I was lied to about the roof that was put on my house. They told me it was a new roofing system that all employees had to be trained and certified. They told me it was a 50yr roof that they warranties for 40yrs. Then after it was installed I was told it's only warranty for 30yrs. They installed the roof on top of my existing roof which is against city ordinance in Tulsa ok. They negated my manufactures warranty by installing it on top of my roof. Then charges me almost 33000.00 dollars to do it.I called them cuz my roof is leaking and they came out and said they didn't see anywhere that it was leaking but I have 2 spots on my interior ceiling with wet spots that weren't there before.Business Response

August 5 2023 I have sent pictures of areas of concern of the roof job that was done. I have contacted two different people that said they would get someone out to my location right of way. I told them the days I would be home so I could show them my concerns. I haven’t heard from anyone since. I’ve talked to ****** ******* who gave me ****s number to talk to contacted ****** again because no one came out **** was away. Sent pictures again to Erie to get someone out and haven’t heard anything since. I’m not going to pay the rest that I owe until someone comes out to fix areas of concern. Plus I picked nails pieces of shingles off of roof, gutters and the ground where they were working ???????? NOT HAPPY AT ALL. I asked Erie Home (advertised online) for estimate. They visited on Aug 15, 2023, looked at roof, explained the process and materials, and gave us an estimate. We signed to have work done, used a credit card to pay $5,000 down-payment.
They specifically said that they have their own experienced crew that does the roofing. I had seen some online reviews saying that they take any local people they can find, so I sent a text message asking again, because we didn't want inexperienced or people unknown to this company, to do the work. They assured me that it would be their crew. I decided to check the BBB website, which had many reviews stating that the people that did the work, were not with the Erie Home Company, and many did not speak English, so they could not communicate during work being done. During our visit, they said someone from the company would always be available for questions. This is very concerning, so I cancelled this roofing plan.
We had been told at the beginning, that if we canceled, we would be charged a re-stocking fee. They are telling me that I owe them a total of $5,764. If I had not felt like I was being lied to, I would not have cancelled, but I couldn't bring myself to let possibly inexperienced workers, that did not even work for Erie, and possibly have concerns go unanswered for a job as large as this, due to language barriers. I know that the BBB has had other disputes with Erie Home, so I am hoping you will already have the information needed, to know if they do or don't have their own permanent roofers. I did cancel 6 days after the purchase (Aug 21) , but they say that they charge even if it's canceled before 3 days. They had not shipped or delivered product when I cancelled, and work was not scheduled to start until Aug 25. I could send you paperwork regarding this order, but they said that they would email all documents, which I never received. August 8, 2023 a presentation was given on replacing my roof and I provided $6000.00 as a down payment for a roof replacement. I was told I would receive a copy of the contract by email. It was not sent. On August 10th I decided to cancel the contract and called the company. I was told I would receive a confirmation of cancellation and a form via email. I was told the cancellation and a request for a refund had been submitted, also that my money would be returned in3-5 days I did not receive an email. 8/11/23 I contacted the sales rep to explain I had cancelled the contract and that he had not sent me a copy of the contract. He explained that I had to fill out a form and that he would send me a copy of the contract that indicated how to cancel the project and a form that HAD to be filled out, signed and returned to him. I did not receive an email with the documents. I called the company again and said I had not received the promised emails or documents. I said I would send a letter documenting my request. I also noted that "I had contacted my attorney not to be threatening, but just to document the cancellation of the roofing project within the appropriate timeframe" as I hadn't received ANY emails or documents. I was told that would not be necessary. I was also told that the cancellation of project had been submitted, but the request for a refund had not been made. The office administrator said she would submit the request for a refund and send me confirmation. I should expect the refund in 3-5 days. I did not receive a confirmation and I have NOT received my $6000.00. I did send the letter via text to the phone number provided by the individual who set up the presentation appt.Business Response

