a form.

      Visiting my daughter out of state, parked in visitor parking for 72 hrs. Went to add time the next day as their site said and they tire locked my car.       Visitors are limited to 72 consecutive hours or 3 days in a row to allow access for all leaseholders of the community to have a visitor park on site since visitor parking is limited and first come first served. These parking rules are established by the community's management. It is the residents' responsibility to inform their guests of the community's rules to include parking.

      I have submitted a picture stating I could not add additional time, however I could register again the NEXT DAY. These directions are the writing of a first grader as they explain nothing . I was going to do that when I found the car locked up. My daughter has been here for a week, she did not know this. She is going to make complaint with the leasing office as guests have to park on the highway 2 miles away. This is unacceptable, no sign near any of these visitor lots.  '?.

      This company was hired to "enhance" parking where I live in *********** **. All it has done is made it where we cannot park in the convenience of the 1st floor, but have to all be piled in floors 1-4. (the 5th floor is technically the 4th and isn't covered)
      This started last Tuesday while I was out of town on vacation in ********. I had my car moved to the 2nd floor (there was literally not one spot available anywhere). When I came back the entire first floor was empty, so as I was headed to the gym at 7pm, I ran inside to get my mail. My windows were open, my doors were unlocked, my radio was on. I came back 3:45 seconds later and there was a boot freshly put on my car and the gentlemen was now working on the next vehicle up from mine. This entire situation has already infuriated the entire building and there are numerous posts on this. I do UNDERSTAND that when there is an event or a concert they should use the bottom 2 floors for money making to put towards our building. That being said, when there is no event, any resident should be allowed to park there. There are NUMEROUS of us who feel this way and parked this way until this situation occurred. I am in no way trying to upset my leasing office or LMS, but this is ridiculous. I paid $130.00 to this gentlemen for him to remove my boot. I feel taken advantage of. There is absolutely no parking now that I have returned, so I have parked my car out front uncovered. NOW all this rule has done has made every single street spot full which I figure will be a way for either the city or building to take advantage of. Currently in the covered spots, there are 2, yes TWO open spots. I have walked the entire floor on each with my camera that I can share. We have over 500 residents and only 10 visitor spots on floor 4? Crazy. They NEED to open up the bottom floor for residents and when there IS an event or we have pre warning-LIKE ALMOST every other building and or city gives you warning, we move our cars by the time assigne

      Hi there, 

      While I understand that the bottom floor is now for commercial space, there are no commercial places located at the bottom of this building. I was scared in the start to even debate this as I want to renew my lease and am still waiting on the things needed to get that done. I must however say this reply and the answers everyone is getting is HIGHLY disappointing. The bottom floor has been completely empty every single day that we have had this new rule in place. That is over 200 spaces not being used. You go through floors 1-4 and there are 5, yes count them FIVE spots open which are hard to fit in. Throw in the fact that the street parking is now completely full from the people who also are upset by this parking situation. Let's say the town gets on that for paid (which I can only assume will happen soon) that is another 40 spots to fill up the parking deck = NO SPACES available. I and other residents are going to continue to email, call, and reach out to both DF, Pier 33, AND LMS until this can get a resolution for BOTH parties. I understand the money that can be made from the parking... here's a solution as they do at many buildings and cities throughout the United States. The night before a big event (concert at Live Oak, the marathon, etc.) put a sign up and send an email out that all cars are to be past the gate or they are subject to a boot or tow. I can guarantee you we all understand and will make sure that the cars are moved for said paid events. When there are NO events in the area, we can park in the parking lot which is attached to where we live so we can simply have easier access to our apartments. I am already being charged an amenity for trash that I do not use, now parking is part of my living I am being asked to spend 100 a month on. I simply ask considerations that our residents can park in floors 0-1 while there are no events, etc. If anyone would like to speak with me face to face so I can layout other ideas on how this would work for both parties, that would be fantastic. Again, looking forward to a resolution that is fit for more than just LMS and booting / tows and that both the resident can be taken care of AND money be made by those who need it.

