    Dear BBB Representative:  Thank you for the opportunity to address Ms. ******' concerns regarding the Fortiva Retail Credit Card for Vivint Services secured by *** **** ** ******** ****** account in our office.  To clarify for Ms. ******, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys if necessary. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  The account in question was contained in a forward flow purchase of accounts directly from **** in September of 2022. By "Forward Flow", we mean that as accounts are charged off, they are sold directly to our organization, and we then outsource the accounts for debt recovery service. A copy of the Bill of Sale has been attached to substantiate our ownership of the account in question.  The account in question was opened on January 19, 2022 for home services, had a last payment of $17.96 on May 22, 2022 and was charged off on December 26, 2022, with outstanding balance of $1140.00.  The account was placed on Ms. ******' ***** ***** Report on April 3, 2023. DNF Associates does not place tradelines through any other credit reporting bureau.  When the account was purchased, the placement file contained Ms. ******' full social security number, birthday, and the service address of **** **** **** **** ********** ** *****.   In order to substantiate the validity of the account, we have also attached the billing statements provided by the original creditor to the consumer. Since the number of statements may exceed the size limitations of the BBB's submission site, we have only included some of the statements with purchases, payments, and the charge off statement that summarizes fees and interest.  The account was opened for approximately 11 months with those statements being sent directly under Ms. ******' name, at the service address. The purchase was through Vivint for home services for the 4276 Sand Pine Aly, Doraville, GA 30360 address and payments were made via recurring debit card payments.   Please note that at no time when the invoices in question were being sent to Ms. ******', did Ms. ******' contact the original creditor and dispute the balance or claim fraud.  If after reviewing the provided information, Ms. ******' would like to resolve the outstanding balance, she may contact our office at ***** ******** and we can assign the account to a new collection agency.  In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out for collections.  At this time, we must deny Ms. ******' request for tradeline removal due to the amount of substantiating evidence provided by the original creditor. In accordance with the Fair Credit Reporting Act, our tradeline is set to be removed seven years from the first date of delinquency. The first date of delinquency is defined as 30 days after the final payment. Subsequently the account will be removed by June 6, 2029.  Thank you for the opportunity to respond to this matter. By "Forward Flow", we mean that as accounts are charged off, they are sold directly to our organization, and we then outsource the accounts for debt recovery service. A copy of the Bill of Sale has been attached to substantiate our ownership of the account in question.

    I am not responsible for this debt with DNF Associates LLC. Nor did I recieve the orginal application/contract per request pertaining to this alleged debt. I never had any contact or communication of any kind with DNF Associates LLC.

    To Whom It May Concern, 
    Thank you for the opportunity to respond and hopefully resolve this matter for Mr. *******. 
    To clarify for Mr. *******, DNF Associates are a passive debt buyer that purchases charged-off receivables and outsources them to collection agencies and to recover past due amounts. We do not have the ability to perform collection services or accept payments therefore we do not attempt to contact 
    consumers. 
    Upon receipt of the complaint, the account was withdrawn from the current collection vendor and placed in an isolated status so no other collection activity takes place. 
    With regards to Mr. *******'s account, the account was purchased from ******** **** in January 2021 and was for a ******** **********. According to the original creditor, the account has an open date of May 25, 2014, a charge off date of November 30, 2020, a last payment date of March 2020 and an outstanding balance of $5108.10. This item was placed on Mr. *******'s ***** ***** report on January 7, 2021. 
    We have attached a copy of the Bill of Sale substantiating the purchase of the account. 
    Prior to the sale, a letter was sent to Mr. *******'s address by the original creditor informing him of the account sale. We have attached a copy of this notice. 
    In addition, we have attached copies of some of the payment statements and the charge-off statement containing a breakdown of purchases, interest, and fees that were also sent to Mr. *******. These statements transitioned from Mr. *******'s prior address to the current address where he resides today. Due to the number of statements available, and the document size limitations of the BBB's web portal, we have sent all statements provided by the original creditor directly to Mr. *******'s current address. 
    Since its purchase by our organization, this account has been placed with six separate collection agencies who have been unable to establish contact through mail or telephone with Mr. *******. 
    In accordance with the Fair Debt Collection Practices Act and the Fair Credit Reporting Act, the original agreement between Mr. ******* and the original creditor is not necessary to substantiate his relationship to the account. 
    We have an account that was opened in his name, his social security number, his birthday, his address, and his new/current address. The account was open for over (five years) with statements being sent to the consumer. There were charges made to the account with the majority being from Mr. *******'s immediate area and multiple payments made to the account. 
    During the account period, even though statements were being sent to Mr. ******* under his name and address, he never disputed the existence of the debt, never claimed fraud, and never contacted law enforcement. 
    Based on the account statements and the actions of the consumer, we find no discernable fraudulent activity and must decline Mr. *******'s request for tradeline deletion. 
    If after reviewing the information Mr. ******* remembers the account and would like to address the balance, he may contact our organization and we can place the account with another collection servicer. 
    In the interim, we would like to assure Mr. ******* that the account was placed in a cease-and-desist status in order to ensure no further collection attempts will be made. The tradeline is scheduled to be removed from his ***** ***** Credit Report in April 2027. Our organization only reports to ***** *****.

