DNF Associates, LLC (hereinafter, "DNF') has received the above referenced complaint, which has been forwarded for investigation and response.To clarify for Mr. **********; DNF is a passive debt-buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts.We do not havethe ability to open lines of credit nor perform collection services or accept payments.DNF received notice of Mr. ************' fraud claim on 02/26/2024. On 03/02/2024, DNF mailed a fraud packet to Mr. **********' confirmed mailing address. On 04/01/2024, DNF received the completed fraud packet and started an investigation.On 04/18/2024, amidst our monthly mass Account update, DNF sent a deletion request to **********and marked the account to be returned to the Originator. After reviewing several accounts, DNF was made aware of an error regarding the transmission of the data. This error had since been corrected.Unfortunately, on 04/24/2024, before ********** had reflected our update, Mr. ********** sent in a credit dispute. This action locked his tradeline and our corrected fde was not applied. Please find attachedproof of deletion request in response to Mr. ***********' dispute. On april 2nd i called dnf and they gave another number to call to settle debt. I called that company, they said they negotiate for dnf ..we came to an agreement on a payoff. The person said at the end of the day I would receive settlement letter and i would receive a letter from dnf. I have not received any letters, now when I call the company i paid off it goes to a voice mail or hangs up on me. I was ripped off $1kBusiness Response

Upon receipt of the complaint, the Account in question was closed with the current collection agency and placed in a cease status. To clarify for Mr. *********; DNF is a passive debt-buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open lines of credit nor perform collection services or accept payments. The Account in question was placed with ** ******** ********* (Hereinafter, "****") on or around 01/31/2024. After investigation, **** informed DNF that, as of the date of this response, no payments have been made towards the Account. DNF reached out to all prior agencies the Account was placed with since our purchasing of the Account. Still, each agency reported that no payments have been posted to the Account. To investigate further, DNF needs proof of payment (I.E. – bank statements) and the phone number Mr. ********* called to make this alleged payment. - The Account in question was opened with Ms. ****'s social security number, birthdate, her confirmed address of ** ******* **** ******** ** 12550 and her confirmed daytime phone number *************.
- The Account was opened on 10/21/2020 and was charged off due to delinquency on 10/28/2022 with a balance of $1019.51. Ms. **** made her last payment towards the Account on or around 03/01/2022 in the amount of $186.00 via debit. Billing statements to support this have been attached to this response.
- DNF placed a tradeline on Ms. ****'s Trans Union credit profile on or around 04/03/2023. As the current creditor and owner of the Account, FCRA laws allow this. Since DNF has received this complaint, a dispute code has been added to the tradeline to indicate it is in dispute.
- Because of the extensive account history and the information being linked to Ms. ****, we do not find the Account to be fraudulent in nature. If Ms. **** can provide proof of fraudulent activity, we will reinvestigate. If Ms. **** would like to discuss how to resolve the amount owed, she may contact

- The Account in question was opened with Mr. ********* social security number, birthdate and a confirmed address of *** * *** ** *** ********** ** 35211.
- The Account was opened on 06/09/2021 and was charged off due to delinquency on 08/04/2022 with a balance of $11,070.49. Mr. ******* made his last payment towards the Account on or around 09/09/2021 in the amount of $283.00 through an online portal serviced by the Originator. Billing statements to support this have been attached to this response.
- Additionally, a former collection agency hired by DNF sent several collection notices to Mr. ******* via email to ***************@GMAIL.COM. The agency has no record of any dispute received in response to these notices. The notice described has been attached to this response.
- DNF placed a tradeline on Mr. ********* Trans Union credit profile on or around 04/03/2023. As the current creditor and owner of the Account, FCRA laws allow this. Since DNF has received this complaint, a dispute code has been added to the tradeline to indicate it is in dispute.

Hello BBB;DNF Associates;; I demand that this be deleted from my credit report effective today as I do not recognized this account, no knowledge and no prior contractual obligations with this company. You violated my rights rights under §15 USC codes sections 1692 d, e f g of FCRA/FDCPA. Remove from my credit report. You violated §1692d of the FDCPA by engaging in conduct that the natural consequences of which was to harass, oppress, and abuse client in connection with the collection of an alleged debt and the collection letter you sent me which contains veiled and empty threats of legal action;
You violated §1692e of the FDCPA by its use of any false, deceptive, or misleading representation or means in connection with the collection of any debt when you engaged in, at least, the following discrete violations of § 1692e;
You violated §1692e(2)(A) of the FDCPA with its false representation of the character, amount, or legal status of any debt and the collection letter you sent me which contains veiled threats of legal action against me, the client;

