Ms. **** deliquent ******* ****** ******/****** ***** **** account ending in **** (Hereinafter "the Account") was purchased directly from the **** ** ******** in November 2022. A copy of the Bill of Sale for that purchase has been attached to this response. On 11/23/22 the Original ******or sent Ms. **** notice of this transaction via email to ************************. A copy of that notice has been attached to this response. When the account was purchased, the placement file from the Original Creditor contained Ms. **** full social security number, birthdate, home address of **** ******** ***** and daytime phone number of **********. In order to fully substantiate the validity of the Account, we have also attached the following: The billing statement detailing Ms. **** purchase from ****** ***** **** in the amount of $1,500.00. The billing statement showing Ms. **** final payment of $131.00, as well as the decline of that payment. The final billing statement, showing all interests, fees and principal equaling the charge off balance of $1664.73. The Account charged off to delinquency on 10/25/2022. Currently, DNF Associates, LLC has a ********* on Ms. **** ***** ***** ******. The statute of removing a ********* is seven (7) years after the first date of delinquency. The Account is due to be removed in or prior to April of 2029. Billing statements indicate that Ms. ******* opened the Account with an address of ***** ******* ***** ***** ** ***** but later statements indicate that Ms. ******* updated the original Creditor with her new and current address. In order to fully substantiate the validity of the Account, we have also attached the following: The billing statement detailing Ms. ******* purchase from ****** in the amount of $1532.37. The billing statement showing Ms. ******* final payment of $497.00. The final billing statement, showing all interests, fees and principal equaling the charge off balance of $1212.37. This appeared on my credit report after I had been making payments every two weeks, it was never on my report prior to August 2023, I made made arrangements to pay even thought this never appeared on my report and suddenly it’s added with a entirely in correct balance of what is owed, this has resulted in severe damage to my credit, after I had been paying. We do not have the ability to perform collection services or accept payments. Because we use third party collection agencies, our system does not have “real-time” balance updates. We receive weekly and monthly reports from our network of collection agencies and Attorneys. DNF placed a tradeline on Ms. ******'s ***** ***** credit report on or around 08/15/2023, with the balance our system. showed due at the time. FCRA laws allow this. However, in an act of good faith, DNF has decided to remove the tradeline. A request for removal was sent to ***** ***** on 09/11/2023. A copy of that request has been attached to this response. Please allow 30-45 days for this change to reflect. Please be aware that this decision does not in any way affect DNF's legal ability to replace the tradeline if Ms. ****** fails to adhere to her approved payment plan. I have been continuously contacted by DNF Associates, LLC about a debt that I have no idea about. They continue to call from multiple numbers. I would like them to cease contacting me. I have never had a contract with this company, so I do not owe them anything. Therefore, they should not be placing anything on my credit report. Furthermore, Ms. **** called DNF Associates, LLC on 08/30/2023 at approximately 11:14am EST, to inquire how to resolve the Account. A phone rep gave Ms. **** the information for ******* ********** ******** ****, the contracted collection agency. A copy of that letter has been attached to this response. When Mr. ****** opened the Account on 01/27/2013, he agreed to ********* ****'s Terms of Service. A copy of these terms has been attached to this response. These terms include and are not limited to: "We may assign any and all of our rights under this Agreement at any time without your consent. Any person, company, or bank to whom we assign this Agreement shall be entitled to all of our rights under this Agreement." Furthermore, Mr. ****** settled the Account with the collection agency we contracted on 08/31/2021. We updated his ***** ***** report to show the same on 10/11/2021. When I apply for something in my name last month, I got denied. When I was provided a copy of my credit report, I saw things on there that were inaccurate. Inquiries and addresses that are not mine were on my report as well as accounts that I never opened. I have contacted the creditors to make them aware of the breach. Now, they are requesting that I fill out a full Packet to show cause in order for them to cease reporting to my credit due to this possible identity theft. To clarify for Mr. *********, DNF Associates are a passive debt buyer that purchases charged off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. Upon receipt of the complaint, We investigated Mr. *********'s claim of fraud and have found no