      Hello,The vehicle of concern is a 2023 Nissan Rogue. Lot Number: ******** Vin: ***************** I initiated a title transfer about a month ago at my local NYS ***. I submitted the title and bill of sale sent by copart. I paid all fees and the clerk processed my application.However, on August 7th I received a letter from the division of field investigation stating that the vehicle has salvage history. And they can not issue a title. Please see the letter attached. I have already spoken to the *** multiple times, they said they are unable to help or reconsider this matter.I have also conducted my own search to obtain a report from ************** Vehicle Title Information System (NMVTIS), which also shows salvage reports.       Unfortunately, insurance vehicles do not qualify for NMVTIS record amendments.  Insurance vehicles are reported to NMVTIS regardless of the sale title type. 

      We only report vehicles that we believe meet the Federal definition of Salvage Vehicle. However, we believe that the Federal definition of Salvage is very broad such that vehicles reported to NMVTIS may in fact not meet the definition of Salvage under state law and therefore are properly sold on a clean title, and also may not be considered to be a salvage vehicle as that phrase is understood to mean by the general public or by the auto industry. 

      The Rogue sold on a clean title pursuant to state law. Please be advised that vehicles reported to NMVTIS, under certain circumstances, may not meet the definition of salvage under state law, and/or may not require or qualify for a salvage title under state law.

      Copart makes all members aware of this particular risk from the differences between state laws and federal laws. One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions.  Mr. ***** member account indicates he has consented to the current Member Terms and Conditions. These Member Terms and Conditions state:       

      I. DISCLAIMERS
      A. Vehicle Condition and History Disclaimer.
      Except as otherwise expressly provided by applicable law, ALL VEHICLES ARE SOLD AS-IS WHERE-IS.
      Except as otherwise expressly provided by applicable law, all vehicles sold through Copart are sold AS-IS WHERE-IS, WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY.  As used in these Terms and Conditions,vehicle(s) means all items posted for sale on Coparts websites and otherwise offered for sale at Copart facilities, including but not limited to cars,trucks, motorcycles, boats, jet skis, industrial equipment, trailers, RVs,etc.  Vehicles also includes miscellaneous salvage items that are posted for sale on Coparts websites under the heading Other Goods.  However,Members expressly acknowledge and agree that vehicle(s) does not mean or include, and Copart does not purport to facilitate the sale of, any cargo or items of personal property which may be contained in a vehicle but are not part of the vehicle.  It is the sole responsibility of the Member purchasing a vehicle to take possession and/or dispose of any such cargo or contents in accordance with applicable law.
      Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles,whether provided in written, verbal, or digital image form (Vehicle Information). Vehicle Information provided by Copart and its vehicle sellers is for convenience only. Members shall not rely on Vehicle Information in deciding whether or how much to bid on a vehicle offered for sale through Copart. Vehicle Information includes but is not limited to: year, make, model,condition, ACV, damage amount, damage type, drivability, accessories,equipment, mileage, odometer disclosures, vehicle identification number (e.g.VIN, HIN, and serial number), title, repair cost, repair history, title history, and total loss history. No effort has been made to list open recalls applicable to any vehicles. Any recalls are the sole responsibility of the purchaser and can be found at locations like www.NHTSA.org.Copart and its vehicle sellers expressly disclaim any and all representations,warranties, and guarantees regarding vehicles sold through Copart. Copart does not guarantee that keys are available for any vehicle sold through Copart,regardless of whether keys are present in online vehicle images, or were present in the vehicle prior to the time of purchase. Certain jurisdictions permit vehicles to be sold with missing VIN plates; as a result, Copart does not guarantee that vehicles are equipped with any or all VIN plates. Vehicle parts may be missing. Copart does not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of the Member to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.
      All Members agree that Copart vehicles are sold AS-IS and are not represented as being in a road worthy condition, mechanically sound, or maintained at any guaranteed level of quality.  The vehicles may not be fit for use as a means of transportation and may require substantial repairs and expense.  Repairing or dismantling vehicles on Copart premises is strictly prohibited.  All Members must arrange to safely and legally remove purchased vehicles from Coparts facility prior to undertaking any repairs or dismantling.
      B. Registration Laws Disclaimer. Copart does not guarantee that any vehicle sold can be legally registered in any state or country, and the Member accepts all risks associated with variations in vehicle title and registration laws between states, provinces, and countries that may negatively impact the marketability of vehicles purchased at Copart. (For example, a vehicle legally purchased on a clean title by a Member at a Copart facility located in State A may be required to be sold on a salvage title if Member transports and resells the vehicle in State B.)
      C. DMV/MVD/DOR Paperwork Disclaimers. Copart is not responsible for defects,errors, or omissions (i) related to motor vehicle department or department of revenue paperwork not processed by Copart or (ii) made by any motor vehicle department, department of revenue or other governmental entity.
      D. NMVTIS Reporting Disclaimer. Vehicles listed for sale at Copart may have been reported to the ************** Vehicle Title Information System (NMVTIS), and transaction data related to vehicles purchased at Copart may be reported to NMVTIS, in Coparts sole discretion.  Each Member accepts all risks associated with purchasing vehicles at Copart resulting from the reporting of the vehicle or the purchase transaction data to NMVTIS by Copart or others. Members may be subject to NMVTIS reporting requirements when purchasing certain vehicles.       This response is not explaining as to why new york state flagged the vehicle as salvage. I will have to go through the salvage inspections process which will take many months and even after I will receive a rebuilt title. It will completely diminish the value of the car. This is completely unfair for me as I paid top dollar for this car thinking it was clean title. I need compensation please.

