My vehicle was taken to Copart as part of an insurance claim I had. There was minimal damage to my vehicle when it was dropped off. When I got the vehicle back there was damage done to it, caused by the way they move vehicles. I originally went through my insurance about the damage then talked directly to a manager at Copart, ****. He was provided photos of the damage. He sent the photo that Copart took prior to the van being transported back to me and said he saw no damage. The damage is visible in their photo, but he refused to acknowledge it and said that some damage was already there and then there were just some smudges. I offered to bring my car for him to see himself and he would not consent to further investigation and denied all responsibility. There was a small crack on the bottom of the bumper from the wreck. Because of how they moved the car it was made far worse. Additional damage cause by them are the black area that are a much a fine cracks. This was caused by the van resting against the tire they keep on the front of the car fork lifts that the car sits against.Business Response

*************************** is not a customer of ********************** and has not purchased anything from or through Copart. Copart's customer in this matter is USAA, who assigned ******'s vehicle to Copart as part of an insurance claim, but later requested the vehicle be returned to him. If ****** has any issues regarding his vehicle while it was at Copart, he should address them with USAA who requested the vehicle be brought to Copart. USAA communicated to Copart then after Copart denied responsibility they were provided with my information and contacted me on my request. (I have sent the following email to the Copart Lansing location, as well as their member services. Followed up multiple times with no response whatsoever.)I recently bid on and was awarded a lot from your yard in *******, ********. The lot number is #******** (2013 **** Taurus SHO Black)(Vin #1FAHP2KT5DG2208050). The sale date was on 08/16/2024. Pickup was scheduled for today (08/20/2024) at 11am. After the sale, I called and spoke to ***** regarding the pickup process and verifying the vehicle condition before proceeding with payment. She informed me I could view the vehicle ahead of my pickup appointment, to verify condition and run and drive status. Upon inspection of the vehicle, the status code of (run and drive) was misrepresented and the vehicle engine was bad and would not start. I went back into the office and informed ***** of the discrepancy and that I would not be taking ownership of the lot referenced. After speaking further with *****, she informed me I would have to pay a relist fee of $600 to avoid further fees. I am reaching out to request a refund of the relist fee or video proof of the run and drive status at time of inventory/arrival at yard.If there is no proof provided of the run and drive status at time of inventory into the yard, I would like a refund for the relist fee paid in the amount of $600.00 usd. In response to the claim asserted by *********************** that was purchased at Coparts auction was misrepresent as Run & Drive. One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions. Mr.Molnars member notes indicate that he has consented to the current Terms and conditions. These Terms and Conditions state:
H. Bids Entered.Once a bid has been submitted, it cannot be retracted, deleted, or cancelled.
E. Account Activity.Members are responsible for all account activity, including, without limitation, all Preliminary Bids and Virtual Bids submitted under the Members username and password through Coparts websites or through terminals located in kiosks at Copart facilities. A Members account may not be transferred or assigned to any other person or entity. The Member shall promptly notify Copart in writing in the event the Members account, membership I.D., or username and password are used without authorization. The Member shall be responsible for all account activity and charges incurred prior to Coparts receipt of written notice from the Member of the unauthorized activity.
D. Relist Fees.In the event a vehicle is not paid for within the time specified by the Copart facility where the vehicle was sold, Member agrees that Copart may, in its sole and absolute discretion, cancel the sale or relist the vehicle for sale, and the Member shall be responsible to pay a relist fee plus any collection costs,including court costs and reasonable attorneys fees. Relist fees may vary by facility. The Member agrees to verify relist fees prior to bidding on vehicles.
The definition of Run and Drive when you see it on the website advertisement states:
At the time the vehicle arrived at Coparts location, Copart verified that the vehicle started, (ii)could be put into gear, and (iii) was capable of moving forward under its own power. There is no guarantee, representation, or warranty that the vehicle is in roadworthy condition or can be driven lawfully upon the highways of any state. There is no guarantee, representation, or warranty that the vehicle will start, (ii) drive, or (iii) move forward under its own power at the time the vehicle is picked up at Coparts location. It is the Members sole responsibility to ascertain, confirm, research, inspect, and/or investigate the vehicle prior to bidding on it. Once the vehicle is removed from Coparts premises, the Member accepts the vehicle as is
The R&D label does not guarantee that any vehicle is safe to drive without first undergoing repairs, nor does it guarantee that any vehicle will ever be roadworthy again. The R&D simply states that, at the time the vehicle was brought to a Copart yard to be prepared for auction, it could be started and moved forward a minimal distance under its own power. No guarantee is made as to the operability of an R&D vehicle at the time it is retrieved.
Our T&Cs point out that the information we provide is for convenience only, and that burden is placed upon the member to gather information on the vehicle prior to bidding on it. This information can be found at section I.A of our T&Cs and reads:
Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles,whether provided in written, verbal, or digital image form (Vehicle Information). Had **************** came out to inspect the vehicle before bidding he would have been fully aware of any issues associated with it. The webpage advertisement even provides a list of Inspector Services,who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. I understand the terms and conditions I agreed to.
Copart *** is alleging that the vehicle was able to start and move under its own power at the time of inventory.
I am simply asking for video proof or any proof for that matter, that the vehicle was at time of inventory able to be started and moved under its own power.
If they cannot provide proof of this. They have no legal basis to claim that it ever ran and drove, without evidence to support that statement. I will be filing a legal dispute against them, as without proof of starting and moving under its own power at time of inventory, their label of run and drive is fraudulent and misleading.

