I wanted to file bankruptcy but then they kept asking for documents and their website never showed how much money you in there except one time which it showed I paid 2600 and bow it just states waiting o. Payment. Then when I sent email to customer service requesting they cancel the bankruptcy filing. I received a email stating it could not until I spoke with someone from management. I received that call today from ****** with the law firm which is 09/19/24. He stated he just wanted to talk to me and let know some I information. So he ask why I wanted to cancel and I told him why were they still asking for documents and why come I could not see how much I paid to them on the website. He stated they were not suppose to ask for docume to until it was close to the day of filing the bankruptcy and he will talk to his people about that. Then he stated I could receive my refund until the ladies in billing look over it and then I received an email from them stating I will not receive a refund of any ***** money. Like told them, I ******* money back. You have not done anything, and you never said you charge a ****** look over the documents which your firm requested.Customer Answer

Horrible Law Firm. I paid 2800 out of 3000 and not once spoke to a actual attorney, I had 3 questions on 3 different occasions. All 3 left unanswered. I am fed up and fired them. I demanded a refund as they have done literally nothing on their end. You do all the work and they mess it all up. They lose documents, don't meet appointment times. You can't even check your balance without calling them. That is how far behind the times they are. I'm sure I will not see my money ever again as they are the worst type of human.Was contacted by ******* H on 16 SEP 24 and informed I wouldn't be receiving a refund. So to sum it up I paid $2,800 and not once was allowed to speak with a attorney even after numerous requests to do so. I was contacted on 18 SEP at 1600 telling me to change my review from a previous BBB complaint before they would send out my refund check. This business practice just proves my point even further. On Monday 16 Sep I speak with ******* and thought the issue was resolved. He tells me a check will be mailed out. Two days later they say they won't send my money until I change the review. No, I will not change the review as that would defeat the whole purpose of this. Who is going to hold this business Accountable for this shady business practices?Business Response

We regret any instance where a client feels like they have not received the customer service experience we work to provide. It is understandable that a client feels like "We have done nothing" when they cancel before their ultimate goal, which is the filing of their Bankruptcy Petition and the discharge of their debts, but this simply isn't the case. The client had a consultation with an experienced Bankruptcy attorney 18 months ago when they retained the firm. As outlined in our retainer agreement, once a client retains our firm, the firm re-reviews all intake documents, client's information, and perform other administrative tasks associated with opening a client's file. they took four month for doing chapter 7 bankcruptcy and now they dont explain me i cant take my 401 k when i did tokk cash out so i have to wait 6 month for filled again bankcruptcy and they dont want give me my full refund was ***** dollar plus was very lack comunication in that companyBusiness Response

We have provided our client with guidance regarding their options under the bankruptcy code. Currently, Allmand Law Firm is in the process of finalizing the accounting closeout for this client, following their decision not to proceed with their Chapter 7 filing. In accordance with our retainer agreement, we will prepare an Accounting of Services to reflect the work completed on their behalf.
As outlined in the retainer agreement: "The Client acknowledges and understands that in a chapter 7 case a chapter 7 trustee will be appointed by the court. The Client understands that the chapter 7 trustee has a duty to investigate the financial affairs of the debtor;"
Debtor took certain action to liquidate exempt assets, without consulting with Counsel. Counsel advised client of the resulting effect of such action on potential Ch 7, at this time. After consultation, client agreed not to proceed with filing Ch 7.

I am writing to formally express a resolution in my bankruptcy case. I started making payments on July 19th, 2023. I paid $150 until the end of December 2023 totaling around $4000. I paid to ****** Law with the understanding that you would handle my bankruptcy filing efficiently and professionally.However, despite fulfilling my financial obligations, I have encountered persistent delays and a lack of progress. Each time I have provided the requested personal documents, I have been met with additional demands for further paperwork, often repetitive or irrelevant. This cycle has continued without any clear communication about when the bankruptcy process would actually begin.After providing all the requested documentation and indicating that I had no further information to supply, I was dismayed to be met with further requests rather than a confirmation that my case would be filed. This experience has left me feeling frustrated and concerned about the handling of my case.To add to my frustration, despite your firm's refusal to proceed with my bankruptcy filing, you have also declined to issue a refund of the $4,000 I have paid. This is unacceptable, especially given that no substantive legal work has been completed on my behalf.I am requesting an immediate refund of my case as a prompt resolution.I will have no choice but to pursue further action, including but not limited to filing a complaint with the state bar association and seeking legal recourse for the return of my funds if they are not refunded. The process has been so long and unorganized that I have ended up arranging payments and settlements with my debtors myself. I asked for an itemized bill to get some of my money back and received a ridiculous bill for charges that seem unfair. I told them from the start that I did not have a mortgage, therefore foreclosure was not an issue. I still kept receiving calls, texts and emails inquiring about my foreclosure status. Every time they did that, $12.50 was added to my bill. This has added up to about $200. This is unnecessary because I stated I did not need to be asked since the beginning.I also have a charge for a document review for a ****** I dont own one. Even after I sent the email of all the documents and the debts that were not mine, I kept getting emails and texts inquiring about the documents, adding $12.50 to my bill every time. There are many charges for document reviews and requests that should not be.The communication was horrible. For my first virtual appointment, no one showed up and did not notify me that they were not available. This happened twice. Every time I had a question, it could take weeks before I received an answer. I have attached all evidence of this.What was worse is after all this, I was told it would be $1300 a month to pay it off. When I did the math of my repayment, I would end up paying $78,000 when my total debt was only $38,000. I had voiced this concern since March and no one ever addressed it to me. I am requesting a full refund for their bad service and for giving me false information of how much it would be at the beginning.Business Response