      This for the ************* location. The General manager *****************************, called my business about letting in all of their 3rd party tow truck drivers into my yard. He was told we only accept certain towers into our enclosed storage yard. ****** decided he wanted to yell at me over the phone telling me that I had to accept his 3rd party vendors in to pick up a vehicle. He didn't want to listen as why we have come to that outcome. His past towers we've had have told us that we are going to do what they say, first off your wrong, or they dont speak english, they cant get to the car, or its to difficult. They have come in and damaged other vehicles and then refused to hand over insurance information. We do not accept their truck in a box program. ****** thought that by turning my business into the state because we only accept certain towers in for copart, that he was going to get really far with that. Well it didn't work for him. When their dispatch calls we always inform them of what towers we allow into our yard. They take it upon themselves to send whom ever they want, and they get turned away. Only to cause insurance companies more money because of storage fee's, but they just tell the insurance companies we are being difficult. I know for a fact that one of their 3rd party towers dropped a vehicle off of their flat bed while trying to load it, a few months ago. ****** believe's that tow companies don't get a say who comes to pick up a vehicle for them, even if they destroy property. Well ****** your very very wrong.

We are a consumer because this the insurance companies yes copart.  They are just trying to close this complaint with out proper repercussions to ******. I could not accept copart into my business and all these insurers can pick up their own cars. ****** doesn't get to make up my policies for my business, and then turn me in cause I won't do what he says. So absolutely I am a customer that deals with ********************** on behalf of the insurance.

      My son was in a car accident that had rear damage. He wanted to get the car fixed and made a claim and dropped it off at Caliber Collision. Between the lack of communication between ****, Copart, Caliber and my son somehow my son's car ended up at an auction lot. Someone called my son, whom assumed it was USAA, and asked if they had permission to pick the vehicle up. *****, my son thought they were calling to get for repairs, not to take to an auction yard. When they called about signing the title is when we realized there was a miscommunication. Unfortunately the company, Copart does not require a signature for the release of a vehicle. Crazy right? So when they called for the title they were asked to bring the car back. They delivered ******* car to the house. At the time they dropped it off my husband and I were home. They did not call or knock on the door to let us know that the car was there. They must have been trying to be quiet because my dogs didn't even bark at them. So when we looked out the window and noticed the car sitting in the drive way we were confused. We went outside to look at it and immediately notice a huge puddle of oil in the drive way. They also returned the car without the license plates. We jacked the car up to see why it was dumping oil and saw that there is a fist size hole in the oil pan. We called **** and they have been trying to get in touch with Copart with no return. They haven't been able to contact them and it has been a month now.