We purchased a vehicle from Copart auction in *********, **. They advertised the vehicle as being totaled due to hail damage. We gave a cashiers check for $7,000 and drove 1 mile and the car had a loud knocking sound. We had to get it towed. Our mechanic said the engine was blown and the bearings are knocking and someone had disconnected the computer from the engine as well. Total loss. We never would have purchased this vehicle knowing the engine was blown. They falsely advertised this vehicle as in my picture the damage type says HAIL. They are dishonest entity and lied. Vehicle Information provided by Copart and its vehicle sellers is for convenience only. Members shall not rely on Vehicle Information in deciding whether or how much to bid on a vehicle offered for sale through Copart. Vehicle Information includes but is not limited to: year, make, model, condition, ACV, damage amount, damage type, drivability, accessories, equipment, mileage, odometer disclosures, vehicle identification number (e.g. VIN, HIN, and serial number), title, repair cost, repair history, title history, and total loss history Vehicle parts may be missing. Copart does not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of the Member to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.

I won a 2014 **** F -150 on 8/12/2024 by way of auction. Upon viewing the vehicle description, it listed that the vehicle had a key, and that the vehicle "run & drive". While I understand that the vehicle's condition is not guaranteed when purchasing in an auction, the key to the vehicle is not something that is an accessory. The key is needed to obtain access to the vehicle, as well as to start/move the vehicle. There is a specific line item in the description, where you will note that the vehicle "Has Keys" as well as on the invoice, it details that the truck "Has Keys". However, when I received delivery notification of the truck on 8/15/2024 at 7PM from the car transportation service, I was notified that both doors were locked, and no key was present we he went to place the truck in neutral to unload the vehicle. As COPART was closed we notified an emergency locksmith to come out to get into the vehicle, so that the truck could be unloaded, and the transporter could get to his next delivery. Unfortunately, it took 30 minutes for the locksmith to arrive, and another 30 minutes for him to get into the truck to be able to unload it. This caused the transporter to miss his next delivery, and in return I had to pay him for the time he was held up waiting on the locksmith. I was charged an extra fee of $75, paid directly to the driver. The total paid to the locksmith was $295. The transporter wasn't able to unload the truck until 8:20pm, and I was there with the locksmith until 10pm. I contacted COPART and they told me that there was nothing they could do. This is false advertising, saying a vehicle "Has Keys" when the vehicle was locked, and no keys came with the vehicle. I have purchased before and not had this issue. The folks at COPART know that consumers will pay more when the cars have keys, and they are trying to take advantage of their consumers. It is false advertising, misrepresentation and bad business. I would like to be reimbursed $370 + $150 for my time.Business Response

