We used a parking garage they own, and upon exiting, were told by the attendant that we would be mailed a bill for parking. No signs were present to contradict him, and when we called upstairs to the doctor's office the secretary said that sounded correct. No bill arrives, but not even three weeks later I receive a violation notice, not for the $9 parking fee but now for $70.25. I call Premier and they said they contract McKinley Payments to do these fines, which INCIDENTALLY is the same address as Premier Parking. I followed the appeals process on the McKinley website and was told "Thank you for your email. We have reviewed the details surrounding your dispute and due to the information you have provided, your violation dispute has been denied. Dispute decisions are final and cannot be appealed. To avoid any additional fees, please submit payment for your violation at mckinleypayments.com by the due date printed on your violation. Your violation dispute has now been closed." Very clearly there was no intent to send us a bill, and the McKinley Payments collector sharing the same physical address implies this is their regular business model of bad behavior.Business Response

On August 13, 2022, I parked in the structure located at 144 2nd Ave North in Nashville TN. There were three other adults in my car. There was not an attendant on duty when we entered the structure at 4:08PM or when we exited the structure at 11:14PM. This was the first time any of my party had used a parking structure in Nashville. We did not see signs (nor did we look for said signs) which supposedly detailed payment info. We assumed that it being a Saturday afternoon/evening and being there was not an attendant on duty, there was no charge for parking.
Yesterday, Sept 16, 2022, I received a 'ticket summary' which states that $95.25 is owed for the 8/13/22 structure parking. $25.00 is the unpaid parking fare and $70.25 is the ticket fine.
I filed an appeal with Metropolis Payments....I stated what happened that day (listed above) ...said I will pay the 'parking fare' of $25.00 but refused to pay the unreasonable 'parking fine' of $70.25.
I quickly received a denial of the appeal. The reason given was there were signs posted everywhere explaining the payment process.
Again, let me say I will pay the 'parking fare.' When I attempted to do that (went on line to web address given on ticket summary) I was unable to pay the 'parking fare.' The Metropolis Payment is demanding full payment of $95.25 and offers no option to pay only the 'parking fare.'
I think the 'ticket fine' is price gouging, ransom and robbery.

I received an 'automated email' from Supportstating "****** Parking fare and fine" has been closed by the system. If you feel that the ticket was closed prematurely please reply to this email to create a follow-up ticket or email [email protected]. I do not understand this notice...I want to pay the 'parking fare'......when I opened the link (for payment) there was no option to pay just the 'parking fare'...the total amount including the fine was the only option to pay....I do not think the fine is justified..and have explained why the 'parking fare' wasn't paid....
If the matter is 'closed' it will appear that I have not offered to pay the 'parking fare' and that is not the case.
My question is has the parking fare and fine been dismissed or has this been turned over to a collection agency? Reading the response from McKinley Payments is confusing.

When I arrived at the parking garage on the morning of 7/26/2022 at 7400 Fannin St. Houston, Tx, the garage gate arm was stuck in the upright position, and when I pushed the button to get the ticket, it failed to dispense. Several more attempts were made, but it did not work. I entered the garage and thought I would pay the tender on the way out. As we were leaving, the booth was unmanned. The arm opened automatically.
I agree that I should pay the parking fee for using the facility, but I shouldn't be penalized for the mechanical issue with the machine.Business Response

I received a parking ticket for an event on 8/21/2022 where the vehicle we owned was parked. The scanner code was malfunctioning so we could not get a code to pay for parking. I sent email communication today explaining the situation. Within 3 minutes of my submission explaining what happened, I was denied. I offered to pay for the ticket but was not willing to pay for the $70 fine. This company is a scam to get money from people. As I stated to the CS agent that I am a disabled veteran and wanted to do the right thing but he/she were hearing it. Email thread is attached.Business Response

I contacted McKinley via email 09.01.22 advising I was unaware I needed to pay for parking at the facility, I requested a waiver but was denied and was given a blanket statement that the fare or fine would not be waived etc. I parked at the facility on 07.30.22 and billed for $87.57 and received the invoice 30+ days after the incident which includes the unpaid parking fare of $17.32 and a violation fine of $70.25. I have no issue paying the unpaid parking fare of $17.32, but I will not pay the $70.25 violation fine nor does the online payment system allow you to adjusted the payment amount.
I have serious concerns that such agency has access to individuals vehicle information without their consent especially since they are not a government agency. I personally would like to know how such information was obtained, and is there signage (at the facility I received the violation) stating they will retrieve such information and how.Business Response

The respond does not state the violation fee has been reversed as of 09.17.22, pending as the payment has a due date of 09.22.22. I logged into the McKinley payment system on 09.17.22, no adjustment!