Copart's customer in this matter is USAA, who assigned Heather's vehicle to Copart as part of an insurance claim, but later requested the vehicle be returned to her. If Heather has any issues regarding her vehicle while it was at Copart, she should address them with USAA who requested the vehicle be brought to Copart.       My car was towed to Co-part ********* by USAA by insurance company, which decided to total the car after an accident. My husband drove two hours round trip to get my license plate and other belongings. They "lost" my license plate after removing it and then proceeded to tell my husband the Secretary of State will give us a new one for free which I do not believe. My insurance company supposedly will reimburse us, but I'm not so sure.

      Good afternoon,I am writing to find a resolution between both ***************** and Copart for damages done to my vehicle and the theft of my personal items on Thursday July 18, 2024. My vehicle was parked at my place of work Mander Collision (**************************************************************). It was towed by the tow truck driver ****** from ***** towing to Copart (****************************************************************). ****** claimed that he checked the *** to my vehicle. However, as we are all aware, vehicle *** numbers are unique to each car. My work place does not have my *** on file and would not and did not give out the wrong ***. ****** also towed my vehicle that is All Wheel drive off the flatbed. Towing All Wheel drive cars incorrectly cause damage, which is clear was done to my vehicle. My vehicle was picked up at Copart. When I looked over the car, there are dents and scratches on the outside of the vehicle that were not previously there. It was also extremely dusty. When I started the car, the check engine light turned on (it had not been on before), and it does not drive like it used to. In addition to the mechanical and cosmetic damage, my personal belongings were stolen. I would like to be compensated for the items that were stolen in addition to all damages done to my vehicle and the depreciation of my vehicle since it will impact the value of my car.

      I have signed to bid online around may 2023. Paying $249 membership and $400 deposit. What it says was I can bid anycar however that information was not right. I have not made any single bid because when I try to bid the cars I want it says not eligible.. technically I didn't get the service. Not only that but also they put me in recurring payment and charged me agin for 2024 for the same amount $249 but after long husle copart returned this fee throug my Bank and cooart send me the deposit i made ($400).Now I'm requesting a refund of $249 that I have paid it for 2023 because I made zero bid because the information is misleading eventhough I have upgraded for this option. ( $249 and $400 deposit).

      In response to the claim asserted by ***** ***** about his Copart Membership and his suggested false advertising.  One of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. ***** ***** s member notes indicate that ***** ***** consented to the Terms and conditions on 4/19/2023. These Member Terms and Conditions state:

      IV. MEMBERS
      A. Member Eligibility. You may sign up as a Member at Copart if you are at least 18 years of age.  In addition,state-specific registration requirements and applicable laws, regulations, and restrictions may further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
      B. Member Types. 
      Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. Registered Guests may search inventory, add vehicles to a Watchlist and create Vehicle Alerts, but Registered Guests may not bid on or purchase vehicles unless their membership type is upgraded to either a Basic or Premier Membership.

      In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
      Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit may also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
      Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
      All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates.  Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address.  Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.

      By agreeing to these Member Terms and Conditions, ***** ***** acknowledged that he understood that based on state specific registration requirements and applicable laws, he may not be eligible to bid on a vehicle in a specific state/location. The Copart webpage even provides a licensing overview page that shows the licensing requirements for each state.  Had ***** ***** reviewed this information, he would have known which states he was eligible to purchase a vehicle in as an individual and which states required other licensing. To this affect, Copart did not falsely advertise anything and we ask the BBB close this case.

      I am rejecting this response because:   I had basic and advertised that I can bid any vehicle if I got to premium membership.  I upgraded it and paid the $400 deposit and paid the differences, which I paid $249. So I didn't get the service.  They might have a written agreemen that cooart send me now but the sales people make wrong statement and taking my money for no service.  They tell you something and misled you intentionally and then they say we have agreement.  If i k ow that why should I pay my money. This is a day robbery.