I.Risk of Loss. Each Member takes full responsibility and assumes all risk of loss for all vehicles purchased from the time Copart accepts the Members bid. From and after acceptance of the Members bid (for vehicles located at a Copart facility), the Member acknowledges that Copart is acting as bailee of the Members vehicle until such time as the vehicle is removed from Coparts premises by the Member or the Members agent or representative. The Member agrees that under the terms of the bailment, (1) Copart shall not be responsible for damage to or loss of the vehicle or parts thereof due to operational procedures in place at all Copart facilities, from acts of theft or vandalism, or acts of God; (2) Copart shall only be responsible for damage to or loss of the vehicle or parts thereof caused by the direct willful or grossly negligent act or omission of Copart; and (3) Copart shall not be responsible for any claim of damage made after the vehicle has left Coparts premises, regardless of whether the Member or any agent, employee or other representative on the Members behalf picks up the vehicle.

I am rejecting your response due to the following: COPART outlines in its vehicle description whether KEYS for the vehicle are included or not within its vehicle listings. COPART also includes a photo of the key inside of the vehicle on the vehicle listing. The key inclusion is also listed on the invoice copy the buyer is given upon payment completion.
COPARTs argument is that including vehicle keys for the vehicles it lists for sale is not "guaranteed". So herein lies an important question, why does COPART advertise that keys are included in the vehicles description if they are not guaranteed? Simple, COPART knows that a buyer will pay more for a vehicle,when the vehicle has keys which are included. This is false/deceptive advertising.When a vehicle is sold as is, it pertains to the vehicles condition and does not represent its inclusions unless its inclusions were not specified at the time of purchase. In this case, the inclusions were specified on the listing, and therefore, COPART is responsible for ensuring that all listed inclusions are with the vehicle at the time of collection. The key inclusion is listed on my invoice copy, on the vehicle's description and is shown in one of the photos on the vehicles listing.
Furthermore, Ill ask you to reference the MICHIGAN CONSUMER PROTECTION ACT (EXCERPT) Act 331 of 1976 ******* Unfair, unconscionable, or deceptive methods, acts, or practices in conduct of trade or commerce; rules; applicability of subsection (1)(hh). Sec.3.
COPART is deceiving its consumers by listing inclusions under the vehicles description, that are not present with the vehicle upon delivery.

I am rejecting this response because: I was in contact with them directly. My first conversation was that I had items in the car - I was advised to ask for a Pull and Ship - which I did. That did not happen - however, I called back and was told I could come and get my items. They knew I was coming - as I called, and I was assured I could come and get my items.
When I arrived - they were not there.

In March of this year, I went to the Copart website and saw a vehicle (2018 Audi Q5) that was in my price range and appealed to me. What made it appealing was the website stated it was a clean title, pictures showing damages to all four doors and quarter panels with only the driver side steering wheel airbag deployed, easy fix. (Budget $15,000).I won the bid for the vehicle and paid all the appropriate fees and the vehicle was shipped to ** ($1100). Once the vehicle arrived and was inspected by an accredited body shop and mechanic, it was deemed that the description from the website was a lie. The vehicle was a rolled over vehicle with the roof crushed in, can't be repaired (no pictures showed that). Mold formed and all airbags in the vehicle was deployed and cut out the vehicle (no description or pictures advised of this). Also they stated the vehicle run and drive but the vehicle was started with a battery jump pack but did not drive because the rack and pinion/entire steering column was broken, the vehicle could not turn right or left.I emailed the general manager of Copart and advised them of the fraud they committed through the broker I used to pay for the vehicle and they told me they is nothing they can do and they're not giving me my money back. Initially, I was told by the broker that Copart told him to have the vehicle ready for pick up to be returned to a local Copart here in ** but they never came to get the vehicle which is still in storage presently.I need a vehicle for work and the family and need my money back to acquire one. The name of the broker is ************************* *************) and he can give a lot more information because Copart could not deal with me since I don't have an account with them and all transactions was done through him.I am kindly asking for your help please. I am rejecting this response because: My money was used to buy the fraudulent vehicle from Copart through *********************
I have the owner of ******** ready and willing to dispute the sale of this fraudulent vehicle. The vehicle again was represented falsely and Copart is entirely responsible for the fake advertisement, false description of the vehicle and deceptive photos. I would really appreciate if the Better Business Bureau can help me get my money back for this sale since the vehicle is unrepairable.