I tried to give them a chance again but I did not resolve my case with them. They were not able to help me because they did not explain to me the correct procedures and still did not provide me with a corrected petition. When I spoke to the actual lawyer, she was rude and intimidating. She did not have the patience to explain things and when she did, her tone and choice of wonders were very rude. I began my bankruptcy process in January 2024. I spoke with a really supportive and knowledgeable person named *********. She was so helpful that I referred others to her and left a five star review. We set up the auto payments and I was paid in full May 2024. Since May I have completed the documents request twice, took the credit class and get no correspondence from this office. When you call the hold line is so long and you leave a message to get a call back 1-2 days later. I spoke with ******************************* today to ask when my filling will take place. I paid in full back in May and up loaded all the documents. She was rude and argumentative. And told me Im still missing documents for July and now August. So they just keep moving the time frame and making me submit more bank statements. Meanwhile ** getting served with lawsuit after lawsuit. Ive seen so many reviews where people are having or had the exact same issues. They went through exactly what Im going through now and Allmand Firm kept all of their money after doing absolutely nothing. Im a single mom. I struggle to put food on my table and I was looking for help. Not a rip off. I dont think they even have lawyers! Id like a refund so that I can take my money to someone else who will actually help me file my bankruptcy because at this point these creditors will start garnishing my wages soon. And me and my kids will not survive this. We will be homeless. I just want my money back.Business Response

I sought out this company despite the numerous BBB complaints because I was desperate in my financial situation. I decided not to proceed with the bankruptcy due to the options presented and unaffordable payments they wanted to structure. I had one phone meeting with the senior paralegal. The next netting was a virtual for final steps on the case in which then I decided not continue. My case was not worked on until I was able to pay the full amount of 3009 which was April/May. Since canceling I am now being told I am not due a refund. How?? For the two meetings I had I can see a small charge however I am being charged every time I sent I. Paperwork they wanted on file, anytime I called on to inquire on the case. Meanwhile my case was not being worked on until I fully paid them. I dont believe a 0 refund is due. I contracted with Allmand Law to help me file Chapter ************************************************************************************************************* my filing over the last 5 months. Most recently, I was advised that the Trustee filed an objection to my case citing my unsecured debt to be three times the correct amount. On 7/7/2023 I started filing bankruptcy with Allmand Law Firm for chapter 7 bankruptcy, and each month they pulled funds from my bank account. The only communication I ever had with them is if I called them. They never called me to give me any kind of updates as to what was happening, because all my creditors continued to call me even after I had given them the number they told me to give to my creditors. Some of them even told me that they couldn't get anyone so they would have to keep contacting me.if there was no case number. My concern is, ******* didn't contact me in any way and they are wanting to keep the entire $1,250 that I have paid into my account. Since there was no communication I understand that they want something but it should not be the entire amount because they have not done anything as far as communication with me. I want $750 of my money back from them. I will also report this information to the BBB. This is not right. They need to so do better in communication with customers. I have saved the only contact I have received from them. When filing they always communicate, but once they have your money started, there is no communication. it appears that it's only about money. Also, Allmead Law Firm put in the closing letter that they had outgoing texts on 10/09/2023 and 11/22/2023 and this is false information. We can go back and check my text messages, From the time I started the paying of my bankruptcy to today 07/25/2024 there has been no communication from them on anything they were doing. I was told that they were doing nothing but collection my money and that it was just sitting in my account. As I stated, they do deserve something, but not my entire $1,25.00. I have reviewed the business response and accept this resolution.
The agreement was for the business to refund me $750.00 of the $1250.00 that was paid. This is the agreement that we agreed upon. I am waiting to receive the noted amount of $750.00 from the business. Upon receipt of the check that is to be mailed to me, I will post that the issue has been taken care of, but until then, I cannot say I have received any refund as of now.
