    Dear CFPB Representative and Ms. ******,  Thank you for bringing this to our attention so we can rectify this matter.  To clarify for Ms. ******, DNF Associates is a passive debt buyer that purchases delinquent accounts and outsources them to a number of national collection agencies for recovery services. In certain instances, we are also a furnisher of information to ***** ***** Credit Bureau.  According to our records, the account in question was purchased by our organization from *** **** ** ******** *** ******* ****** ****** * ***** ***** in February 2023 and outsourced for service. The account was then reported to Ms. ******'s ***** ***** credit bureau report on April 3, 2023.  Based on Ms. ******'s inquiry through the BBB, a request for a complete set of validation documents was sent to the original creditor. Since the original creditor has yet to provide the information in what is deemed to be a reasonable period of time, the account has been closed in our office to ensure no further collections take place and we have requested deletion of our tradeline through ***** ***** Credit Bureau.  In closing we wish to apologize to Ms. ****** for any inconvenience she has been caused by this incident and appreciate her bringing this matter to our attention.     Dear BBB Representative:  Thank you for the opportunity to address Ms. ********' concerns regarding her **** ** ********* ******* ****** ****** for ******. Please note that Ms. ******** has also filed a complaint with the Consumer Financial Protection Bureau No. *************** and that organization is receiving the same response.  To clarify for Ms. ********, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if deemed necessary. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  The account in question was contained in a portfolio of accounts purchased directly from *** **** ** ******** in September 2022. This was a forward flow agreement with *** **** ** ********, where once an account was charged off, it was sold and transferred to DNF Associates.  The account was for ****** **** ******** with a service address of **** ********* *** ***** ************* ** *****. It was opened on December 3, 2021, had a last payment of $63.00 on March 3, 2022 and was charged off on October 10, 2022 with an outstanding balance of $1638.69.  On November 23, 2022, an email was sent from the original creditor to Ms. ******** at ***************************; that the account was sold to DNF Associates. A copy of that notice is attached.  The account was placed on Ms. ********'s ***** ***** Credit Bureau Report on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau.  When the account was purchased, the placement file contained Ms. ********'s full social security number, birthday, email address at the time, and her home address of **** ********* *** ***** ************* ** *****.  In order to substantiate the validity of the account, we have also attached the following:  •  The Bill of Sale between *** **** ** ******** and DNF Associates, substantiating our purchase of the  account.  The billing statement detailing Ms. ********'s purchase from ****** in the amount of $1462.77 for home web services.  The final payment statement, acknowledging Ms. ********'s payment of $63.00 via web payment. The charge-off statement, showing all interest and fees after charge-off for the balance of $1638.69.  DNF  ASSOCIATES  **** ** ****** ***** ***** **** ********** ** ****** *** *************  If after reviewing the provided information, Ms. ******** would like to resolve the outstanding balance, she may contact our office at ***** ******** and we can assign the account to a new collection agency.  In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out for collections.  At this time, we must deny Ms. ********' request for ********* removal due to the amount of substantiating evidence provided by the original creditor. In accordance with the Fair Credit Reporting Act, our ********* is set to be removed seven years from the first date of delinquency. The first date of delinquency is defined as 30 days after the final payment or April 2022 for this account.     I am filing a complaint with the Better Business Bureau regarding the actions of DNF Associates. They contacted me without my permission regarding an alleged account, despite claiming that they have no intention to collect. It is perplexing why they would randomly email me when I never provided them with my personal email address. It appears that their intent is to provoke a reaction or coerce me into paying a debt that I do not owe. I have not requested any validation from them, which would’ve entail original documentation rather than copies or a forward flow agreement. Furthermore, we have never had any prior conversation before their initial email yesterday. This communication amounts to harassment, and it is essential to clarify that I did not provide consent. I have already issued a cease and desist order, and they are only permitted to communicate their compliance with my demand to cease. Any additional documentation they send in an attempt to collect will constitute another violation of the Fair Debt Collection Practices Act (FDCPA), and I have the legal right to seek damages in a court of law. I want to emphasize that this is not a threat, but rather an assertion of my rights as a federally protected consumer in accordance with the law.

    Thank you for the opportunity to respond to Ms. *******'s complaint. According to our records we responded to a similar complaint made by the consumer through the CFPB File Number ******* ********. We have attached a copy of our response to the CFPB for your records.  Prior to receiving this complaint and the complaint from the CFPB, the account was placed in a cease- and-desist status based on a complaint the consumer filed against our vendor who was servicing the account.  According to our records, on June 15, 2023, Ms. ******* filed a CFPB complaint against our vendor (CFPB File Number ***************). We received notification of this from our vendor on June 22, 2023. According to our vendor, the consumer requested cease and desist on the account and request validation of the debt.  Upon notification of the complaint and request by our vendor, the account was placed in a cease-and- desist status to remove it from collections, and we sent the consumer the validation documents. There was no intent to collect the debt and the documents were sent for informational purposes only.  Thank you for the opportunity to respond.     I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  As per the Fair Debt Collection Practices Act (FDCPA), it is important to note that I have not had any prior communication with this company. According to the FDCPA, consent must be given before any communication can take place. Any attempt to contact me without my permission is considered harassment and abuse. There was no permissible purpose. I want to make it clear that this company is only authorized to respond to my written cease-and-desist demand, not for the purpose of debt validation. My demand has been clearly expressed in writing. Failure to comply with this request will lead to legal action, as provided by federal law. As a federally protected consumer, I have rights, and any communication from this company will be considered as potential evidence in a court of law.