May 22nd contracted with Erie $44,758 for new roof
June 28th, 2023: signed Contract Amendment by *** ********, Senior Representative for Erie Home Construction stating: “Erie to give customer a $3000.00 rebate check, as well as a 100-foot garden hose approx(imately) 5-7 business days from 6/28/2023. All other aspects of this job to remain the same”. Furthermore, the Contract Amendment states, “It is agreed and understood by and between the parties that this Amendment and the Agreement constitute the entire understanding between the parties, and there are no verbal understandings changing or modifying any of the terms of this Amendment.”
On July 17th, we called Erie to find out why we had not received the rebate check nor the replacement hose as promised. We were told by **** that this would not be forthcoming until we signed a Completion Certificate issued by the lending bank, Medallion. Again, **** threatened to have a lien put on our property if I did not sign the bank certificate. Since we had signed Erie’s Completion Certificate on June 28th, I agreed to now sign the bank’s certificate. I suggested that I do this electronically to speed things along. Erie agreed and I electronically signed the document that afternoon.
Five days later, on July 21st, Mr. ******** came to our house. He brought with him a 100-foot garden hose, but no check. The hose he purchased was a substandard, low-duty hose to replace the heavy-duty hose that they damaged. Mr. ******** stated that Erie would not issue a check until and unless we now sign yet another form, the Customer Complaint Settlement Agreement. This was unacceptable to us as we had already agreed to sign their Completion Certificate and Contract Amendment a month earlier.
It is now August 11, 2023, and we have not received the rebate check. promised to us by *** ********. We would appreciate any assistance that you can provide in helping to resolve this situation and in getting us our check.

Thank you for your quick response to our request for assistance from the BBB regarding the Breach of Contract by Erie Construction. I received a call from *** *********, Senior Representative for Erie this morning. He asked if I had spoken with our attorney about this issue as I told him that I would, before letting me know that Erie received notice of a complaint to the BBB. He went on to again stipulate that a condition for a issuance of a rebate check is that we sign their waiver form that we had refused to sign. This is a legal document binding us from pursuing any liability or legal remedies against Erie. He knew that this was the case prior to his signing the Contract Amendment on June 28th. He wrote on this Amendment that they would issue a $3000 rebate check to us within 5-7 business days from the signing date, June 28th.
Unfortunately, we appear to be at an impasse. He said that he does not have to honor his commitment until and unless we sign the waiver. He said that he forgot to get this form signed on the day we signed the Contract Amendment. We offered to sign it once we received the rebate, but he fused. I was hopeful that a notification from the BBB would cause Erie to reconsider their position and agree to honor their commitment to us.
Please let us know how to proceed with this matter so that we can receive the money that was promised to us. Thank you very much.

