By obtaining my consumer report on July 30th, 2022, without any permissible purpose you are in violation of the Fair Credit Reporting Act (FCRA) codified at 15 U.S.C 1681b(a)3(f)(i). ******************************, 260 F. Supp 2d 711 (S.D. Ind. 2003) I have not initiated any transaction with FLAGSHIP CREDIT ACCEPTANCE. Furthermore, I do not have an account as defined under 15 U.S.C. 1693a(2) with FLAGSHIP CREDIT ACCEPTANCE for review or collection. Your offenses amount to Aggravated Identity Theft pursuant to 18 U.S.C. 1028A. You knowingly transferred, possessed, or used, without lawful authority, a means of identification of me, which is a felony punishable with up to 2 years of imprisonment, in addition to civil liability. Pursuant to 15 U.S.C. 1681n(a), Any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under Title 18, imprisoned for not more than 2 years, or both. You are in violation of the Fair Credit Reporting Act (FCRA), [15 U.S.C 1681b(a)3(f)(i)., for unlawfully obtaining my Transunion consumer report on 07/30/2022 without my authorization or a permissible purpose under the 15 USC 1681b(2) Fair Credit Reporting Act (FCRA} and its guidelines for permissible purpose. A person shall not use or obtain a consumer report for any purpose unless; 1. The consumer report is obtained for a purpose for which the consumer report is authorized to be furnished under this section. 2. The purpose is certified in accordance with section 1681b(f). ******************************, 260 F. Supp 2d 711 (S.D. Ind. 2003). I traded in my 2016 ***** ********** and the dealership sent the check on June 22 by *** ** (tracking number ************). They received it on June 23 and it was cashed and cleared the dealerships bank on June 27th. However, they have not credited this money to my account for payoff. Additionally, I made an extra payment on the 29th of June because they called and said they had not received the check.I have sent this information to Flagship and shared the tracking number and facts. However, they keep telling me it will take 72 hours and it has been well over that time.Business Response

The original loan amount was for $24,895 I put $3000 down I made 21 on-time payments for the amount of $630 to equal the sum of $16,230. I went to trade up into a new vehicle at the same dealership I purchased it from and they were completely taken back at the fact that I was $9000 upside down in my loan. At that point I was completely livid. So we called Flagship credit to ask what the problem was which at that point they told me that I was being charged an extra $13-$14 a day from my payments being late mind you they did not report any of my payments late. My payments were always on time. At that point they told me I owe them $28,027.87 as of February 14, 2023. They disposed the vehicle the day after on February 15, 2023. After almost two years of on-time payments and $3000 down I told Flagship credit that I wanted out of the loan because they took complete advantage of me with predatory loan tactics and to come get the vehicle. They chose not to come and get the vehicle right away so its sat in the driveway waiting for them to pick it up, which they did not do for months. When they finally came to pick it up.I gave the keys with no problems and let them take their property back. They ended up selling the vehicle for $9000. They were completely compensated moneywise for the loan, how I came to this conclusion is I gave them a total of $16,230 cash Plus the $9000 that they sold the vehicle for after collecting it from my driveway thats a total of $25,230. The original principle was $24,895. If my math is correct, they actually got an extra $335 out of the loan. Flagship credit says I owe them $19,835.64. I am a ************ veteran. I have bled and almost died for this country. Now I cannot get any car company to work with me, because of Flagship credits predatory loan tactics. Whats right is right they need to remove this default from my credit score they have been paid in full for their property.Business Response

I am rejecting this response because: I am not dealing with flagship. Now they have a breakdown of all my late payments but on the day I tried to refinance, it was reported that my payment were current and up to date but $9000.00 upside down and couldn’t get me a print out of payment history I ask numerous times after that day as well I’m not going to stop. I’m looking into what steps I need to take next this is exactly what I expected.