      Jan 10, 2023, we fell victim to predatory wheel locking in violation of of the City of ********* City Ordinance. My car was booted for allegedly “parking over the white line.” This is not accurate nor is signage in compliance with ordinance to enforce this as a violation. The vehicle was not occupying more than one space and the only enforceable sign present was referencing reserved parking spaces (which this was not.) Images attached for reference. I am seeking full reimbursement of the $180 that was required to remove the wheel lock

      This **** ******* was wheel locked for parking within a parking deck where a valid parking permit is required. Signs can be found at the entrances to this deck that state "Permit Parking". Unfortunately since this vehicle was parked against the community's posted rules and was wheel lock in accordance with all local ordinances no refund or reimbursement will be authorized.

      Correct, sign at the entrance to parking deck states permit parking only. All parking spaces within the parking deck are then parking by permit only. A valid parking permit must be displayed at all times while parked inside the parking deck. Assigned reserved spaces are provided at an additional cost for permitted vehicles. All non-permitted vehicles must park in the visitor parking section outside of the gated area. No further action will be taken.

      A boot was placed on my car and it took 2hours from the time I called them to request them to remove it which seems a little crazy. Received a call from a number with an area code that’s not from around my area, not associated with business, and different than the number left on my vehicle. Caller did not leave a voicemail but then texted and said they are with booting company and are leaving and charging me a fee. I texted back immediately saying I am walking to car but they said they had already left. Texted and explained that it was unfair they did that and they said they would assign me to another agent

      All vehicles are responded to in the order at which they are received. Local agents cannot call out from our land lines when they are in the field, just like many other service companies. Unfortunately when our agents arrive and there is no person available at the vehicle they will have to leave to respond to other vehicle requests.       My car was booted overnight at my brothers apartment. I was staying there to take care of his cat. I was given a temporary parking pass made of paper which I left on my dash. However, after driving home from a 16 hour shift at the hospital, it must have fallen off of the dash onto the passenger seat or floor. I woke up on Sunday for a 12 hour shift and found my car booted at 6:37 a.m. I called the number there immediately, left a message and sent a text. I called both numbers provided on the slip a total of 7 times over the next two hours with no response. I had to wake my parents up and have them drive an hour to take me to work.

      The company did not get back to me until 5 hours and 9 minutes after my first call, which I believe is a misdemeanor in Charlotte NC. The two hours I was not at work, meant that the hospital floor I work on was understaffed for those two hours. The hospital is already stretched thin on Sundays.

      At work, I thought that certainly after it could be shown that I was parked there legally and after the company was clearly in the wrong that they would take the boot off free of charge.
      However, when they finally showed up at ~9:30 pm that was not the case. My brother and his fiancé got home so I could not sleep at his apartment and was forced out of necessity to pay the 140$.

      If I could go back in time, I would have angle ground the boot off my car and begged them to take me to court for the supposed 3,000$ fine. This company does not operate legally, or morally. They use technicalities to extort money from people, and are not interested in the spirit of the law. They are only interested in what the law enables them to take from people. People who don’t have the money or time to engage in the legal system.

      The company clearly does not operate within state and city ordinances, at least in this instance. One of the ordinances that is very important to follow is the time frame required by a booting business to respond within. Which is most areas is at most an hour, and some areas is 15 minutes. You have broken an important rule, but what recourse do I have? I didn’t follow a rule and was charged 140$ which is a lot of money for me, you broke a rule and there are no consequences.

      On 10/22 I was wrongfully booted at the ***** ****** apts. I was in visitor parking and still received a boot. To get it removed I was charged $140 cash which is ridiculous and clear extortion. It shouldn’t be that much in no situation. There were plenty of open spaces lms is a greed company that takes advantage of ppl.

      All vehicles parked within the community must park in accordance with the community's posted parking regulations. After reviewing the photos of every vehicle wheel locked on this date we can see that this vehicle was not parked within a marked VISITOR parking space.       After parking in an unmarked parking spot in the visitor section of a garage, my car was unjustly booted due to not having a parking pass.

      I called the company to complain, and the operator told me the garage becomes "permit only" after 9pm. This "rule" is not displayed anywhere in the garage. As seen in the attached video, the sign says permit only parking, which contradicts the operators justification. Additionally, the sign does not give information about time restrictions, and the wall of the garage also has signage displaying visitor parking.

      The signage does not reflect the supposed rules of the garage and is deliberately misleading.

      The sign says Permit Only Parking, to be parked there all vehicles must display a valid parking permit. During business hours vehicles may park within the spaces specifically designated for the business they are patronizing. Those spaces are clearly marked.