July 10th 2023 salesman (**** i think ) and trainee from Erie Home came to our house to give us estimate on metal roof. They both checked out the roof and took pictures of it. Then they came in the house. Salesman went up in our attic. He took pictures of it. When he was done him and his trainee started telling us all the damage and showed us pictures. They spent 4 hours giving us a spill about their products. We was hesitant about it all. We even told him we had to think about it. I even read him 3 negative reviews about the company. He kept insist that wasn't his company. He would back up his company 100% even if he has to come do the work himself. He promised a brand new roof and new gutters. Payments less $100 a month. He showed us rafter up in the attic he said needed replace real bad. I asked him if they would replace that too. He said it would have everything new on it. Even the rafters. Fiancee told him we would have to discuss it in private. He kept insisting we sign the contract and put down payment that day. We gave him $100check for him to hold for 3 days while we decide. Salesman came back on 13th. We discussed again how we wasn't sure. I even read him some more reviews. He kept insist that wasn't true. He promised again that we would be happy with it even if he has to come out to do it. We ended up agreeing to go with it on the condition every thing he said was carried out. We gave him $5000 check for down payment. He was to destroy the $100 check we gave him on the 10th. That's the only thing the company did that he promised. Company didn't put new metal vents on, new rafters. They replaced couple of the decking. Not all of them like they supposed to do. None of things he promised was done. I am rejecting this response because: First all nothing was done like the salesman said on July 10th. If we knew it wasn't going be done like the salesman said we would have never agreed to anything. As far as any contract we didn't see it on paper. The salesman did it all on his tablet. The words was so small neither one of us could read it. The salesman basically scammed over everything,. He said there was no reason to go word to word. He just showed us where to sign and intial things. We asked to see it all on paper. We never got it. We even asked for before pictures, during the construction and after pictures. We never received them **** and I completely said we wanted time to discuss it private. The salesman said we couldn't do that because if he left without any signed agreement that day. He couldn't offer us all the discounts and everything he promised us. He promised us a military discount because **** son is in military. He promised us a complete brand new roof. Rafters and beams, sheeting, waterproof membrain, ice shields, 3 different types of shingles and roof ridge vents. Fiberglass-core roofing system. He also said he would give us a discount for being a show room for their advertising. He asked us not to give out the discount prices that he was giving us. We agreed to that verbally. He even promised 6 to 7 percent interest. The payments would be NO MORE THAN $100 a month. At that time on July 10th he didn't know we had insurance money to put towards the job. He did ask for a small deposit to get the contracted started that day. We did put a small deposit down on it on the July 10th. When he came back 3 days later w$5000 on the original contract so we thought. We both again stressed it to the salesman we could not afford any payment more than $100 month because we are both on a fixed income, He guranateed us that he would make sure of it, We even stress on the 3rd day that we wanted pictures before, during and after. I asked him how are we suppose to know if they did what he said that would be done. He guranteed us the pictures which we didn't receive. He also guranteed that we would be 100% satisified with the work even if he himself had to come out and supervise. We have paperwork to substainted our claim. We can not scan them to add to this at this time. There is more to the claim then we can cover on this list. Such as shingles we got was not what we bought from him on July 10th. The shingles where suppose to be fiber glass core. We examined what he showed us and we could tell they was heavy ridged and hard to destroy. The ones that they used wasn't that way. They was thin flimsy and rip real easy by hand. WE WANT THE ROOF REPLACED WITH THE RIGHT SHINGLES AND THE PRICE WE AGREED TO ORIGINALLY. IF THAT CAN NOT BE SATISIFIED BY THEM THEN WE WANT COST ADJUSTMENT FOR THE WORK THAT THEY DID NOT DO AND INTERFERE OF THE QUALITY SHINGLES THAT THEY USED. Erie takes customer
complaints very seriously and always reviews and inspects the allegations
carefully. Wherever possible, Erie will work directly with the customer to
ensure satisfaction. Here,
Erie has no record of any oral discussion, price abatement or discount being
offered to this customer. Instead, the purchase price was fully set
forth on all contractual documents, which the customer signed. The customer
acknowledged in the signed contract that there were no prior oral
representations and that the written agreement reflects all terms and
conditions relied upon by the customer. The contract further reflects that the
Customer agrees there are no set-offs or retention of funds under the
agreement, and that he is responsible for paying all amounts as set forth following
substantial completion of the work. If the customer did not agree with the
written terms on the contract, even after he signed it, there was a three-day
option to cancel the agreement. Nonetheless, in an effort to resolve this
matter, Erie did offer a discount which was rejected by the homeowner as not
being large enough. The amount the Customer is demanding as a discount is
nearly one-third of the contract balance, which Erie cannot accept.Customer Answer