I was a customer with Flagship. My account was paid off and there was a credit on the account. I have made multiple attempts to discuss this with customer service however I have not gotten a response from the email request for a response. There were 2 emails sent. Because the account was paid off I am unable to get ahold of a representative over the phone. The only way a person can reach a representative is if they have a active account which my account is no longer active since it was paid off. I'd like for this matter to be addressed and I'd like for you to go a step further and resolve the issue with emails going unanswered. I disagree with the fact that if a customer no longer has a active account that they are unable to discuss previous business as I may need information for legal or tax purposes and the way the phone line is set up it does not allow for a person to get beyond entering a active account number.Business Response

I don't recall getting a request from BBB about a update. I have not gotten a response from the company addressing the funds that remained on the account after it was paid off. On March 14, 2023, my dad passed away unexpectedly. Since then, I have been able to update and make payments on the truck that was purchased before dad passed. Bu now, (7/10/23), since they have changed the website, I am unable to access his account. They keep saying things like they need an email explaining what happened, or that they can't give out the new website because I'm not on the account. And the documents they say we need, either we don't have it, or we don't know where to get. They also keep telling us to refinance and that's not what we want. I have his email and his password (or what used to be his password), so it isn't like I was asking for that. I just want a website and maybe a way to change the password.Business Response

Have loan for 2016 ************ with Flagship. Had a higher interest and payment due to divorce and moving. Not long after getting loan, my husband had to retire early due to knee giving out and then knee replacement plus one daughter in college. So because of all of that I had asked for 7 different payment deferments. The only thing they did was tell me to check in two days to see if approved. Never got any paperwork or phone messages as they now say. My loan has reached maturity in June 2023 which was extended from November 2022 because of the extra payments. Last deferment 2020 and all late payments were also paid. When checking on 6/6/2023 because a balance was still showing for a little over $7000. They say it’s because of the deferments. I have never gotten any paperwork or notices adding any amounts to my loan. They cannot tell me what the $7000 is. I was also told that day they had a new system and it would not take a payment anyway until I could find out what was the balance for. Was told to call the next week. I called again on the 16 th of June and talked to Dana who said I could offer a settlement and normally most offers were half of the balance so she wrote up as 5 payments of 713. And told me to call the next week to see if they accepted it. So I called again 6/23 and Aaron said it was in review. Called on 6/30 still in review but made a $800 payment. Called today 7/10 because of 4th is July week and was told by marisol that the offer was rejected because they could get more for my car at auction. Said A supervisor would call me back. I have paid a total of more than $58000 for this car originally $34000, and should not have to pay $7000 that I have never had any statements showing an additional 7000 due. A agency is willing to pay my car note up to date and they are asking for a W9. All I get are team member who refuse to give my account number or email me my balance. Account number: *********** Old Loan balance: 11,178.97 at the time before payment made of 342.69 on May 16 2023 New Loan balance: 10,954.14 ******** claim number: ********** Check#: ********* was sent out on May 12 2013 Amount total: 11,313.09 On Friday June 30th I called flagship and was given total misinformation. At the time of the payment I no longer had the vehicle because it was a total loss but I decided to pay the amount that I usually pay so that the ******** check would be sufficient to pay off the loan balance and and a late fee won’t be applied. Since both payments were made I am owed . I have called multiple times in the past month and in one occasion I spoke with a supervisor/ manager was told I won’t be getting a refund but she could not explain why and told me I will be get an email of the payment history which was sent to me already before. I was given total misinformation about the refund amount being 508.26 and the dates of when the check was cashed. one representative told me June 3 was when it was cashed, then I spoke with my insurance agent and was she provided a copy of the check cashed on May, 19 2023. I called again Flagship again Wednesday July, 5 spoke with a representative named Monce and she told me that “my payment on May 16 is not reflecting in their system therefore was not made”. I checked when my bank statements and payment shows it the payment history and I have email confirmation of the payment being made. I have documentation showing all this information I can email it or fax. I would prefer to speak to a representative to explain or provide additional information if possible.Business Response
