      Paid for 24 hour parking on March 21st at 717 operated garage in *********, Tn. yicketed on the 22nd for unpaid parking fees. provided proof of charge on the credit card on the 21st, as well as text message confirming parking timed and dated on the 21st. They persist in claiming the parking fee was not paid in spite of the written proof requested.

      I am rejecting this response because: The business practice of this business is to issue fraudulent parking tickets, then deny proof when provided to prove payment for parking was made. There was never any reason to issue a parking ticket in the first place, as I have confirmed with my credit card company that payment was made to the parking garage company on the date and at the time i initiated the parking.

      March 26th/27th $46.70 A parking fee I did not park in the lot. I scanned the ** code, yes, but it was to see if there was a specific part of an alley not under a parking fee - there were 3 signs above 3 spots in the alley only, not at the end where I orginally thought I wanted to park. In scanning the ** code, it prompted me to enter my phone number. It did not tell me that I was agreeing to pay/park in the lot. The next screen did not provide a confirmation that I was paying for parking either, nor was a notification sent. It had the wrong license plate number listed (not mine), and did not prompt any validation for the card on file. I left the lot as I had no need to stay 12 hours.or did I want to pay $40+ I have tried to resolve this issue with the company. They were incredibly rude (told me to stop talking), and said that by scanning the ** code I agreed to pay. There is nothing on the sign, in the lot, or on the page that says this. The woman I spoke to - ******** - was rude, and said that because they didnt have cameras in the lot, theres no proof.I have a venmo receipt to a valet attendent down the street that proves I parked elsewhere.

      Metropolis operates garages all over the country.I have been to the one in ******, ** and at **************************, ***Both have clearly marked signs for the cost of parking (****** $5, Garden State Plaza $15)They only allow you to pay via credit card and automatically add a 99 cent convenience fee at both locations.This is illegal because 1) The signs with the pricing does not mention mandatory convenience fees 2) it is illegal to charge a convenience fee without offering a preferred method of payment void of that fee.I called and asked and they said "too bad it's in our terms of service" but that doesn't make it legal.They have no way to pay without adding this mandatory convenience fee.This adds up as I park there at least twice a week.Multiply that by the thousands of customers at their hundreds of locations and they are illegally charging hundreds of thousands of dollars a year through this fee.

      1) you can put anything you want in terms of service but it's not enforceable if illegal and the fee is illegal because 1) the only visible signs say $5 Max with no mention of a convenience fee and 2) there is no preferred payment method void of this free as required by law. 

      They are still 100 percent breaking the law and taking advantage of people.

      I am rejecting this response because:

      Metropolis is still charging this illegal fee.

      Nothing they responded with makes this fee legal.

      It is illegal because

      1) a sign saying $5 per day + fees is not sufficient, it needs to detail the fee.  Using their logic they could decide to make the fee $50 and you would be required to pay it once you enter the garage.

      2) No matter what they post or put in the terms of service it is also illegal to charge a convenience fee when there is no preferred payment method that does not have the fee imposed.  This is an illegal attempt to get out of their paying taxes on this fee.

      If you are thinking big deal it's just 99 cents think again. 

      The operate over ***** garages with over 2.1 million parking spaces.

      Assuming just 10% daily occupancy that amounts to $207,900 per day in illegally collected fees which amounts to over $75 million dollars collected illegally each year. 

      In reality their daily occupancy is likely over 50% especially when factoring locations where cars park short term and a spot can turn over several times a day.

      Think of how they are cheating the government on their taxes.

      Even factoring a minimal 10% tax rate they are bilking the government out of millions of dollars a year with this illegal fee.

      A company should not be able to continue to break the law without impact and the BBB should not consider this resolved.

      Point 1: If a seller of good or services imposes a surcharge on a consumer using a credit card, the seller must notify the consumer of the amount of the surcharge.  Disclosing the amount of the surcharge by stating a percentage is permissible, but in all cases the surcharge must be disclosed prior to the consumer incurring any charge for goods or services.

      Disclosing only that a surcharge will be applied, without also disclosing the amount prior to the consumer incurring a charge, is not sufficient to comply with the law.  For example, it is not enough for a seller to post a sign stating: "We impose a credit card surcharge that does not exceed our processing costs".

      They do not disclose the amount of the surcharge prior to entering the garage.  The sign has a big notice maximum per day $5 and in small fine print + Service charge.  The issue is not the small print, the issue is that does not comply with the law as it does not disclose the amount.