    To clarify for Ms. ******, DNF Associates LLC (DNF) are a passive debt buyer that outsources purchased receivables to collection agencies and/or attorneys if necessary. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  The accounts in question were contained in a purchase of accounts directly from **** in October of 2022. A copy of the Bill of Sale has been attached to substantiate our ownership of the accounts in question.  The **** ******** ********** account was opened on July 23, 2018, had a last payment of $25.00 on January 24, 2019 and was charged off on September 22, 2019 with an outstanding balance of $1518.69.  The **** ******** Card account was opened on June 1, 2018, had a last payment of $150.00 on February 1, 2019 and was charged off on September 22, 2019 with an outstanding balance of $3114.31.  Both accounts were placed on Ms. ******'s ***** ***** ****** on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau.  On June 23, 2023, Ms. ****** formally disputed the ******** Card through ***** ***** and the tradeline was updated as "Disputed."  When the account was purchased, the placement file contained Ms. ******'s full social security number, birthday, and the address of **** *** ******** ****** *********** ** ***** which is consistent with the address used in her complaint and substantiated by the consumer's driver's license information and public records that are obtained in connection with the collection of a debt.  In order to substantiate the validity of the account, we have also attached billing statements provided by the original creditor to the consumer. Since the number of statements may exceed the size limitations of the BBB's submission site, we have only included some of the statements with purchases, payments, and the charge off statement that summarizes fees and interest.  The account was opened for approximately 14 months with those statements being sent directly to Ms. ******'s under her full name and at her confirmed address.     I made a full FTC report on 07/25/2022 about my idenity being stolen. Included in this report, are all of my **** accounts they are attempting to collect, that are not my accounts.  Futhermore, this letter still failed to address that I am not liable for these debts with **** because I do not have a signed contract with this "Passive Debt Buyer" as they referred to themselves as. They did not provide me with the original contract as requested as well.  I demand these accounts be removed from my credit report.

    Dear BBB Representative:  Thank you for the opportunity to address Mr. ******s concerns regarding the ******* ****** Credit Card for ********** *** secured by *** **** ** ******** (****) in our office.  To clarify for Mr. *****, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if necessary. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  The account in question was contained in a ******* **** purchase of accounts directly from **** in September of 2022. By "******* ****", we mean that as accounts are charged off, they are sold directly to our organization, and we then outsource the accounts for debt recovery service. A copy of the Bill of Sale has been attached to substantiate our ownership of the account.  The ********** *** account was opened on July 4, 2021, had a last payment of $99.00 on April 21, 2022 and was charged off on November 10, 2022 with an outstanding balance of $1565.26.  The account was placed on Mr. ******s ***** ***** Report on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau.  When the account was purchased, the placement file contained Mr. ******s full social security number, birthday, the address of ***** ** ***** ***** ****** ** *****, and an email address of **********************.  In order to substantiate the validity of the account, we have also attached the billing statements provided by the original creditor to the consumer. Since the number of statements may exceed the size limitations of the BBB's submission site, we have only included some of the statements with purchases, last payment, and the charge off statement that summarizes fees and interest.  The account was opened for approximately 16 months with those statements being sent directly under Mr. ******s full name and at his address, which was confirmed through the Department of Motor Vehicles. Web payments were made on the account, and we have requested the transactional data surrounding the payment.  DNF  ASSOCIATES  **** ** ****** ***** ***** **** ********** ** ****** *** ************* Please note that at no time when the invoices in question were being sent to Mr. ******s home, did Mr. ******s contact the original creditor and dispute the balance or claim fraud.  With regards to Mr. ******s claim that he does not have a contract with DNF Associates. He is correct, but that has no bearing on the debt. His agreement with ******* ****** Card Services specifically states under the "Assignment" section:  “ASSIGNMENT; TRANSFER We may sell, assign or transfer all or any portion of your Account and all or any portion of our rights under this Agreement to any other person without prior notice to you. You may not sell, assign or transfer any of your rights under this Agreement."  Subsequently, DNF Associates purchased and now owns the outstanding receivables as well as the right to enforce collections.  If after reviewing the provided information, Mr. ***** would like to resolve the outstanding balance, he may contact our office at ***** ******** and we can assign the account to a new collection agency.  In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out to a collection agency for service.  At this time, we must deny Mr. ******s request for tradeline removal due to the amount of substantiating evidence provided by the original creditor.     I received a notice that I have a collection from DNF ASSOC on my credit report. It says it was opened on 12/20/2022 for $3,235.00 with account number starting in **************** that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the FCRA and FDCPA.