    I received no contact from dnf associates about this credit and it just popped up on my credit reports. The Balance of $4432 from **** is showing up under dnf as a collections account. Several years ago This card was stolen and used to make fraudulent charges. I alerted **** of the charges and they refused to open disputes claiming i made the charges. I did file a police report and a FTC fraud report with this account included and provided it to **** with no response from them several times. Please remove this account from my credit report. I contacted HSCB several times before they know the card was used without my knowledge.

The account was charged off for non-payment on November 17,2019 with a balance of$420.28.On Xpd 3,2023 our organization furnished a tradeline regarding this account to Mr. ******'s ***** **** report.To further clarify for Mr. ******.When the account was purchased, the placement file contained Mr. ******'s full social security number,birthday, and the address of **** **** ***** *** ******** IL 60609 with an email address of******.****************.Public regards substantiate that **** ******'s has an active driver's license, identifying that same address as his residence at the tit~lcth e account was opened.The account statements detail multiple purchases made. The statements were sent to Mr. ******'s name at the referenced address. Finally, since the statements reflect multiple payments made to the account. It is highly unusual to receive payments on a fraudulent account. In order to further substantiate the account, we have requested additional details of the account payments source from the original creditor such as if the payments were made by check, credlt card, or debit card.If after reviewing the provided information, Mr. ****** would like to resolve the outstanding balance, he may contact our office at ###-###-#### and we can assign the account to a new collection agency.In the interim, the account has been placed in a cease status in our system to ensure we no longer send it out for collections.At thls time, we must deny Mr. ******'s request for tradeline removal due to the amount of evidence provided by the original creditor, but we have placed the account in a dispute status pending additional information.     I had a collection on my credit report that I disputed (original date was roughly 5 years old) it was removed immediately. Then, it was put back on my report with a new date of 2020 and subsequently removed with no action taken on my part within 60 days from it being placed on my report. My score suffered roughly 200 points because of this and after the collection removed itself my score has not went back at all. it was in the 750s, now its 577 and has been that way for 90 days.

    I would like it removed completely as I believe it is sitting on my report as unpaid debit. The account in question I hadn't opened any ****** credit account at anytime in my life so it can't be from me.

    Please find the attached response.Thank you for the opportunity to investigate and respond to Mr. ********* concerns.  To clarify for Mr. *******, DNF Associates is a passive debt buyer that purchases delinquent accounts and outsources them to a number of national collection agencies for recovery services. In certain instances, we are also a furnisher of information to ***** ***** credit bureau.  With that said, according to our records, the account in question was purchased by our organization from the original in November of 2020 and reported to Mr. ********* ***** ***** on November 3, 2020. A review of our files shows that we requested deletion of our tradeline from Mr. ********* ***** ***** report on April 10, 2023 for the reason of "Fraud".  We request that Mr. ******* review his most recent ***** ***** report. If the tradeline from DNF Associates still exist, we suggest he contact our office so we can further investigate the matter. As for the account, it has been closed in our office as Fraud.  In closing we wish to apologize to Mr. ******* for any inconvenience he has been caused by this incident.     A quick review of my credit report uncovered an entry from DNF Associates. I have never engaged with any contractual agreement with DNF Associates to owe a debt to them or have ever been provided any original documentation either validating the debt or that I entered into an agreement with them.

We do not have the ability to perform collection services or accept payments therefore we do not attempt to contact consumers.  Upon receipt of the complaint, the account was withdrawn from the current collection vendor and placed in an isolated status so no other collection activity takes place.  With regards to Mr. *****'s account, the account was purchased from **** in October 2022 and was for a ******** *********** According to the original creditor, it has an open date of October 16, 2007, a charge off date December 5, 2018, and an outstanding balance of $10,108.67.  This item was placed on Mr. *****'s ***** ***** report on April 3, 2023 with a date of delinquency of March 2, 2018.  In October 2022, the account was placed with one of our vendor agencies, ******* ********** ********* On October 25th, 2022 the agency sent an initial demand notice to Mr. *****'s last known email address of *******************. A copy of that document is attached along with a copy of the charge off  statement.  Based on the information obtained from the Better Business Bureau complaint, we see that the contact address and email were outdated. We have updated Mr. *****'s contact information and have sent the account information directly to his attention. We have also included our purchase agreement with **** substantiating the account purchase.  If after reviewing the information Mr. ***** would like to address the account, he may contact our organization and we can place the account with another collection servicer.  DNF ASSOCIATES **** ** ****** ***** ***** **** ********** ** ****** *** *************  In the interim, we would like to assure Mr. ***** that account was placed in a cease-and-desist status in order to ensure no further collection attempts will be made.     DNF received a defaulted credit card account on me. Instead of listing the date that it defaulted they list a different much more current date. DNF states that they are not a debt collector. Yet on my ***** ***** report they are listed as the collection agency. All mail I have received from them was titled DNF. Also this debt is well over 5 years old and in Oklahoma they can’t collect after 5 years. Also this company did not validate my debt as I asked nor have they provided me with original consumer contract. This is a very dishonest company. First of the month I’m going to hire a attorney I talked with last week.