evidence of fraudulent activity. In fact, Mr. ********* made payments on the account while it was placed with one our agencies for collections. He made three (3) payments of $123.44 on 3/31/2023, 4/30/2023 and 5/31/2023. The account was placed with another agency most recently (7/28/2023) and Mr. ********* requested a settlement to resolve the account and was provided $1,205.00 in 2 parts to resolve and at no time did he mention fraud prior at any point in time. To clarify for Mr. *****, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if deemed necessary. Our company does not attempt to contact consumers to recover past due balances or litigate, we outsource such services. The account in question was contained in a portfolio of accounts purchased directly from *** **** ** ******** in March 2023. This was a forward flow agreement with *** **** ** ********, where once an account was charged off, it was sold and transferred to DNF Associates. The account was for ****** *********, with an account address of **** ******* ***** ****** *** ** ********** ** *****. The account was opened on January 16, 2022, had a last payment of $138.00 on June 23, 2022, was charged off on February 15, 2023 with an outstanding balance of $2364.63 and a statute of limitations date of June 23, 2025. The account was placed on Mr. *****'s ***** ***** Credit Bureau Report on May 15, 2023. DNF Associates does not place tradelines through any other credit reporting bureau. When the account was purchased, the placement file contained Mr. *****'s full social security number, birthday, and address of **** ******* ***** ****** *** ** ********** ** ***** and email of ********************. In order to substantiate the validity of the account, we have also attached the following: The Bill of Sale between *** **** ** ******** and DNF Associates, substantiating our purchase of the account. The billing statement detailing Mr. *****' purchase from ****** ********* in the amount of $2,262.92. The final payment statement, acknowledging Mr. *****'s payment of $138.00 via his debit card. The charge-off statement, showing all interest and fees after charge-off for the balance of $2364.63. In order for this account to meet the proper validation requirements in accordance with FDCPA I demand you submit the requested items below. Failure to provide all highly requested items or address a fact than your silence shall equate to agreement of the fact that you are furnishing an invalidated account along with all violations alleged below. Please provide a detailed expounder for the following items requested below to confirm the validity/Verification of this alleged debt: 1) An explanation of what this alleged account balance is for. 2) A complete Audit Trail calculation of this balance, including the complete payment history on this account, so I have proof that the amount is correct. 3) a contract/ agreement between me and your company signed by both party’s which articulates mutual consideration that would induce me to pay you on this alleged debt. 4) a sworn statement under penalty and perjury that my social security card was not used In order to open this account. 5) certified mail receipt with proof of delivery to the right consumer showing that a dunning letter has been submitted to me within 5 days of the reporting of this account in accordance with 12 CFR 1006 model form B-1 to assure you have not violated my rights under 15 USC 1692g. 6) Provide All promissory notes & original contracts authenticated by me and the alleged original creditor both sides must be original not fraudulent copies. which expresses mutual assent to assure “meeting of minds” (Without 2 signatures there is no meeting of minds therefore no valid contract) 7)Swear under penalty of perjury that you have firsthand knowledge regarding to this account. otherwise, you legally cannot validate this debt. (Verification) 8) provide me all documents you have submitted to CRA’s in order to successfully create this account, if any of them are from the alleged original creditor you will be held liable under 15 USC 1692j for furnishing a deceptive form. 9) Provide all documentary evidence of account including public and private accounting ledger in accordance with GAAP pursuant 12 USC 1831N(2)(A) and 12 USC 1831N(C) inclusion of balance sheet items 10.) provide your NMLS id to prove that you have a valid License to collect in the State of Florida. Without a state license you will be held liable for illegally collecting in the state. Violations I am alleging your company has committed which has negatively impacted my life: 1. I am alleging that you have created submitted false and fictitious statements to CRA’s (Financial institutions under 15 USC 6827(4)) to make it seem like I owe your company this alleged debt when in fact I do not, as I never contracted nor transacted with your company at any time in the past. Which is punishable under 18 USC 1001. 