I purchased a vehicle from ******* **** in 2020. The loan I received from Exeter Finance was at an extremely high APR of *****%, which I believe to be predatory and unjustifiable given my credit history at the time. I am facing significant difficulty in making payments due to this high interest rate.I have attempted to reach Exeter Finance multiple times to discuss options for reducing my APR or obtaining more favorable terms, but I have not received a satisfactory response. The loan terms were not fully explained to me at the time of signing, and I was not informed about the potential impact of such a high APR.Request: I respectfully request an investigation into the fairness of the loan terms provided by Exeter Finance, especially the high interest rate. My vehicle was repossessed, but I paid all the required fees to retrieve it. However, shortly afterward, I noticed additional charges applied to my account. ********************** has been charging me a late fee every month on these new charges, which has been increasing my overall loan balance beyond what I actually owe. My contract does not indicate they have the authority to add extra charges to my loan without my consent or knowledge, nor was this ever explained to me. I did not receive any documentation notifying me that this would occur. Suddenly, I am faced with late charges and a growing payment amount, despite making my monthly payments on time. I cannot afford to pay these fees, and at this rate, it feels like I will never pay off my loan. Despite receiving a denial letter from Exeter Finance, they subsequently placed a lien on my vehicle that extends until February 10, 2025. This action raises significant legal concerns regarding the validity of their lien under **UCC *******, which governs the attachment of security interests, specifically requiring a valid security agreement and the debtor's rights in the collateral.Moreover, I have repeatedly attempted to clarify my situation with both Twins Auto and Exeter Finance but have encountered substantial obstacles and a lack of communication. This behavior may constitute violations of the **Equal Credit Opportunity Act (ECOA)**, 15 U.S.C. 1691, and the **Fair Credit Reporting Act (FCRA)**, 15 U.S.C. 1681, as withholding the adverse action letter and relevant information is unlawful.I am formally demanding clarification on the following:1. I paid off my auto loan account on 10/07/2024 for $11,991.32 and the installment contract was mailed along title being sent to the bank I refinanced through. 2-3 Weeks after that happened the payment on the loan was randomly reversed. I called Exeter and they could not give me a reason as to why it was reversed and no communication whatsoever as been received about it til this day (4/10/2025). They have since been falsely reporting the status of the account as past due and now charged off on my credit report which cause me to lose over 100 points. This needs to be fixed and deleted off of my credit report.Business Response