      Point 2

      Businesses are prohibited from imposing any surcharge
      that is greater than the actual cost to process the credit
      card payment. A seller must disclose the amount of each
      credit card surcharge in a manner that complies with
      the law, as described in questions above, as applicable,
      even if the surcharges vary. Thus, if a sellers costs vary
      depending on the credit card used by the customer, each
      surcharge must be disclosed in accordance with the law.
      For example, a sign posted in the appropriate locations
      stating the following would be in compliance: We impose
      a credit card surcharge of 2% for using Credit Card X and
      a surcharge of 2.25% for using Credit Card Y.
      A store may impose a flat rate surcharge so long as the
      rate charged does not exceed the actual costs of processing
      that transaction. For example, a seller may impose a 2%
      surcharge for all credit card transactions, even if its costs
      of processing exceed 2%

      Metropolis however charges a flat $5 fee on the $80 monthly parking which is above what they are charged by the credit card processor.

      At the moment I can not find the law on the providing an alternate preferred payment method that is void of the surcharge, that may be at the federal or NY State law as I have parked at their garages in NY as well.

      Metropolis is a predatory company that fraudulently tries to ***** Nashville residents for parking. In this case, my parking was validated by the company I was visiting. Metropolis, as they do regularly, failed to acknowledge this and now want $30. They are one of the most hated companies in ********* and regularly try to extort false fees. There is an entire page on ********** dedicated to this deceptive, fraudulent company. They need to shut down.

      Parked in this parking lot. Posted sign showed parking fee of $8 for full day of parking. When I used the app, it said parking was ******* I was leaving the lot at 6:15, it said all cars needed to be moved by 8 am. I was staying at a hotel down the street and would not be able to move by 8 am.I called to cancel the transaction, but no one answered. They called me back over an hour later and said it was too late to cancel the transaction because an hour had passed since I parked. This despite the fact I was waiting for the. To call back AND I moved the car right after I parked.I asked to speak to a manager and was told there was no one available.

      I parked in a Metropolis parking garage on Sunday, March 2nd. I entered the wrong license plate number. I was charged $34.00 for parking for less than 2 hours when the sign said $18.00. Then, 6 days later, I was charged another $19.00. I reached out to Metropolis to explain he situation, and was told by a Metropolis agent that I am not entitled to a refund. Essentially, I parked one time in their garage, what was supposed to be for $18.00, and I have not been charged $53.00.

I was charged $53.  I was recently refunded $19.00.  I am still out money because the refund was not for the correct amount.       I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. Initially, the business told me that I was not entitled to a refund.  It was not until I included the Better Business Bureau did the business decide to refund me my money.  Also, in their final email, they described the refund as a "courtesy."  The refund has nothing to do with a "courtesy."  They overcharged me and refunded me my rightful money after days of correspondence and wasted time on my part.  

      Regardless, I received the refund and am thankful for your support.

      I was given the attached notice for a $9 parking fee plus a $25.25 processing fee from metropolis (for parking in their lot on 12/9/24) on 3/1/25. I promptly paid the notice on 3/1/25. After reviewing the credit card statement attached, I had prepaid $30 for parking at this location for the event attended on 12/9/24. I called metropolis and was told by their representative that once I could provide the statement that I could be reimbursed. I asked for the information ahead of time so I could send the documentation and told that I could not be given anything at this point but to call back. Once I did the new representative told me that there was nothing I could do since I already paid. I asked for her name or employee number and she hung up on me.

      I parked in a lot managed by this company in **************** on February 26th. Roughly a half hour after I logged into their site through a QR code they provided, I was charged over $500 and my bank notified me my card had been compromised, likely as a result of me using the site. I contacted the company to report the issue and am happy to pay for parking, but the company refuses to provide me with a secure way of paying, is slow to respond, and responses are wrought with spelling errors. I am receiving emails from Metropolis threatening me with late fees and am requesting that any late fees be waived until a secure means of payment is provided to me. If a secure means is not provided, I request my payment is waived.

      On 3/7/2025, I parked in their location in ******, **. A sign was posted outside that says Early Bird $9, enter between 5am and 9:30am and out by 7pm. I parked from 8a to 10:08am and was charged $21. I opened a complaint with Metropolis, the response I got was that I needed to get validation to get the early bird price. I was also told that it was a valid charge because there was a flat rate of $21 that day. This was not posted anywhere, I had parked there for the first time 2 days prior and was told by the attendant that everything was automatic and that the cameras capture the license plate and payment automatically applied. No one said anything nor posted anything about validations. This is a public parking building in the middle of ******, ** that is not attached to any mall or shopping area. They are a fraudulent company who posts misleading and fraudulent signs to mislead customers. I would like a refund of the excess payment they charged **** am attaching the photos of the early bird sign posted at the entrance and it does not say anything about validation.

      Metropolis parking garage fraudulently charged my credit card for parking. They also stored my credit card information without consent. I never gave them my credit card information, i never agreed to the charges. I validated parking through a medical appointment. This is the second time, in two different states this company has committed fraud. I want the stolen money refunded and i want the company to destroy any records they are keeping about my card information.

      The company made no effort to fix their fraudulent behavior. The BBB did nothing to solve the issue either. 

      there has been no communication on how they have my credit card information, its a new card.