Ms. ******* made her last payment towards the Account on or around 04/29/2022 in the amount of $100.00 via text. Billing statements to support this have been attached to this response.
Additionally, a former collection agency hired by DNF sent an initial collection notice on or around 02/06/2023, which would include her right to dispute. This notice was sent to Ms. ******* via USPS to her confirmed mailing address. The agency has no record of any dispute received in response to that notice. To clarify for Ms. ******; DNF is a passive debt-buyer that purchases charged off receivables and

have the ability to open lines of credit nor perform collection services or accept payments.
Ms. ******'s TBOM / ******* / **** ******** ********* LLC account ending in 5931
(Hereinafter, "the account^^) was purchased directly from The **** ** ******** on or around
06/15/2023. A copy of the Bill of Sale from that purchase has been attached to this response. When
the Account was purchased, DNF adopted the Originator's rights associated, including credt
reporting as the current owner of the Account.
Ms. ****** was sent an initial collection notice a collection agency hired by DNF. A copy of that notice
has been attached to tlGs response. In this notice, not once did the collection agency threaten any legal
action. Instead, they adhered to all collection and coinpliance laws applicable.
DNF placed a tradeline on Ms. ******'s ***** ***** credit profile on or around 08/15/2023. As tl~e
current creditor of the Account, FCRA laws allow this. Ms. ****** acted on a reduced amount
settlement offer and paid the collection agency on 08/30/2023. The Account in question has been
paid as agreed since.
In an act of good faith, DNF has decided to remove the tradeline, even if not legally required to do
so. Attached to this response you will find a copy of the deletion request to ***** *****, as well as. a
paid in full letter issued by DNF.

Mr. *****'s **** * ******* ****** ****** * ********* *** *** ******* account ending in **** (Hereinafter, "the Account") was purchased directly from *** **** ** ******** on or around 01/18/2023. A copy of the Bill of Sale from that purchase has been attached to this response. When the Account was purchased, DNF adopted the Originator's rights associated, including credit reporting as the current owner of the Account. The Originator sent Mr. ***** notice of this sale via email to ********************. A copy of that notice has been attached to this response. The Originator did not notify us of any dispute received in response to this notice. Mr. ***** was sent several collection notices via email by a collection agency hired by DNF. A copy of that initial notice has been attached to this response. The collection agency's system indicates Mr. ***** opened and viewed these notices on several occasions. The collection agency did not notify us of any dispute received in response to these notices. Since, DNF has placed the Account with several different agencies, as it is common practice. To date, no payments have been made to DNF or any of its agencies. The Account in question was opened on or around 03/29/2021 with Mr. ***** social security number, his birthday, his email of ********************, his confirmed daytime number of ***** ******** and an address of ***** ********* **** ******** ** *****. A copy of the Application Summary has been attached to this response. Later billing statements indicate Mr. ***** updated the Originator with his new mailing address of ***** ****** ** *** ******* ** ****** Mr. ***** made his final payment via debit card to the Originator on or around 05/03/2022 in the amount of $122.00. Subsequently, the Account was charged off due to delinquency on 12/02/2022 with a balance of $995.64. Billing statements to support this have been attached to our response. DNF placed a tradeline on Mr. *****'s ***** ***** credit profile on or around 04/03/2023. As the current creditor of the Account, FCRA laws allow this. The statute for reporting an account is seven (7) years after the first date of delinquency. The Account is due for removal in or prior to June of 2029. Because of the excess Account History and the information being linked to Mr. *****, we do not find the Account to be fraudulent in nature. I have provided sufficient documentation as to why I do not agree with the response from the business. Please see attached form from my previous response. Per FCRA I as a consumer am supposed to be protected from predatory and illegal collections actions such as the practices that DNF Associates has utilized on me. I have request and spoke to the company numerous times asking for the original contract signed with a wet signature, To verify the validity of said debts. To which none have been supplied and other documents have been supplied all of which do not adhere to the federal regulations along with state regulatory laws and are not listed as sufficient documentation needed for my request. When the Account was purchased by DNF, the placement file from the Original Creditor contained
Mr. *******'s full social security number, birthday, a daytime phone number of ###-###-####, a

Mr. ******* was sent an initial collection notice from a former collection agency lked by DNF on
08/01/2023 and 08/07/2024. The collection agency did not notify us of any dispute after receipt of
that notice. Contrarily, Mr. ******* discussed settlement options with this agency on 08/15/2023 via
phone call but was not willing to set up this offer wit31 banking information. Mr. ******* was sent a
second notice from the same agency on 08/21/2023, offering a settlement in writing. The collection
agency's system indicates Mr. ******* opened these notifications on several occasions. Still, no
dispute was received in response. Copies of these notices have been attached to our response.
DNF placed a tradehe on Mr. *******'s ***** ***** credit profile on or around 11/14/2023. As
the current creditor of the Account, FCRA laws allow this. The statute for removing an account is
seven (7) years after the first date of delinquency.
If after reviewing the attached information Mr. ******* would like to resolve the balance due, he inay
contact DNF during business hours and we will then place the Account with a collection agency to
collect on our behalf.