I parked in a Premier-managed garage in downtown Nashville in a space that is free for up to 15 minutes for ******* Bank customers. I was in and out of the bank in less than 10 minutes and received a $75 parking violation. I opened a dispute for this violation and it was immediately closed without explanation. I emailed the customer support address on their website and received no response. I also cannot get in touch with anyone over the phone.
Does this company truly turn these violations over to collections? I parked in a free space for the business I was visiting. I should not have to pay a $75 violation for doing nothing wrong!Business Response

I sent a dispute explaining how I couldn't pay the ticket because the app would not let me add my car details, and they sent a generic response. When I sent more details of the incident and how I'd be happy to pay the $6 parking bill but not the $70 in violations(response in the photos attached), all of a sudden I've been ghosted. I've sent at least 10 emails and received no response from them after their original generic response. I have 10 days left until the payment is due or else it will be sent to collections. I will continue to send a daily email, but I doubt I will get any response at all.Business Response

We visited Nashville in June 2022. and now, 2 months later we received 3 separate different "parking violations" from this company. When the first one came, we reached out and they alleviated the fee however, 3 weeks later we got the other 2 violations. it's all from the SAME LOT. We used other locations throughout the city during our stay with NO PROBLEMS but now this ONE LOT has all the issues of "non payment" but their system was able to track us in & out of lot. We have no problem paying the parking fees which would be $10 & $15 but the astronomical violation fine of $70.25/ EACH is ridiculous. I feel there may even be a technology glitch with this one lot system since all our other locations worked perfectly fine - using the same systems. I am more than happy to discuss with the BBB more details or even work with the company to resolve the parking fees due totaling $25 - just feel the additional violation fees should be excused.Business Response

I received a parking violation from July 30, 2022 for $82.25 at the parking garage located at 701 Trinity St.. This is ridiculous, because when I tried to pay by phone with the QR code that was there, it never worked. I was trying to pay, but it never let me. The 12 minutes that i was there is the time that i was trying to pay. I never left my car, and i decided to go to another parking garage because there was nobody to assist me. I'm trying to contact a representative from this company but it directs me to service bots. It is not fair to pay a fine when i was willing to pay for the parking space.Business Response

I made a good faith effort to make a $28.00 payment for parking via the operators QR code system on 8/9/2022. The app/website indicated payment was processed. On 9/8/2022 I received a notice in the mail that payment was not made and billed for the $28.00 parking fee plus a penalty of $70.25 for a total due of $98.25. I contacted McKinley Payments regarding the issue and they requested proof of payment via a receipt. This was my first time having to use a QR code to pay to park. I didn't even know there would be a digital receipt issued until they stated so. I checked my bank account and they are correct that they payment did not pull from my account. I then requested an accommodation to pay the $28.00 parking fee but waive the penalty based on the situation and a good faith attempt to make payment at the time and not knowing if it was a mistake on my part or an error in their QR payment system. The operator immediately rejected my request with what appears to be minimal consideration and demanded the full $98.25. I am asking the BBB to investigate the issue to a) help resolve my personal issue and b) investigate how often this happens as it appears the operator can levy these charges at will with little recourse for anyone to provide proof in a dispute. In my opinion, the operator's actions appear very open to billing abuse with little or no oversight to their actions.Business Response

The contact with me they refer to was the reply from them that resulted in me contacting the BBB. This is not an updated action from the business. The response I received inferred that their QR payment system is foolproof and stated that since I don't have indisputable proof of payment, both payment and penalty are non-negotiable. I was advised they consider the appeal closed and there was no one to discuss with further and no path for additional consideration. Based on the language used in their replies to both me and the BBB, the response appears to be "canned". I am unsatisfied with the businesses reply. The reply, in my opinion, is a complete lack of interest in honestly and openly addressing customers concerns and complaints. Their reply to the BBB is misleading as well, as they indicate they have attempted to work with the consumer about the complaint when they, in fact, have not. They just refer to inadequate correspondence prior to complaint filing.
