To clarify for Mr. ******, DNF is a passive debt buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open credit accounts nor perform collection services or accept payments.  Mr. ******'s delinquent **** * ******* ****** ****** * ****** ****** account ending in **** (Hereinafter, "the Account") was purchased directly from *** **** ** ******** in April of 2023. A copy of the Bill of Sale from that purchase has been attached to this response. the Original Creditor sent Mr. Proceeding this transaction,  ****** notice via email to *******************. A copy of that notice has been attached to this response. The Original Creditor did not notify us of any dispute received in response to that notification.  When the Account was purchased by DNF, the placement file from the Original Creditor contained Mr. ******'s full social security number, birthday, a mailing address of *** ****** ** *********** ** ***** and an email of *******************. We have since updated his file to reflect his most recent mailing address.  The final purchase made on the Account was on or around 08/11/2022. A copy of the billing statement. including this purchase has been attached to this response. Mr. ******'s final payment was made directly to the Original Creditor towards the Account on 07/27/2022 in the amount of $378.00. Subsequently, the Account charged off due to delinquency on 03/19/2023 with a balance of $ 4153.04. Billing statements to support this have also been attached to this response.  DNF investigated Mr. ******'s claims of being threatened with legal action. Of the four (4) collection agencies DNF has placed the Account with since our purchase, no legal threats were made on any recordings DNF reviewed. If Mr. ****** can provide more information to this claim, DNF will reinvestigate.  DNF furnished a ********* to Mr. ******'s ***** ***** credit profile on or around 08/15/2023. FCRA laws allow this, as DNF meets the requirements for a passive debt-buyer and current creditor of the  Account. The statute for reporting a collection account is seven (7) years after the first date of delinquency. This ********* is due to be removed in or prior to September of 2029.  If after reviewing the provided information, Mr. ****** would like to resolve the outstanding balance, he may contact our office at ************ during our business hours, and we will place it with a collection agency to assist him in negotiation and payment. Thank you for the opportunity to respond to this matter. These people are relentless. They garnished my paycheck with no prior notice stating that my employer is responsible for notifying me of legal action to garnish my wages. The company that they "bought" the account from has actually provided me credit over the past 12 months, so I do not understand how a company can legally "buy" a debt and collect on it. I am out $499.35 that was to be used to get my car fixed so my child can remain gainfully employed in this messed up system that constantly goes after we hard workers that may have stumbled financially in the past due to hardship, Covid, or just trying to manage day-to-day living. This type of predatory behavior by multi-million dollar companies needs to be stopped. I am notifying my state senator.

    Business Response

    Date: 02/15/2024

DNF Associates, LLC (Hereinafter, "DNF") has received the above referenced complaint, which has been forwarded for investigation and response. To clarify for Ms. ********, DNF is a passive debt buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open credit accounts nor perform collection services or accept payments.  After investigation, we were able to locate two separate accounts purchased by DNF associated with Ms. ********. We can only assume she's referring to the Account that has not yet been paid as agreed.  According to the Attorney, Ms. ******** was sent notice on both accounts on 07/09/2020. The first account Ms. ******** resolved was sent for garnishment 04/06/2022. Ms. ******** made contact with the Attorneys 08/02/2022 and was able to come to a payment agreement. Garnishment was then released.  The Account we assume Ms. ******** is referring to in her complaint was sent and approved for garnishment in December of 2022. She would have been notified by her employer, as she stated in her Complaint.  Debt-buying is a common practice. DNF acquired the Account from the Original Creditor; this includes all the Original Creditor's rights per the Terms & Conditions. As the Current Creditor, DNF is well within its rights to place the Account with a collection agency or collection attorney for recovery purposes.  We'd like to ensure Ms. ******** DNF has never placed a tradeline on any of the three major credit bureaus regarding this account. If it's being reported by the Original Creditor as a "Charge-off"" or "Sold to another lender", that would be accurate regardless of any payments made to the debt-buyer or their affiliates.  If Ms. ******** has any further questions regarding this Account, we urge her to contact the Attorneys, as they will be most knowledgeable on the next steps after garnishment.  Thank you  for the opportunity to respond to this matter. If we can be of any further assistance, please feel free to contact us directly. Sincerely  David ** ****** Chief Compliance Officer

DNF Associates, LLC has received the above referenced complaint, which has been forwarded for investigation and response. To clarify for Mr. *************, DNF Associates, LLC (Hereinafter, “DNF”) is a passive debt buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to open credit lines nor perform collection services or accept payments.  Mr. *************'s delinquent **** ******** **** account ending in **** (Hereinafter, "the Account") was purchased directly from **** **** **** ******** *********** (Hereinafter, "Original Creditor") by DNF on or around 10/13/2022. A copy of the Form of Assignment and Bill of Sale has been attached to this  response.  The file placed by the Original Creditor contained Mr. *************'s full social security number, his birthdate, an email of ********************, a daytime phone number of ***** ******** and a mailing address of *** ***** ** **** ***** ** *****.  The Account in question was opened 03/30/2018 and the last payment received by the Original Creditor was on or around 09/20/2019 in the amount of $511.00. Subsequently, the Account was charged-off due to delinquency on 05/11/2020 with a balance of $10,638.55. Billing statements supporting this have been attached to this response. With the extensive Account History paired with the many local charges made to the Account, DNF does not find the activity in question to be fraudulent in nature. As the Current Creditor, DNF furnished a tradeline on Mr. *************'s ***** ***** credit report. FCRA laws allow this. The statute for removing a tradeline is seven (7) years after the first date of delinquency, defined as 30 days after the final payment was received by the Original Creditor. This tradeline is due to be removed in or prior to November of 2026.  We wish to apologize to Mr. ************* for any inconvenience this has caused. If he would like to discuss how to resolve the Account, we encourage him to contact us. We will then place the Account with a licensed debt collector for recovery purposes. In the interim, the Account has been placed in a cease status to ensure no further collection efforts are made.  Thank you for the opportunity to respond to this matter. DNF Associates, LLC (Hereinafter, "DNF") has received Mr. *************** response and it has been forwarded for review. We urge Mr. ************* to read the Terms & Conditions associated with the Account in question.