    I would like for this collection to be removed asap or I will file a CFPB and FTC report.

Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  The account in question was contained in a portfolio of accounts purchased directly from *** **** ** ******** in December of 2022.  The account in question was opened on February 11, 2022, had a last payment of $200.00 on April 27, 2022 and was charged off on November 18, 2022 with an outstanding balance of $3235.31.  On December 20, 2022, an email was sent from the original creditor to Ms. ****** at  [email protected]; that the account was sold to DNF Associates. A copy of that notice is attached.  On January 4th, 2023, our collection vendor ******* ********** ********, sent their initial notice to Ms. ******'s same email address. A copy of that notice is attached.  The account was placed on Ms. ******'s ***** ***** Credit Bureau Report on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau.  When the account was purchased, the placement file contained Ms. ******'s full social security number, birthday, email address, and her home address of ***** ******** ****** ********** ** ****** In order to substantiate the validity of the account, we have also attached the following:  The Bill of Sale between *** **** ** ******** and DNF Associates, substantiating our purchase of the  account.  The billing statement showing Ms. ******'s purchase from ******* *** ********* in the amount of $2777.67.  The final payment statement, acknowledging Ms. ******'s payment of $200.00.  The charge-off statement, showing all interest and fees after charge-off.  DNF  ASSOCIATES **** ** ****** ***** ***** **** ********** ** ****** *** *************  If after reviewing the provided information, Ms. ****** would like to resolve the outstanding balance, she may contact our office at ***** ******** and we can assign the account to a new collection agency.  In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out for collections.  At this time, we must deny Ms. ******'s request for tradeline removal due to the amount of substantiating evidence provided by the original creditor. In accordance with the Fair Credit Reporting Act, our tradeline is set to be removed seven years from the first date of delinquency.     This showed up on my credit report with the last month. It's dated for 1/31/21 for zero dollars. This never on my credit report until last month and I have no idea what it is.

    Thank you for the opportunity to address Mr. ****** concerns regarding the tradeline that appeared on his ***** ***** credit bureau report.  To clarify for Mr. *****, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if necessary. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  On September 20, 2020, DNF Associates placed this tradeline on Mr. ***** ***** ***** credit report regarding the delinquent collection account he had with ***** ********** **** * ******* *** ********* According to our records, the consumer paid our vendo* ******** ******** **********  On March 16, 2021, our organization updated Mr. *****' ***** ***** credit report to identify that the account in question was Paid in Full.  On March 23, 2021, Mr. ***** contacted our office and claimed that he was told by Atlantic Recovery Solutions that if he paid the account, the tradeline would be removed from his credit report.  After reviewing the call recordings from the collection agency, we determined that the representative did not indicate that the tradeline would be removed from the consumer's ***** ***** report, but they did say it would be updated, which it was. Possibly Mr. ***** misconstrued what the agent meant by updated.  Nonetheless, we would like to assure Mr. ***** that the tradeline has been properly updated to show the account was paid and this was done so in accordance with the Fair Credit Reporting Act.  Thank you for the opportunity to respond to this matter.     Thank you for the opportunity to address Mr. ******* concerns regarding **** / Platinum ********** (****) account in our office.  To clarify for Mr. *****, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if necessary. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  The account in question was contained in a purchase of accounts directly from **** in October of 2022. A copy of the Bill of Sale has been attached to substantiate our ownership of the account in question.  The account in question was opened on December 13, 2007, had a last payment of $319.00 on October 28, 2018 and was charged off on May 5, 2019 with an outstanding balance of $14730.50.  The account was placed on Mr. ******* ***** ***** Report on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau.  When the account was purchased, the placement file contained Mr. ******* full social security number, birthday, and the address of *** *** ******* ********* ** ***** which is substantiated by the consumer's driver's license.  In order to substantiate the validity of the account, we have also attached billing statements provided by the original creditor to the consumer. Since the number of statements may exceed the size limitations of the BBB's submission site, we have only included some of the statements with purchases, payments, and the charge off statement that summarizes fees and interest.  The account was opened for approximately 12 years with those statements being sent directly under Mr. ******* full name, at his confirmed address. Multiple purchases and payments were made during that period.  At no time when the invoices in question were being sent to Mr. ******* home, did Mr. ******* contact the **** and dispute the balance or claim fraud.  If after reviewing the provided information, Mr. ******* would like to resolve the outstanding balance, he may contact our office at ***** ******** and we can assign the account to a new collection agency.  In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out for collections.  At this time, we must deny Mr. ******* request for ********* removal due to the amount of substantiating evidence provided by the original creditor. In accordance with the Fair Credit Reporting Act, our ********* is set to be removed seven years from the first date of delinquency. The first date of delinquency is defined as 30 days after the final payment or what was defined by the original creditor. In this instance, **** defined the delinquency date as December 2, 2018.