2. I am alleging that you have used my social security card as a matter of unauthorized use in order to create this account. Violation under 15 USC 1602(p) 3. I am alleging that you have never provided me a validation form in accordance with 12 CFR 1006 model form B-1 within 5 days of reporting this account on my credit report as required by congress. if you believe otherwise, please provide the tracking number with proof of delivery to the right consumer. 4. I am alleging That you have used false and deceptive attempts to collect, according to 12 CFR 1006.2(g) definition of a creditor, a debt buyer is excluded from being a creditor but on my creditor report it shows that your company is my creditor making the reporting of this information false and inaccurate for fact as this would be a deceptive form under 15 USC 1692j. Notice it is fact, that I hereby demand, that you cease and desist all collection activity in regard to the fictionally created account that you have made under my name. unless you can provide me all requested documents with a sworn statement of truth that you have not committed any of these violations on my behalf than this debt will remain as invalidated, and you must delete this account from my credit report immediately. I demand you discharge this alleged debt which in fact do not owe, if you comply with deletion request than there will be no further action taken on my end. Dear BBB Representative: Thank you for the opportunity to address Ms. ******'s concerns regarding *** **** ** ********* ******* ****** ****** for ******. To clarify for Ms. ******, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if deemed necessary. Our company does not attempt to contact consumers to recover past due balances or litigate, we outsource such services. The account in question was contained in a portfolio of accounts purchased directly from *** **** ** ******** in September 2022. This was a forward flow agreement with *** **** ** ********, where once an account was charged off, it was sold and transferred to DNF Associates. The account was for ****** **** ******** with a service address of ***** ***** ******* ***** ******** ******* *****. It was opened on July 16, 2020, had a last payment of $67.00 on March 16, 2022 via debit card and was charged off on October 23, 2022 with an outstanding balance of $2810.00. The account was placed on Ms. ******'s ***** ***** Credit Bureau Report on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau. When the account was purchased, the placement file contained Ms. ******'s full social security number, birthday, and her home address of ***** ***** ******* ***** ******** ******* ***** which is her substantiated address through her current driver's license. In order to substantiate the validity of the account, we have also attached the following: The Bill of Sale between *** **** ** ******** and DNF Associates, substantiating our purchase of the account. The billing statement detailing Ms. ******'s purchase from ****** in the amount of $4000.00 for home services. The final payment statement, acknowledging Ms. ******'s payment of $67.00 via web debit card. The charge-off statement, showing all interest and fees after charge-off for the balance of $2810.40. With regards to Ms. ******'s claim that she does not have a contract with DNF Associates. She is correct, but that has no bearing on the outstanding balance. What Ms. ****** may not understand is this supposed "technically" has no basis of fact. This is a standard dispute, organizations such as ours receive based on misinformation proliferated through the internet. DNF ASSOCIATES **** ** ****** ***** ***** **** ********** ** ****** *** ************* Debt purchasing, like that performed by DNF Associates, is fully legal and regulated on the federal and state level. It is a viable alternative to recoup losses from outstanding receivables for small businesses and lending institutions that do not have formal internal collections. We refer Ms. ****** to her agreement with *** **** ** **************** **** for ******* which specifically states: "ASSIGNMENT; TRANSFER We may sell, assign or transfer all or any portion of your Account and all or any portion of our rights under this Agreement to any other person without prior notice to you. You may not sell, assign or transfer any of your rights under this Agreement.” Simply put, DNF Associates legally purchased the rights to this debt and Ms. ****** now owes DNF Associates $2810.40. Our position remains that there is indisputable evidence to substantiate the debt and that Ms. ****** is the responsible party. In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out for collections. Please note this does not preclude our organization from sending the account to counsel for review. At this time, we must deny Ms. ******' request for tradeline removal due to the amount of substantiating evidence provided by the original creditor. In accordance with the Fair Credit Reporting Act, our tradeline is set to be removed seven years from the first date of delinquency. The first date of delinquency is defined as 30 days after the final payment or April 2022 for this account. Subsequently our trade line will be removed on or before April 2029.