I am writing to formally dispute a negative item on my credit report associated with the account number [****************] held by DNF ASSOC. Upon reviewing my credit report, I discovered inaccuracies that are in violation of my rights under several statutes, including the Fair Credit Reporting Act (FCRA).
First and foremost, I must address the issue of privacy rights protected under the Health Insurance Portability and Accountability Act (HIPAA). As outlined in 15 USC 6803, I maintain the right to privacy concerning my personal information, which extends to any medical or healthcare-related data. The inclusion of this information in a credit report without my explicit consent is a direct violation of my HIPAA rights. Therefore, I request that any medical-related information be promptly removed from my credit report.
Furthermore, under 15 USC 1692g(b), it is mandated that upon receiving notice of a dispute, the disputed account must be investigated and, if found to be inaccurate or incomplete, promptly deleted. I am formally notifying you of this dispute and requesting that the account in question be thoroughly investigated and removed from my credit report if any inaccuracies are found.
Moreover, I demand full compliance with 15 USC 1681n and 15 USC 1681o, which require both the furnisher of the information and the credit reporting agency to ensure the accuracy and completeness of the information provided. It is evident that proper procedures have not been followed in this case, as evidenced by the inaccuracies present on my credit report.
In order to facilitate a thorough investigation, I hereby request account-level documentation pertaining to the disputed account, including but not limited to records from the furnisher and any communication between the furnisher and the credit reporting agency. It is imperative that all parties involved fulfill their legal obligations to ensure the integrity of my credit report.Business Response

DNF Associates, LLC (Hereinafter, "DNF") has received the above referenced complaint, which has been forwarded for investigation and response. Upon receipt of the complaint, the Account in question was closed with the current collection agency and placed in a cease status. To clarify for Mr. *******; DNF is a passive debt-buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open credit lines nor perform collection services or accept payments. Mr. *******'s **** * ******* * ******* ***** ********* account ending in **** (Hereinafter, "the Account") was purchased directly from *** **** ** ******** on or around 10/23/2023. A copy of the Bill of Sale from that purchase has been attached to this response. The Original Creditor sent Mr. ******* notice of the sale via email to T*******[email protected]. A copy of that notice has been attached to this response. The Original Creditor did not notify us of any dispute received in response to that notification. When the Account was purchased by DNF, the placement file from the Original Creditor contained Mr. *******'s full social security number, birthday, a mailing address of *** ******** ** ******* ** ***** and an email of **********************. We have since updated Mr. *******'s file to his most recent mailing address. We urge Mr. ******* to review the Health Insurance Portability and Accountability Act ("HIPAA") to understand its lack of relevance to the Account in question. The Account owned by DNF is a retail account, unrelated to Health Insurance or any medical claim or service. If after reviewing the attached information Mr. ******* would like to discuss how to resolve the balance owed on the Account, he may contact DNF during business hours and we will then place the Account with a collection agency to collect on our behalf. Someone by the name of James *****, called a family member looking for me. I am sure the tactics used to obtain my personal information and family members phone number are AGAINST federal laws & Fair Debt Collection Practices Act. I do not have a contract with DNF Associates (also known as ******* ********** ******** ***) and I did not sign any paperwork stating that I am under any financial obligations with this company. They did not provide any validation or original contract as I requested.Business Response

To clarify for Mr. *******, DNF Associates, LLC (Hereinafter, "DNF") is a passive debt buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to perform collection services or accept payments. DNF is not "also known as ******* ********** ******** ****". The collection agency was hired by DNF to collect on our behalf. Mr. *******' delinquent ******* * **** account ending in **** (Hereinafter, "the Account") was purchased directly from ********* **** in October of 2023. A copy of the Bill of Sale from that purchase has been attached to this response. ********* **** sent Mr. ******* notice of this transaction via **** on 10/28/2023. Please find attached a copy of that letter sent to the Complainant. Preceding this, on 04/27/2023, Mr. ******* signed an Installment Loan Contract with ********* **** * ******* ****** and he agreed to their Terms of Service. Mr. ******* failed to adhere to the terms of this Contract when he failed to make any payments towards the Loan. A copy of this signed contract has been attached to this response. These terms include and are not limited to: “12. ASSIGNMENT. We may assign your Loan and sell, assign or transfer any or all of our rights or duties under this Contract to another financial institution or company without prior notice to you. That person will take our place under this Contract" Furthermore, DNF would like to clarify that it is lawful per the FDCPA for a collection agency to call family members to inquire about Location Information. To fully validate the Account, we have also attached the full Account Pay History, confirming a charge-off balance currently due to DNF in the amount of $2236.07. DNF furnished a tradeline to Mr. *******'s ***** ***** credit profile on or around 01/16/2024. FCRA laws allow this, as DNF meets the requirements for a passive debt-buyer and current creditor of the Account. The statute for reporting a collection account is seven (7) years after the first date of delinquency. This tradeline is due to be removed in or prior to June of 2030. If after reviewing this information, Mr. ******* would like to discuss how to resolve the Account, he may contact DNF during business hours. We will then place the Account with a collection agency to negotiate and take payment on DNF's behalf. Thank you for the opportunity to respond to this matter.