    Please find the attached response.Thank you for the opportunity to respond and hopefully resolve this matter for Mr. *******.  To clarify for Mr. *******, DNF Associates are a passive debt buyer that purchases charged-off receivables and outsources them to collection agencies and/or Attorneys to recover past due amounts. We do not have the ability to perform collection services or accept payments therefore we do not attempt contact with consumers.  Upon receipt of the complaint, the account was withdrawn from the current vendor and placed in an isolated status so no other collection activity took place.  With regards to Mr. *******'s account, the account was purchased from **** in October 2022 and was for a **** *********** It had an open date of February 18, 2018, a charge off date October 18, 2018, and an outstanding balance of 811.94.  This item was placed on Mr. *******'s ***** ***** account on April 3, 2023 and updated with a dispute status on May 3, 2023.  With regards to the specific complaint, Mr. ******* is correct that the Statute of Limitations with regards to credit card debt is five (5) years from the first date of delinquency, but that State of Oklahoma Statute of Limitations only applies to legal action taken against the consumer. The Fair Credit Reporting Act (FCRA) Statute of Limitations for delinquent credit card accounts is seven years (7) from the date of first delinquency.  With regards to the date of delinquency, our organization placed our tradeline with the Date of Delinquency that was provided by the original creditor ****, which is six (6) months prior to charge- off which was April 18, 2018. This was done in accordance with the FCRA § 623. Responsibilities of furnishers of information to consumer reporting agencies [15 U.S.C. § 1681s-2] in order to ensure the account was not re-aged.  In closing, we would like to apologize for any inconvenience this has caused Mr. *******.     On 4/2/2023, I noticed a collections account that was recently opened by ********** from DNF Associates that I have no knowledge of. I have never received any correspondence regarding collection attempts on behalf of DNF Associates. To resolve this matter, I sent certified mail disputing this inaccuracy, with no response in over 30 days. Due to DNF Associates not responding in a timely manner, they have violated federal law under the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and the corresponding local state laws. This negative item should be removed immediately from my credit report.

    Please see attached response.We would like to thank you for giving us the opportunity to address the concerns of Mr. *****.  Please note, Mr. ***** has also filed two (2) complaints with the CFPB under complaint # *************** and ****************  To clarify for Mr. *****, DNF Associates LLC (DNF) are a passive debt buyer that outsources receivables to collection agencies and/or attorneys. Our company does not attempt to contact consumers to recover past due balances, we outsource such services.  Upon receipt of the complaint, the account was placed in a cease status and withdrawn from the servicing collection agency.  According to our records, the account was purchased from **** for a ******** ****** ***** account number **************** with an address of ***** ******* **** ******** ** ***** and an email address of *******************  According to the placement file provided by the original creditor, the account had an open date of July 10, 2019, a charge off date of February 7, 2021 and a remaining balance of $3962.01 at charge-off.  The account was placed with our servicer ******* ********** ******** and on January 4, 2023, they sent their initial notice with the required 1692g language via email to [email protected]. They received no bounce-back that the email account was no longer active. A copy of the notice is attached. On April 13, 2023, we received the consumer's written request for validation. Please find attached a copy. Though the document contained a new physical address, it contained no new email address. Because of that, on 4/13/2023 we sent the validation information to the email address at ****************** through a secure email. A copy of that email notification is attached.  Not until we received Mr. *****' CFPB complaints, did we realize he no longer utilized the email address *******************  We wish to apologize to Mr. ***** for this error and have attached the validation documents we received from the original creditor to this complaint response. We have also included a copy of the sales agreement substantiating our purchase of the account.  If Mr. ***** would like to address this account, he may do so by contacting our organization. We will then outsource it to a third-party vendor who can service the account.  DNF  ASSOCIATES  **** ** ****** ***** ***** **** ********** ** ****** *** ************* In the interim and as stated above, the account was withdrawn from our servicer and placed in a cease status so it will no longer be placed with a collection agency unless requested by the consumer.  In addition, we have removed our tradeline from Mr. ****** ***** ***** account on May 10, 2023.