I am rejecting this response because: We still stand behind the fact the work was not nothing that the salesman sold us when he first came out to give us estimate. Here's what we will agree to if the company agrees to it. They accept the contract was for 14,000 not the 19,000. They subtract the $5000 we put down on it of the $14,000 which leaves us $9,000 owed on it. 2nd thing is they do not use our home as a show case home like we agreed to. I WILL NOT STAND BEHIND A COMPANY THAT DOES NOT CARRY OUT WHAT THE SALESMAN SAID AND PROMISED FROM THE BEGINNING OF THE WHOLE PROCESS. 3rd thing we are willing to let Erie out of the warranty they gave on their service . If they make the payments no more than $125 a month since we are on a fixed income. We will pay the $9000 off in payments as long as payments is $125 month no matter how long it takes to get the $9000 paid off. 4th thing we agree to we will close this case out and not say bad thing about Erie on social media or better business bureau. ALL THIS DEPEND ON IF ERIE AGREE TO THE WHOLE THING WE OFFER TO SETTLE WITH. $9000 at $125 a month. NO WARRANTY FROM ERIE. BETTER BUSINESS CASE CLOSED. NO BAD REPORTS FROM US ABOUT ERIE.

I, ****** *****, hired Erie Roofing to fix my home roof because with the wind part of my roof got damage. The issue is that they never told me that my homeowners insurance could help me, which I ignored. After they finished the job they told me to call my insurance so they could help me pay. My homeowners insurance told me that I had to call them before the job was done, not after. The other issue is that the bank they finance me with, is charging me a $110.00 interest rate per day. I was charged to pay for 15 years a total of $36,489

Unfortunately, Erie Home does not work with insurance companies as we are not aware of their practices, any concerns of them not accepting this as it was after the installation would need to be taken up with the insurance company. As for the financing, the customer did sign a DocuSign document that was a loan application and went over the interest rate as well as the monthly payments. We (my boyfriend and I) applied for a loan (21,000 dollars) to get our roof done. My step father co-signed for us. We filled out the loan paperwork with us being the primary and him the co-signer. We were also told they were going to provide the work permit but ended up not having it the day of and a code enforcer put a cease and desist sign on our door for a week while Erie took their time getting the permit. Fast forward a couple months we called the loan company to find out an exact due date of our first bill and were told we didn’t have an account with them. Come to find out somehow my step father was the primary on our loan and we weren’t even on the loan at all. Now we’ve been trying to get this resolved and get answers from Erie and they have not returned our calls for about two weeks. I’m very upset at the mishandling of personal information and the fact that they just changed up the loan without telling my boyfriend or I or my step father.Business Response

The Erie home roofing, from Rochester replace my roof in the month of May and in the process they damage the driveway of my residence, the company agreed to pay the repairs as long as I summit a repair quote, which I did, the amount is $1,200.00; since then nothing had happened, now they don't return my calls, or my emails. I HAVE "0" CONFINDENCE LEVEL IN THEM EVEN THOUGH MY ROOF IS SUPPOSED TO HAVE A 30YR WARRANTY! MY LAST CONTACT WAS WITH INSTALL MANAGER! HE CALLED ME AFTER I CALLED THE OFFICE AND ASKED THE OFFICE MANAGER IF SHE COULD PLEASE HELP ME WITH THE WIND MITIGATION CHECK! MAKES SINCE RIGHT, JOBS COMPLETE, SHE'S GOT THE PAPERWORK, CUT THE CHECK! INSTEAD, I GET THIS GUY THAT SOUNDS LIKE HE'S TRYING TO PLAY A BOUNCER IN A BAR AND HE'S PRECIEDES TO THREATEN OVER THE PHONE! HE'S TELLING ME "IF I HAVE ANYMORE PROBLEMS, I BETTER CALL HIM INSTEAD OF THE OFFICE MANAGER"!..............OK! WELL, CUT THE CHECK WHILE YOUR IN THE TRUCK! I am rejecting this response because: installation manager came out to my house! we did cover all the issues and problems and we did reach an agreement but as of yet i have not received the compensation promised! at first it was a few days now it will be next week! beyond the 10-day limit! the gentleman seemed sincere and honest but so did the sales lady that first came to my house! she was not honest at all! trust runs booth ways, they didn't trust me after i signed the contract to pay them cash 25k even though i live in a great area, great home, great credit rating and they forced me to give a copy of my checking account to show i had the money they still put a lien on my house without me knowing about it! so until i get the check it's not over!