How can this complaint be closed when I specifically stated that Copart was untruthful in the advertisement of the vehicle. Absolutely ZERO dialogue was afforded to be by the business or BBB. I only received emails notifying me that nothing was done. I have all the information for the car dealer who is ready to speak on my behalf since it was his credentials that was used to purchase the vehicle on the hope that the advertisement was true.
Now that the BBB in my opinion did nothing to help someone who in good faith tried to use his savings to afford a vehicle for work and is still without a vehicle and my money, the BBB is now telling me this case is closed when I had absolutely no communication with said party. Such a shame.

I was required to place a deposit in order to participate in auctions on the website. The deposits are to be fully refunded upon request. I have made several requests with no refund being issued. I made my first request on July 1, 2024 by phone to their customer service line and made a second request on August 5, 2024 via their website chat function. The website says it can take up to 30 days for a refund to be issues but it has been 45 days since my initial request. I have no confidence that the company is working diligently to provide my refund and have not communicated any reason for the delay of the refund. I request an immediate refund either through an electronic method or a paper check mailed to my address on file with Copart, which ever is quicker.Business Response

I am reporting the negligent and unprofessionalism of this claims department.On the date of 03/25/24 I went to retrieve my vehicle from this location . I noticed my vehicle had damage to the rear door that was not there prior to being sent to this lot. I immediately reported the damage to a representative of Copart and, after proving that the there was no rear damage to my vehicle, Copart accepted the responsibility and admit the damage did occur onsite. I spoke with *************************** who informed me that I would need to get an estimate. The estimate was completed and sent back on 04/07/2024. ******************** informed me that it would be forwarded to the claims department. However, In the past five weeks I have not received any updates or correspondence about my claim.I have sent countless emails to ********************, in additional to calls and attempts to contact other representatives or management.Still no updates have been received.The cost of damage is over $2000.I am reaching out with this complaint because I am seeking resolution to my ongoing issue.Business Response

Hello,The vehicle of concern is a 2023 Nissan Rogue. Lot Number: ******** Vin: ***************** I initiated a title transfer about a month ago at my local NYS ***. I submitted the title and bill of sale sent by copart. I paid all fees and the clerk processed my application.However, on August 7th I received a letter from the division of field investigation stating that the vehicle has salvage history. And they can not issue a title. Please see the letter attached. I have already spoken to the *** multiple times, they said they are unable to help or reconsider this matter.I have also conducted my own search to obtain a report from ************** Vehicle Title Information System (NMVTIS), which also shows salvage reports. Unfortunately, insurance vehicles do not qualify for NMVTIS record amendments. Insurance vehicles are reported to NMVTIS regardless of the sale title type.
We only report vehicles that we believe meet the Federal definition of Salvage Vehicle. However, we believe that the Federal definition of Salvage is very broad such that vehicles reported to NMVTIS may in fact not meet the definition of Salvage under state law and therefore are properly sold on a clean title, and also may not be considered to be a salvage vehicle as that phrase is understood to mean by the general public or by the auto industry.
The Rogue sold on a clean title pursuant to state law. Please be advised that vehicles reported to NMVTIS, under certain circumstances, may not meet the definition of salvage under state law, and/or may not require or qualify for a salvage title under state law.
Copart makes all members aware of this particular risk from the differences between state laws and federal laws. One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions. This response is not explaining as to why new york state flagged the vehicle as salvage. I will have to go through the salvage inspections process which will take many months and even after I will receive a rebuilt title. It will completely diminish the value of the car.