      I was involved in a wreck on 7-11-24, where sadly my car was totaled. My insurance said they would be towing my car to Copart in ***********, ** until the adjuster could come and officially "total" it out. I was told by my insurance that once it was deemed "totaled", I could come clean it out. The wreck happened right in front of the fire department, so when the tow truck arrived, due to the location of the wreck, I was not given any time to grab my things from my car. The tow truck driver stated he could not block any fire trucks so he had to hurry things along. My car was deemed "totaled" on 7-17-24. At that time I immediately contacted Copart and told them I would like to come clean out my car that day as well as drop off my car title. When we arrived a younger female (who did not identify herself) came to the front and asked what car I needed. We proceeded to tell her our situation and that we were there to clean out our car. They brought our car to their "cleaning out" spot for customers and to our shock, almost everything had been stolen out of our car. I immediately looked at the girl and asked where our things were. She responded with "Oh I don't know". I repeated to her again, where were our things. She again responded with "I don't know but this happens a lot here. You can just contact your insurance company and file a claim". My husband and I both just stared at her in shock because I could not believe I was being told so carelessly that we should just report our things missing to insurance. That was all the information she provided us and we left Copart with heavy hearts and not with our stuff. They stole my children's DVDs, money, sunglasses, apple air pods, and more. We spoke with ****** ****** (general manager) who denied any responsibility. I can not believe the amount of complaints from other customers reporting the same things. This "business" should not be allowed to operate. I WILL be filing more complaints against Copart.

      ****** ****** is not a customer of **********************. **********************'s customer in this matter is ***************** who had ******** vehicle delivered to Copart as part of an insurance claim. If ****** has any issues regarding their vehicle while it was at Copart, they should address them with **************** who requested the vehicle be brought to Copart. As this is not related to a marketplace issue, Copart respectfully requests the BBB close this complaint.

      I am rejecting this response because: Sadly I became an unfortunate customer the day my car was dropped off to your facility. You do not get to give an automated response to a claim suggesting you STOLE from a customer. Your company should be ashamed of itself for the lies you feed people and the money you gain off of customers personal belongs while you let the insurance fork out the money for YOUR mistakes.

      Copart had me pay a membership fee of ***** to bid on items they have for auction, I paid the membership fee, bid on an item they then email me and tell me the seller no longer wishes to sell the item and they canceled the bid, I have not been able to place a bid on anything else because they havent released the bid they canceled. I contacted member servies by phone and email and they keep telling me that the bid has to be removed by technical team a new ticket was created and escalated to a higher team to resolve the issue and have the bid removed. I have been dealing with this same thing since the beginning of July. Today July 20th I spoke to member services 2 times 2 different people to get the bid removed or my membership fee of ***** refunded. They stated that they can't do either one of them that the ticket has to be escalated. None of the staff with customer service can transfer a call to a supervisor or fix the account they messed up. I am simply wanting a refund of my ***** for the membership fee returned to me since they can not remove the bid they canceled from my account and allow me to use the service I paid for. This has been on going for over a month with copart.

      In response to the claim asserted by ***************************** about her request to refund her Copart Membership fee,  one of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. *********************** member notes indicate that she consented to the Terms and conditions on 7/2/2024. These Member Terms and Conditions state:

      IV. MEMBERS
      A. Member Eligibility. You *** sign up as a Member at Copart if you are at least 18 years of age.  In addition, state-specific registration requirements and applicable laws, regulations, and restrictions *** further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
      B. Member Types. 
      Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. Registered Guests *** search inventory, add vehicles to a Watchlist and create Vehicle Alerts, but Registered Guests *** not bid on or purchase vehicles unless their membership type is upgraded to either a Basic or Premier Membership.

      In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
      Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit *** also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
      Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
      All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates.  Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address.  Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.

      By agreeing to these Member Terms and Conditions, ***************************** acknowledged that she understood that she was signing up for yearlong membership. As stated in the terms and conditions, that ***************************** agreed to, the annual membership fee is non-refundable. We ask the BBB to close this case.

      my vehicle was totaled by the insurance, and i told the insurance that i want to retain my totaled vehicle, suddenly a company named copart showed up and picked up my vehicle without my knowledge i contacted the insurance company and they stated that i can go to copart and pick up my vehicle but the towing will be on my own cost, i agreed and went to copart in person to release my vehicle and they stated that you can send a towing company tomorrow to pick it up the **** Name was Ad) and the next day which was yesterday i sent the towing company to pick up my vehicle on my own cost and they stated that the system is down unfortunately we cant release the vehicle until the system is up, i tried to contact the Manager but no respond, i ended up without my vehicle and the towing company charged me$300 without my vehicle being towed. i spoke today with ******** the supervisor and she said unfortunately no body noted that the towing company was here yesterday to pick up your vehicle.. i need copart to reimburse me for the towing that i paid without my vehicle being delivered and copart still have my vehicle until this moment. Tried to contact the corporate office with no response
